No. You need the information from the last 3 years but are only required to send in the most recent tax transcript with the I-864. If you were not required to file in any or all of the last 3 years, then you provide a statement as to why you were not legally required to file.


Just include a statement with your I-134 about why you were not legally required to file. No need to get anything from the IRS about not filing. The co-sponsor fills out their own I-134 and provides their most recent tax transcript(or a complete copy of their return with all forms, schedules, W-2s and/or 1099s), letter from their employer stating position and salary, most recent pay stub(s) and proof of being a USC or LPR.

Just a statement? It seems a little too easy :)

I think he meant tax returns for your father(the cosponsor) and you as the main sponsor. My fiance didn't work as well last year, so he called the IRS and they told him to fill out a form, don't remember exactly what form, mail it to them and then he can request from them a certificate of non filling(for the last 3 years cause he was outside of USA and didn't work as well). I will take that certificate to the interview along with a letter from him signed explaining why he didn't file for the last 3 years. This is what we're gonna do, but you should call IRS regarding your tax returns.

Not in the case of CR1/IR1, in this case the coversheet checklist is a RFE. it is sent by NVC when something is missing. In the OP case they have paid the on line fee bill but as yet the NVC has not received the paperwork from them so they generate a coversheet checklist that is emailed to the agent.

aside from that we have txt each other since its expensive for phone calls....

We used snail mail a lot. It's the best proof because of the post mark on the envelopes. You can't fake that.


i agree with nagishkaw...even if you petition an alien relative say your parents that doesnt know how to use computers this is a best evidence...

it wouldnt hurt to have at least 3 or 4 snail mail in addition to your proof of continous relationship but if your fiance insist not to do so hopefully your skype proof wouldnt be a problem

I am in the same situation. I wasn't sure how to handle it either. My stepfather is co-sponsoring my fiance. When I filled out my I-134, I put "Temporarily laid off due to lack of work." I didn't know what else to put. I put this on the line where they ask for your employer. I sent my tax returns, the letter that shows how much I get from unemployment, and a letter fron the Social Security administration showing how much I receive monthly. (I recieve benefits for my 16 year old son from my previous husband's death.) I was unable to get a letter from my employer where I'm laid off. I tried, but they wouldn't give me one since I am on lay off status. :( My stepfather's income exceeds the poverty limits. I'm just praying that it will work. My fiance's interview is December 4th at the U.S. embassy in Bucharest, Romania. I'm praying he will be approved. I'll certainly let you know how it goes. I've done all I can do, and I'm just trying not to worry. If it is God's will, he'll be approved. Good luck to you! I hope it works out for you too! :)

Just throwing this out there even though I'm pretty sure what the deal is... I was laid off work a couple of weeks ago and my NOA2 is happening any day...I already have a co-sponsor and I expect to be gainfully employed again within the next couple of months. How do I fill out my I-134? I have all the tax returns to prove my earning potential and my co-sponsor earns well above the poverty limit so does anyone have any advice for how to approach this? I will be collecting unemployment benefits but only for a short time.... Any advice is appreciated, thanks!

So I just read about someone who got their NOA2 from CSC in a month and a half! While I'm very happy for them, I can't help but wonder how I can be sitting here, five months from receiving NOA1 and still be waiting? It seems that plenty of people who filed way later than me are getting their NOA2's so I guess I'm wondering if anyone knows why this is? Who at UCSIS randomly decides who gets expedited? I know military members get expedited but they can't all be military....

Just feels really unfair....No RFE either, just....nothing :angry:

I'm trying to understand this sentence. Are you saying that your fiancee herself did NOT file the I-134? That you only had one I-134 and that was the mother's? If so, I believe that is your problem: your fiancee HAS to file the I-134 regardless of her income and regardless of whether there is a co-sponsor. Then in addition to your fiancee's paperwork, her mother must also file the I-134 as a co-sponsor, with all HER supporting documentation.

I'm preparing for this stage myself, so someone please correct me if I'm wrong on the above. But I'm almost positive that the fiancee (petitioner) must file an I-134 regardless of cosponsorship.


That is exactly how I read it as well. Seems pretty clear that Petitioner decided not to submit the I-134 at all. Huge mistake!

Want this fast and easy? File a NEW correct petition, pay the fee and get on with it. There is no conflicting petition since there IS NO petition in your name. Just send a new one and eat the cost...call it education expense. The fees in this process are the least of your costs, so it is no big deal. Seriously, you are doing all this to save $340.00????? That is the only benefit you could possibly receive at this point. $340 makes all this go away tomorrow.

Duplicate everything (except the incorrect petition) and send it out.

As for explaining it, good luck with that. Lithuanians, though they are FSU they really are not, if you get my drift. A Ukrainian or Russian woman would seriously question her decision about marrying you. They like men that just kinda "handle it" and do not bother them beyond signing something where needed. Such kinds of actions by the head of the family cause serious soul searching. It is what it is, so break the news to her as you think best.

