ummm just a question... why not just do all the forms yourself? It will take some intense reading and question-asking, but I dont see your situation as being that terribly complex. I would gather all the forms and read thru them and then decide, just an opinion as that is one of the reasons why sites like VJ exist.

I actually read on a different visa legal website that, although it is recommended that you file for the AOS as soon as possible, there really is no definiate time line on when you should apply. Basically, they said on the other site that fulfilling the requirement to marry within the 90 day period was the only obligation with regards to applying for the AOS on any time frame. I hope that's right, considering it was a visa lawyer info site (I'll try and find the link and post it here).

Basically, I think we're going to try and go for the AOS as I'm in the US. We married before the 90 days were up and we really don't want to be seperated, even for a day. On top of that, as I said before, our life is here. There's no-one at home we could stay with, as we would go together, if we went down an alternate route, so the K-3/AOS is the way to go for us.

We're going to start on the forms the next few weeks here and take it from there.

It's just a shame that life gets in the way and I know that a heck of a lot of people can't afford to spend the $1500+ right after getting married and both relocating. I mean, it's a sign of the times. We're almost all suffering with the economy and it's pretty understandable that most people can't get such a substantial amount together when there's other things you need to pay to just live day to day.

Anyway, thanks again for the advice and I'll keep you posted.

Hi guys,

It's been quite a while since I last posted a question on here.

So, here's the situation. My husband (yay!) and I got married in Sept 08, after we went down the K-1 route with the I129F. We married in Galveston, Texas (the day before Ike hit the island and we were vacated from our honeymoon :( ) and we have been living just outside Houston since then. Due to the main problem a lot of folks are facing right now (finances), we have had to save hard to get the fund built up to get the AoS/K-3 sorted out. We're there now and ready to make the move to getting the visa sorted out.

I'm having trouble now trying to found out the best course of action to take. I've read through the forums here and have noticed a lot of posts about the K-3 becoming obsolete. I believe, from trying to piece things together, that we should now try for either the CR1 (if we apply now) or IR1 (if we wait a few more month until our second anniversary). I'm wondering what the best thing is to do.

I have also read that applying for the CR1/IR1 comes with a lot less paperwork and significantly less cash to pay out. While the money issue isn't a problem, as we saved for the I-485 (I believe), I'm not sure exactly what we need to file for now.

My concern is that the CR1 is based on couples where one person lives outside the US. Well, I've been here with my hubby since July 08. We married in time, so the legality is not a concern. My worry is that if we go for the CR1/IR1, I'll have to go back home and file/interview from there. That's problematic as I have no family or friends I could stay with while that goes through. Besides, I don't want to be seperated from my beloved for even a day.

Also, what paperwork EXACTLY, in all totallity, is required for the CR1? Again a little confused there. Some places are saying i-130, bio and affadavit, others are saying 1-130, 1-129f, bio and affs. Is there anything other? Also, is the total cost for going down this route really just $355 or is there more to pay for filing. I know that we might have to do the medicals, etc again, but I'm asking with regards to filing fees.

What would be the deal with the AoS once we're into the i-130 process? Do we still need to go for the i-485, or is everything covered with the cr1/ir1?

Any help would be much appreciated as we're really looking to get this sorted out as soon as possible.

Hi!
I had that same problem for almost 2 weeks now but was able to correct it a couple of minutes ago. I tried so many different things. The only different thing I did this time was to keep the check mark on the part where it says "Remember Me" when logging in.
Try to log out and then log in again. Make sure the part where it says "Remember Me" is checked. Then just try to update your timeline like normal.

Hello All, I'm finally getting started with the K-1 process. Received my Noa1 yesterday. I updated the timeline but it is now not allowing me to view it. I updated the timeline with The Noa1 date then clicked submit, but everytime I try to access my timeline it says that it hasn't been autolinked, even though I went through the correct steps. Is there a time gap as to when it will be updated on the screen, or am I somehow doing something wrong. I know the importance of updating the timeline so thats what I've been trying to do.

Don’t take it the wrong way but this forum may not be for you. People here are dealing with lots of stress because of the long wait to get this visa. I'm not going to bad mouth you, but for example my fiancee is pregnant with our first child.

We have to go through this ridiculous process just like everyone else, stand in line and wait. I can’t even see the stages of my baby growing (and will never be able to see those stages, until we have another).

