K-1 Fiance(e) Visa Process & ProceduresK1 Visa- Interview in Jamaica- petitioner's presence?

It can certainly never hurt to attend the interview. Additionally if the interviewing officer has any doubts at all about your relationship it can help lead to an approval.

I plan on attending the interview for that very reason.....

K-1 Fiance(e) Visa Process & ProceduresK-! Visa and Work?

My K-1 Visa was approved and I am moving to the USA May 23! I know I can apply for my SSN right away but do I need a work permit to work? I didn't realise I may not be able to work right away! Can someone let me know if I need to fill out the work permit form at the same time as my adjustment of status, or let me know if I can just start work right away because I have a SSN.

Thanks!

You didn't realize you couldn't work right away???? Um, do some research and please fill out your timeline....

K-1 Fiance(e) Visa Process & ProceduresConcerning the NOA2

Wouldn't you think this miracle worker would know the answers to those questions if the answers had an impact on the timing of these cases?
Who informed you of the 1 to 7 month timing?
From someone that went thru this process I can tell you there is no magic formula. My case for example took 408 days. Most don't take that long. There was nothing unusual about my case so no real reason for the delay. Hopefully yours will be faster than that.
What you are experiencing is normal including the frustration. Beware of those that tell you they have the inside track. This journey is about following the procedures dictated by the laws of the USA. You, like many others didn't know anything about those laws in the recent past nor did you care. Now they affect you and will do so through out this long journey. That is what we have learned as we gathered experience.
The normal processing times haven't been normal for a long time but its all they can refer to. They are working on about 2.5 million cases per year. They are ALWAYS behind. We see your questions a million times per year here on V J. Everyone thinks something has gone wrong just as they filed their case. V J provides timelines and a lot of other info that can be used to be as informed as possible. Learn to use it or disregard it as you wish.
I doubt you will find an immigration based version of the " road less traveled ".

K-1 Fiance(e) Visa Process & ProceduresNon impediment

Where does you Fiance live????

He was given false information because it is listed under their products and service for 5000 JMD. It is required from everyone, so they have to know what it is. It is the certificate of non-impediment, you get it at the Registrar General's Department. •No impediment certificate: An official certificate of the results of a search for marital status where the individual was not married. A letter is given if marriage is located.

Here is a link of what it looks like. http://www.rgd.gov.j...s/no impedi.jpg

Applying for a Police Record

In applying for a police certificate, the applicant must first pay the prescribed fee of one thousand dollars ($1000 JMD) for regular 21 day processing or two thousand dollars ($2000 JMD) for the 5 day express service. Payment may be made at any of the tax offices islandwide. In order to obtain a local police record for travelling you will need:

•Your valid passport

•Taxpayer Registration Number

•Two passport-sized Photographs

•Receipt of payment from any tax office islandwide.

After payment of the prescribed fee the applicant must visit one of the processing offices which can be found at the following locations;

•34 Duke Street, Kingston. Contact # 1876-922-0125/ 3221

•Pompano Bay, St Mary. Contact # 1876-975-5066

•May Pen, Clarendon. Contact # 1876-986-1491

•Or Summit, Montego Bay, St James. Contact # 1876-971-7241

Always on the ball, you're like the overlord of the JA portal, lol. We are all lucky to have you and thanks for always sharing what you know!

K-1 Fiance(e) Visa Process & ProceduresHas ranting died down on CSC K-1??

Hi! Newbie here but have been reading posts as a non-member. I'm a USC filer for K1 going on more than 5 months now at CSC. Can't take it anymore so I am joining forces here. Did you guys know of an official USCIS Facebook account? (Ooops... can't post a link since Im a newbie. Just look for the USCIS offical FB on your FB accounts). We can also "bombard" this site with our postings under their Topic on March 12 about the load transfer. I've seen some posts there but not a considerable amount. Maybe they would lend an ear (or at least be visible to them) if that topic is loaded with tons of postings by us. Just my thought or did I miss this post. Thanks

Please fill in your timeline, it is of great help to everyone here if you do.

K-1 Fiance(e) Visa Process & ProceduresOriginal Signatures
Aloha, me and my sweetie are just starting our K-1 journey and I already have a question.

