My husband applied for his in Calgary, and was told it would be 1 - 2 weeks. But his is the name check one, he doesn't require the fingerprint one. And I think they (the Canadian ones, at least) are good for 6 months, but I haven't double checked that yet.

Grats on your marriage! If you fill out your timeline, you can find timelines similar to yours, and see how long the process is currently taking. Also, there is a region specific forum that might give you more insight into what to expect. As to the lawyer, we decided to do the paperwork ourselves, and save the money for getting on with our lives. That is something you and your wife have to decide together. Read the guides, they help!

Thanks for all the responses! Yes, I don't think it's a false checklist letter (sorry for calling it an rfe) and even if it were I already talked to the NVC people on the phone and they just said it's probably best to play it safe and send things again with clear explanations. It is weird that they themselves seemed to be outside of the loop, unsure of what exactly they needed or why I was asked for certain things, but I'll do what they say. They did say that it wasn't necessary for me to prove I'm a US citizen again. In fact, on my checklist sheet, which was addressed to me, it said "You, the joint sponsor, have not provided...etc" which seems in itself an error since I am not the joint sponsor.

You are dealing with people that answer the phone, and don't review the information. If you are in doubt, call and ask to speak to a supervisor.

I'm actually done gathering all the NVC things already. I have two of the major things ready: tax transcripts (yearly and account,) tax copies, Form I-864. I'm preparing my wife to do the electronic agent selection. I'm still a bit shift on the whole DS3032; D230, Packet IV, Packet III, etc. I figure I have a while to learn those. I've been a bit lazy also I can't find a definative guide. One guide says one thing another says another thing. Throw some hints my ways.


Packet III (and 4, I think) belong with K-1 visas.

Hi, JadenJewel. I noticed your timeline shows a case complete at NVC on 04/28/10. Are you waiting on the interview? Montreal Embassy normally is backed up 2 or three months. People with case completes in the first part of April received June appointment dates. Our case completed on 04/14, and we are still waiting to get in interview date. By the way - you will be looking at the IR1 -

CR - conditional residency - married less than 2 years - spouse will get a conditional 2 year green card - 90 days before the 2 years is up, you will have to file for removal of conditions.

IR - Immediate relative - married over 2 years - spouse will get a 10 year green card, and you will not have to remove conditions.

Only way to confirm no RFE's for AOS is to call and talk to an operator, but it sounds like it was a false RFE.

You will need an ITIN number, so she needs to fill out (or you need to fill out and have her sign) a W-7, and you wil send that in with your 1040 form. (You can use EZ if you don't have to fill out the G-2555 for foreign income earned for her wages). She will aso need to sign the 1040/1040EZ.

(Read the instructions to be sure, but I think . . . ) Since they live in the same household, the father and mother (if they file taxes jointly) will fill out the I-864A. If he lived at a different address, then he and his father would file I-864, and his mother would fill out the I-864A. But as I said, double check, to be sure.

Okay guys I think I got the NOA1 today! It has my receipt # on it and when I take it to the USCIS website, it shows it was accepted and initially reviewed. The letter states it was only a letter to say they received it. Is this the NOA1 or am I missing something? I hope this is it :)

Hi,

I originally filed a K1 for my husband and we got an interview date but b/c of family reasons we decided to forgo the K1 and get married and file a CR1. My husband just had an visa interview in Chennai two days ago and the interview went fine but the officer said that he couldnt give my husband the visa at this time because of administrative processing and handed him the blue sheet. The officer also returned the original documents to him but kept the PCC, local police certificate and his birth certificate. He had him sign some papers and take the oath. He said that it could take up to several weeks. Also, he did not take my husband's passport but said that once we were contacted by them then we should sumbit the passport.

Has anyone had a similar experience? How long does this usually take?

Thanks for the response. I have special conditions right now that would not allow me to file my taxes at the moment. But I truly intend to file all of them once these conditions are removed.

So Should I add a letter with my AOS saying that I earn less than 9,350$ and that's my I have no tax returns?
Or they will just get that from the info I'll be filling in the AOS?

Phone records are good, any cards or letters you have sent to each other, gifts, affidavits from family and friends. As to the pictures, I had mine on the computer, and copied and pasted them into a word document (I put about 8 pictures per page), so I could put captions under the picture. Just short one sentence captions that stated who or what. For you, since they already suspect your pictures, maybe a caption of not only where you were, but some small bit of info, like what was happening when you took the pic. Make the captions like you were making it for a friend to see. (Not sure if I am explaining it right).