I know there are people who would use the K1 visa for other purposes but I can guarantee you most of us on this site are pissed off because of those people who make the process that much longer for us.

So if you love her and want to spend the rest of your life with her use the K-1, but if this a try out thingy then most of us probably wont sympathize with you.

I'm going through Texas Service center as well, but it seems as though they are transferring the petitions to the California Service center. So I would check Cali for a more accurate timeline since that’s where it'll probably end up.

As far as the timeframe it really varies case by case, and yes you’re probably looking at a 6 month time period to have the visa in her hand (really depends on lots of factors). I'm sure others have more info for you.

Also you may be able to get your petition expedited if you’re going to be deployed soon, that’s really the only way you can expedite your case. They wouldn’t even expedite my fiancee who is carrying our child right now.

Hi

Wanting to know a bit more about the police certificates required at the US London Embassy. I know each consulate very as far as their requirements. It’s a bit early to get them, but want to be prepared because of the time it takes to obtain them.

Me and my fiancee spent over a year in her birth country (Thailand) recently and I think we will have to get one from there as well, not sure though. Could those of you who have gone through this Consulate give us the exact requirements for the police certificates they need, and how soon should we obtain them?

From what I understand she needs police reports from all places lived at, for more than one year since the age of 16. Don’t know if this is correct because I was probably looking at another embassy’s requirements.

Assuming your in the UK, it takes up to 2 months (could very likely be much shorter). If you lived in Germany before the age of 16 then you don't need one from there.

Hi everyone.. I dont meet poverty guidelines and will use a co-sponsor but since I still have to fill out the i-134 and be the primary sponsor, I have a question about my bank account. I have a savings account in which I have several thousand saved up. I deposited large portions of my pay checks into it. The problem with my savings account is that my parents opened it up for me when I was 15 and their names are on it too. Their names are on the statements along with mine. My checking account is in my name, alone. I called the bank to have their names taken off the savings but they said I would need to close the account and open a new one. If I want it to look good, (since I already have other financial factors going against me, and thought it would atleast look better if I had several thousand saved up) should I just use the account I already have with my balance, deposits, etc for the year or should I open a new account in my own name?That might look a bit hasty but it would be all me. I know, I dont qualify as a sponsor anyways, I just thought it might look better on a side note and might add a lil positive factor to the circumstances when the CO officer looks at everything.


Well Paul I don't think you need to do all that since they will be looking at your co-sposponsors 134 instead of yours (since you don't meet the poverty guguidelines to begin with). It may look better but I don't think it will make a difference when the CO notices you don't meet the guidelines then goes directly for your co-sponsors 134.

Check the requirements for Canada because it is different for every country. I know Thailand is 6 months and UK is 1 year. So either contact them directly to see the validity, or check with someone here on VJ who had to get one from Canada.

This shouldn’t be a problem. I did a lot of traveling to UK and Asia and don’t have any stamps for reentering the US. I submitted my passport with the I-129F for proof of having met. So as long as they see you were in the same country at the same time it shouldn’t matter if you don’t have reentry stamps to your own country.

My fiancee needs to get her Birth Cert. translated into English, and I want to kill two birds with one stone if I can. We are trying to wait a bit so that if we need to get the Police Cert. translated it won’t expire in the 6month time period that it’s valid for. It would be great if it could be issued in English so that we can go ahead and get the Birth Cert. translated.

All you would need to do is send proof of having met within the last 2 years when initially submitting the I-129F, the rest comes later (All foreign language documents must be translated). The passport I would send because it would show this proof (if he has visited you here) (you could also send your passport copy if you have visited him). The rest you could send copies if you wanted and detail them as for your reason in including them (couldn’t hurt).

I'm doubting that, from what I've heard the 90 days is a pretty strict rule. I would get a marriage license and get a quick courthouse marriage and if you are wanting a big wedding plan one for later (even though you're already legally married).


:thumbs: I agree do the quicky and then plan later for the biggy. I checked the quick route here in Houston $40 for license and $40 for the courthouse marriage.

Yes you can visit. This process usually takes awhile to complete depending on what Service center you go through (4-6months). They advise that you don’t visit once the I-129F is submitted, but others have done it. So visit and double check your paper work and submit it while you're here.