For the initial K-1 package, do we need to submit original signatures for those documents requiring them? I.e. letter of intent, etc. or would a signed then scanned/emailed document be good enough?

I was originally planning to get the package w/original signatures together when I visit in a couple of months, but if scanned or faxed copies are ok I could start now.

Thanks in advance for any help.

K-1 Fiance(e) Visa Process & ProceduresQuestion 18 on I-129F
A quick question, did a quick search too but couldn't find anything about this.

How much detail do you need for question 18 on the I-129F, "Describe the circumstances under which you met." Is a couple of sentences okay, I'm thinking of something like the following...

"We met while she was working at XXXX on MMM/YYYY, we chatted, exchanged phone numbers, texted for a few days then met up for coffee. We then started dating and chatting via email and text."

As you can see I'm not a very wordy person, but if they need more I guess I could add more fluff.

K-1 Fiance(e) Visa Process & ProceduresAOS,SSD,Not Working
Hello, I am now waiting for noa2,(noa18-10-07). I am permanently disabled and receive SSD income,(15,125 a year) but 125% poverty level for Hawaii is 19,688. Found out can use SSD as income, and lawyer told me to get bank account up to 25,000,which I can do. Even then I will be borderline for pov. level, and will have my brother-in-law as co-sponsor.(same household, more than adequate income). I am not working and wondering if this will affect decision at interview. Also I have read many stories on whether USEM accepts co-sponsors or not, with K-1 visa. I live with my parents and do not pay rent, food, etc. will a letter from them help? Anyone know of an approval when petitioner is disabled and not working? Would appreciate any help. Thank-You!

I-134 is used for other NON-Immigrant visas like student, business, visitors, etc... In those cases the sponsor can specify how much, and how long they will provide sponsorship. Question 11 does not apply to K-Visas which are immigrant intent visas.

Yu and Dan Thank-You for your reply. So I guess I will put on ques. 11, N/A(K-1 visa process for permanent residence). This is found on Captain Ewok example bform section. Our interview is on 3-11-08 6:30 am USEM. Thank-You once again.

K-1 Fiance(e) Visa Process & ProceduresNOA1 (woot!) Plus a few questions

Just got NOA1 today! So excited things are moving along! My petition got sent to the California processing center
Anyway, just have a few questions.
1) Engagement ceremony pics. I included them in my packet, and now I'm worried that since they look pretty extravagant someone might possibly think we're married. From what I understand our ceremony was pretty typical of Cambodian culture. I attached the pic I sent, look and you can tell me what you think. Do I need to be worried about my petition or is it only the consulate I need to fear? What can I provide that might help our case that we've never been married (besides being basically legally impossible for me to have married her in Cambodia, the laws are way too strict these days)
2) Receptions. We are planning to have 2 receptions, one in Cambodia before we come the the US and get married, then one here after we get married. Is this dangerous also? We are planning in holding our Cambodian reception after the visa is in hand, so I don't think they will be anyone who really questions if we are married after the consulate interview, right?
3) Honeymoon. We've talked and we really want to go on a cruise. Are there going to be restrictions on cruises with her status?

Anyway, wish me luck and fast processing times!

Cool looking ceremony. You wrote on the pictures "Engagement ceremony," right??? I hope so. Hey, at least she's not in a white dress.
I don't think you need to do anything to prove you AREN'T married. You're not married, so just go in there assuming there's no reason anyone would think you are.
There's nothing dangerous about having a reception in Cambodia. The people at the embassy aren't going to be watching you from the bushes with bino's. The only way they know that sort of thing is if you step on your own toes and tell them.
As far as the Honeymoon, I'd avoid leaving the US with her for any reason until she has a green card in hand. Better safe than sorry.
Good luck! You and I got our NOA1 at about the same time.

K-1 Fiance(e) Visa Process & ProceduresSharing a language

Actually, this is quite common! Before I learned Mongolian, there were many Mongolians who I communicated with in Japanese. Then, even wilder, there were some Mongolians who could speak Chinese who I communicated with by writing Kanji.

