Also, the USCIS website says that my file was touched today! Things should start moving very fast for you guys!

Thanks everyone! I appreciate your quick responses! I ended up checking "Yes" and writing "I intend to likely pursue further higher education in the U.S., but have no distinct plans at this time.", but I think I will probably redo the form and just check "No" for simplicity's sake. I think your assessment is correct that this form is used for many different types of visas, and so this question is probably not so relevant for a K-1 filer.

In all of the samples I have seen everyone has just checked the "No" box on question 33 of the DS-156 form that asks if the filer intends to study in the U.S. This would probably be the path of least resistance, but if I know that my fiance plans to pursue a doctoral degree here in the U.S., how should I handle that on the form? If I don't mention it and just check "No" for simplicity's sake, could that come back to haunt us in some way during the AOS process? If I want to be honest and say yes, but there are no firm plans or anything already in place, how has anyone dealt with that in the past? Any guidance would be much appreciated! Thanks!

When I mailed in our I-129F packet, I blacked-out some things from the emails. I could have used different emails, but I chose the ones that I did for specific reasons, so I really wanted to use them. I understand the argument either way (for one, it is pretty good evidence of your legitimate relationship! but, it is also extremely personal). I will probably try to pick out emails with tamer content for our interview that won't require any blacking-out (haha), but I think for the most part the printouts of your sent/received logs are really great evidence as well, and that should not have any really personal information included.

From what I have heard (and I am by no means an expert!), it seems that for many people seeking visas through the Juarez consulate, the main impediments that they encounter have to do with over-staying previous visas in the United States or otherwise having been in the United States illegally in the past. I said "for Mexico" because I think this is a fairly unique issue for the Juarez consulate due to the proximity of Mexico and the U.S. Anecdotally, I have been told that your average run-of-the-mill K1 interview is probably the most simple and boring thing the people at the consulate will see all day when you go to interview (I was told this to be put more at ease), because a lot of the people interviewing there have been in the U.S. already and have married a USC there, and are now going back and having to get waivers and such to bring their status into legal compliance. It is those types of situations that I would think an attorney would be very helpful!

I would tend to agree with what everyone has stated. I have said before on here, I am an attorney (but not an immigration attorney), and unless you have a complication (for Mexico, a previous overstay in the U.S., criminal history, or something of that nature), I get the impression that most people should be able to handle this process on their own without much trouble.

The bulk of this process is providing biographical and personal information, which you would first have to give to any attorney who you would hire anyway. The hardest and most time consuming part is compiling all of the information you will need, and hiring an attorney will not save you any of that trouble. Additionally, it seems like people do a much better job of tracking and moving their own case along with the help of this website than some of the "not-so-great" immigration firms out there. All in all, I say do you homework, use this awesome resource, and save your money :).

thanks patient 2010 but its the middle names i am having the issue with. so the last name is fine but the middle names are reversed on the passport. on every other docs it is John Doe but on the passport the given names right below surname is written as Doe John and thats why i am worried.



We had a similar situation with my husband. His birth certificate says John Mark Doe, but his passport that is four years old says Mark John Doe. We applied for the visa using the birth certificate name John Mark Doe, but USCIS changed it to be what the passport says Mark John Doe, and this is how we've been submittign all of his paper work since. I believe that the visa and the passport should be in synch so there are no issues when you travel. They understand that in Nigeria people flip flop these names and it is no big issue.

It`s been exactly 5 months(Oct 7, 2010) since we received our NOA1 from the California SC( phone text message. snail mail a week later) I called USCIS today and the call left me a little befuddled. I was told that I was still within the 5 month processing time. So they will give me a reason tomorrow ? I was told the date they are currently working on K-1 cases from Sept 16,2011. However the VJ time line says NOV 7, 2010. Is this normal ?

Hello friends,

As as many of our friends here know, our petition was put on hold in Vermont. August filers, touched in December inquiry Feb 18th, letter March 6th stating background checks have not been finished, please give us another 180 days. Seriously considering changing attorneys to Michael Gurfinkel, My current attorney says to pray and that its out of her hands. Well... we have prayed and prayed and prayed.

From what I have researched, this guy is suppose to be a leading immigration expert attorney and of course comes highly recommended from serveral of Ruby's friends. He is also the most expensive attorney money can buy.

I guess my question or comment is, Has anyone else used his services with success or have any comments or knowledge regarding him?

I don't mind spending the money and I have a telephone consultation with him scheduled for Monday. I did go to my congressman's office this week and they assured me they would do an inquiry, but from what I have read, once you receive this letter, there is really nothing anyone can do but wait.

I suppose I just want to be sure I have done everything humanly possible to expedite this case and have it approved.

Any comments or insight would be most welcomed.

Maybe Im just missing something or just dont see it. When your scheduling an online appt for the Manila embassy on the 2nd page it ask purpose of visit. Nowhere on the choices does it list for Fiance or any type of K visa for that matter. It states business, pleasure etc.... then it has another drop down box and ask for classification of visa none of which are K1. Please Help!!

I am very upset. My K1 application has been pending for six months. My senator had been told we could request expedite at six months. When she followed up on that with USCIS she got this reponse:

The processing of your constituent’s petition has been delayed. All petitions or applications received by the U.S. Citizenship and Immigration Services (USCIS) are required to have routine security checks that are resulting in delays of the adjudication of petitions or applications. We can give no definite indication of when they will be completed. We apologize for the delay. You may wish to check the status in sixty days.

