Nope. If your case is not complicated and you're not dealing with any of the aforementioned issues, just file for the K-1 yourself. You'll save yourself unnecessary costs and further complications that can come with hiring a lawyer. Other than that, I guess it's a matter of personal preference.

I am going through Vermont also and I received confirmation that my package was delivered on the 25th of June. They have yet to process my check, so I have not received my NOA1 either. I was beginning to wonder if I should call to follow up already, or if others were having the same issue with slower processing times for their NOA1. It sounds like others are having to wait for their check to clear and to receive their NOA1 as well, so I won't panic just yet...

Yeah, the Texas processing location is not putting case numbers on the checks. But, I received my NOA1 in the mail the day after my check cleared, so it should not be too much longer for you. My file was also touched today, if that means anything? Someone mentioned that they were touched about a week out and then they got their NOA2 the next day, so I am flipping out a bit-probably nothing though, and in a month the waiting will be killing me! haha

Spread out over a few weeks, I probably spent a solid day or two researching, pulling and reviewing the necessary forms, and compiling the biographical information we needed, getting new passport photos taken, communicating back and forth with my fiance re signatures and his photos and things like that, gathering up the evidence of our relationship that I wanted to send, and drafting our letters of intent and a cover letter. Then I probably spent another day filling in the forms and compiling my fiances documents, labeling our photographs, and pulling the packet together.

I really spent a lot of time researching in advance (although I only found this website right before I filed) so that I was comfortable with the process. There are samples of the letters of intent and cover letter online, so that is a no-brainer. Also, just about any question you run into has probably already been asked and answered ten times already on this website. I think my best estimate would be a solid weekend of pulling everything together (not including transit time for anything your fiance has to send to you, such as documents requiring original signatures).

Just be confident that you are intelligent and you can get through a couple of government forms!

I just submitted our I-129F a few weeks ago, and it is really not that bad once you start putting everything together. I am an attorney (although not an immigration attorney), and unless you have some special concern about the process, such as a criminal record or something like that, I just can't see why it would be necessary to hire an attorney to complete the K-1 visa paperwork for you. Most all of the information you will have to provide to the attorney eventually anyway, so if you can spare the day it would take to put everything together and make it perfect, I say save yourself a few thousand dollars, scour this website for tips, and DIY :).

If you do decide to use an attorney, just be careful and do your research. There are lots of horror stories out there about shoddy immigration attorneys (watch out for general practitioners that just dabble casually in immigration law), so in my opinion it is better to just educate yourself and take control of the process. Save your money for your wedding (especially seeing as you are students)!

I am under the impression that in Mexico, even if you have been married in a religious ceremony, you would still have to have a separate civil marriage before the Mexican government would recognize you as "legally" married, and that they are two distinct processes there. If this is correct, then if you ONLY had a religious ceremony you are not "legally" married in Mexico, and can still apply for a K-1. Can anyone with more information shed any light on this? Obviously, as has been said before, if you do determine that they are separate processes, I would still not include or mention your religious ceremony anywhere, as it may be confused with a legal marriage.

I actually have the same concerns. My fiance has a bunch of tattoos all over, none of which are gang related or even very "tough" looking (haha), and he also has a few piercings. I understand that in the medical evaluation they are just checking to make sure that you don't have any communicable diseases, etc. from the tattoos and piercings, but I also know that in Juarez they consistently send patients with tattoos and piercings to psychological evaluations during their medical exams. Is this purely to ascertain whether or not the tattoos are gang related, or is the psychological evaluation for some other reason?

Would it be advisable for my fiance to remove his earrings and his tiny nose stud for his medical exam? In all likelihood he was not going to wear them anyway for the medical exam and for the interview, but I assume a physician would still notice the holes. Regardless, there is no getting around the tattoos. If anyone has gone through the psychological evaluation at the Juarez medical exam due to having tattoos and has any information to share as to what kind of questions they asked and whether they were just trying to find out if you were involved in gang activity or not, your knowledge would be greatly appreciated!

I think we are just going to have to take a "wait and see" approach. There is no way to know how long the consulate will be closed or how it will affect visa applicants (other than the obvious delays). I think the K-1 applicants will probably be in a better position when the consulate re-opens because of their "open invitation" for interviews (assuming your invitation letter had been mailed pre-closure).

All in all, if there was some new security threat or something like that, or if this closure will improve security, even though it is heartbreaking to think that many visas will be delayed, I would much rather that and have everyone make it in and out of Juarez alive with their loved ones.

On question 18 of form I-129F, how we met: If I was introduced to my fiancée through a mutual friend, should I name this person? Or is stating that it was a mutual friend enough? Does it matter?


My fiancé and I met through a relative of mine, so I went ahead and named him on the I-129F. I reasoned that it looked a little more "legitimate" and factual to have the person actually named, and it would also maybe give them something to ask us about in our interview or to compare against any kind of background check or something like that. Maybe I was over-thinking it, but I figure that it can't hurt to include as much information as possible throughout this entire process, as opposed to being vague (unless for some reason you would not want to be associated with this person ;) ).

I just got my NOA1 today and it has my middle initial but does not have my fiance's middle name or his middle initial even though this info was included on the G325. Only his first and last name. Should I be concerned? I'm asking because while his first name is an Engllish-Christian name his family in Nigeria calls him by his Bini (tribal) middle name.


If it makes you feel better, our NOA1 included my middle initial, but for my beneficiary fiance, it only listed his first and last name (no middle name, middle initial, or "second" last name). On the NOA2 however, it included a middle initial for him. So, I don't know if there is any rhyme or reason to what they include or not. I have only seen people say to call USCIS when there is an error on an NOA. I am not sure that a missing middle name or initial would qualify as an "error", but perhaps someone else has more insight into the significance of what names they include on what documents.
