Hello, first of all I'd just like to say how great this forum has been for me. I just made an account today but have been using the information for about a month now. I'm in the process of collecting and filling out all the forms for the K-1 visa. My fiancee has worked a casual job in addition to multiple full time jobs and I was wondering how to input that on the G-325A employment section. I've seen conflicting advice and wondering if I need to put it on the form and include a supplement, or just use a supplement, or even if a supplemental paper is needed. Any help is greatly welcomed. Ok.. after misreading your post, then having trouble editing mine.. lets try this again.

My timeline is a great example of the Sydney Consulate at the time. So when is your ceremony in Australia?

If you file now... you have a 5-6 month wait for the I-129F. Then another month for NVC processing. Then 2ish months for the Consulate. She has 6 months to get here from then. If you mail it now, you will have a window of six months to do the ceremony in about 8-9 months from now. So between December 2011 to June next year.



The ceremony is for the 24th of march 2012. So between december 2011 t June 2012 would be the perfect time table. I'll be sending it out soon as possible. Thanks for the help.

Oh, sorry. To clarify we are doing a religious ceremony in Australia before she comes to the states. I'm worried the six months will end before the religious ceremony. We are doing the legal one in he states after that.

Hello,

My Fiance and me just got engaged and she left back to Australia. I am about 90% done with all the K-1 visa packet for her and could finish and send it off this week easily. Here is the thing, we are marrying this time next year (already have the church reserved). I know once the process is done and she gets the visa she has 6 months to enter the US. If the whole process goes real quick (I've heard of the California service center finishing in 11 weeks and sending it off), we could have the issue of her visa expiring before the wedding, which is when she is coming to the states.

Any advice or any information I could use? Like is there a point we could hold up the process if it moves to fast? Like the interview at the consulate? Or should I just file soon and hope for the best?

So Thomas you can get all that sorted ain a few months to send over to Australia. It takes no time at all to get done. The letter from your employer just needs to be on a business letter head stating yearly wages and full time or part time. ^6 paystubs, and no tax transcripts are needed for Australia. The 134 is never asked for at interview well wasn't at mine and have nver heard of it either. I would suggest you get Marrissa to get police report and medical done around end of July. The medical you may have to wait till you get your case number from NVC after approval as some of the doctors require a case number. I was lucky mine didn't. As the beneficiary I looked up all the documents I needed on the US consulate site Sydney and downloaded them all and started collecting so when the packet 3 came I was ready to send them in the same day.the 156 and 156k can be downloaded any tim but she can start to have a look and read over it all. Hope this helps

Hello, I just received my NOA-1 today in the mail. I know it will take many months to get approved but I don't want to be caught off guard when its finished. I don't want to scramble around gather all the supporting documents for the I-134. So I'm wondering when would be a good time? Would doing it now be to early? Like does the bank document and the letter from my employer have to be done with in a certain amount of time? Thank you for your help.

Slmat malam everyone -

I am US researcher currently living in Indonesia on a dissertation fellowship, getting ready to file the I-219 petition to bring my Indonesian fiancee back to the states to get married.

The I-129 states I should file my form with the service center "based on the last place I lived in the states". However, the last place I lived (and where my fiancee and I plan to return to be married and live) is in Hawaii, where I am on academic fellowship. This is not my permanent residency, however, as I am still a NH resident and file my taxes there. Should I be sending the packet to the California or Vermont service center? I am concerned this might cause problems later with the I-134.

As I understand I DON'T need to file the I-134 with the I-129 package. However, I did notice that the I-134 will require proof of my temporary residency in Indonesia. Will a photocopy of my temporary stay and research permits from the Indonesian government suffice?

The thing is, I have a derivative who's going with me so I guess she will be under a k2 visa category. Do I have to pay a separate document verification fee for my kid? If yes, when I txt DELBROS with the CASE NUmber, and when I fax the receipt to the USE Manila, would they be able to find my daughter's information since the MNL case number is under my name?

My fiance called his bank last week and was asking for a certification from his bank that will show all the deposits made on his account and his current balance, he mentioned that he will use it for petitioning an immigrant. The representative sent an 'affidavit of support' thats exactly their term. and im confused as to whats in that affidavit of support that is coming from his bank. does anybody here seen that 'Affidavit of Support ' particularly Navy Federal Credit Union?

