We recently completed the K1 process and wanted to share some things that we've experienced in our journey. 
 
Early adjustments for k1 Beneficiaries coming to the states. 
 
1. WEATHER,   IT'S COLD.  
 
It's very hard to prepare someone for the type of cold that we are experiencing here in the midwest, but, one thing I can tell all cold weather sponsors, "be prepared to buy winter clothes"  smile.png   Get your wife/fiance' a nice coat, some gloves, a winter hat and some boots. Do this as soon as she gets here, do not delay.  This may sound like common sense, but, set aside money in your budget for these Essential items. 
 
2.  FOOD
 
Try to find a local Asian market if possible, we have lumpia wrappers, Jufran, adobo, canton, bihon, Nagaraya cracker nuts, lechon sauce, stikko, tocino, langonisa and other home style treats. These comfort foods will make your spouse feel somewhat more comfortable in the strange new world they find themselves in. 
 
3. FEELINGS OF ISOLATION
 
For the first few months, our spouses have no drivers license, they can't work, they have little or no social network and will be stuck at home a lot while we are at work. MAKE SURE that you get out every day and do SOMETHING, even if it's to get groceries, take a walk, ride a bike, join a gym, go to church, anything. Our spouses are used to having multiple avenues of transit with jeepneys, tricycles, MRT, cab, etc...  Imagine the feelings of isolation that one must experience going to a new country and being stuck at home at the mercy of their spouse to take them EVERYWHERE.  YOU MUST BE COMPASSIONATE about this.  Provide access to SKYPE, YM, VIBER, Facebook, ANYTHING to stay in touch with family back home.  
 
4.  INDEPENDENCE
 
When my wife arrived, I had her iPhone  and credit card in her married name waiting for her. As soon as she arrived she had the ability to communicate back home and money to spend. Speaking of money, Grab some currency, including US coins, and practice at the kitchen table with how much each coin is worth. Be prepared to explain why the dime is worth more, even though it is smaller than a nickel.  smile.png    
 
5.  SLANG
 
Be prepared to explain all slang and be a translator for the every usage of the English language as it applies in the states. I asked my wife for a buck and a quarter at a flea market, she asked why i needed a bucket of water....   That's when it occurred to me that i had not done my job as her husband and changed my game plan a bit. We are so comfortable that I sometimes forget that she does not know many slang terms and I fall into a comfort zone, forgetting that slang is an improper use of the English language. 
 
6.   JEALOUSY
 
Look, if you are married to a filipina, she is going to be jealous..  deal with it.    re-assure her, love her, again and again. Makulit sobra. 
 
 
7.   COMMUNICATION
 
It really goes without saying how important this is. If you don't communicate, you won't make it, period.  As much as you may know your loved one online, it is a completely different world in the reality of living together. In the online relationship world, you still have space, you can end a conversation and have your personal space and privacy. In the real world, there is no space. You are in each other's space, especially in the beginning. You will be the center of a universe for your spouse, the only known variable in their world. Imagine leaving your family, your life, your friends, everything you've ever known, moving to a new country and marrying someone that you've maybe spent a month or two with in person.   I can't stress enough that you must be understanding and allow for an adjustment. To do otherwise is just not fair.   Seriously, prepare yourself mentally and emotionally.  BE PATIENT
 
8.  FIND A COMMON HOBBY
 
Find something that you love to do together, at least ONE THING.  It can be anything, as long as you both love to do it. This will give you a foundation of doing things together and will instill some instant order in your rapidly changing life. We bought bicycles, joined a gym and found a church we both like.  Those are the little things that gave us instant stability, something we could both agree upon and pursue together. It's really great for times when I just don't have anything intelligent to talk about, ( it happens)  Sometimes we can just go work out and look at each other with nodding approval. 
 
9.  CREATE MEMORIES.
 
Take a lot of pictures!   Especially during the "honeymoon" period of your relationship. Build as much good will as possible early on. YOU WILL NEED THIS LATER ON!  Some days are better than others, that's just marriage. It is really nice to look at our Facebook or wedding album and look at our happy pictures. We borrow from the "good will" bank of happiness to see us through our trials.  We often post happy videos and pics on Facebook for our friends and family to see. It is great to have the moral support of our social network, encouraging our marriage and love. 
 
10.  LAUGH
 
Look, there is enough pressure involved in this transition. Just remember to give each other a break, don't put too much pressure on every single decision. Just take one day at a time, remember what's important. Love each other.  REMEMBER WHY YOU WANTED TO BE MARRIED IN THE FIRST PLACE. It may not always be easy, but it's always worth it.

