Hi all,
Me and my Fiancee registered a while back and have yet to post so I thought I would say hello. I was wondering if there are any statistics about the length of time til we get our NOA1?
Thanks for reading

You should search for other posts on how long it takes, as this question is probably asked about once or twice a day. It really depends. Everything during this process is case by case.

Welcome to VJ, and good luck.

Yep, it is. The question was just a conversation starter. I have searched many times for things I need and found them every time, but I never had the opportunity to chat with anyone that way. Therefore, the purpose of my post was an introduction/ice breaker.

Hmm, money order. Looking at your timeline, you have already got your NOA1? What method of delivery did you use? Your package was sent the day before mine and it has not even been 5 business days yet. The post office said that it would arrive there today and since it is registered mail with a return receipt I will know shortly. Thanks for the reply

You could at least let him know that Cebu is safer than Manila, less street thugs and pic pockets, and friendlier people.

I just sent them in on 10/10/2008 so no update just yet, the package should have arrived there today.

My Fiancee is abbynorm1 if you want to chat with her or send a message.

And tell that man of yours to get his tail down to CDO and visit you, I felt far safer in CDO than in Manila. I love it there and met many Americans there and on the plane who live there now instead of in the states.

First, congrats on the engagement, my Fiancee is also Pinay (CDO). Yes, I did. If it makes you feel better, you can download the forms straight from the uscis website. but they are exactly the same documents, the only difference is that; here the guides will mention things that the uscis website or instructions will overlook to help to keep you from getting an RFE. I have read some similar topics about this (regarding the fiancee's name), but I was wondering what other people have filled in for the section where it asks for the father's and mother's first name.

Let me use an example Asian name: Nguyen Nam Grioa

Should I use: "Nam" as the first name or should I use "Grioa" as the first name? Or.... should I use "Nam Grioa" in the first name box?

If I remember correctly, Vietnamese names are constructed with the last name first, then the middle name and then the first name. I filled out some paperwork for one of my EX's brothers and it was written as Nguyen Van Tho, but she told me that his first name was Tho, and I already know that Nguyen is a Vietnamese last name.

Something that I wanted to point out, in your time line you have Texas service center as the place of filing, (not yet filed) but if you live in Texas you will be filing your I129f in Vermont, just a heads up.

Welcome to VJ

Thanks smile.gif I'll put in the last part of their name as their first name.

When I filled in the timeline, I just selected a random one since I didn't know what to choose at the time. I'll update it with the correct information.

I was just letting you know so that you didn't loose precious time waiting on the packet to be returned.

Hi All!!!

I just mailed this week the visa petition and today I joined this site. I have a few questions, I will ask each in its own thread.

Question #1
If there is a age diffrence between the me and my fiancee. Does that make any diffrence? What if the age gap is 30 years?

I would appreciate any input.
Thanks,

See other posts for other questions star_smile.gif

Age differences are the norm in the Philippines, just check any dating website that hosts the Philippines and you will see most ladies are searching for a man 10 years her senior minimum. They want a mature stable man to provide for the family and be responsible. Me and my Pinay have a 16 year gap.

Good luck and welcome to VJ

My fiancee is in the Philippines, she has a very good friend ( also in the Philippines) who is in the process of annulment. she is engaged to a guy from Connecticut I think. I have suggested that they join VJ to have a better resource for information. but in the meantime, their question is:
when should they begin collecting evidence of a relationship? Should they provide all supporting evidence, or should the evidence begin the day after the annulment is final?

Does anyone have any bad experience with the USCIS or the Manila embassy being strict about this?
Thanks

K-1 Fiance(e) Visa Process & Procedureslawyer or not?
QUOTE (ms_jinga_lala @ Dec 4 2008, 10:16 AM) <{POST_SNAPBACK}>
I'm just curious how many of you had lawyers and how your processing of the K-1 went whether you had one or not? And by that I mean if you didn't use a lawyer do you feel like it was stressful, difficult, not that bad, etc. And if you had a lawyer did you feel comfortable during the filing process? And would you recommend getting a lawyer and why?