You can enter the USA and it's territories from any of it's POE's whats to say you planned on a marriage in HI, and honey moon there before "going" to Guam. Or perhaps after you interview and have visa, something comes up and US Citizen moves to another state before you use the K-Visa. The I-134 has to do with situation at time it was signed, not with the situation after, this can always change.

I would not worry about this

Yes, as far as the consulate is concerned, your paperwork indicates that you are moving to Guam, nothing is stopping you from changing to HI, and there is NO restriction on moving to HI.

Hello,

My fiance filed my k1 visa petition when he was in Guam so the poverty guidelines he used is based in Guam as well. Today, we have decided to get married in Hawaii and stay there for a year or two instead of Guam. After my medical today, I was instructed the CD of my medical results will be sent to my port of entry.

I remember when I was filling up the forms on my medical three days ago, it asked me whats my petitioner's address in the US, so i put the Guam address. and asked what is my port of entry, I put in Guam.

During the releasing of results earlier, the nurse had me double checked the address for letter correspondence and it has the Guam address. I was hesitant to tell the nurse that we were thinking of living in Hawaii instead. Hawaii's poverty guidelines is way higher than in Guam. Im afraid that it might complicate during my interview because my fiance's income tax shows just enough for 6 persons based on Guam's guidelines not Hawaii.

Can I change the address when I get to the US?

No, just that line with your complete signature as printed on your certificate. About your photo, was that done with an ink jet printer? They do want to you print your name on your photo with alien number, but only so they get the correct photo or the photo taken of you at your biometrics.

US passport still uses your submitted photos, and your name should appear exactly like it does on your certificate. Same deal there, want you to write your name exactly like ti was printed.


It was just glued on my certificate. So I do not need to sign at the side of mt photo? Just the line?

My wife's did not have a signature on the photo. According to the form it is because she changed her name and the name changes have the picture stuck on the form instead of imprinted with a signature.

The instructions say to sign the edge of the photo and the signature line exactly the same way.

I didn't even realize the certificate needs to be signed. Glad I found this thread. What if your photo doesn't have a signature? For me, they just used the photo I sent along with the application. Topic of signature never came up with the IO.

On my certificate I have my First Middle Last name as well as my SSN card. I always sign using First and Last though on on all documents including USCIS forms. I'm reading online now that you must sign with your middle name as well. That won't match anything I've ever signed in my life if I follow that rule. What would be consequence of signing it however I like?

get a magic jack. go to www.magicjack.com and that will give you more information. there is a retailer here in the philippines already and you can ask them to buy it from here. not over 3k pesos. PM me and il give you the retailers cell number. i have one here and it works perfectly fine. all of my family in different city and provinces has one. since we get a mainland phone number, you (in the US) can call it just like calling another state. you can bring the magic jack anywhere. the thing is they would need to be online for you to call them anytime and for them to call you also. you dont need to be online for them to call you bec they can call your cell in the US or your landline for free. thats calls to US and canada for free. hope this helps.

hello,

one more question about affidavit of support for a K1 visa. just to clarify, I will bring an affidavit of support during my interview right and he doesnt need to notarize it anymore - according to the new rule, right?

second question, we received the NO2 yesterday and was thinking my interview might be in a month already. We wanted to prepare all the stuffs that we need already and all we are waiting for right now is the affidavit of support. w2s for 2008 are not in yet so he cant file for his income tax return for 2008. Although he has a business in guam that he is paying taxes every month that is enough to 125% of the 2008 poverty guidelines with all the pay stubs until october 2008.

He doesnt have pay stubs after oct 2008 til the present since he is here in the philippines with me and wanted to be with me during my interview day. However, he is making money out of his business in Guam and is paying taxes as well. what do you guys think, what does he needs to show during my interview if he has no work since oct 2008 up to my interview day since the Income tax return for 2008 is not filed yet.

is there anybody here in VJ who is from guam? bec my fiance is paying taxes every month depending on how much money he make for his business.

