No, it's not possible to schedule an interview before NOA2 - it's not even possible to schedule an interview right when getting NOA2 - you have to go through the NVC, then they send it to the embassy, then the embassy will tell YOU when the interview is on their schedule - unfortunately you have no control over it.

Second, having or not having a lawyer will not speed up / slow down the process or avoid a request for additional evidence.

First I would like to know if it is possible to schedule an interview date before receiving the NOA2? I notice on other profiles that the time between NOA1 and NOA2 is average but then the interview is about 3 MONTHS after the NOA2! Never expected to wait so long for the interview :(

Next question is did any of you guys have a lawyer to file the paperwork? I know it doesn't make a difference in the processing time if you do have one, but I was wondering if anyone was required to turned in extra forms or the process was delayed, even after having a lawyer.

Sorry if my questions are repetitive to others or just plain silly, but I can see I will need a lot of support going through this. :crying:

Now is it me or the majority of people who get denied their petitioner did not fly down for the interview ????..knowing Jamaicans i can see them thinking something wrong with this relationship " yuh mean fi tell me seh u man/ooman have a interview ahn yuh nuh come dung fi support him...DENIED???...lol, i'm joking but I do want to hear other peoples thoughts on this.

The same money that I will use to travel to Jamaica to be there with him for the interview, is the same money I can use to pay for his plane ticket to come here. Your fiance got a chicken pox vaccine which is a 2-shot series. You get 1 shot, and 4 weeks later you get the second shot. You cannot be given 2 live-virus vaccines in less than 30 days unless you receive 2 *different* live virus vaccines on the same day.

I had to go through a lot of drama getting my vaccines done and learned a lot about how many shots per series (2 for MMR, Varicella) and how much time you need between the 2 shots. It's annoying but that's how you get immunity...


So you're saying that it is possible to get the second round of varicella shots and influenza shot on the same day? I hope that's the case.

Hello everyone.

While filling out the Fiance Letter of Intent, I can't decide which address to use for (USCIS service center address). I live in Texas, and according to the USCIS website, I could submit to the following two addresses.

Most places that I've read up on states it's the later address. Which one should I designate in the letter? unsure.gif

After reviewing that link you posted, I can honestly say that we wouldn't raise any "Red Flags". Except for one... When we originally sent our I-129f, we never included a letter regarding our relationship, feelings, and its evolution. We provided enough evidence including photos, e-mail, IM logs, calling card purchase records, flowers, and other gifts I've purchased for her all those years.

Again, not a single narrative about us. All they have to go by is Question 18. :bonk:

I will construct an EOR with the first paragraphs detailing the methods by how we communicate, feelings toward each other, and future plans. Following that will be a general outline of what we did each time I visited her. Will doing this add enough counterweight to our dilemma?

With regards to the EOR letter itself. Should I sign it (does it need to be)?? How about getting it notarized? Should she do it at GUZ, or should I do it here in Houston?

I think that the EOR????????????????????????????????????????????????????????????????????????????????????????????????????????becomes engaged a week after meeting the first time and files a scant I-129f shortly there after, then the VO has little to go by. I think this is also the same when it comes to being in Guangzhou during the interview. If your fiancee is well prepared and you both have clearly demonstrated a committed decent-termed relationship, then your presence is not a factor other than to provide emotional support. People can argue all of these points, I think each case will be affected by different factors and it is difficult to generalize without hazard. You do not have to send an EOR letter with the petition, but it also doesn't hurt to include a clearly detailed (not sappy) account of your relationship. Most likely, and EOR letter will only be accepted at the interview if the VO is "fishing" for fraud. A well prepared fiancee will most likely have a couple requisite questions followed by "pink." This is the one trend I have noticed. Good luck! :thumbs:

I do wish I had submitted one with the I-129F. Is it overkill or not? I'm not sure. But after visiting my fiancee 6 times (once a year, a week each time). I don't want to give them any doubt what-so-ever! I just hope my case isn't the type that could be red-flagged because we left out 1 or 2 page timeline of our relationship with the I-129f. When I answered Question 18, it was three or four sentences max. :unsure:

My understanding of EOR was it was to be sent after the I-129f package, or is that what Question 18 is about? Regarding that question, I gave a very brief discription of when I first and last my fiancee in China and that we met online.