You are only going to lose more time if you continue to mess with USCIS on the phone. Just ignore any mailings you get for John and Jane Doe and go with the correct names. The incorrect petition will die a natural death when no one acts on it.

Also given the gross negligence of your error (that IS what this is) I have to advise you to carefully read the instructions and make SURE all the other documentation needed is attached to the petition...G325a, letters of intent from both of you, passport photos, proof of meeting in person, proof of eligibility to marry (if applicable), proof of your citizenship

My view is that the current status quo merely represents an especially bad time for a system that is woefully inadequate at its best. I commend those who are willing to wait patiently out of a desire to not cause a fuss for others, but I think the reality is that K-1 filers need to be much more vocal about their displeasure with a service that almost everyone agrees is absurd and unaccountable, even if their current petition is not especially delayed by the USCIS's own arbitrary standards.

The US government is huge and complex. I'm not cynical enough to think that our elected officials or agencies deliberately do a poor job at oversight, but, given limited resources and knowledge within layers of bureaucracy, it makes sense that services will inevitably fall short of citizens' expectations if citizens just sit quietly on their disappointment and do not let their reps know when things aren't working right. The USCIS is supposed to be run for the benefit of citizens, not to make citizens' lives more difficult. The reality of administering such an agency through relatively low fees (guaranteeing access) and concerns about fraud and national security that will affect non-petitioners is always going to delay processing to an extent, but that does not mean petitioners should just throw up their hands and accept that 6-7 months, or even 5 months, is a reasonable waiting period. We need to make it clear to elected officials that we want them to pay more attention to and improve this particular service.

Why do people think the DACA filings are getting priority at CSC, anyway? It's certainly not because those petitioners were content to accept their current lot and vote for politicians who were complacent about it; it's because those beneficiaries and their friends made a huge stink about the status quo and made it clear to elected representatives that their votes depended on changes. K-1 petitioners will perhaps always lack the unity and lobbying power of hispanic groups, but that does not mean we cannot make any difference.

To answer the OP more directly, I'm right at the 5 month mark and by no means currently delayed to a point where I meet the USCIS's own arbitrary standards for expedition or review. But I can see the writing on the wall and I'm not just going to sit back and wait a few more months to start a series of inquiries that itself may take several weeks and months. So I wrote one of my senators a very thorough letter that dealt both with the USCIS's systemic problems (opaqueness, lack of accountability, manipulation of the processing time frame, operation under seemingly purely political--not statutory--priorities, etc.) and with the hardship that being delayed several more months would cause me and my spouse. I received a very thoughtful and concerned response from a staffer less than 48 hours later and have since had my complaint forwarded to the USCIS legislative liaison, who I am waiting to hear back from.

I know that I may not get my file looked at any sooner than I would have if I had not written anything. But I may. And, more importantly, I know that there is someone in a serious position at the USCIS who is receiving complaints from a senator's office. If the senator's office receives and passes on enough complaints, I'm sure the senator himself will get wind of it. And all it will take is one or two congressmen or senators who seriously look into the issue to get something changed, if not now, then when immigration reform is drafted over the summer. It might not happen because of my letter or yours. It might not happen at all. But I can guarantee you it will never happen if we don't raise a fuss, and that'd be a shame for both current and future K-1 petitioners.


Very well stated! I did the same thing when I was at 4.5 months of waiting, a month later, I received my approval. I have no way of knowing if it was because my Congresswoman's office made an official inquiry but I wanted my voice heard in some way. The system is so utterly broken that reform needs to be demanded, one way or another!

So I have emailed NVC about few days away from two weeks asking about the case number on our k-1 process but not have heard back from them. Today I was reading over a few old posts that came up from the search box and figured that this is normal not to hear from them right away being they get hundreds of emails. I was just curious if anyone recently has any update on how fast they reply to emails being the post's Ive read were from quite a while ago. If anyone has read my previous post its pretty hard for me to call NVC from brasil since long distance calling can be ridiculously expensive. I was also wondering if emailing NVC is the only way I can find out the information on the case number?

Other than that for Brasil filers, how long does it take for the embassy to send the information about the embassy receiving the case? If I'm not mistaken they send the appointment letter with that or does my fiance book his appointment for one of the dates available?

Any ideas and thoughts will be greatly appreciated =)

I was looking at Igor's list to see the NOA1 v NOA2 dates. Hey - there's no point checking my own dates as nothing is happening anytime soon chez CSC.

What I was pondering is the variability in dates of NOA2 v NOA1. I can sorta understand that someone coming from a fraud country might have to wait longer. What I find odd is that two people from the same country might have completely different NOA1>NOA2 periods. Shirley they are stacked on the overflowing shelves of CSC in incoming data sequence and they get pulled off the shelf in order.

It can certainly never hurt to attend the interview. Additionally if the interviewing officer has any doubts at all about your relationship it can help lead to an approval.


I plan on attending the interview for that very reason.....