I tried calling the USEM 3012000 then local 5184 that i got from some topics here in VJ. We have received like 4 letters in the mail stating that i have to contact USEM to set up my appointment. I just want to call this 301 2000 local 5184 number so that i dont need to pay to call the call center with a 1-909 number that cost a lot of money. I just want to ask whats up with my case because when i call NVC, they say i am on AP. ( yes. that sucks!! im there for 31 days and counting!!) if i buy the 18 dollars pin that is only good for 3 calls to the 1-800 number. so i want this route. I tried this before and it worked. the lady that i have spoken to told me that it was just misrouted and normally i would be asked to really call the paid call center service. any advice guys?

Clearly the other characters have no problems at all since their visas have already been approved and they are all here in the US.

I say get a good immigration lawyer especially that there is "fraud" involved because of the "simulated birth" ( when another person is entered as the mother of the child in the BC other than the real mother ).

Sticking to the truth or not, I believe a good lawyer can give your fiance's mother the best advice to fix everything.

So, my mother in law went to the philippines last april 2007 married my fiance's half brother's father. Went back to the US and filed petition for IR2 for the 2 kids, CR1 for the father. All visas were granted since, they really had relationship a couple of years back, had babies and my mother in law's first husband died 2002.

The 2nd kid who just turned 21 just got to the US last December 2008 with an IR2 visa. Same goes with the 3rd kid who is now 18yrs old and said will be granted US citizenship. ( his case was expedited by USCIS for him to get a US citizenship before the age of 18. so when his mom filed the IR2 visa for the youngest son come april 2007, after 3 months, it got approved together with the father's CR1 visa. the reason behind that was they wanted the youngest son to be in the US before his 18th bday to be granted the US citizenship and the CR1 of the father was also expedited together with the youngest son's petition since being a minor, they want the father to be with him when he gets to the US).


Are you sure your terminology is correct? If the 2 kids just recently came to the US (December 2008?) on IR2 visas how is it that anyone is a US citizen?


Lets put names on this situation so that it will be clearer. My fiance's name is Luck-e, (soon to be married to him so I consider his mom my mom-in-law) His mom's name is Gloria, His 21 yr old kid is Rey, and the 18 yr old kid is Warren and the one with the CR1 visa's name is Luke.

When there were petitioned, their visa shows IR2. Their cases got current when warren was 2008. USCIS expedited the warren's case because of the CHILD CITIZENSHIP ACT of 2000. Their case was different (warren and Luke) it didnt go the normal wait periods because USCIS expedited their case. It is stated on the letter with the instructions on how to medical, that Warren has to be in the US before he reaches 18 in order for him to get a US CITIZENSHIP. We were informed by the USEM when we called that his case is expedited and need not to be scheduled. Just go to the embassy anytime Mondays-Fridays 8-5pm and they can have their interview anytime. However, Rey who is 20 yrs old when the case got current, was left here and just got his visa last Dec 2008. There were no instructions nor letters stating that he will have the US Citizenship just like what warren received.

This is something that you need legal advice to know what options are open. Things dont work the same way here as in the Phils. Your attempts to fix things on your own might jeopardise all of your families future here. Get a good lawyer.

I figure i have to post this here. i hope you guys can help...

My mother in law petitioned my fiance's half brothers and their dad. They are now in the US but left one here who is over 21 yrs of age.

The whole story there is, my fiance is the first son of my mother in law way back 1981. My fiance's dad petitioned him and his dad and left for the US when he was 7yrs old. My fiance's dad was addicted to drugs and was turning crazy and hurting my mother in law. My fiance and his mom ran away, went to guam and went to the philippines because he was turning all crazy and cant control him anymore. They felt that that was the only way to go.

When they were here in the Philippines, my fiance's mom met another man. (my fiance and my mother in law are both USC already and this was around 1987 i think). He had 3 kids with this man, the eldest is the 22 yrs old now. However, because she wanted to keep this as a secret from her in laws in the US, when she gave birth, she had her sister put her name as the mom of the new born baby. She gave birth in the province and you know how the system works here, you can always ask favor for them to do that. So there, the birth certificate shows that the mother of her baby is her sister and the father of course is the new man.

After a year, she got pregnant again but this time, she put her name on his birth certificate as the mom and the new man is the father, this kid now is 21 yrs old now same goes with the 3rd kid is 18 yrs old.