After reading about how important the EOR is, I'm starting to freak out that maybe that should have been submitted with the I-129f package!!! :o :crying:

Because my case it going to GUZ, are we already red-flaged and don't even know it yet? Would sending an actual EOR at interview help at all? I'm getting the impression that they would blow it off. Why? I NEVER got an RFE!!!

Please check the dates on your I-134 form. I think you are using a form that is out of date. The current version (10/30/08) does not have the requirement to be notarized or affirmed by the CO. You are allowed to use older versions of the I-134 but it seems unneccessary and certainly not recommended.

It specifically states you do not require notarization.

See page 1, lower left corner of I-134 instructions for this form.


Sure enough, that's what it says.

You must sign Form I-134 in your full name. (Note: Signing Form I-134 is under penalty of perjury under U.S. law).For this reason, it is not necessary to sign Form I-134 before a notary, nor to have your signature notarized after you sign it.



Which begs the questions. WHY is the option to have it notarized still even an option on the form? :blink:.

"You must submit in duplicate evidence of income and resources, as appropriate:"

It includes items such as a statement from an officer of bank and statement of employment.

So does this mean I need two original copies of each now? Two signed letters from work, two signed letters from my bank? Or can one be original and one by a copy?

We got our NOA2 on May 13, 2010. So, I'm in a rush to get information gathered to send to her ASAP. However, I have some reservations about as to when I should start. For example, will my banking info be considered "stale" by the time the interview is conducted? Also, I plan on sending her the following... Please tell me if I'm on the right track.

1. Copy of original I-129F packaged that was sent out.
2. Copy of NOA2 letter.
3. I-134 with 3 years of tax/income data (IRS Transcripts).
4. Bank account history.
5. Letter from employer.
6. Letter of intent to marry (updated)
7. Eveolution of relationship letter.
8. Proof of on-going relationship. Includes photos, passport visa stamps (scanned and printed), calling card CDR list, e-mail, and skype chat logs.
8. Certified Copy of Birth Certificate (Long/Full size).

Do I need to also provide proof of residency letter (I live in a single bedroom apartment)?

Most importantly, which of the aboved mentioned should I get notarized?

BTW, Packet 3 and 4 is intended to be filled out by the beneficiary (my fiancee in China). Any action items needed by me state-side that requires mailing out to her?

With regards to sending my fiancee original documentation. How do I go about it if it's mostly or all electronic. For example my flight tickets were e-tickets. Also, my paystubs are sent to me in e-mail because I have direct deposite. I've already sent these with our original I-129F package. If I provide them again to her, will they be considered "originals"?

Also, I never used a birth certificate when submitting the I-129F package. Instead, I submitted photocopies of my passport as that can be used in place of a birth certificate. What do I send to my fiancee? My original passport, copies of passport, or do I now need to apply for a copy of the birth certificate to send to her?

GUZ looks for her to have a life plan for USA. she should have employment or educational goals that are reasonable. she should have a chinese drivers liscence and an international translation so that you can begin to teach her to drive the day after she lands. if not, you will have trouble getting her a liscense in USA in a reasonable time. no matter where she gets her liscense, she will drive horribly for the first year. get used to the idea of it now. buy extra life and medical insurance.

My fiancee lives in Shanghai. She either walks, takes subway, or the taxi. Americans in New York City can also do without a vehicle. Granted, we would be living in Houston, TX where having a vehicle is practical. However, her desire to take drivers education and obtain a Texas drivers license would be enough Right?

My fiance just passed through Calgary US Customs with hardly any issues. They did say that having a copy of the petition and NOA1 helped a lot and kept the questions to a minimum. Also, have copies of your return ticket.

The customs agent's wife happened to go through the same process so some sympathy there. She will be here in a few hours =) yay!

I'm tired of going to Calgary every month hahahahaha, but the airline pass privileges do help. Good luck

You get your appt time and then have to check in and get a number to speak with someone. So go early. However, I know you are only allowed to be so early and I don't remember that time frame. When I have gone here in Atlanta they have been nice and fast. I don't think they always know what they are talking about though. Good luck.

