I sent my petition on January 24, 2008. Other than NOA1, I haven't heard a peep from USCIS. I have been tracking my case online, and there hasn't been any activity since February 20. It seems like most of the other CR-1/IR-1 filers at CSC have already received their NOA2s. I am strongly considering contacting my representative now, my wife and I are coming up on 6 months of waiting.

Should I wait until USCIS posts the new dates before doing any inquiries? I know they won't listen to you until you are at least 30 days out, but if they move the date forward as they have in the last couple of month, I may be outside the processing dates. Should I just try to be patient and hold out for a bit longer?

Looking at the historical data on VJ for January filers at CSC makes me really anxious. Sometimes I think they misplaced my case, sometimes I think I'm just unlucky and need to wait, but now matter what excuses I make...I can't help start to feel the desperation sink in. sad.gif

I-864 comes with instructions, here is the paragraph 25. Federal Income Tax Information :

If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.
You are not required to have the IRS certify the transcript or photocopy unless specifically instructed to do so by a Government official; a plain transcript or photocopy is acceptable. Telefile tax records are not acceptable proof of filing.

Further down:
If you provide a photocopy of your tax return(s), you must include a copy of each and every Form W-2 and Form 1099 that relates to your return(s). Do not include copies of these Forms if you provide an IRS transcript of your return(s) rather than a photocopy.

Seems pretty clear. These instructions are included in the PDF I-864 that you can download from USCIS site.

I have a freind that has been in this situation for almost 10 years now. She and her husband married within 90 days of POE on a K1. Due to financial circumstances and low income ( plus lack of joint sponsorship ) her USC husband's I 864 has been denied. This freind has since given birth to two children and has made it even more difficult for the USC husband to meet the poverty benchmark.

Their relationship is legitimate, caveat, the absence of an approved I 864 the wife has no greencard. The wife has received EAD but has been unable to find work while also caring for their two new children.

It's possible that they may continue to be "out of status" for a long time unless someone steps in as a joint sponsor.

SO YES, in this case, OP should move ahead with adjustment of status.

It is actually good to hear about your friend's situation SPSguy. Not that the situation is good, but that there's no real problem with the amount of time. For us, because of the situation, we are living with my inlaws right now and they are going to act as the joint sponsors for us. They did the same for us with the K-1 application. That's not a problem, other than my mum (in law..more like a real mom) saying "ohh noo" when I told her that all those form had to filled in again:).

Again, we're fine in terms of not overstaying on the K-1. We did marry within the 90 day time frame, so that's all good. Yes, we're still very much together and going strong. Hoping for the situation on the finances to change very soon so we can get into a place of our own and hopefully start a family within the next year.

I'll have a read over the links and post more if I need clarification on points. Thanks again for all the help. It is much appreciated!

Yup - there is NO REGULATION for 'when to file for AOS'.
Only a reg for 'marry within 90 days'.

This is not a 'K-3/AOS', btw. This is a 'K-1/AOS' - unless yer hiding a K-3 in yer pocket somewhere, and haven't told us about it.
FWIW - The I-485 fee is 1010, currently, and if EAD and AP is filled at same time, those FEES for I-131 and the EAD are waived. There will be some other medical fees for a civil surgeon, though.

Phewwwie! Glad for the confirmation that there's no specific timeline for the AOS in our situation. Despite all the hurricane hardships, we did get married within the 90 days, so we're good there. (TS Edvard hit the day we got our wedding permit, cancelled initial wedding date and TS Gustav hit that day and finally married on Galeston the day before Ike hit! Yes, it was a weird time there!)

Yeah, I guess this would be a K1-AOS. We got the K1 and married, so it's the AOS as a completion to that. I thought we had to convert it to a K-3 or whatever, but I guess not as we married here legally and have been living here legally. Just confused now about the forms to file. If we fill in the I-485 and also the AP and EAD all together, the AP and EAD fees are waived, is that right? Also, do we still need to file the I-130? I can't find much info that really makes crystal clear sense about fees/forms, etc. There's a lot of convoluted and conflicting info online, so it's pretty confusing. Also, we don't want to use a lawyer as that will raise the price up to a point where we couldn't afford to pay for the AOS!

As for the medical, I guess I'm going to have to go for another as mine was in Dec 07 (I think). I do have the vac info up to date here and have had no serious illness since (other than that nasty bout of flu last April). Shouldn't be so bad though as I think that's around $100, and that's pretty affordable.

Well, I'll keep you posted and thanks for getting back to me and putting my mind at rest!

I seem to have a new question each day. :lol:

If we get married in the US and my husband returns to the UK as we plan, does this mean when it comes time for his visa interview, will he be able to do that in London?

I just read on another site "If choosing to marry your sweetheart outside his/her country, you must remember that this will be the country your spouse will have to go to for the visa interview!"

If that's the case, how would he get back into the US to do the interview in the first place?