I am crying my eyes out. FI has a clean history..so do I..what would cause this? How long will this take if anyone else has gone thru this can tell me your experience?


WE RECEIVED THE EXACT SAME LETTER AFTER OUR SENATOR GOT INVOLVED, TOOK ABOUT 2 WEEKS FROM THE TIME WE WERE TOLD IT WAS DELAYED! DONT GIVE UP HOPE, 6 MONTHS IS JUST A STALL, CALL EVERY COUPLE OF DAYS AND ASK FOR UPDATES.

You both need to fill out your own version of the I-134.

Since you are a student and presumably not working, you only need to provide the I-134.

The joint sponsor should fill out the I-134, provide documentation of current pay such as pay stubs, letter of employment is nice but not necessary and should provide three years of tax transcripts or tax forms (with W-2s if tax forms and not transcripts).

IMPORTANT: Make sure the joint sponsor is eligible, he/she must be a US Citizen, US National or LPR. Make sure you submit the proper documentation which would be the joint sponsor's copy of birth certificate or copies front and back of green card.

Hello Everyone,

My fiance and I are currently working on everything we need to send in with packet 3, basically his part of the work is done (medical, police certificates, etc.), so now all we need is my Affidavit of Support. The problem is that I am currently a law student and have had no income for the past two years. I already have a co-sponsor who makes well over the poverty line, but I'm very confused as to what exactly I need to do in terms of the I-134.

First, I'm confused as to whether both myself and my co-sponsor each have to fill out the form and get all the documents required?

Also, some people say that my co-sponsor would need to file tax returns (I've heard some say of the past 10 years, past 3, past 1, etc..) but on the instructions sheet, it does not say this is a requirement unless you are self-employed (which he is not).

Can someone clarify all the things I should do? I sooo do not want to get RFE'd! Any help would be appreciated!! :help: Thank you!

We filed mid- June and received our NOA2 on July 24th. Apparently we got incredibly lucky because right when we sent our petition, they opened up the Texas processing center to take some of the load off VSC, so they sent ours to Texas. Normally, from what I've heard from other people, it takes anywhere between 3-6 months for processing at the VSC. Either way, I would try calling VSC to check the status. I completely understand your frustration...don't give up and we'll cross our fingers for you guys! :)

If they'll have the qualified joint sponsorship packet, you should be fine. Even though you don't qualify as sole sponsor, you are still the primary sponsor and as such must submit all required documentation--including tax returns that have a bunch of zeroes on them.

Yeah copies of your tax returns, printed from Turbo Tax or whatever are fine. Certainly no harm in getting a joint sponsor. Good luck!


I'm having a concern kind of along similar lines. I'm not in debt but I have been a full-time law student for the past two years (now in my final third year), and have had no income for two years. I have a co-sponsor who makes well over the poverty line. We sent in packet 3 to the Embassy and just received an RFE stating that everything we sent was fine, however I also need to send in my past tax returns and current pay stubs. I don't know if they didn't read the part on my Affidavit of Support form that said I was a student with no income...anyways, the tax returns are no problem. I have those, but now I'm worried that they're going to say that my full-time student, no income status is a problem. Does anyone have any experience with a situation like this? :help:

So happy for you that eventhough you by accident applied for the wrong consulate/embassy, it all worked out just fine.. How lucky are you. And 33 days. I could still only hope and pray for that... let's see. I'm positive... whistling.gif

We applied for ours with a lawyer/visa help firm in the US, and eventhough they are very good for the petition submission I am not sure they are that good for my processing, that is why I am very very very worried.

Firstly, I am now totally confused about how many packages arrive... what is what?

Secondly, I might be visiting my fiance when the package arrives - what to do then?

What additional documents do you need - Police clearances from all countries lived in, birth certificates, what else??

Do you think it makes a big difference that your I129F is in VSC and yours CSC? Is CSC faster?

I've been reading quite a bit on this website, and now is my turn to ask a few questions:

My fiance and I met while both living and working in Dubai. Unfortunatley, due to the economic situtation, he lost his job and returned to the US in March 09 to a great job. Our K1 application was submitted on the 8th of April, notice of application received today. Questions are:

1. We submitted to the Vermont service centre. What have other members experienced in terms of the waiting time for the approval of their K1 petition?
2. How long after the K1 petition (NOA2) has been approved does one receive the package from the embassy?
3. Is it worthwhile to have my fiance present at the interview? Is there anyone here from South Africa, living in the UAE, with a fiance from the US?

Hello Everyone,

I'm A U.S. citizen planning to marry my fiance from the Philippines, so I petitioned for a K-1 Visa a little over 1 year ago, everything appeared to be going on schedule in the process, we even obtained my fiances passport, letters etc, but after receiving the NOA 2 my fiance never received the "packet 3" or anything else?

I blame myself for not aggressively following up on this, but at the time I was/am living with my fiance in the Philippines, so we were/are together.

My question is: Where do we go from here? Have I waited too long to follow up? Will we need to start over?

Hey everyone. My fiancee's interview was today in Bucharest, Romania. She had all the requested documentation except that I mistakenly sent her a photocopy of the divorce decree instead of a certified copy. She got a 221(g) saying that the petitioner(me) must send a certified court copy. So I went to the courthouse got the cert. copy and sent it DHL to her. Should I be worried? Will everything be ok once she goes back with the certified copy?? They kept my I-134, letter of employment, tax returns, bank statements, the ds-156, and the ds-230.