You do not send anything back in Morocco. Your SO will take it all with him when he has his interview. He should have received an interview date in packet 3. Morocco does not havea packet 4 and does not require affidavit of support. Make sure that his police certifiacte has the word "Nothing or None" written on it and that it is translated. The celibacy form also needs to be translated. You may want to ask the questions that are Morocco specific in the MENA forum where there are many of us to guide u and answer your questions.

Just administrative. Make sure that your SO knows the new address bc that is something they ask in the interview. I would advise that if you move after you have your interview date, to wait until after the interview. Makes things a little easier during the interview. Unless you can prepare your SO with the new address and then there is no cunfusion. I hope that made sense.

He stated that it wasn't from a single act. It was for 4 seperate incidents over the course of a year. Merely the arrest and charges occured at one time. Four counts of felony distribution would count as four seperate acts, I would think. You can't distribute the same "product" four times at exactly the same moment in time....



Well, I guess we then need to ask if it was the same narcotic or not. Technically, he could have had more than one narcotic on him or had just enough that would allow them to charge it as a distribution charge. Now, I also hae to ask, even though that was what he was chareged with, what was the OP convicted of? That also will make a difference. He dad say that they occured at the same time. Remember that a charge is only a charge and not a conviction. Realistically, we would need more info for an exact answer. But if they occured at the same time as a result of the same arrest, then it is one single act and I have seen people with several distribution charges on one docket.

a lot of countries allow marriage to distant cousins, haven't heard about first cousins due to the gentic issues when it comes to the children, but as said before, be prepared during AOS and such to show that it is a bona fide romantic relationship. They may be a bit harder wtih you thinking your intention is not what it is so be careful and good luck!

wow...super good questions there. i am not sure that by legitimizing ur daghter here would make her a citizen unless you can prove u r her biological father. i mean, she wasn't born here and her birth records are not here. what is the burden needed to prove ur a citizen here in the courts and show that she is ur child? many children come attached to the SO, but that does not make them citizens. i think this is a very complicated situation and you may need to talk to USCIC yourself or an attorney to see what your best options are. wish i had some insight for you. sure hope someone else does.

From past experiences, I would not realy on e-mail or the site where u can sign up to chek for touches and all that. Niether were accurate for me. Our 129f still shows pending and we are AOS approved. Touches were wrong and missing. I wouldn't count on that info too much.

Social Security is federal and does not vary state to state. You can apply for your ssn after you are married. What varies is the requirements for marriage. IN the info that is posted by mnay states, it will say that you need your ssn number. However, you need to call and inquire since you will not have one. A marraige can still be performed if you can prove you are here legally. The information that is posted is for the most routine situations and questions and you are an exception. I know that when my husband and I went ot get married, the info said he needed is ssn. I explained that he was here from another country and had to wait to apply bc USCIC had to put him into the system and that is takes a couple of weeks before he can apply for ssn. They told me that all he needed was the documentation to show that he was here legally and we could be married. Take the time to call or send them an e-mail about your circumstances. Good luck!

My advice to do it the simple way. That being cross the border once on your K-1 and then do a simple wedding. Go to the court and get it done. Do the fancy wedding whenever you want wherever you want later on.

I got my K-1 in December but knew I wouldn't be driving until the late-spring early summer. (Car repairs and didn't want to get stuck in snow). I REALLY WANTED to fly to the US for a visit as we hadn't seen each other in a long time. But chose not to.

When I did use the K-1 visa, I asked the border guy processing my stuff if it's possible to cross into the US for a quick visit without actually activating the K-1. He flat out said no. So in my case, I wouldn't have been able to use it.

I also wouldn't recommend trying to cross the border without activating the visa because if they decide to not let you into the country without processing the visa, they're going to take you into the room and fingerprint you and stuff because "they're not letting you into the country."

I tried to move to the USA with a K-1 visa that was 3 days expired. They said nope and fingerprinted me, typed into their computer for about 10 minutes, then sent me back home to Canada. Didn't seem to make a difference when I came back with a 2nd K-1 visa (that wasn't expired). But I did have that wondering around in my head. Will they make a big deal out of the whole incident with the 1st K-1 visa.