My wife has her 10-year Green Card. Can she travel to Dubai without having to apply for a visa? This would be for a short visit only (perhaps 1 week) as a tourist.

With a US green Card, I'm pretty sure you can go anywhere in the world, It's just a matter of country's requirements. Whether a Visa is required or not. If visa is required, I'm pretty sure US green card holders will not have a problem obtaining one.

Is this K1 in the Philippines? Manila US Embassy rarely accepts co-sponsor for K1.

Hi,

 

My wife and I were recently married in June (K-1 visa).  We are having a problem with the Department of Foreign Affairs in the Philippines regarding getting a passport for my wife's minor son.

 

We went to the Consulate of the Philippines in New York to change the name on her passport to her married name, report the marriage in the Philippines and get a "red ribbon letter" from my wife that gives special power of attorney to her mother with affidavit of support and consent to travel.  The letter and affidavit are in my wife's married name and the consular officer approved it.

 

Now the DFA is giving her mother a problem, saying that since there is no record of the marriage and change of my wife's name yet at NSO the "red ribbon letter" in her married name is unacceptable.  The woman said the red ribbon letter should have been in my wife's maiden name.  So why did the consular officer sign off on a letter and affidavit that would not be accepted at DFA in Manila? We also provided her mother with an original marriage certificate to show the name change (married in USA).  Does anyone know if this is really correct?  I ask because, having been to the Philippines, chaos is the rule and if you asked 3 different Filipinos the same question you would get 3 different answers.

 

Also, my wife's AOS case is in initial review but she has received her combo card with advance parole.  She is thinking of just going to the Philippines to get his passport and bring him back after the K-2 interview. Two questions: (1) She arrived in U.S.A. on April 2, 2013 so the I-129F petition is good until April 2, 2014? (2) She was out of status for 40 something days, is there any danger in her traveling to the Philippines with advance parole to get her son.

 

Really confused and frustrated about what to do now.  Thank you for your help.

Well, if they say they won't accept it even with copies of report of marriage from the Philippine Consulate & a copy of her Philippine passport with her married name, then the cheapest recourse you can do is to make another SPA & consent to travel with your maiden name and have it consularized again and mail it to Philippines one more time.

Its been quite sometime since I posted in this forum. Its been hectic. SN: (currently processing my mother's paperwork)

 

I have few questions though regarding how family laws covers in the Philippines about my situation.

 

When I filed for divorce, I was being processed to become USC, when the divorce got finalized. I have been with the greatest man I have ever met who is also the father of our unborn child. 

We are planning to get married sometime this year here and also in the Philippines for buying few properties wise.

 

I was told that if the USC spouse filled for divorce, which in our case we were both USC when the divorce got finalized... few of our good friends here said, that i just need to bring the divorce decree  to void my marriage in the Philippines from my ex...

HOW TRUE is this?

By the way, your friends are wrong, you can't just bring the US divorce decree to the Philippines and have your marriage dissolved in the Philippines as Philippines is a sovereign country and they don't have to accept any foreign judgement.

 

It will have to be petitioned to be recognized in the Philippines for a judge to issue a final order of recognition.

HI everyone,

 

This is a topic that my husband personally experienced.

 

#1. I'm afraid Hank is wrong about the Philippines not to be able to recognize the divorce decree in US coz the previous Filipino filed for it. As long as you are already a USC by the time the divorce was finalized, you are OK for petition for recognition of foreign judgement, in this case, the divorce decree.

 

#2. There's a reason why they want to have her marriage in the Philippines taken out of NSO records and it's because of properties. Although, Marriage in US can be reported via Philippine Consulate in US via report of Marriage, this does not dissolve the previous marriage in the Philippines.

 

Now, although her previous spouse has nothing to do with the property that her and the new spouse will buy in the Philippines (but could be argued in court), as she's legally divorced in US, the next of Kin based on NSO records will be the previous spouse. So, if she dies, the previous husband gets to claim the inheritance.

 

When trying to invest in the Philippines, it is very important that you have your divorce decree recognized in the Philippines.

 

Now, there's one info in this case that i didn't get to know for sure, Is your future husband a natural born USC? if so, he can't own a lot in the Philippines, a condo maybe but with limitations. A foreigner can own a lot in the Philippines only if it was inherited from someone (the only exception).

 

Good luck to you guys but i still would recommend you having your divorce decree recognized. I do know lawyers who can do it for you and I do have the requirements for it too if you want. But you need a lawyer to file the petition for you.

