Just a note - the operators that you are talking to are reading from a 'script'. Not sure exactly when NVC starts scheduling interviews, but they schedule until they run out of spaces for that particular embassy. The operators say they only schedule one month in advance, and only during the second week of the month. We received our interview notification email on 05/27 - interview is for 07/13.

To file married, filing jointly, you would need to get her an ITIN number (Form W-7), and use that instead of a social security number. If you file married, filing jointly, you get a bigger deduction on your taxes. If your wife works, you will need to file a form (forget the form number) to exclude her income, when you file your return. You can probably get better info regarding taxes on the regional forum that covers India. Good luck.

yeh very true! i would just ignore it because i know it wouldnt move forward even if approved by USCIS it would get closed by NVC!


Know what you mean, would probably do the same thing, except these folks are trained to be suspicious! No way could they find that many naturally paranoid people to work for them! :lol: You could always send in the RFE info, then withdraw the K3 petition. Don't know if that would add more time to the process or not. I would just answer it, then let the K-3 die.

From what I have heard, it all depends on the individual who questions him. I would have him bring proof of strong ties to his home country. In the Canadian forums, they mention lease agreements, bank statements, letters from employer, things like that.

My husband had a valid point too though. I have already booked my flights and they are under my maiden name. I will have to call the tarvel agency and even see if it mayb be possible to change it. Im not even sure its going to work as i dont think they reconise the marriage here in germany because we got married in FL. I think we have to do get an apostile and his BC translated and stuff and to be honest my interview is in 16days and no way am i gonna get all that done in time. If they do reconise it, it will take 5 days to get my passport back and i will call the consulate and just make sure its ok to change my name before the interview.



I did that - booked a flight in my maiden name, then realised passport was in my married name. I called the airline, and they told me to bring both passports, and a copy of the marriage license to show them. It took a about 5 minutes more to check in, but I didn't run into any problems.

I have my husband's name, I just want my husband!! :devil: :lol:

State laws can regulate name changes in the United States. Several specific federal court rulings have set precedents regarding both court decreed name changes and common law name changes (changing your name "at will").

  • One may be employed, do business, and enter into other contracts, and sue and be sued under any name they choose at will (Lindon v. First National Bank 10 F. 894, Coppage v. Kansas 236 U.S. 1, In re McUlta 189 F. 250).
  • Such a change carries the exact same legal weight as a court decreed name change as long as it is not done with fraudulent intent (In re McUlta 189 F. 250, Christianson v. King County 196 F. 791, United States v. McKay 2 F.2d 257).
Usually a person can adopt any name desired for any reason. Most states allow one to legally change his name by usage with no paperwork, but a court order may be required for many institutions (such as banks or government institutions) to officially accept the change.[1] Although the States (except part of Louisiana) follow the common law there are differences in acceptable requirements; usually a court order is the most efficient way to change names (which would be applied for in a state court) (except at marriage, which has become a universally accepted reason for a name change). It is necessary to plead that the name change is not for a fraudulent or other illegal purpose (such as evading a lien or debt, or for defaming someone).

The applicant may be required to give a somewhat reasonable explanation for wanting to change his name. A fee is generally payable, and the applicant may be required to post legal notices in newspapers to announce the name change. Generally the judge has limited judicial discretion to grant or deny a change of name, usually only if the name change is for "frivolous" or "immoral" purposes, such as changing one's name to "God," "Superman," "Copyright," or "Delicious."

In 2004, a Missouri man did succeed in changing his name to "They." [2] The Minnesota Supreme Court ruled that a name change to "1069" could be denied, but that "Ten Sixty-Nine" was acceptable (Application of Dengler, 1979), and the North Dakota Supreme Court denied the same request several years before (Petition of Dengler, 1976).[3][4]

In nearly all states, one cannot choose a name that is intended to mislead (such as adopting a celebrity's name), that is intentionally confusing, or that incites violence; nor can one adopt, as a name, a racial slur, a threat, or an obscenity.

Under the federal immigration-and-nationality law, when aliens apply for naturalization, they have the option of asking for their names to be changed upon the grants of citizenship with no additional fees. This allows them the opportunities to adopt more Americanized names. In the 2005 version of Form N-400, Application for Naturalization, Part 1 (D) asks whether the person applying for naturalization would like to legally change his name. During the naturalization interview, a petition for a name change is prepared to be forwarded to a federal court. The applicant certifies that he or she is not seeking a change of name for any unlawful purpose such as the avoidance of debt or evasion of law enforcement. Such a name change becomes final once a federal court naturalizes an applicant.

