Also, in my situation, we were eventually told to seek a lawyer, also. Apparently, he had gotten caught before we were married and had a 7 year ban on his record. So I do agree that speaking with a lawyer would be the best place to start.

I think about the US citizen husbands and wives who marry and have children with an illegal alien. Do they actually think about before having children with an illegal alien, they could lose their spouse at any given time and the same situation can happen to them also?



I wish most of us did know how hard it would be when having children with someone who is illegal. My ex-husband was an illegal alien from Mexico. I never knew how hard it would be as far as getting him legalized. We have two children together. I went to the Service center located in my city and they gave me so much wrong information. They made it seem so simple...file the I-129F, he goes back to his country in time for the interview, gets visa, then comes back. That was the process that I was told, not knowing that it was truly much more complicated than that. No, I don't think most people who have fallen in love with someone who happens to be illegal think about the consequences of it. Just imagine how many people are following the "word on the street" and whatever misinformation USCIS tells them and you have a lot of false hopes and children who may never see that parent again. Yes, it is a sad situation, and my children don't see their father either. Last I heard, he had also gotten caught and might be getting deported back to Mexico.


To the OP, sorry that I don't have any concrete answers for your situation. I wish you the best and hope you can get this resolved in an easy and timely manner.

2 weeks isn't a lot but perhaps if you show enough evidence of a bona fide relationship, it will be enough.
People have been approved and gotten visas with just a one time meeting.
I would post in your regional forum and talk to others who have gone through the same consulate.



Right, there are two separate issues, meeting in person and evidence of a bona fide relationship. Your meeting is sufficient for USCIS to approve your petition but you'll need to show evidence of bona fide ongoing relationship at the interview. This does not absolutely require more time together in person. Many show evidence of ongoing frequent communication, whether with chat logs and examples, emails, pictures, letters, visits or a combination of those.

Those who have told you you'll be fine are addressing only the petition approval portion of the process. You'll need the bona fides evidence to actually get the visa.


You are right about this. Many of us in the African Forum have had successful visa approvals with only having met our fiances one time. Two weeks may seem like a short time to some COs, but you need to make up for it with tons of evidence. My fiance and I only met once for two weeks, but I made sure to send every piece of evidence I could think of in order to prove a valid relationship. Just remember, you aren't the only person who has done that (especially if the country isn't particularly easy to get to often- like Zambia). The consular officer has encountered this same scenario many times, but it's the evidence that counts.

Background checks could be checking for criminal activity, terrorist activity, past USCIS applications, name checks, etc. Basically, just verifiying that your information on the application matches who you are.

They ask - in the G-325A it is for the last 5 years, the DS-230 asks about every place lived (by beneficiary) for since the age of 16. (Not sure about the I130, I don't have a copy of that one at work to look at).

The petitioner does not need the police certificates, the beneficiary does. And he cannot request those for you, you have to.

Hello everyone.
My fiancè is in the military, and yesterday he got a call from his work, saying that he is going to be sent [b]TOMORROW (07/31) to the gulf to help with the oil spill problem...
The thing is, he is going to be gone for 2 MONTHS, and we are in the middle of the k1 process. We estimate that we are gonna get the NOA2 in the next 2 months or less, but he won´t be home to get the notification.
My question is, can he go to the post office, and ask them to forward his mails to his mother´s house?
He will probably be staying at barracks or a hotel, so he can´t forward the mails to where he is going to be staying...
I am not freaking out yet, but a little concerned, because if we get the NOA2 while he is gone, we might have some issues with gathering documents and stuff....
Any ideas???
Any help will be appreciated!

I don't think the post office will forward mail from USCIS. Have him call the post office, see if they will hold his mail, and allow someone to pick it up for him, once a week.

hey guys thanks all for ur feedback and info.

yeah we have a really hard time to find a co sponsor. the ppl who wanna do it dont hit the minimum cuz they have kids and then add me to the household as well makes the minimum way higher. and the ppl who could help us have some concern cuz it is a responsibility.
so we really dont know what to do.

yeah with his tax return he didnt hit the minimum by like 1000 dollar. so we called the uscis and they said when we increase the income with a second job it all will work out..
so my hubby had a second job and got way way more hours and he already hits the minimum way over know. but the officer at the interview thought no.

we really thinking all changes and options thru right now.

You might want to research your options a bit. If you go for a CR-1, the time isn't that much longer than a K-1, and he can work as soon as he gets his social security number. With a K-1, he has to adjust status before he can work (or leave the States), and that takes a few months, from what I have read. It is also less expensive than the K-1, since he does not have to adjust status once he gets here.

If you went the CR-1, then you can have your wedding anytime you want. He just has to go back to Canada, and wait. If he has strong ties to Canada, he should be able to visit, during the process.

I had scanned our pics and had them on the computer. I used Word, and inserted the pictures on plan paper, I had 9 pics per page. That left me room to write a short note under each pic. We didn't have any trouble. (We did the Cr-1, not the K-1, but should be the same on pictures.)

OP - AFTER I fired her, I would take everything she has written you, and find out the address of your state's bar association. You can't really report her for giving you bad advice about immigration (not a crime), but suggesting you falsify your tax records is just wrong.

Haven't got the green card back yet, which then lets you know that they got it.

THAT's why I'm asking about... IF YOU GET AN EMAIL/TEXT MESSAGE... when they receive responses to RFE's.... because as Hank states... sometimes the USPS can really screw things up. and down. and all around.


Not when you have a way to track the package. I think you can track it by the number on your certified receipt. And give it a week or two, to receive the green return receipt. Hang in there!

Living with your parents during the process shouldn't be a problem at all. Just as long as you're employed (or will have some sort of financial support for you and your future spouse), put the correct address information on the forms, and will be able to accommodate your spouse, you should be fine. :yes:
