Where can I get the tax transcript online and instantly? The reason why I haven't ordered one yet is because I'm currently located in Europe and I assume that it takes at least a month to order it and receive it via mail.

My I-130 petition has been approved. I'm now preparing the Affidavit of Support (I-864 form). I was wondering if it's necessary to order tax return transcripts vs. just having copies of the 1040s that I filed. I know they also want to see all W-2s when showing the 1040s, but the thing is I have income from mixed sources. For example, for my most recent tax return, about 30% of my income was reported on a W-2, but the rest is self-employment income. Will it be ok if I just show them the 1040 form (including Schedule C) and the W-2 that lists about 30% of that year's income? Or should I order a tax transcript for that year?

Correct, on Part 5 you would put a "1" for question number one and then a "1" for question number two and then add up for a total of "2" on question number eight.

And yes, as I mentioned in my other post, you need to file a tax return even if you're living abroad (as long as you met the minimum filing requirements).

I think you can type your name where it says "print sponsor's name) on your computer because your handwritten signature goes somewhere else.

In Part 3 questions 2a-f, no, you don't write your wife's info here again. You only list her in Part 2. 2a-f are only used for additional family members.

Then in Part 3 question 7 (enter the total number of immigrants you are sponsoring on this form from Items 1 through 6), you put 1.

Correct, in Part 3 question 1 you click "Yes" because you are sponsoring the principal immigrant (your wife) who is named in Part 2.

Regarding your phone number in Part 4, I'm not sure. I recently posted the same question on this forum. I was even wondering if it's a good idea to list a foreign residence in this part since the sponsor has to be domiciled in the U.S. If you still have a U.S. phone number, why not list it here? I was even considering getting a U.S. skype number because I don't have a U.S. phone number anymore. It doesn't even let you enter a foreign number format in this field. So maybe they want a U.S. phone number listed here?

Yes, just back file your taxes. And according to the instructions of the I-864, the assets have to be 3x the poverty line if you're sponsoring your spouse, see here http://www.uscis.gov.../i-864instr.pdf

 

Yes, as your current income, you would put 0. And nothing goes in 6c. I noticed the instruction lines sometimes don't match the lines in form I-864. I think the income in 6c would be the income of for example your wife if she had current income that continues in the U.S. And then on line 10 you add all incomes together (in your case put again 0).

And then for 13.a.1, 13.b.1 and 13.c.1 you would again put 0. Because you didn't have U.S. income according to your tax returns.

Yes, as CNTrav pointed out, even if you are not required to pay taxes in the U.S. (because you lived abroad and paid taxes there), you're still required to file a U.S. tax return. On this tax return, you can then exclude your foreign income. It's called FEIE, see here: http://www.irs.gov/I...ncome-Exclusion

 

Regarding your question, yes, the income has to be U.S. sourced income. So if your current income/job doesn't continue in the U.S., you won't be able to list it on the I-864 form and will either need a co-sponsor or qualify based on assets (have at least $60k in your bank account). I also read that it's best to have the money in a U.S. bank account, but I'm not 100% sure about that.

 

Regarding Part 6 Question 13-14: As a U.S. citizen you're required to file a U.S. tax return no matter where you live (if you're meeting the filing requirements, which is I think gross income of at least $10,000 for single filers and $20,000 for married filing jointly). So you can't leave these boxes unchecked. What I would do is back-file the last 3 years. You can explain that you weren't aware you had to file tax returns because you resided abroad. A lot of Americans don't know this and back file taxes later. And if you haven't made more than $91,500 in 2010, $92,900 in 2011, $95,100 in 2012 and $97,600 in 2013) you won't owe any taxes because you can take the foreign earned income exclusion.

I was thinking the same thing. It used to be an indicator of imminent approval, but now (except for a lucky few) it seems those of us getting that notice right after filing will still have a normal wait time, but will have no head's up a few days in advance. Oh well, checking it and seeing an approval with no advance warning will be just as exciting, maybe moreso. I'm not even 2 months in and I check every day anyway... lol

Me too, but then I checked forums and it sounds like you get an automatic e-mail message when you get NOA2 just like when we got NOA1, so there's really no need to check the website, right?

I am the wife, beneficiary, and canadian. My pd is june 11 and still waiting for noa2. I am planning to go abroad (to australia) and stay there for awhile.

My question are:

1. when noa2 come, can i do my nvc process while in australia?
2. what are documents needed for nvc?
3. can nvc process be done if both petitioner and beneficiary are abroad (australia)?

I will come back to canada for police check, medical, interview and poe.

About the bonafide of marriage, to tell you the truth, we did not send any just because I was saving that part for NVC stage when we will have to submit my husband's IV package. I have friends who went through the same and we didnt have any problem and our case was approved right away. But since you already have those ready, it should be ok if you send them anyway. I just think its not necessary at the USCIS stage though as long as you send your marriage certificate.

USC will leave Europe for US in may and is now filling out the I-130, but not yet sent it in. Wife wants the least time to be apart.

Can the wife enter the US on a tourist (90days) and apply the I-130 when in the country or must it be from outside?

After I-130 we file the I-485.

Hello everyone,

 

I'm not sure if this question has been asked before but here it goes. My wife and I got married Dec 2011 and we submitted our application Jan 2013. I delayed the application for over a year. Now it's been approved and now in the middle of it. I don't want to write an essay here about what happened between us but basically we are getting divorced. She resides in Honolulu, Hawaii and I live in Canada. It may sound weird for everyone but it's not your typical reason for divorcing or ending a marriage. My question is what would happen if we were to get married again later on and reapply for the whole thing? Would there be a problem? Is it even possible to reapply again or is this a one time thing?

When i received my NVC case number i noticed it starts with MTL which basically means MONTREAL. I live in Vancouver area and was wondering if my wife and I may have made a mistake in regards to having the interview done in Vancouver instead. She said there was no option to choose or anything. I've just completed my DS - 260 form online and submitted it. Is there no US embassy in Vancouver anymore? I was wondering if there is a number I can call request and change the interview location. Are all interviews done in Montreal, Canada now?

I don't mean to hijack this thread but I have a question in regards to mailing the documents to NVC. I've completed my DS-260 form online and now it says I have to submit the necessary documents. I can't find the document cover sheet for it. I only have the AOS document cover sheet available to me. The only bar coded sheet that I can see is the confirmation page of the IV which has my information and NVC case number on it. Do I print this and include this in my documents when i mail it to them? It doesn't say anything on it about being a document cover sheet like the AOS.

the noa2 is valid 4 months. so, if you got noa2 on May, then it's validity will expire in September. Check your noa2 notice, on the right side, where it says "Notice Type: Approval Notice; Valid from xx/xx/2013 to xx/xx/2013"

 

And yes, you need to have your interview before it expires.