No, we didn't use a lawyer. I found this site months before I was ready to file my K1. I read other threads about this topic of lawyer or no lawyer and found that the lawyers will slow down the process, and you will end up doing most of the work anyway (collecting evidence and making copies etc...) the online forms are not difficult to fill out and the guides are rather straight forward. Actually, I was unable to find a post that said that the lawyers sped up the process. There were a few people who were satisfied with the lawyer's performance, but most were not because of serious delays in filing or weeks with no returned calls/emails. If you choose to use a lawyer, get some kind of time frame commitment as to when they will file your case once your part is finished, otherwise it could be next year sometime.
A friend of mine had me convinced that I needed a lawyer, and he recommended his Manila expert for K1's. So I called the so called K1 expert for the Philippines. After a short conversation, he laughed at me because of my situation (which is the same as many VJers here which is only having met once in person) so I hung up and decided to do it myself.
Whatever you choose, Good luck

So you filed the same day as me, but I got my NOA1 on the 15th and touched on the 18th. If your timeline were filled out, it would tell you when to expect the NOA2. but since it is not filled out, you can expect it to read something like this:

Our story has more similarities than differences. I just wanted to let you know about Skype if you didn't already know about it. It uses a webcam and mic just like Yahoo or ooVoo, but I find the video quality of a far higher quality than the others that I have used. It is free to use and it saves logs of call times and dates, has text, and games. I have a pretty cheap plan I use when I have to, but most of our time is spent on Skype.

As posted on an immigration law firm website :

There is a provision in the law that may exempt the petitioner from the meeting requirement "if it is established that compliance would result in extreme hardship to the petitioner or that compliance would violate strict and long-established customs of the K-1 beneficiary's foreign culture or social practice, as where marriages are traditionally arranged by the parents of the contracting parties and the prospective bride and groom are prohibited from meeting subsequent to the arrangement and prior to the wedding day." INA § 214.2(k)(2). Unfortunately, such waivers are very rarely granted by the USCIS. The "extreme hardship" exception has been interpreted by the USCIS to mean something very close to "impossible". It generally is available only to people who are so disabled that they can't fly at all. As for the second grounds for a waiver, very few people qualify for this exception, and those that do often have a difficult time proving it to the government's satisfaction.
You don't need to post the reason here as to why he cant visit you, but if you both are not Hindu undergoing an arranged marriage, or he is not bed ridden then it most likely wont happen.

K-1 Fiance(e) Visa Process & ProceduresInterview Questions
Hi everyone!

I have my interview on Thursday afternoon in the US Embassy Dublin and I'm very nervous. Can anyone tell me what I can expect to happen during the interview and/or if anyone has experience of the Dublin embassy.

My finace is here in Ireland with me and we have been living together since 2005. Would it be advisable that he attends the actual interview with me, if he's allowed to? Obviously, seens as we live together and have numerous things that point to that fact, proving our relationship is no problem. My concern is that he has not been able to work while out here and prior to this, he was a student so never had to file taxes, as he has not had any taxable income. His parents are acting as my sponsors and we have all the docummentation from them here and ready to go. I know he has to fill in the Affidavit of Support, and the lady we spoke to in the embassy a few months ago say that a letter to state his position with regards to finance will be fine, so long as we have the information from his family. Is this really the case?

Also, what sort of questions can we expect to have?

Thanks in advance!

K-1 Fiance(e) Visa Process & ProceduresFiancee is pregnant
And again I ask how is this different than people with children? A few here have children who are missing the other parent, parents missing birthdays....etc.
I have just been diagnosed with a debilitating disease, should I get there sooner than someone who is healthy?
Can I make a special case because school starts end of July and I don't want my kids to be starting school late, in a new country, in a new home, away from their friends and family?
Everyone has special circumstances.
Being together for pregnancy is not a NEED it is a want.
[/quote]

They should expedite all cases were children are involved, pregnant or not. Also do some research about bonding while in the womb and fetal development. This bonding has a major effect on how the Father perceives his child and makes the bond stronger in life, also the father interacting with the baby (speaking closely to the stomach) builds bonds that will carry on throughout life (baby will already know the sound of the fathers voice even before birth). Not to mention stress on the Mother passes through the placenta straight to the baby subsequently raising the babys blood pressure thus making that baby whos mother had high stress, more susceptible to diseases like Diabetes and other major problems (all because the mother was stressing alot throughout the pregnancy)
Children are our future, and future care takers, to not put them 1st is definitely inhuman.

K-1 Fiance(e) Visa Process & ProceduresFiancee is pregnant

What really apalls me is not so much that people spout more opinion
than fact on this issue, but it is those despicable individuals that crawl
out of the woodwork to criticise and belittle people like me and my
fiancee who have gotten pregnant during the K1 process and are
looking for ways to speed things up.

