you guys, i heard another script and yes email is being included on their call flow, second is they said you might want to call by next week to see if this administrative process is completed. so i guess they have an idea that i am on my 50th day already. by any chance, do u guys suggest to call before they close if u call when they open? do you guys think it will change on the system by the end of the day? i always call like 2 hours from the time they opened.

I received an email today. from a family friend that works in the immigration and she got an email from embassy saying that my case is still at the NVC and it will be there next week. I hope its right. at least i got them look for my case other than calling NVC everyday. Hey you guys, NVC is closed today? today is monday in the US right?

Does the NVC mail a letter to you with a NVC case number, for you to call and track? Or do you have to call the NVC and acquire the case number yourself?

you may call NVC first. If they received your case from USCIS they can give you the case number over the phone. in the next coming days or weeks, you will receive a notice that they got it and assigned you a case number. but then again, you may call so that you keep yourself posted while waiting for the mail to come in.

"hi maam, it seems that we recieved your case from the USCIS last january 20 and we are currently processing it. we sent a notice to washington for further investigation on your case and as soon as we receive this, we will notify the petitioner and send it to the consulate. you will be contacted by manila consulate on how to schedule your interview but as of the moment, all we are waiting for is the response frm washington. that's it!" its the first time i heard that and i was hoping to hear something exiting at the last words of his sentence. their system was down yesterday morning tho but i tried calling every hour to check. hehe. dang!! how i wish im out of this NVC thang.

I mentioned Washington many pages ago in one of my posts. The NVC employee I talked to at the time had a bunch of problems with the English language, so I couldn't tell for sure what they were saying. It was something along the lines of this.

do you guys think it would be ok to have our medical done already like next week? medical here in PI sometimes takes like 2 months for some sputum test or something plus my kid has school so its better for her to be absent this monday and tuesday compared to the next following weeks. My NOA2 shows that it will expire may 2009 so i want to have everything ready by the time it gets here,

I dont want to do the medical when i learn that it is out of AP already then its when i find out that i have to do the sputum test on our medical and wait 2 more months. what do you guys think?


I had mine while I was still in AP, and I had all my papers together ready to go. Like you , I was in no mood to hang around once we were on the way finally.



I Know. i really dont even want to call but i call just for the hell of it. even if i dnt want to. anyway, il be on my 6th week by next week. i'll have my medical with my kid next week. However, my kid is on K2, do we share the same case number because my NOA2 doesnt state her name on it. anybody knows?

does she work at the NVC? there are various points in the process from USCIS through NVC to the embassy at which you can go into AP and I would scream if the reason we got held up for 6 weeks was to do something as simple as that!

that im not sure if she is from NVC or USCIS because when we were introduced last year when she was here in manila, they said she works for the US immigration. I gave her my case number on my email and i guess that's the reason for us because my fiance just got divorced in guam, maybe they are checking on that. But she said to contact her again after 10 days if i havent heard anything from them yet.

My fiance called trice...first was when we learned that we were on AP since Dec. 17 (Jan.15). Second was Jan 28 and they told him that they will send the papers within the week and third was 28th, a day after they sent our papers to USEM. Good Luck...


weee i passed today not calling NVC. i usually call everyday to check because I cant help it. lol. but finally i got tired of hearing the same thing from NVC that its still under process. My fiance recieved 3 letters from immigration but i dnt know what is it. i havent talked to him yet but he just left a msg saying that there were 3 letters from immigration. I wonder what were those? anybody here have an idea?

Yes...Its so easy just to say im waiting...but gosh, actual waiting is really hard. But after 40 days stucked at NVC, they replied to my email about asking my case status. I sent email at NVCINQUIRY@state.gov and 10 days after, they informed me that my papers are totally sent here in Manila last Dec. 27. Im so happy bcoz im now on the next higher level of this journey...getting nearer to the most awaited part...interview time and receiving VISA. Its only a matter of silent prayer. Thanks GOD!

Frankly, this is a problem that needed a solution in mind before leaving the former joba and going to he PI. You can try basing everything on last year and taking your chances.


He had a talk to his employers today and w2s are to be sent this week. so he will be filing the income tax return for 2008 and will just bring supporting documents like bank statements showing deposits for the past year and the current balance plus the Gross Receipt for january 2009. I guess we'll just take the chance of basing everything on last yr. thank you pushbrk for the inputs. it helped us alot.

NVC has recently received the petition from USCIS and gave me an MNL number today. So i am preparing documents i need during my interview. we are woking on the affidavit of support now. My question is, my fiance started a business in Guam its for a media service last July 2008. He is also working at the same time. he earned 35,500 plus for the year 2008. My question is, since the 2008 just ended and w2s are yet to be mailed and if in case I should have it before my interview like around febuary, it might take a couple of weeks before my fiance completes preparing his ITR for 2008 so my fiance might not have enough time to file the 2008's ITR. can we just show his paystubs, w-2s and the filed taxes for the newly set up business and his 2007 income tax return? Is it ok if the business is just new but is earning enough money together with his jobs to reach the 125% of the poverty guideline.

