if she had it delivered, it takes 5 business days since she lives outside the manila. that is if theres no review on her case. if you are on administrative review it takes normally 6 weeks to 2 months. i requested the consul if i can have mines picked up. and he approved it. i got a call after 2 business days and picked it up on the 3rd day.

everythin in the philippine govertment ofc is currupt. Its not that I hate my birth country as a whole, its just that things never did change. Remember that I asked them when I got my son's CRBA and they didnt informed me of such to mislead me as well. That was confessed by a friend of mine who happens to work there as well.

hi guys,

just want to share my unpleasant experience. I got my son's CRBA last 2006 when he was just 3 months. When I got that, I inquired when should I apply for his Exit clearance, the department of immigration said I can apply for it anytime just be sure that the kid leaves not over 1 month and it only cost 1500 somthing. My fiance and I was in the processes of fixing issues before filing his petition to me that time. So I did not get his exit clearance yet. They told me that my son would have a overstaying penalty if he returns from the US and stays over 1 yr but will not be charged any penalty if he hasn't left philippines yet. SURPRISE SURPRISE. I finally got my visa and now will be flying to US on June 8, so I decided to get his exit clearance certificate last Friday May 29, 2009 and at window 35 of Department of Immigration, they told me that howcome his CRBA was given 2006 and I am applying for his exit clearance only now?? I told them what I was informed way back. So I was instructed to fill up some forms and go to the other window.

This is the window that will give you the quotations on what you will be paying and how much would it cost. It came to my surprise that my payment slip totalled to more than Php 7,000!!! I got so mad and told the girl what I was told before, and she gave me instructions how to waive the penalty costs over Php 4,000. I was instructed to go get a letter of request called 'UPON FILING" and give it to a certain officer at the back of the main immigration building. You have to go to a super dirty place and see alot of fixers around typing documents, photocopying docs also and notarizing as well. My letter costs Php 300. When I came in I dont have my kids 2x2 pics so i had his taken for Php100. I went to the same bulok building again to give my letter of request so that they can waive the penalty. The 'officer' granted my request. (wow thank you ha.. corrupt filipinos)

Anyway, I went back to the counter that gave me the quotation and told me to go straight to the cashier. The cashier stil wants me to pay the full amount despite the letter granted. It seems that he doesnt know whats that for. So i called the girls attention who instructed me to do the waiver. They recomputed it and now was down to more than Php 2,000 plus express lane fee of 500. I felt like I got no choice so I paid for it instead. I went back to window 35 to verify what I paid for, had my sons thumbmark and here's the funniest part, I was asked to come back after 5 hrs to get the certificate! Remember that I paid for express lane fee for 500 and now I am asked to go back after 5 hrs to get it! #######! This is why I hate Philippines. So beware you guys. If you guys got your CRBA, be sure that your kid will leave the philipines the same year or else, every month its a penalty of Php 300.

( I booked it under my maiden name because my passport shows my maiden name) However, my alien card shows my married name already. Is that ok? Hope to hear from you guys.

My 'fiance' continued with the petition because he thought the relationship with the first wife will be fixed once she get to the US. My fiance went to Guam and not flew to hawaii with her because he got an offer for a new job and a business around end of March. As you notice the petition took alot of years and the first wife already had the plans all set and dont want to go with him to Guam. THe whole plan was for the wife to go to Hawaii and my 'fiance' try to go to Guam and check out the life there. My 'fiance's ' business went well the same time as the wife got a stable job in Hawaii. He wanted her to come over to Guam with him and unfortunately, they started fighting over it and resulted to divorce. My fiance filed for a divorce on July 2008, that was 3 months after the wife got to the US.

My fiance decided that after the divorce, he will petition with with a fiance visa petition. Divorce was granted Oct 3, 2008. My fiance filed for my K1 visa on Oct 10, 2008. He went to Manila for 5 days and proposed to me on October 15, 2008. I am all worried about our case bec he just got divorced and the ex wife just got to the US. I know that it will be a red flag for them. But we still pushed thru with it as we really have a bonafide relationship with trials and mistakes along the way.

We were also worried about his income when we'll have my affidavit of support since he got there in the middle of the year meaning it will be hard for him to earn income good for 6 household. THat will include the ex wife, their kid, me, our baby my first kid and him. But his business suffice the income and made 35k for 6 months plus savings. so were ok with that.

People here thought that we are having a VISA Fraud with my case and will cause the first with to be deported and me being denied on my interview. Let me tell you guys that I JUST GOT MY VISA APPROVED, for one because we really love each other and our relationship is genuine. Mistakes happen, we are just people not perfect as it is.

For all the people who hated and posts stuffs againsts my case, I understand your point. And thank you also for being a part of our journey.

you may call NVC at 603 334 0700 and ask if they have sent your case to manila yet. if yes,then you can go to st lukes and do your medical, be sure to bring your NOA2. if they havent sent it yet, that means you have to wait til they sent it. thanks

US Embassy and Consulate DiscussionHIV testing for NIV discontinued?
My question was not if the information was true (it's clearly stated on the State Dep website) but to what degree embassies abroad are complying.

