Agreed, 10 months is a good estimate. Try to find something to do with your time. One thing I have done is watch a movie each night. If you have amazon prime account, many of the movies are free, that covers a couple hours of the day. Call your friends and go out together. Sitting in front of the computer waiting for word from USCIS is painful. Go for a long walk, start planning your life together-I do not mean in the bedroom but in real life. Look up english courses, look into public transportation so he is not stuck at home while you work, look for others in the area from same country or a church that fits his religion, go there now to get a feel for the church, etc.

What address did you send your package to, if you mailed it to the wrong address, it would be returned with the check not cashed; wrong classification could mean you sent it to an area of USCIS that does not adjudacate fiancee visas. Based on all the information you have written, this sounds like the most likely result.

As others have said, unless there is something amiss in your record, the attorney is going to slow down the process. The forms are straight forward, you will either fill them out yourself or provide all the information to the attorney so his secretary can fill them out. I have seen to many horror stories with attorneys, most don't know their as* from a hole in the ground-they are just paper pushers for a dime. sure, there are some good ones and if you case is special, find one of them.

$5K, that's a boat payment or a house payment, not a fee to fill these papers. The entire job will be completed by a secretary at a keyboard, there is nothing for an attorney to do unless there are problems.

Add enough details that they know this is a long term relationship, no intimate details but dates, times and frequency are very important to include along with proof of the travel (receipts, etc).

It appears you have the bases covered. Go through again and make sure all forms are signed-this is a common problem. I would make sure you check is a personal check so that you get the receipt number on the back of the check. Certified checks, once cashed, will be kept by bank and you will not see the receipt number.

I would also send be FedEx to Texas Lockbox so you have tracking. I have seen to many folks that have not received their NOA1 after a month, I can not imagine the pain of not getting this first step complete asap.

Hello,

I sent the I-129F package to Dallas about a week ago, and just received our first NOA today. However, I may have made a mistake with my I-129F package.

As I have read many places, you should make two copies of the entire package before sending the petition. I did not do this. For evidence, I didn't send originals, I sent copies of the evidence- but for the official forms, I didn't make copies.

Does this matter? What should I do?

I would generate a new set with the same information; sign your copy and then when you send to your sweetheart for her/his interview, remind them to sign their copy also.

They are only concerned that you are over the guidelines, fluctuations are of no concern to them provided each year of over the guidelines. You can list the car but I doubt is would be worth the effort, they usually prefer liquid assets.

The primary documentation needed is proof of meeting. Typically, this includes receipts of airplane rides, hotel receipts, bus receipts, other type of receipts, pictures of you and your sweetheart together. Because I go to Russia, I always get photos next to a Russian sign or monument as that shows our location and the fact that I am in Russia. The chat logs only show that relationship is continuing, that is good but the primary evidence is the proof of meeting-put most of your effort in the "proof of meeting" in the past 2 years.

You do not need mountains of proof, but the proof they expect is pretty specific. You need to prove you have met (airplane tickets, pictures together, passport stamps, etc)-you have done that. You need to prove you have an ongoing relationship, a couple emails a month or chat logs or letters, etc.

It would be nice if someone agreed to purchase your home but delayed moving in until you are approved. Chances are, that is not going to happen. You post sounds like you have one foot in UK and one foot in America, this is not a good situation. You need to look for options, a place to live. Then get serious about selling or renting the house. Trying to balance the house, place to live, selling, etc will drive you nuts. I would make a decision to get ready for moving, find a temp. place to live if the house sells, put real effort into selling house and getting your affairs in order and ready to leave.

Nevertheless, once the visa is issued, you have 6 months before you must immigrate. After 6 months, the visa is cancelled and you must start over again.

People spend 5-9 months complaining about the wait, wanting an expedite, etc ... only to be approved and then post "NOW WHAT DO I DO?!" threads. Do your research while you wait, make sure the beneficiary knows what to expect, get your life in order because someone is uprooting theirs for you. In terms of your relationship, this visa process is very short and very minor.

I would plan on 10 months. If you are really lucky, maybe faster and if unlucky, maybe slower. Typically, NOA1 in one week, NOA2 in 6-7 months, NVC a couple weeks and interview-a couple months. The process is difficult but it is the price we all pay for being law abiding citizens and to be with our significant other.

it might help if I explain how you package is prepared by USCIS for adjudication. When the package is received, it is put into a file folder with a two prong clip at the top (hole punched). So the adjudicator will thumb through your file by turning pages that are bound at the top. For this reason, it is best to submit everything attached to 8.5X11 paper. If you did submit some thing in envelopes, not worries but to make it easy for the reviewer, it is best to have everything the same size and organized.