Cool, I learned the 2000 common use Kanji too while in Japan. I never thought about using them to communicate with Chinese people. It would be very bare-bones way to communicate, like me writing someone "food 6 time together go"
Holman come downMaleJapan2013-01-10 14:23:00
K-1 Fiance(e) Visa Process & ProceduresSharing a language

I am in a similiar situation. Close to 6years knowing my fiance, I never really thought of communicating with him entirely in English so that he can learn...he only knows a few basic words...I guess that there is still time for him to learn and for me to learn his mother language (Berber/Arabic). We both communicate in French

That's really cool. When I was leaving my job in Japan last month, the girl who was replacing me was Californian and her husband is Japanese. They only communicate in French. I can't imagine both parties using a second language to communicate, pretty wild.

K-1 Fiance(e) Visa Process & ProceduresI-129F Question 18, enough detail?

No, we have seen each other in person several times in the last year and those meetings were mentioned in the answer to question #18 and well-documented with airline tickets, train tickets, hotel receipts, etc. So it sounds like we should be good then, I was just having a last-minute panic attack that despite carefully preparing everything I missed something :-).

I think you can relax, it sounds like you did a good job of documenting your recent meetings. For Question 18 I attached a one page document. It had about 6 paragraphs briefly explaining how we met and what we did on our first date, each other time I flew to see her and she to me, and details about when we lived together. I included the dates (as in: April 4th to April 12th 2011) of those visits.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa for first cousin marriage in Vietnam

Hi guys,

I need your advice on something. If Vietnam (country of my fiancee) doesn't permit first cousin marriage, then will that fact have any impact on me getting a finance(e) visa for my girl? I intend to marry her in the state of Florida, which does permit first cousin marriage. Thanks in advance for the help.

hmm, well she'll be getting the interview and visa from the US embassy there. So, her home country really doesn't have much to do with the process. Don't volunteer that information unless you are asked directly about it. I think as long as it's really legal to marry your cousin in Florida you will be fine. You're not getting married in Vietnam, so you're not breaking the law there.

K-1 Fiance(e) Visa Process & Proceduresplease help.. really need an advice :'(

I mean he has must be served in the army for 6 years and re-enlist for 4 more years to transfer his GI bill..
he joint the army from 2011, so he has been 2 years in the army now.. :(

Well it's no mystery how much money he makes; as an E-3 with over 2 years of service that's $22,800 per year. It's posted online here: http://www.navycs.co...-pay-chart.html
If he just signed up for 4 more years I'm sure he got a re-enlistment bonus too, which is $6,500 for 4 more years.
I just hope he hasn't done what most E-1 to E-3's do which is buy a huge truck/ sports-car they can't afford and take out a loan. Anyway, you won't be living in poverty if you move in together, you just need to follow a budget and be good about it.

K-1 Fiance(e) Visa Process & ProceduresPlan Goes Into Motion **TOMORROW** - NERVOUS. NEED HELP!

I think I've read too many horror stories on here and I've been really hesitant to file this while she has been here. I've been staying in Vancouver for 6 months, then coming to Chicago for 6 months, and we've been doing that back and forth because we can afford to as 23/21 year olds... and to say the least it has pissed off the border guards a bit. She has been interrogated before at the border, flagging her and we sat around for 2-3 hours while they asked her about every single trip she has taken in recent memory. I was worried that in the interview/approval process they would see that we were essentially doing the exact same thing while I file for the I-129F (she has been here for 4 months already) and that it would flag some sort of visa fraud.

Probably irrational fears, eh?

Yeah, I think you'll be fine. They worry about the long stays when she crosses the border because they don't want her going into the US and then not going back home to Canada. But it sounds like you guys have been following the law, not overstaying tourist visas. The people who check your K-1 Visa will just see your documentation that you guys visit each other all the time and it's likely a genuine, loving, relationship. So, for them I think it will be a positive thing.

K-1 Fiance(e) Visa Process & ProceduresPlan Goes Into Motion **TOMORROW** - NERVOUS. NEED HELP!

Shamelessly and desperately bumping!