I had read the K3 wasn't really needed anymore, but wasn't sure if it was a requirement when filing for the CR1. Thank you for your response.

Depending on where you are married the wait for your marriage certificate may vary. We were able to get ours the day of our wedding and mailed in our petition within the week. Good luck!

We can not afford for him to stay in the US without being able to work. He arrives here next month to visit me and we are considering getting married in the US while he is here and he would return to the UK after his visit. Then he can go back to his home and job in the UK. At that point could I file for a CR1? Can we get married in the US for a CR1 to be valid?

My fiancee is from Taiwan and we will be getting married there in March. Taiwans HHR office says that since I am not living there they will use her address in Taiwan as mine. Also they require everyone to have a Chinese name in order to get married.

I was planning on filling out the I-130 with my Chinese name listed as another name for myself.

Will either the Chinese name or the incorrect address cause that much of an issue when filing the I-130?

Hyd, you need to wait couple of days to forward the case to Chennai. Then you can email to Chennai consulate for the interview status since you're not in official July list.

You will not be able to enter inside the Consulate on interview date, though you are citizen. You'll have to wait outside. I think I am not wrong. If they want to ask you some questions, they may call you inside.

Interview questions - I think I've seen a TON of them online - they are all pretty basic ... but let's make sure to send our beneficiaries questions to help alleviate their nerves in advance smile.gif

Documents - make sure the beneficiary remembers to take PHOTOCOPIES of all original documents submitted to the NVC with the DS-230 packet to ensure that they get their originals back without a hitch.

Proof of relationship - this is something we've all probably discussed ad nauseam but make sure your beneficiary is already organizing (or has organized) letters, emails, photos, cards, telephone calling records, wedding albums, etc into a packet/parcel


Just a couple questions for feedback from you guys:

How much time are you leaving between the interview date and the ticket you are booking for the beneficiary to come here? Rajee, here you go with my suggestions.

Medical - Interview appointment letter describes about medical procedure as per NVC. So, we have still NOT taken the vaccinations so far, just waiting for the appointment letter. Can somebody throw more light on this - if letter contains the vaccinations list. Otherwise, we need to take them now.

In my case, her both parents are doctors and they own their own hospital, so vaccinations are not a problem.

VFS - As per the Chennai U.S consulate web site, it says - ""All new immigrant visa applicants are expected to visit VFS for document processing 10 – 15 days prior to their scheduled interviews at the Consulate."

Interview questions - I have a basic list and posting here as attachment. If you have more, please add them. Some of the questions may not be applicable to you.

Documents - Yes, PHOTOCOPY of all originals is a MUST. Also, don't forget to collect the originals back after the interview.

Proof of relationship - whatever you listed are good. For some religions, it is MANDATORY to produce RELIGIOUS marriage certificate too, in addition to the CIVIL marriage certificate.

Passport Pickup - Only Mumbai consulate allows this in India. Rest all will courier it. Thanks to Indianheart for this beautiful link to track your passport delivery after the interview.

Visa - The visas are affixed inside each passport and the applicant is given a sealed envelope which should be hand carried, UNOPENED, to the United States and submitted to the immigration inspector at the U.S. port-of-entry.
If the sealed envelope is opened prior to arrival in the United States, the immigrant visa fee of $400 must be paid
again at the American Consulate, and a new sealed envelope will be handed over to the applicant.

Final Tips (Add more here) -
1) Please fill everything in CAPITAL letters and BLACK ink
2) All dates are in the format MM/DD/YYYY (ie. for Aug 15, 2001, write 08/15/2001)
3) All names must be in the form of FIRST NAME, MIDDLE NAME/INITIAL and LAST NAME as in the passport
4) Both Index fingers should not have any cut or wound since there may be fingerprinting at Consulate and at POE, USA.
5) Do not fold any of the documents, please take a large envelope (A4 size or letter size)
6) Have a nice attire for the interview with less jewelry etc.
7) Have pencil, black ink pen etc.

yes rajee that is also perfectly fine! my husband did contact a well known panel doc in chennai who performs everything for immigrant visa interviews, and was told he can get it done ahead of time or come tochennai and get it done with medical itself..

just depends.. my husband wants everything done ahead of time.. so there is no delay god forbid something goes wrong u know..

so ur wife willbe fine, she can do it in delhi or in her city it does not mater, if she waits for letter that will be fine also..the only thing was the gap btwn vacinations, for varicella is 3 weeks. so my husband wil get it done in another 2 weeks then go to medical inchennai and then submit vfs fee etc...

YA SURE, tell her to go ASAP in her city and get those shots done and THEN get it writeen on letter head from the hospital, listing what they gaveher..

then 2 weeks before her interview she can go get her medical done, and they will see she already got vaccinated!! so she doesnt need to do it then..

dont stress it , just ask her to call up a doc and tell her for US immigrant visas she needs to get vaccinated..

so he repsonded to my husband through mail, saying what shots he needs since he has no records.. and he can get them done in hyderbabad and does not need to get them done in chennai..

