Ok guys.. plz plz plz plz help... my fiance studied in the UK and India and he was there I think for more than 12 months but not constantly.. he went bak an forth from Jeddah and to those places, does this mean he will need a Police Clearance letter from UK and India. I am not sure if Uk even has his info an how will he able to get it from there if hes not even there.. he left bak in 05 and hasnt been back ever since. What about India? Can anyone help me on how to get a PCC from India. My fiance is a resident of Saudi, but has an indian passport since he is an indian. He has lived in Saudi all his life but went to India for education purposes and was there for more than 6 months. Any idea on how I can get a PCC from india since he is not there anymore. I am really desperate as our packet 3 is almost on its way to him. I am not worried about anything just these PCC as he has to get 3 PCC. One from Saudi, one from UK and i guess one from India. Hello everyone...

We are currently going through the K1 approval process (we have received the NOA1 and should get the NOA2 anytime... I hope)... My fiancee and her daughter (17 y.o.) were planning to come visit me for two weeks in July, partly so that her daughter would see how life is in Houston, and also to look at some universities in Texas she may be interested in attending. Considering that we will still be going through the K1 approval process when they make their trip in July (probably going to have an interview scheduled for sometime after they return to Brazil), I was wondering if there would be any problems with them making this trip at that time. Please consider the following factors that may or may not have any relevance:

  • My fiancee has already visited me twice before beginning the K1 process... She has dual citizenship (Brazil and Japan), so she used her Japanese passport to enter the USA, because that way she didn't need a visa.
  • Her daughter (Brazilian citizen only) successfully received a tourist visa after the K1 process was initiated (only had a NOA1). I should note that during the interview for her tourist visa she stated that the purpose of her trip was to visit "her mom's boyfriend" and to look at universities in Texas. So they know that her mom has a boyfriend in the USA, and they approved her tourist visa anyway.

Will there be any problems with them coming to vitit at that time? Anything we can do to avoid problems?

How do I find details about the process for a K2? I know what to do up to the point when the K1 (and the K2) are issued. But what happens next?

Do I follow the same steps as the K1 once my fiancee and her daughter enter the country? i.e... Do we apply for EAD, AOS, SSN, etc. for the daughter at the same time that we apply for my fiancee?

What about if the daughter follows my fiancee at a later date?

Also... The daughter wants to go to college in the US... She is taking the SAT + the TOEFL + applying to universities in Texas... But I was wondering if she could go to college with a K2 visa??

Is just that their case load is getting larger, and more backlogged perhaps.



I expect the whole process to take longer than the 5 months since they are getting more backlogged and I have read the comments. However I thought they processed in order of reciept. For example I expect to look at the timeline one day and see 'NOA2 dates being processed today = Aug 1' and in a day or two the 'NOA2 dates being processed = Aug 2'. Instead we went from August 3 to July 31 through VSC. How is it possible to go backwards??

So the average processing time of my friends (I have 3 that have done the K-1 visa) including interview, was 4-5 months. They all started their petition early last summer (2009).

I'm about to send in my petition at the end of the week. I live in Chicago Illinois (I don't know if that means Texas will send my petition to Vermont or California.)

I just read on one of the other threads that its taking 4-8 months before they even get a NOA2 from USCIS?!!! And that there's a huge scam or backlogging or some crook that's in charge that everyone's upset about??? How long is this really going to take? Is this only in Vermont??

How many people have actually experienced this backlogging, or is this only a minority?


There is a big backlog in Vermont for whatever reason and they are processing longer than the goal of 5 months. Everyone applies to the Dallas lock box and the application gets sent to your designated center but I don't know where Chicago is sent (although I am curious since I grew up there). If you look for "Igor's List" under immigrations timelines and K1 Visa, you can select each service center and see how many forum members are waiting ahead of you and what NOA1 dates are now receiving their NOA2. This is a small percentage of overall applicants from what I hear. We just need a little more patience than your friends needed.

I called today and was informed that VSC is currently processing applictaions received August 21. They also said they look at 30 day baches...so anything between Aug 21 and Sept 21 is being worked.

As our application was received 16 Sept, they can't officially do anything until they are processing applications received 17 Sept...because only then would ours be considered late. So close, yet still so far!

First, you may want to update your timeline as I believe only Vermont and California service centers handle K-1 visas. You probably sent your app to the Texas lockbox facility for check processing and then it was transferred to either VT or CA, depending on where you live. If your receipt number begins with an "E", its in VT, if it begins with a "W", its in CA. Right now, California is working much faster than Vermont. If you call USCIS customer service, they should give you a date of applications that is currently being processed. This date is just an idea because they only update the "date" once a month, usually in the middle of the month. The latest date from Vermont is September 11, though applications from before and after Sept 11 have been approved recently. I have been waiting for more than 6 months and finally got my Senator involved and am waiting for a progress report on Monday. Contacting your senators or congressmen is free (you are their constituent), but they will require you to fill out a privacy release to request information. I wish you lots of luck, especially as a fellow British/American couple!


FYI, Vermont is processing at or after 16 Sept 2010 as of this past Friday. They didn't tell me the exact date, however finally let me submit a service request. Just the day before they wouldn't let me submit one because they were still reporting they were processing 11 Sept.

We got our NOA2 on April 6th via email, and then the hardcopy a week later.
We still haven't gotten our NVC notification although I heard that it takes 2-4 weeks for processing, but is that from the time the hardcopy is received or the day of approval?