1.) can i just bring my fiance's 2007 income tax return since 2008's income tax return might not be ready by febuary just in case my interview will be set this february.

2.) the total income from the w-2s and the NEW business will be 125% of the poverty guideline, but the business is NEW, is that ok?

He's going to be declaring the income he currently derives, not what he derived in the past. He can provide tax returns but cannot base his current income on what he earned last year from a job he doesn't have anymore. Does the business provide sufficient income? If so, what evidence can he provide to support the income claim.


evidence would be the filed gross revenue tax every month. In guam, when you have business, you file your earned income from this business every 20th of the month and pay corresponding tax due. last 2008, he earned 31k plus from the business that he currently have. He is currently not with that previous job since he is here in the philippines right now. this january 2009, even if he is here in manila, his business earned 2,500 gross revenue. can he bring his w-2s for his previous job and filed gross returns from the business last year nd january 2009's gross revenue tax filed?


You keep asking what he can bring and fail to notice the key factor is his current income. It would help if the two of you actually looked at the I-134 to see what I'm talking about. It asks him to declare that he currently derives $X income from X source. "Gross Revenue" can be but usually is not "income". It can be, in a service business with no overhead but I take it he knows the differnce and needs to read the form and decide what his answer would be and what he has to docuement that answer is true.

Of course, he can bring any financial documents he thinks will help them rule in his favor but he must answer that one question truthfully and back it up. I'm always leary when the USC is not involved in asking the questions. He's there with you. It's his affidavit of support. Why isn't he asking these questions?

In section 7 of the I-134, he is required to complete the present tense statement, "I derive an annual income of:" Stating last year's income is not a present tense answer. A present tense answer would be to annualize the "income" not "total revenue" derived from his business, since that is his only income in the present tense. Is he at least reading my answers?

He's going to be declaring the income he currently derives, not what he derived in the past. He can provide tax returns but cannot base his current income on what he earned last year from a job he doesn't have anymore. Does the business provide sufficient income? If so, what evidence can he provide to support the income claim.


evidence would be the filed gross revenue tax every month. In guam, when you have business, you file your earned income from this business every 20th of the month and pay corresponding tax due. last 2008, he earned 31k plus from the business that he currently have. He is currently not with that previous job since he is here in the philippines right now. this january 2009, even if he is here in manila, his business earned 2,500 gross revenue. can he bring his w-2s for his previous job and filed gross returns from the business last year nd january 2009's gross revenue tax filed?

I've helped friends and families with their petition and as soon as we learned that the case is being sent here in manila, we go to st lukes right away without the appointment letter. Just bring your passport, the 2x2 pictures and the payment. If the guard will look for the appointment letter, just tell him this.. 'kuya sabe po samin ng NVC, kayo nalang daw po ang mag rerequest eh" ok na yon. We always do this that way if you found out your sick or something, you'll know as early as now. Bec that happend to us already. we went to st lukes and had a medical with the appointment letter and it turned out that she has this spot sa lungs then she would have to go back after 2 months, which is very frustrating. so we tried making excuses kay kuya guard para we can do the medical early. just be sure you'll not do the medical more than 3 months bec it has an expiry date. wait until the case is sent here in manila then go to st lukes na.

Were you asked for the original NOA1, NOA2, and NVC letters? I am planning on sending color copies to my alien fiancee in Tokyo, but will send the originals if necessary.

Were passport pics of the sponsor (US citizen) required as well? I hadn't thought of including them!

I have a hard to replace FS-545 Consular Birth Report that I'm skittish about sending overseas and was hoping a color copy would be sufficient (that's what I included in the I129F submission). I am trying to obtain an original, but the FS-545 is no longer used and the replacement FS-240 is difficult to obtain. Oh well, no one said this was going to be easy, eh? ;)

This is standard procedure for K1 visa applicants who are not Japanese nationals. In these cases there is no packet 3 & packet 4 there is only a K1 packet. Your fiance will get the K1 packet after the preliminary requirements already forwarded have been satisfied.

My fiancee and I were blessed with a NOA2 on 10/27/06.

Within a week the U.S. embassy in Tokyo sent my fiancee a packet - but instead of what we expected it was only a preliminary information sheet. She filled out her biographical information and sent it in via registered post (which shows receipt soon thereafter).

The instructions were to wait until her final packet arrived.

I have been following the VisaJourney timeline to the letter and was surprised when there was an extra step thrown in there that wasn't mentioned.