Rajee great thread!! I am planning on leaving for india july 24 and coming back august 10 with my husband... our interview date is set for july 28 and he will be bookin his return ticket on aug 10 will me.. i think that is enought time for his to receive the visa in hand after interview...

i talked to my huby about IDP and even his siblingsgot that before leaving india and it did not work here, in my state, they had to apply for drivers license from that states.. so basuically no use here, he said he would just go straight to written and drive test after he gets here..

so we thought not to wory about that until he gets here..

Fathima reached Chennai on 25th morning and went to the Lister Metropolis Lab for her X-ray and blood test. Also, she collected the report from the lab in the evening after 4PM. The report is in a sealed envelope to give to the physician. So, that part is over kicking.gif

Because of this, we pre-poned her Physician appointment 1 day early. So, instead of Friday, it is going to be tomorrow - 26th kicking.gif

Another good news is somebody from NVC walked to my home and hand-delivered my (petitioner) copy of Fathima's interview appointment letter. I am just kidding rofl.gif

It actually reached by mail yesterday kicking.gif NVC printed it out on 05/28/2008, mailed it out on 06/06/2008 and I got it on 06/24/2008. what a speed devil.gif I have scanned all 5 pages and emailed to her, so that she can take the print out from Chennai, though it is not necessary kicking.gif kicking.gif kicking.gif

There is a Medical cover letter as part of Packet 4 forms in the consulate website. We have taken 2 print-outs of that. Then usual required docs such as interview letter, passport, photographs, fee, medical records etc.

Nobody has mentioned about I-693 forms. Probably, physician will have those forms. However, we are planning to take 2 sets of I-693 forms too.

DS230 part 1 and part 2 ( even though we already sent it in with DS230)

Hyd, I will convey your salaam to her star_smile.gif and ours to your hubby too star_smile.gif Also, ask your hubby to get IDP, so that he can drive the car here from day 1 after arrival. It is so easy to get in India. I think she paid Rs.1,750 with her Indian driver license and there was only verbal interview. She got in 2 days time. I think it is worth to get it.

5) Completed DS-230 (This is in addition to the submission to NVC)
6) 2 Passport Photos (This is in addition to the submission to NVC)
7) Completed SSN Form
8) Stars and Stripes Lounge fee Rs.400 for 2 persons (One for her and one for her mother)

VFS gave her the receipt and coupons for the lounge. Some of the above documents are part of Packet 4.

Stars and Stripes Lounge is an air conditioned lounge, 5 min. away from Chennai U.S consulate. Applican't relatives can wait there. It has snacks and beverages bar. There is a shuttle bus every 30 min. from lounge to the consulate. Also, after the interview, applicant will be picked up from the consulate by the shuttle bus. I think it is worth to get the lounge. Also, applicant can keep their additional baggage there.

She is all set at VFS office now. Now proceeding to medical to Chennai next week. She had most of the vaccinations on her blood test done at their hospital, except very few. Waiting for antibody result tomorrow for those. If it is negative, her parents will give boosters to them.

Hyd, you can wait for interview letter. You may get it, unlike our situation. I think ours is lost in the mail or NVC screwed it up devil.gif

If you don't get around 20 days prior to your interview date, you can write to Chennai consulate, so they will give your interview confirmation and the instruction to download packet 4. That'll be more than enough for VFS visit. At that time, You need to tell the consulate that your case is not officially listed in July list.

I don't think you will have issues with interview letter. I heard they send to only good people star_smile.gif star_smile.gif star_smile.gif

So you already sent the DS-230 with the stuff they asked you to send? I wasn't sure since it's not listed on your timeline. If you did, then you should hear from the in about two weeks, either if it's an RFE or a case completed auto message at their number.

I'm not sure how soon they schedule appointments with the US embassy in Tokyo, but for most they make the appointments on the second week of the month for the following month. See if you can find other members going through Tokyo for CR1 visas and ask them. But if it works like most embassies, and there are no RFEs, you should be able to have an interview while you're there with her.

Actually I just paid the IV bill and sen off my wife's DS-230 with all the stuff requested today.
So you're saying if there is an RFE it will be within the next two weeks? That would be great as I dont leave until the end of July. I could have everything sent in before I leave.

How about for the interview? I'm assuming I should bring a copy of my birth certificate and passport but should I gather anything else before I head to Japan?

hey amastar, im so happy ur almost thru NVC

u should definately hear case complete before end of JULY for sure.. after they enter ur wifes ds230 they take about a week to have ur case completed.. so call them after 3 days and see if ur ds230 has been entered into their syste.m. if the operator says its been enetered then that means its under review and u should be done within next 2 weeks max from my guess..

i am flyin to india to be with my husband during the interview also.. im takin a copy of my birth certitificate, some phone card bills, and my us passport ofcourse..