I have been through Atlanta a few times returning from Russia, but never as a Russian bride. Nevertheless, generally, the lines at passport control are long and move relatively slow. They are organized, not like DME airport lines in Moscow (a mass of people moving as a blob toward the windows). They did have a dog sniffer twice looking for food on two of my trips but he was cute, just a beagle and well behaved.

Binders are useless. An understanding of government filing is beneficial. The government uses top binding of file folders. This means your file will be two-hole punched on the top with a metal binder inserted. Therefore, any three-ring binders and such will be discarded as everything ends up in a similar file folder to the next guys packet.

Yes, an RFE indicates you case has been assigned to an adjudicator and they have reviewed you case. Answer the RFE and if all goes well, you will be approved in a couple weeks, well at least the NOA2 approval

It is always a good idea to attend the interview unless it will be so stressful that you look terrible as a couple together. Keep in mind, when you are together, it is important how you interact together. Do you work together, do you support (emotionally) each other, do you appear to be in a good relationship, etc. I do not see language as that important, she can learn English but if you can not communicate emotionally (eye contact, touch, etc), that that will be seen by others and IMHO, it could cause problems.

In direct response to your question, I would submit the I-129F application (after carefully reviewing the guides, instructions, etc). You will receive an RFE (request for evidence) and you can send the photos of the two of you together at that time. At least that would get you started on this long wait. Make sure you provide sufficient proof that the two of you have met (except the photos you do not have)

Two types of photos are required. One is passport photo of you and passport photo of other, alone in picture.

Second type of photos is to prove you have met, must be photo with you both in picture, best to have a number of them, maybe 4-6.

MIke, the info on Elena's Models is only in the section of the site about tours. I believe, in relation to tours, they are acting as a marriage broker. I believe as a dating site, they are not marriage brokers

Mike, I just got my lady here in Nov and we had a heck of a time at the Embassy in Warsaw. The consular kept asking over and over which broker we met thru. It was so bad that I was asked or rather told to leave and go into another room. He kept Tanya there for at least 20 min asking in different ways the same question over and over. Which broker and how many men she had met thru the broker. Well to make this shorter we did use a visa firm out of Ca to do our I-129 and they had marked that we used a broker. Which was an incorrect answer. We used russian bride.ru which is a FREE DATING SITE, not a broker.
We did get the visa and was told that marking yes to that question was wrong on our part in not knowing the difference between a broker and a dating site. So if you didn't pay anyone for a marriage only to read or answer letters you used a dating site. CLEAR I hope?

Warsaw/Belarus is not Kiev/Ukraine, nor is it Moscow/Russia, it is not even the same for Warsaw/Poland. All consulates are different and consulates that handle multiple countries have different standards for different countries. Warsaw handled Ukrainian visas until 2005 and the procedure and degree of difficulty is much less in Kiev than it was in Warsaw.

The OP should read the consulate reviews for the Kiev, Ukraine consulate for K-1 visas. As you know, the large majority of American men marrying FSU women have met through a "marriage agency" as they are often called (FSU folks being much more direct than Americans, what do you expect?) It is as common as white on rice, yet shows up almost never as a topic in an interview in Kiev.

I agree, at best, the issue of IMBRA is confusing. I met Olga on Elena's Models, here is what their site says about the imbra issue

"Notice: US Federal IMBRA Law prohibits the exchange of personal contact information until a time after which a female foreign correspondent has acknowledged seeing your Marital/Criminal background information. Your Marital/Criminal background information is on file at the specific office that supports the women's correspondence. You may request that a foreign correspondent (women) view and sign this information. Once this information has been acknowledged and placed on file the exchange of phone numbers, emails, addresses and rendezvous information is permitted but not mandatory and the foreign correspondent is not obliged to do so."

I found this under the section of the site that deals with tours so it is still confusing. I believe that agencies that act as tour guides and directly arrange introductions certainly fall under IMBRA. I am not so sure of the traditional dating agencies such as Elena's Models.

Nevertheless, I am going to answer yes to the question if I met my fiancee via a marriage broker and I will explain how we met in my discussion.