What is there to be desperate about? The K-1 visa is a good option for what you want to do. I don't know what you are talking about "she files in Vancouver," You can send in the K-1 (I-129F) packet from Chicago while she is there with you. This way she can help you assemble it with all the pictures, letters, and various forms you need her input for. She doesn't need to be in Vancouver until it's time for her medical and interview. Don't get desperate, just read the K-1 flowchart and get educated ;)

K-1 Fiance(e) Visa Process & ProceduresWhere to Marry?
Remember a marriage ceremony is just kind of a show, the real deal goes down in government offices with paperwork. So if she wants a ceremony for her family to attend in Canada you can do that, but if you are using the fiance visa you just don't do the real marriage paperwork until you get the visa and are both in America. You don't even have to tell family/friends the Canadian wedding wasn't the official deal.

On had 2 other name changes (first name) which I did put in -- and it didnt leave any room for prior married name anyway. Her divorce papers went in... but maybe she could just say she never changed last names when she got married?

and that brings up something I thought was a bit funny, but a total pain when I was doing the 129... Thai people changing their names whenever they feel like it.. arrgh.. On had 2 name changes, and her son had 3. and yes -- I had 5 certificates of name changes with translations and attestations in the packet.

Then the other day she was saying her son wanted to change his name again.. I had to tell her please no, wait until the 129 is approved first. hah

Wow, I didn't know they were like that. I'm all against making the i-129f package anymore complicated. haha

Thanks everyone! I'll be sending in my I-129F package soon.

So, for question 7, should I answer None, or should I enter her prior spouse's last name?

K-1 Fiance(e) Visa Process & ProceduresChange of address question!
Definitely call ASAP and speak to someone. My husband (petitioner) called and spoke to someone at USCIS who did the change of address over the phone. A few days later, we received the confirmation letter in the mail at our new address in a new state and we even started getting notices about our case at the new address. This was back in October 2010. Regardless of us changing our address in the system and receiving mail from USCIS at our new address, I found out we had an interview appointment that we knew nothing about, scheduled in our old city and our case was transferred there. Just on a whim, I called and left a message for the director of the local USCIS in our old city one day just to check on our case because it had been months since our status online was updated. She called back and that's when, to my surprise, I was notified that we had an interview in the next 3 days. In another state. UNBELIEVABLE!!! She said that as far as she could see in her computer the address showing was our old one. Thought the systems were linked. I told her "but we're getting mail at our new address from USCIS. She was a bit puzzled, nevertheless, she changed the address in her computer and canceled the appointment. So she said, she forwarded our case to our current state's USCIS office. NO WORD. It has been over a month. If I didn't call my case would have been considered abandoned. No fault of ours. They don't care. Call and be sure to follow up.

I had my interview in London yesterday and we were approved smile.png not an altogether smooth day - forgot about the phone charger in my bag so was subsequently thrown out at security and had to queue again having dumped the charger in a bush. The ticket with my number on it stated that I arrived in the hall at 9.21am and I finally left at 1.05pm. So much for their "you can expect to be at the embassy for 2-3 hours"!! But I'm not complaining because I'm moving to the states in 10 days!!! Wooohoooo

Sorry to hear it took so long for you at the embassy. I was out in 1h 10 mins. And I also got the visa...it's such a wonderful feeling to have it in my hands! :D

I will be leaving around middle July, haven't booked the tickets yet.

My fellow September filers smile.png I'm here to tell you everything went great today dancin5hr.gif If it wasn't for the long waiting, it would be a very nice experience wink.png

I have no idea why I brought all these proofs of the ongoing relationship or letters of intent to marry! I was never asked to show any of these. All they asked of me were: passport, birth certificate, police clearance, I-134 Affidavit of support, forms DS 156 (x2) and DS 156K, 2 photos.

Then, when my time came after a long long wait, the consul (who was a young, pretty, nice and smiling woman) asked me regular questions that were very predictable (about how we met, when we got engaged, his visits to my country, my visits to the US; Did he meet my family? Did you meet his family? What does he do? What would you like to do in the US?, etc. etc.). She asked me many questions, but they were standard questions I would imagine. Nothing scary. In the end she told me everything's correct and fine. She congratulated me and wished good luck smile.png

I entered the Embassy at 7:55 am, went through security check and at 8:10 I was sitting in Immigrant Visas room holding my ticket (number). I left at 10:40.

Congratulations!!!! :joy:
