BUT be prepared for it to take MUCH longer and be MUCH harder. Remember you were warned. Thanks. I heed to the warning and your words of wisdom. I am open to all possibilities, let's see what will happen. The truth is abuse. VAWA or Divorce, nothing was supposed to happen but sadly abuse has. I will be open to the divorce very much, will see what comes first. Please do recommend of people who tried to do the VAWA but found it very difficult and failed. You must know someone as you know it would be much longer and much harder. Especially someone who dealt with mental illness and abuse both at the same time. My spouse did not disclose his condition to me ever, and in one year he got hit, and all the abuse followed, and no matter what I have done on the past many months to keep this relationship going, i got kicked out this month. I thought my 90 day window opened on 08.22.12. Got my packet ready and sent it out on 08.20.12, thinking that USCIS (@California) would get it after 08.22.12 (from Honolulu) and to my 'over zealous' self, my packet came back on 08.27.12 with a cover letter that read that I had submitted it too early... USCIS, CA received it on 08.23.12. I researched online, and found I was off by a few days. My 90 day window opened on 08.24.12. Get an immediate appointment with infopass - also send an email (if there is an email out there somewhere) to USCIS regarding this. 2. Tell the HR (nicely) that I have set an appointment with the DHS regarding this matter, and as the letter is a DEPARTMENT OF HOMELAND SECURITY/FEDERAL/FBI issued document and as the HR can't accept it, to please give me the reason in written so that I can take that letter and talk to the DHS about issuing me something that HR would accept. 3. I would believe the HR would not give anything in written 4. IF they do, take that letter to infopass and ask to help for this harassment and violation of FEDERAL document. Hope this helps. God speed. Does anyone have any advice or experience with the the following situation. My wife just accepted a new job working in the lab at a hospital here. The HR dept needs her to fill out the I-9: Employment Eligibility Verification form. She gave them her green card with the the I-797 that shows it has been extended 1 year. However, the HR dept is saying that irregardless of the I-797, her green card is still expired, so they are not considering it as falling under List A of acceptable documents for the I-9. They are telling her that it falls under List C and so she needs something from List B, which primarily is a Drivers License. However, she only has a learners permit at this time. Appreciate it my wife received a letter from the DMV regarding extending her drivers license. It instructed us to return a photocopy of her residence extension letter, so we sent in a copy of her NOA1. ..it seems to be going just as 'smoothly' (slowly!) as the first time she applied for her license. Back then her paperwork was stuck in the state capitol while they tried to verify her immigration status. Once we realized this and called the state DMV immigration department, they then had us fax them the same proof we had already submitted when applying (green card). ... ...we just now did the same thing again and faxed them her NOA1 letter, and are now waiting for her temporary drivers license extension. They advised that they cannot send her another one until her first one expires, so in the meantime they will send her a temporary license. Removing Conditions on Residency General Discussion	I-751 Aug 2012 filers	This question is re: our government issued IDs = State Ids and the kind. Mine expires as the day my GC expires 11.22.12. So,does this mean a number of problems from 11.23.12 till whichever day I will get my new GC - which I think would be Jan 2013?!? I am thinking if I should get my IDs renewed using the NOA after 11.23.12 - what are your ideas? Any other people who are thinking like I am, or I am just 'over-thinking' it....sigh... Removing Conditions on Residency General Discussion	I-751 Aug 2012 filers	My packet was sent back..... Why, because I am a fool.... My GC was due expiry 11.22.12. I thought my 90 day window opened on 08.22.12. Got my packet ready and sent it out on 08.20.12, thinking that USCIS (@California) would get it after 08.22.12 (from Honolulu)- and all will be good... and to my 'over zealous' self, my packet came back on 08.27.12 with a cover letter that read that I had submitted it too early... USCIS, CA received it on 08.23.12. I researched online, and found I was off by a few days. My 90 day window opened on 08.24.12. I was so greatly mad at myself... so greatly mad... will send today, 082812, which is the 86th day. But, they did open my packet, reorganized it, put it in a nice binding clip, and stapled my check on the form - left bottom. Now, I am thinking, is this correct to do? Write "Resubmitting on 08.28.12" then my A# and sign on a blank white page and put it on top, and mail it back... I am in Honolulu. I still can go to post office. Removing Conditions on Residency General Discussion	i751 approved in 3 months by CSC	i took vacation for november but havent bought our tickets yet. now i can buy them as soon as we get her card. we went to the philippines 5 months ago and she got hassled in guam when she showed the immigation officials her 2 year green card. wasnt too bad but i wonder if they'll treat her the same with a 10 year green card. anyhow, my wife is eagerly awaiting her results from her california board of nursing exam results. i hope she gets good news soon. Removing Conditions on Residency General Discussion	interview	It definitely sounds like you are going to have an interview. That is what happened to me. Except we did get a RFE 8 months after applying ROC. We had to file a service request and that is when we got the dreaded letter of adjucation to a local field office. About 2 weeks later we got the interview letter. Usually the interview is about 2 weeks after receiving the letter. Our appointment was 2/13/13. We are still waiting to hear from the outcome. The IO said that we will hear a decision 30-60 days later. Which 30 days exactly was March 15th. I don't know how or why they decided for us to have an interview. Even the IO said that all our paperwork was in order and we had strong evidence of a bona fide marriage. The only thing we didn't have that the officer asked for was wedding pictures. I told her that I had more files in the car if she wanted me to go get them and she said no. Who would have thought they would want wedding pictures? We had been married for 3 years all ready and all we brought inside was evidence collected since my husband arrived to the US!!! I'm not sure what to expect next. I am hoping for the greencard. If not we will do what we need to at the next step. Technically he qualifies to apply for his citizenship but we are worried about going on with the N400 while the greencard is still being decided. Plus if we need to get an immigration lawyer, we would need the money for that. Let me know if I can answer any questions for you! Good luck!!!