Also, do a timeline of your relationship. People from hard countries say it helps a great deal. Go over the timeline with him, and make sure you both know the dates and events. There are some posts about relationship timelines, just not sure where. I know a lot of people in Vietnam create them.

Unfortunately Igor's list doesn't have country data. That would've been an useful view. General rule of thumb is that Europe countries take the shortest amount of time. Personal exeriences.

NOA2's are taking longer and longer. For a while, it seems getting it within 100 days was normal. It's taking 150 days nowadays. It will only get longer from what I can tell. This too I predicted from looking at USCIS national average goals. I feel like such a sage.

Furthermore, as you can see from above figure, if you're name starts with Q, it takes the longest amount of time to approve your case. Noone trusts the Q's. On the other hand the Ivory's, the Ivana's and the Isma'il get to enjoy an unprecedented delay of only 46 days between NOA1 and NOA2. It doesn’t matter which of the spouse’s initial is I. As long as one of the spouse is I’s, it’s all good.

What other ridiculous information can I come up with?


PS: I actually spelled 'ridiculous' correctly. I always want to spell it like 'rediculous.'


Any way to figure by country? I have been curious about that, but I am not as good at analyzing data as you are!

SimAsh - you should be hearing soon from USCIS. Based on what I am seeing on Igor's list (see page 1 of this thread link is posted by Teya), Month of march just started and you should be next. If everything goes well, here is what will happen after you get your NOA2:

2 weeks to get a case number
4 weeks to get through NVC (without RFE)
4 weeks to get an interview call (may be less)



Just a heads up - NVC seems to have slowed down a bit. Not by much, but at that stage every day of not knowing is frustrating. Just wanted to let you folks know it might be 5 - 6 weeks with no RFE's. But it's worth it!

If you will be making 125% over the poverty limit, I think so. You will need a letter explaining why you did not file taxes in 2009, though. You are applying for CR1/IR1 visa? Have you filed the I-130 yet? The AoS will be needed for the NVC stage, so you will have time to get paystubs and such. Read the guides, they tell you, in detail, what you will need. Good luck!

Hey guys,

Yes, we were temporarily denied...Very sad and frustrating, but I won't go into that right now.

These are the reasons:
1. Our police certificate did not meet the embassy's standards--even though the NVC said that it did and we never received any correspondence WHATSOEVER from the embassy. Luckily, we'll have this document in about 72 hours. Not the issue here.
2. In my co-sponsor's (my grandFATHER) tax returns his wife (my grandMOTHER) is listed. He filled out the I-864 form with his info; the money he personally made, his assets, etc and didn't add my grandMOTHER's info. She was in his tax return though--they filed jointly.

At the interview (everyone was nice) the document reviewer (pre-consular officer) said that my grandmother needs to fill out the I-864A form since she was listed on the tax returns. (DAMN YOU NVC!! Why didn't you say anything before?? Should I be angry with them??) Simple, right?

My questions: does my grandMOTHER (household member) fill out the I-864A in accordance with the I-864 form and 2008 Income Tax Returns previously submitted?? OR does the co-sponsor submit Income Tax Returns for 2009 PLUS a new I-864 form AND THEN my grandMOTHER fills out the I-864A ??
Or am I complicating things..

Other then that things went well. We still had our interview which was like 5 minutes and they hardly looked at our evidence as a couple. They kept Lucas' passport and said to bring documents and once received/if everything was in order they'd mail us his passport. Still, frustrating!!!!

You can also put her as beneficiary for your life insurance, collect communications between the two of you - letters, cards, phone bills, boarding passes where you have visited her - stuff like that. They want you to prove it is a 'real' ongoing relationship.

Also I wanted to ask you something... I had someone help me fill out my I-130 form because I was so scared to make a mistake (it was before this website of course) she charged me almost $300.00 dollars for that, now she wants -$250.00 x2 to do my I-864 and I will need a joint sponsor... I work part-time and I come in under less that (900.00). I have assets, I own a home with my ex husband, but there is so much paper work involved I want to avoid any RFE's. I just need encouragement! I know that a lot of people did this on their own...did you do this on your own?

(I realize you weren't talking to me, but . . .) We did. There are people here willing to answer any questions you might have in regards to filling out the rest of your paperwork. There are also examples of how the paperwork should look, when complete. If you try on your own and look at the examples, and still don't feel comfortable with the paperwork, you can always go back to her - just my opinion. :)