My mother in law went back to US and worked, my fiance was left here in the philippines with his half brothers and their father (half brothers father). My fiance followed to the US after sometime. My fiance's dad was deported to the philippines because of drugs. When he went back here, he still continued to take drugs until he totally lost his mind and cant recognize people around him anymore. My fiance's dad did 2002 due to multiple organ failure.

Before my mother in law left for US before, she ended her relationship with his new man that got her pregnant with 3 kids, move on with her life to continue to raise her kids and just sending money to the philippines if she could. When she is starting to have her life back considering the nightmare that she had with my fiance's dad, being a battered wife, she eventually petitioned her mom and went to the US as well. She finally fixed her life and moved on with it.

On 2007, me and mother in law talked about having my fiance's half brother come to the US. I see no problem with it since those are her kids anyways. The only problem that came across our conversation was the very first kid that she had her sister sign the birth certificate as the mom. What she taught about is to just marry the father so that the father can bring him to the US.

So, my mother in law went to the philippines last april 2007 married my fiance's half brother's father. Went back to the US and filed petition for IR2 for the 2 kids, CR1 for the father. All visas were granted since, they really had relationship a couple of years back, had babies and my mother in law's first husband died 2002.

The 2nd kid who just turned 21 just got to the US last December 2008 with an IR2 visa. Same goes with the 3rd kid who is now 18yrs old and said will be granted US citizenship. ( his case was expedited by USCIS for him to get a US citizenship before the age of 18. so when his mom filed the IR2 visa for the youngest son come april 2007, after 3 months, it got approved together with the father's CR1 visa. the reason behind that was they wanted the youngest son to be in the US before his 18th bday to be granted the US citizenship and the CR1 of the father was also expedited together with the youngest son's petition since being a minor, they want the father to be with him when he gets to the US).

If you are following this story, you will notice that the eldest son was left here in the Philippines. We are thinking of the fastest way to bring him to the US. I understand that being over 21yrs old will make it 10-15yrs of wait, but that is fine, he is willing to wait. Two choices that I have thought of, the youngest son now is a US citizen and is working, can petition him as a brother of a US citizen, the father with CR1 visa cant file as of yet because his visa is conditional and still have to adjust status after a while before he can file the petition, am I correct?

However, BIRTH CERTIFICATE is a major requirement during the process. should we stick to what is on his birth certificate and stand by it that the mother is not my in law but her sister's? Or should we fix his birth certificate and file a LATE REGISTRATION AT OUR NATIONAL STATISTICS OFFICE and place that his mother is his real mother. (it sound redundant but thats the simplest way i can state it, sorry ). If we fix his birth certificate, instead of the brother petitioning the eldest son, my mother in law can just petition him right? Im just thinking of complications that will arise and whats the solution for this because, in reality, she is still the mom.

let me recap my questions:
1.) Can my fiance's eldest half brother go to the US after being petitioned?

2.) who should petition him?

3.) should we stand by what is written on his birth certificate that his mother is my mother in law's sister, or should we just file a LATE REGISTRATION at NATIONAL STATISTICS OFFICE and place that his mom is my mother in law? Is that possible?

4.) I understand that US embassy does its own verification with our NATIONAL STATISTICS OFFICE, so I'm assuming, this might really be a big problem because they might see there that his name will appear twice on the database, one it will show the same dad but different mom (that is what I am thinking) So I really dont know how to fix this mess.

I hope to hear some advice here guys. Sorry if its really long but its really like a soap.

weehhh!! were on the stage. I was stucked @ NVC since January 20 and they sent my case to USEM last March 13. I called the call center to see if they got it and want to schedule an interview date last TUesday March 16, but they said, they only got the electronic notice from NVC that the case is completed and will soon recieve it case. Did you all already? When did they send your case from NVC?

Another thing I found to do was to wheel and deal with the guys selling the Rolex Watches on the streets of PI , they make great cheap gifts to your buddies.

They will walk around offering 2 watches in a case for around 1000 pesos. You can easily talk them down to 250 to 300 peso for both watches

I brought back like 12 rolexes last time, and gave them out to friend.

Another thing if she needs any dental work done, have her go to dentist and get checked out and have everything taken care of in PI. It's penny on the dollars for dental care in PI......

I wanted to do my braces here but they said when i get to the US, the dentist will just take it off because it has to be maintained by the same dentist that put it on.