It has been ~3 weeks and she has not received any additional documents from the embassy. Calls to the embassy (including the fee line which is ~1500yen for < 1 minute) have just told us that they cannot reveal status of individual cases.

Has anyone gone through something similar with the U.S. embassy in Tokyo, Japan?

I'm no lawyer, so I won't argue with you about what the constitution says. Even if I'm using the wrong words, I know this is true. As an example, not saying it is equivalent to applying for a K1 VISA or anything.

When I apply for a job, employment laws dictate that the potential employer can not discriminate against me based on race, religion or sex. As a process of hiring an employee, employers must follow rules. When they violate those rules, the applicant has rights...ugh, privileges. Or whatever you want to call it. Whether that involves due process, well, I'm no lawyer.

Though the laws are not the same, it is my understanding that the concept applies equally to a government agency.

Since you are a student where do you live? How support yourself and has anyone made deposits or given you money for living expenses? And so on.


I live in an apartment I bought. I still have a small mortgage. I live by myself.

I'm living off my savings and investments. I have no work income since I quit my job. I do rent out my parking spot for some extra cash. But that's too small of an income, even to report on the tax returns. Like I said, my finances are fine, even without a co-sponsor. But I'm using one anyway, since I have no job.

I am aware of the talk that co-sponsors aren't accepted at HCMC. Even savings don't matter, according to some. But I know that there is such a thing as immigration policies. So the government shouldn't be allowed to trample on my rights. If they do, I as a citizen have due process, don't I?

I know many of you are trying to help by identifying red flags. But there's nothing I can do about my finances. It is what it is. From what I have read, there should be no problems. My only concern is the introduction by a family member. I can't change this fact, and I'm not aware of any rules that cover this topic. Thus, the CO can make any conclusion he wants and I have no recourse. This is what I'm trying to resolve now. Are there any recourse I can use?

The reason why this issue is so insidious is because it's valid. Yes, the sister played matchmaker and wants to bring someone to the USA. But, that in itself isn't proof that the relationship is fake. Since the intent is basically true, there's no way to invalidate it. That's the insidious part.

That's the engagement ceremony? Yes, we had an engagement ceremony. With over 150 guests, including my mom.

How long have known your fiancee?


Three years. I have some emails from our initial contact. But not a lot. We mostly use Skype. Unfortunately, my computer crashed and I didn't have backup. So I don't have Skype logs from then. I use Gmail, so that's why I still have emails from then.

How do you know her sister? How long have you known her sister?


Through my uncle. She was playing matchmaker. I didn't know her until my uncle introduced her (Kelly) and my fiancee (Kenly). Note, my 5th uncle is married to another relative of theirs. That's how Kelly knew my uncle.

Also, Kelly's husband used to live next door to my grandma back in VN and was friends with my cousin in VN when they were young. We didn't know this until we returned to VN and the family chatted. Don't know if any of this matters. Kelly also used a K1 VISA to enter the US. She's now a citizen though.

How many trips have you made to VN? How many trip did you make until you proposed? How long have you known each other before the engagement?


I've only made one trip to VN. This was for the engagement. We've known each other for 2.5 years before the engagement.

We took lots of pictures with different clothes during my visit. The trip was 2 weeks, but with flight time, that's only about 11 days actually in VN. I have ticket stubs to many tourist spots.

Did you recently get divorced?


No, we both have never been married.

Some other info that might be relevant.

1. When we were introduced, I had a job. But since then, I decided to switch careers and went back to school full time. I still have another year of school left. I do intend to use a co-sponsor for the affidavit of support. Though I do have enough assets without a need for a co-sponsor. Note, I do have a reason why I'm applying for the VISA now instead of waiting until I find a job in my new career. Kenly and I have discussed it extensively.
2. We have been calling on the phone and writing letters, but only started when we decided to get married. For the rest of the time, we've been using Skype for voice/video chats.
3. We're both Chinese, and in our late 30's (our birth date is actually only a few days apart, she's older). We're both born in VN. I immigrated to US 30 years ago.
4. No criminal records, and in my last job (the one I quit), I had secret clearance.
5. I have a BS (in Engineering) degree from the first time in college.

That's all I can think of that might be relevant to the application.

So the only red flags I can see are; being introduced by Kelly, and spending a short amount of time physically together. The latter one can be explained. But I have no idea how to respond to the previous one if the CO thinks that's a problem. Some of you commented that it could be addressed in question 18 of I-129F, can you explain how? I know it's too late now, but I would still like to know, in case Kenly needs to say something at the interview.

And if anyone can see other red flags, please let me know. Thanks...

I'm in the process of petitioning a K1 VISA for my fiancee in VN. We were introduced by family members (her sister and my uncle). I read in the forum that this could be considered a red flag. I would think being introduced by people who know each other is much better than by total strangers. I guess that's just my own point of view.

My question is, should I address this and if so, how?