We got our NOA2 on 4 April via email and have no mail from NVC either...however I called NVC last week and was told our application was sent to Vancouver on 15 April. I had to wait 15 min for an operator to hear that and get the case number because the automated service had no record of our case using the VSC number. My fiance then emailed Vancouver, who said it normally takes about two weeks for them to receive it. He has not yet gotten anything from the embassy.

My fiance had the same problem. He ended up printing the version with only answers. When we got to our interview they wanted him to use thier computer to fill it out, however the internet was down so the embassy personnel ended up filling it out for him to verify.

Depending where you live you can get the marriage certificate right away. We got married on Saturday, took the form to the courthouse on Monday to register and got certified copies about an hour later. They weren't that busy, we asked nicely and explained it was for immigration purposes. You might call your local courthouse and ask first, if you have the time to register right away. We were in Cook County in Illinois.

Hello group - Thanks to all for all the information on this site. This is the greatest resource for anyone that is working with the USCIS.

One question - I just submitted an I-129F and I went to the USCIS site to check on the status of the case.

I am a bit confused though on the status message I received back and I have provided it below:

Initial Review

On November 18, 2009, we received this CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice.

Thing is, it is clear that I DID not submit the CR189 PETITION TO REMOVE CONDITIONS.....I submitted the form I-129F, Petition for Alien Fiance. Anyone else have the same situation or seen this phenomenon before? I am concerned that maybe they made a mistake and now things will be delayed unnecesarily even though I submitted the correct form.

Just got off the phone with my (very upset) fiance'. She told me that the biological father of her son is refusing permission for her son to get a Costa Rican Passport. He needs this Passport because without it, there will be no U. S. Visa. She had an appointment in the local city near where she lives for next week...19th of March. Initially, he had agreed IF she would sign a legal document relieving him of any future financial responsibility for the boy. No problem with that because he doesn't pay anything anyway....or rarely does. (He's supposed to pay $36/month.) Any ideas about this from you experts in this realm?

One other thing I wanted to say about this and this is my last comment..I promise! Really it goes without saying that the US embassy cannot help you in anyway regarding the immigration of a Costa Rican child. All they will tell you is what they need to issue your fiance and her son a VISA if you meet all the requirements. Of course, one of those requirements is a passport with the special permission from the father..and you get that through the immigration department in Costa Rica which is where your hold up is. 'Propina' or bribe may be the way to go here..but make sure you start the bidding by asking the father what it would take..then your fiance gets to wait in line for hours and hours with the father....Nooooo fun!

By the way...when getting the passport, we were able to get the permission letter at the same time issued...it is a separate very official (although not all that fancy) piece of paper with Cedula information of both parents that stated that the daughter of my fiance had permission to go with either parent outside the country. They stamped it with a special 'sello' or seal from the immigration department. So, that way, there are not 2 processes you need to go thru..if you get the passport you can get permission to leave all at one time...Also, let me be clear...there was some discussion when we were talking to the immigration folks about what kind of permission was being granted...different options if you will. One choice was to have to get permission for every time the child left. Another choice was to have full rights to just the mother (father would not allow that). Another one was either parent (that is what we got). So, that is your challenge. Again, good luck!

Bribe may work..I had the exact same situation..what we did is have many family members put pressure on the father to sign for the passport and the permission to travel. After some discussion it worked, although I will say the 3 hour wait in the line at immigration with the father was no fun! :-) Anyway, all went well and we avoided any confrontation and we are good now. If that family pressure had not worked, we would have resorted then to financial type of enticements, and then lastly, gone for the 'extincion de paternidad' which you can get from any attorney in Costa Rica. Problem with that route is it usually takes at least 6 months..so you should start that process sooner rather than later if you have to take that road. There is a guy Greg Kearney I consulted with before I got the signature..he seemed really good.

Hi all!

My fiancee sent the I-129f on 03/18/2010 and I will go to visit her (to give her the ring!) next week. I have a round trip ticket... I read somewhere that I will have to tell the immigration officer we asked for a K1 visa... Do I have to since it hasn't (and it won't be) been appoved by the USCIS yet?? What if I want to go back later (maybe in June)??
Other question > I read in the VJ K1 guide that: "Depending on which U.S. airport you fly into (NY JFK) some will issue a temporary 90 day work authorization if asked for". Someone can give me more information abt it?? (do I have to ask prior entering the US? Do I just have to ask the immigration officer?). I will live in NY (Poughkeepsie) and I usually flight to JFK.

Thank you az110965 for your quick response. Those were my thoughts exactly about the divorce decree and with my employer there is not changing their minds about anything. They hire third parties to handle all aspects. I think there are four stages to get somebody hired and the first three are through another company and that part takes about 5 months. My mind as at ease and I have all of my tax returns and transcripts. Thank you again for your knowledge.

My boss has informed me that it is against company procedure to produce a letter of employment. They gave me an 800 number, for a third party company, so the CO can call. :bonk: Tomorrow I will go to my credit union and hope they will give me a letter for the I-134

paperwork. I have also contacted my ex wife about a notarized letter stating that we are not and have not been living together since before our divorce in 2000. She said "no" because her name is private. :rolleyes: I am interested to know what others have done about getting something for this situation with an ex wife. Should I worry about having proof of not living with her, since before our divorce in 2000, for the HCMC consulate?

No, it's not possible to schedule an interview before NOA2 - it's not even possible to schedule an interview right when getting NOA2 - you have to go through the NVC, then they send it to the embassy, then the embassy will tell YOU when the interview is on their schedule - unfortunately you have no control over it.

Second, having or not having a lawyer will not speed up / slow down the process or avoid a request for additional evidence.