Comments about cutting the queue, and pregnancy being a choice that
could've been prevented, are utterly crass, unsympathetic, and inhuman.
I'm surprised that nobody here has actually shown their true colours and
recommended the possibility of abortion given the anti-family, anti-children
sentiment some have expressed.

The bottom line is that it is fundamentally wrong and unjust NOT
to expedite K1 petitions for pregnant couples. They do deserve "special
treatment" because a child is no small matter, and it is for the greatest
good of the baby that the USCIS ought to see to it that the parents are
brought together ASAP.

I cannot condemn enough the insidious cretins on this board who insist
that pregnant couples deserve no special treatment. It is discrimination,
intolerence, and selfishness of the highest order. Yes, the visa journey
is long and hard as it is, but pregnant couples have a real and present
need to be together - they don't just have to deal with the heartache
of separation anymore. To say they should remain in the same boat
as everyone else is just plain wrong, and you people should be ashamed
of yourselves.

Well put, I couldnt have said it better. I would feel this way even if my fiancee wasnt pregnant.

but hey if you can jump the line and you are ok with it then feel free everyone else will just have to wait....

Yup, Kezzie's right, it could have been prevented. The rest of us just has to wait.

If I was a priest yes it could be prevented. Condoms do break ya know, and some woman cant take the pill and other contraceptives (due to medical conditions). Get real man, I believe in fate something that is out of everyones hands. If I was meant to have a child this year then it was meant to be, no condom is going to change fate.

K-1 Fiance(e) Visa Process & ProceduresFiancee is pregnant

Congratulations to the pregnant ones...

What's that mean for everyone else? I guess everyone go get pregnant to expedite their cases and have the congressperson deal with 100s of new petitions wanting to get expedited due to pregnancy. So if you're pregnant now... I suggest making those calls/letters ASAP, otherwise people will get the idea that they can beat the system this way. Maybe not on purpose, but I'm sure others will find reason to do it on purpose.

For everyone else... I guess you have to let a few people cut in line, maybe more, once the word gets out that you can expedite your case if you're pregnant. Well good luck to you guys, hope the government doesn't start seeing an influx of pregnant fiances and starts delaying cases.

David A.

Your entitled to your opinion. Those of us who have pregnant fiancee's didn't use the system to get expedited. Its just a fact a child needs their parents for their development. its not like one day I decided that getting pregnant was a way to get her here quicker (Its a blessing that was out of our hands). So you think my fiancee should be stuck in a 6 month waiting line when our baby is due by the end of it? 1. a new born is not supposed to fly until 6 months of age, 2. Women shouldn't fly close to their due dates, 3. Let you be in the same boat as us and you cant see your child growing. If your anti family and anti children then don't have them if you don't have the best interest of children in your heart (thats my reason). I would gladly let a few pregnant couples infront of me, the number is so small that it wouldn't have that big of a effect. Just my opinion

I sent a expedite request with our petition stating our situation (pregnant) and got no help. I think I'll be writing my congressman today because this really sux that I cant see my baby growing (first child). Sent several emails to CSC and they replied "sir we do not expedite for the reason you requested" absolutely absurd. Maybe something can be done after all.

K-1 Fiance(e) Visa Process & ProceduresNew Here.. Please Help?!?!??!??!?
Hi,

I am new here. As all of you I am too trying to bring my Fiance here on a k-1 visa. He is in Saudi Arabia. We met online 5 and a haf years ago and then met in Kenya (the country i was born in) on July 14, 2009 and got engaged on July 20, 2009.

I have the following paper work
I-29F (signed by both me and him)
Form g-325a (signed by both me and him)
Letter of intent (both from me and him and signed)
Letter of declaration (both by me and him signed)
Passport photo (him and me)
our boarding passes, visa stamps, tickets...

Now i had a question. do i need more stuff to send them, and also. we got engaged infront of my family in kenya but it wasnt a big ceremony and my sister took a video of our engagement. so we dont have actual pictures of him putting the ring on my finger, so from the video we took snapshots and sinc eit is from a digital camera it is very blurry the pixels arent taht great. i mean you can still sort of make it out but is that ok or do i also make a cd of the video and can i send pictures of us being together with family (like random pictures) and pictures of being together. is that ok?

also do i need to send them my birth certificate or his birth certificate and since i am naturalized through a certificate i am sending them a copy of my certificate and it had said front and back but there is nothing on the back. i am also going to send a copy of my passport to be on the safe side.

what else do i need to send? am i missing anything in this packet? i still need to work on my cover letter.

please help me if you can. because we are tired of being apart and want to get this done as soon as possible. :-( :-( its really hard without him. and this site has helped me a lot so i really need advice.