Hello,
 
My fiance has her K1/k2 visa interview March 11th. I hear so many other couples say as examples of proof that they do intend to marry once the fiance is in the petitioners country they provide a reciept of a planned reception, church wedding, guest invitation list..... Due to my being married a few times in the past we plan to be married at the local courthouse by the probate judge. So my question to those on this forum is do you have any ideas on what she could say or present  at the interview to support the fact that we do intend to marry?

We both submitted letter of intent to marry & with the letter, you can create and summarize the timeline on how and when you guys met. We had a lawyer made our letter of intent though but it doesn't have to. As to our letter, I had mine notarized in the Philippines and my fiancé (before) had it notarized in his state. (Having it notarized may not be needed but we just want our papers to be legit)

Not a single reciept or proof of our reception was submitted.

Annie had her CFO session in Manila yesterday.  She passed!!  They asked two questions about me.

1. What is your fiance's mothers maiden name?

2. Why does your American fiance want to marry a Filipina?

 

Of course they also asked how we met and how many countries have we been to together.  She is at the embassy interview right now.  Hoping she can fly to the US on Feb 16.

PhilippinesQueries regarding form 1040/ITR for K1 visa

Hi everyone.
My interview with the Manila US embassy was scheduled on the 24th of January.. Next week it is (I'm getting nervousas the day goes by). The application process for the K1 visa started May 2013 and my fiance' sent me the needed documents like his ITR/form1040, W2 form and other pertinent papers. However his ITR was for the year 2012 because he hasn't filed his form1040 for 2013 yet. Should I still wait for his 2013 ITR or will the one he sent me will suffice?

As long as you're fiancé's 2012 taxes meets the poverty guideline, you're good. You don't need 2013 taxes if you're interview happens before the April 15, 2014 deadline.

My fiancee just got her CENOMAR from the local NSO office.  I noticed that on the part of the letter that says purpose of CENOMAR it says Visa (New Jersey)... New Jersey is misspelled : New Jersy.   Will this be as an issue with the Manila US Embassy?  Everything else checks out.  Thanks in advance for your input.

Yeah, AP is the only logical reason for such a delay. But a CEAC "Issued" status after 7 months, without USEM contacting her? Or her contacting them. Hhhhmmmm ... Some people can still be this patient, I guess.

The only problem with telling OP that medical is valid for a year by which the pertinent information we have before hand is the ff:

 

-We know that OP is still on K1 process.

1 year doesn't apply to this, if this was AOS, I would go with what your pick.

 

It's just that, most members here tend to look up to our more seasoned members as infallible :). I am too:)

 

and it's also quoted here that you corrected all of us here that says 6 months to 1 year. What if OP, followed the one year and waited more than 6 months before her interview and only to know that her visa can't be issued coz her medical is more than 6 month old? (which is technically expired as far as K1 Visa process is concern)

 

I also want to clear this out that Visa validity is dependent to on medical expiration and not medical dependent to Visa validity, which goes to say that you can have medical issued without a visa but can't be issued a visa without medical. So, medical would be the basis here, i would say.

 

I would also note that paperworks validity varies and is dependent on which process you are in.

 

an example would be Birth Certificate or Marriage certificate from the Philippines which on the initial I-130/I-129F, plain copy of documents are acceptable but on the time of the interview, they are told to bring a NSO original documents.

You are confusing visa validity with the medical.  The visa is valid for 6 months from the date of the medical.  The medical is good for 1 year actually, which is good to know come AOS time.

We are aware that our medical can be used for AOS if it's still within the year limit but the OP was obviously asking on the validity of his/her medical before his/her interview in Manila.

Just curious Hank, if medical is really valid for one year, does it mean that if your interview is 7 months later, then you don't have to redo your medical?

What would be the visa expiration? I assume that the reason behind the visa expiration was based on the 6-month expiration of medical in the Philippines. I believe they are related

Yes, I paid $40 already. That was for 2 copies at $20 each. They have already emailed us giving us Western Union Instructions for the $89. I'll try to pick it up and send by FedEx. 

 

On a side note, we asked them by phone if they can send by FedEx and they said no because FedEx is not in US :-) I didn't even bother to respond to that.

Hehehe.. the explanation I had with regards to the FEDEX thing was, there was/were bogus payments made to FEDEX during the course of their partnership with them which led to Fedex cutting ties with NSO online.

 

The person telling you that there's no FEDEX in US is obviously mis informed :)

Anyone ever try to get their certified BC from US through Cencus (NSO)? I paid the fee online and that is for sending within Philippines. After calling them, we are told for "special courier" to US, I have to send them $89 via Western Union.