In some states, individuals are often allowed to return to the use of any prior surnames (e.g., maiden names upon divorce). Some states, such as New York, also allow married couples to adopt any new surname upon marriage, which may be a hyphenated form of the bride's and groom's names, a combination of parts of their family names, or any new family name they can agree upon adopting as the married name.

To maintain one's identity, it is desirable to obtain a formal order so there is continuity of personal records.

Remember, to change your name in your passport you will have to comply with the rules & regulations in your home country.

They may require a marriage certificate with the name change (which you can't produce) - so you have to check on the
laws & regulations in your home state as well as your country of nationality.


Others who have responded apparently may have done so on the basis of their having an existing marriage certificate with the name change.





She is CR1/IR1, should have marriage license, especially if she got married in the States. :yes:

I think we made a big mistake by getting the medical exam too early. Here is something I overlooked in our information packet:



My wife is pregnant, and we plan to have the baby in South Korea. Since we completed the medical exam on June 25th, does this mean she must leave the country before December 25th? The baby is due on November 28th, but we need about a month to apply for the baby's American citizenship and U.S. passport.

Let's say we get the visa on September 25th. Does this mean the visa will only be valid for 3 months because of the medical exam validity? Thank you for your answers.


The three month validity is mentioned if TB is present. The 6 month validity mentioned in your quote refers to the medical is good for 6 months. The CR-1/IR-1 is valid for 6 months from the day the visa is issued.

Hi all.

Finally, I have some time to finish this up(thank God)and have a couple more questions. I tried a search but found nothing. Quick rundown: The I-130 is for my wife of 2+ years together and a croba for our 2 yr old daughter.

Under section C, Question 21 states;

21. If filing for your husband/wife, give last address at which you lived together. (Include street, city, province, if any, and country):

Well, the thing is that we've never really lived together for more than a few weeks and that's when I'm visiting. If I write her address than that might indicate that I live over there when I don't, wouldn't it? I know it says LIVED together(past tense)so maybe not. But they also want the dates of when you were living together. Should I just answer with an N/A or NONE, or? I just don't want any contradictions or confusion, but at the same time I get the feeling they want some kind of answer.


Next question:
Section D Question 1;

1. If separate petitions are also being submitted for other relatives, give names of each and relationship.

My current answer is; A CROBA will be filied for HER NAME. Relationship-Daughter.

Is a CROBA a form of petition? I suppose it wouldn't hurt to have it like this. Or are they specifically looking other I-130's in the process? Any other suggestions?

I added an attachment, and explained that we had not legally resided together, that he lived in Canada, and I lived in the US, when we met, and that it was only during the visits (and listed them) that we were able to be together. Was probably overkill, but I would rather they have too much ino, than not enough.

Hello everyone.
I have paid online AOS Fee $70 exactly a week ago (July 8th). Yet the status still shows IN PROCESS. I've checked my bank and they already withdraw the money on July 9th. I called NVC and they said that they still haven't seen any update on the payment. But on July 13th, NVC replied to our DS-3032 and asked us to pay $404. We paid online and it's paid today. Can we use this Document Cover Sheet for both I-864 and DS-230 since I don't want to wait for the AOS fee to clear. I see that there is nothing special on the document cover sheet beside the barcode; thus, I guess it would be ok to use it for both. But I just want to make sure.
And a second question: Is it ok to send a copy of pay stub or is it has to be original?

You can send the DS-230 seperate from the I864. I would wait for the payment portal to show paid, and print the correct cover sheet.

I sent copies of the pay stubs.

THe online processing is for the NVC stage only. It seemed like the only reason it was faster is there was no wait time for snailmail. You scan and email all the paperwork, just have to remember to bring the originals to the interview.

you can only do this during the open enrollment time....your husband can add you regardless of you are greencard holder or us citizen as long as you have to wait for the open enrolment time...this is the time when he is about to renew his health insurance for the next year.


Most companyies have what they call 'life changing events' - birth of a child, getting married, losing coverage you had wthru spouse's workplace, etc. You can generally add someone who qualifies, or make changes to your policy only during open enrollemnt, unless there is a life changing event.

Rian? If you can get a letter from where you were covered under insurance in PI, they should accept that as proof of loss of coverage. That is what I was told would be needed to add my husband outside of open enrollment.

FYI - You don't have to have a social security number to be added. My husband doesn't have one yet, and I added him (we weren't sure we could get a letter stating he lost coverage from moving here) in open enrollment back in November. When they sent the letter asking for the social, I called and explained the situation. He is covered (not very well, thankfully he still has coverage in Canada!), and has been since Jan 1.

It took exactly 90 days from NOA1 to NOA2. Look on the bright side, once you get your NOA2, and you get your case number from NVC, you can do the electronic filing optin.