Thank you and sorry for laying all this out.

K-1 Fiance(e) Visa Process & ProceduresMy fiance's daughter
Hi all,

I am just starting the process to bring my fiance to the USA from Brazil via a K1 visa... I am using all the resources on this web page for information and guidance, but I have not been able to find details regarding what is necessary to include my fiance's 16-year old daughter in the approval process.

In addition to the steps outlined on this web page for the K1 application, is there any additional forms or information required to include my fiance's daughter in the visa request?

Any details you can share would be greatly appreciated.

I was told about 3-4 Months, she already had a B1/B2 Visa, maybe that helps too, looking at some of the timelines on here it must be absolutely killing people to wait...this is my first post so go easy on me blush.gif

More than likely you stand a good chance of running afoul for visa fraud in USCIS eyes. whistling.gif

I dont see how, she entered the USA on a valid B1/B2, we are not going to marry while she is here on that I-94, when the time comes for her interview she can return and follow the proceedure, theres nothing that says she has to stay in Mexico because the K-1 process is moving along, if the interview is beyond her 6 months then she returns regardless, its just nice thats shes here with me on the B1/B2, were not going to do anything to mess it up.

What you're doing now is fine. zqt3344's comment went with your January 20 post. See below.

Ahh okay I see that now, ohh well good to know you think all is okay, she explained everything to the CBP in secondary at ATL yesterday and he was very nice and didn't require to see any paperwork or proof.

Miriams B1/B2 is valid for another 9 years, why dont I just cancel my K-1 application which was received last Friday by USCIS in Vermont and go the other route, that way we won't be apart and can apply for an adjustment of status once married, seems like I dropped the ball by sending her back and I feel really terrible.

I agree with everyone else.
You two will make it....
I don't know if Vermont is still fast like it used to be, but if it is then you're wait won't be too long anyway.

Good luck - K1 is the way to go good.gif

Okay shes flying in on Thursday, I have typed a letter for her explaining shes visiting me with all of my contact info, since I dont have an NOA-1 yet I have told her to print out the I-129F and supporting docs plus a letter from her job stating shes off for that amount of time and a bank statement and a utility bill, not forgetting her B1/B2 Visa, I got to beleive thats all she needs, shes staying until Feb 26th, maybe they will give her a three month I-94 or better, no need to return till she gets her stuff from the Consulate right? Cheers

Shes here! and they gave her 6 months on her I-94, no need to go back anytime soon, hope she can stay until the medical and interview if it comes before the end of the 6 months.

Don't worry, Simon...I'm sure that going the regular K1 route was the right thing to do!

All the best to you and good luck! good.gif

Thanks for that, I will stick with the K-1 Visa, but once the Letter comes NOA come showing a number and case etc, I will scan a copy and send it to her then she will come and visit me for a while on her B2, based on my other question about visiting the USA while the K-1 process is ongoing, which everybody tells me is okay since you are being honest about your visiting intentions.

Why are you waiting for a letter? She can come anytime she wants as long as she doesn't overstay or otherwise misuse her visa.

She came over in September and stayed with me until December 28th, I sent her back because I was afraid of the adjustment of status process making her return and so I think if she comes back so soon it might raise a flag ever though she was coming and going all the time for her job, I would like her to have a copy of the letter to back up any questions that might be asked by CBP just in case as people on here have suggested.

What we always said was "here to visit" if they asked who, "my fiance". He was always let through with that. We always brought the K-1 paperwork and evidence of his employment back home. Also bring a lease or rental agreement, stuff stating you go to school, whatever shows that you have ties back home and aren't going to stay in the US.

Thanks to everybody for their advice, it has been very tough the last few days with a very strained situation with lenthy calls on the Vonage phone and lots of tears and things that should have been left unsaid, I am just waiting for the case letter so I can scan it and send it to her then I will book a ticket for her to fly in, I figured on a month, I doubt she will be needed in Mexico to fill out any paperwork or meet anybody at the Embassy so soon in the process.