 

I have some feeling I will never see the BC or $89 again...

This is true though but we declined it.

 

Requesting BC through the NSO website and have it delivered (regular delivery 6-8 weeks) to a US address is $20 each but having it expedited, you'll need to pay additional $89 via western union to a forwarding company called Sead Parcel Services, no matter how many documents you ordered.

 

If you paid it already, you should have a batch request number or batch reference number.

 

Shoot them an email and ask for your update.

What we did was to have it re routed to local delivery, delivered it to our relatives in the Philippines, Just scan a signed authorization for somebody to receive your BC and a scanned copy of your ID(Philippine passport) preferably. I then asked my relative to mail it to me here in US via DHL which cost us less than $30.

Hi folks. I'm not really sure where exactly to post this question so if it's in the wrong part of the forum, forgive me.
 
Anyway, to make it short, no story, only the facts.
 
Male U.S. citizen in Florida
Female Philippino citizen in Cebu, never been out of her country and never been through a visa process.
Both were married in the Philippines.
U.S. citizen in Florida now wants to divorce her.
 
I've heard countless contradictory responses to this question from a host of different places so I came here to ask.
Can the US citizen file for divorce from a Philippine marriage while he is in Florida. If he can then I can see where he would then be a free man again. But, what about the woman in the Philippines. Is she also free now to remarry?

File the divorce in your state, ( I suggest hiring a divorce atty), when the divorce is finalized, you are free to marry anyone. If there's no waiting period for remarriage in your state (check withyour atty).

Provide your x wife her the divorce decree. If she wants all stuff in order, she can then file a petition for recognition of Foriegn judgement (divorce decree), once petition is granted, the final judgement is then forwarded to appropriate agency (NSO) to dissolve your previous marriage in the Philippines.

She then can marry again.

I'm sorry if i post in wrong Forum i just don't know where to post my situation. to start, i have 10 weeks old baby now we had her US citizen birth certificate and social security card i gave birth 3 days after Christmas last year her father is US citizen and we are here in San Jose CA, my  plan is to apply a dual citizen for my baby and my question is where to start what are the required documents to bring when we go at the Philippine embassy? is there anybody here that had same situation i would appreciated if you guys share info. thank you

All you need is to fill up the form, submit your NSO birth certificate, showing you are born in the Philippines and your daughter's birth certificate showing you are her/his mom.

 

Your baby qualifies for CITIZENSHIP RETENTION AND RE-ACQUISITION ACT OF 2003 (R.A. 9225) based on you, a natural born Filipino mother.

Hi Everyone,

 

My fiance had her interview at the US Embassy on the morning of March 12 (Philippines).

 

She said it was a long wait to talk to the 1st interviewer who looked at our file and affidavit of support and asked some questions.

 

Then it was another long wait to talk to the 2nd interviewer (US consulate).  He also looked at our file, the pictures that were sent with the initial petition and then asked a couple of questions.

 

At the end of the interview, my fiance asked how everything looks and the consulate said....

 

"YOU ARE APPROVED."

 

Whooo Hoooo!!

 

Thank You!!!

 

They took my fiance's passport so they could put the visa on it and would mail it back to her.

 

Whoo Hooo!!

 

We are both pretty psyched!

A foreigner can't own a lot in the Philippines , the limitation of 1000 sq m is only for naturalized US who were Philippines born but this is obsolete already as the dual citizenship law passed already. If you are a Naturalized citizen and was Filipino by birth, or coz your parents are Filipino, then you are eligible for dual citizenship, this entitles you to buy as much land as you want in the Philippines.

Now, if you are a foreigner, you can buy a condo but can't own more than 40% of the condo unit in one project.

By the way, most of the realtors or license brokers in the Philippines already know these... So, even if you think you can buy a lot and decided to buy, realtors will tell you, you can't and suggest to buy a condo.

The only way a foreigner can own a lot is through inheritance.

He's still eligible to file for dual citizenship, just tell him to apply at a nearest Philippines consulate. He just needs his mom 's NSO birth certificate (as a Filipino) and his birth certificate showing the name of his mom and fill up the application.

When he's dual, He can stay forever in the Philippines with no fees and can come back in US anytime too. He will have both US & Philippines passport.

Filipino - American gets Balikbayan stamp(valid 1 year) upon arrival in the Philippines as long as your US passport says that you were born in the Philippines.

If you want longer, apply for dual citizenship at your nearest Philippines Consulate.