Jak Embassy page with instructions for medical exam still has the incorrect information posted about the HIV test requirement. However, on emailing them they confirmed that the HIV test is not required and emailed me a whole new set of forms for the medical exam reflecting the change in requirements.

Think it may take a while for all embassies to catch up on compliance to this, so probably best to email them directly if you or your partner have an upcoming interview.

I'm preparing paperwork and information for my fiance's upcoming visa interview at the Jakarta Embassy.

Recently came across information on the State Dep website that as of January 4, 2010, the US government no longer considers HIV a communicable disease and HIV positive status can no longer be used to deny persons a visa to the United States (I can't believe this is just being codified now in 2010 .... wow).Visa News State Dep

This also means that HIV tests should no longer be required during medical exams for visa interviews at US embassies abroad.

I am wary about whether the embassies are actually applying this rule as of yet - but would really like to know if this has been applied across the board. My fiance lives quite far from the capital where interviews are conducted, and would have to leave almost two weeks early for his interview in order to be sure to have enough time for the HIV test component of the medical interview to be processed before the interview date.

I've emailed the Jak Consulate but no word from them yet. I am sure that more clarity on this issue would be helpful for lots of folks, so if anyone has reliable information or links please pass them along!

Let me share this to my fellow stuck people,

you guys know about the $18 pin when calling the immigrant visa call center?im not sure if it applies to other countries or if it is just in people in the US who petitions people in the Philippines. Anyway, their website says we can use the $18 pin twice only but there is a part of the site that shows you can use it 3 times. But hey! I tried it 3 times and it worked! not even 3 times, I tried it the other day for the 4th time and another one today for the 5th time and it still worked! hahaha. funny.

BTW ... for those who finally got out of AP HELL ... how did you find out? Did you get a letter, email, phone call, etc? Or was it by your daily phone calls to the NVC to check on your case.

When I call to check on our case, I am always told that "we will contact you when your case is forwarded ... ". Pardon my negativity, but I don't really have a lot of faith that I will get any notice or ANY kind from the NVC when they finally let us out.

Just wondering how it went for you ...

I think at this stage it varies according to the embassy in each country. I really don't know what the process is in Philippines. But since there are so many Filipinos on VJ, I'm sure others could give you better information about what to expect. Hopefully it won't be too much longer for you. Hang in there, you've made it this far!
If it makes you feel any better (I know it won't), we got released from NVC the same day that you did. And we still don't have our Packet3 from Bangkok embassy either. We emailed them today to ask about it. I'm hoping to get our Packet 3 in the next few days. We shall see smile.gif

My fiance filed my k1 visa petition when he was in Guam so the poverty guidelines he used is based in Guam as well. Today, we have decided to get married in Hawaii and stay there for a year or two instead of Guam. After my medical today, I was instructed the CD of my medical results will be sent to my port of entry.

I remember when I was filling up the forms on my medical three days ago, it asked me whats my petitioner's address in the US, so i put the Guam address. and asked what is my port of entry, I put in Guam.

During the releasing of results earlier, the nurse had me double checked the address for letter correspondence and it has the Guam address. I was hesitant to tell the nurse that we were thinking of living in Hawaii instead. Hawaii's poverty guidelines is way higher than in Guam. Im afraid that it might complicate during my interview because my fiance's income tax shows just enough for 6 persons based on Guam's guidelines not Hawaii.

Can I change the address when I get to the US?


Please note: THIS IS NOT IMMIGRATION ADVICE. I'M NOT A LAWYER OR ANY KIND OF EXPERT. CHECK WITH A LAWYER FOR EXPERT ADVICE.

I don't think the address you put on your medical papers are very relevant to this issue. The POE you intend to use is entirely irrelevant. You can enter anywhere in the US and it should have no bearing.

I think that what will be much more important is the US address you put on the visa application itself, particularly the DS-156,DS-157 and DS-230. Most important of all will be the I-134 that your fiance needs to complete as Affidavit of Support. That's where he effectively is taking an oath regarding his ability to support you. If I were you, I'd be very careful to ensure that he completes the I-134 truthfully with regard to his finances and his current address (I-134 does ask for 'residing at' address). Usually the address has no bearing on the threshold support levels, but since in your case it does, be sure to put his current address there.

I.e. - For I-134 the real issue you should be concerned with is where does he live right now? If he currently lives in Guam and has not yet moved to Hawaii, then put Guam on I-134. If he's already moved to Hawaii, put Hawaii. If you fear he won't have enough income then either have him list additional assets (if he has them), or consider getting a cosponsor. Or stay in Guam a little while longer smile.gif

For the DS-230 they ask for 2 US addresses: the permanent address in the US where you intend to live and the address where you want your green card mailed.
If you already have a Hawaii address where you intend to live, I think you should provide that for both entries. If all you have now is the Guam address, use that. You CAN change your address later, after you are in the US. DS-156 asks "At what address will you stay in the US"- same advice applies.

I've just gone through a similar consideration. Ok, much less drastic - I didn't move across the Pacific ocean, just 10 miles from one Chicago suburb to another. Still, I had filled out all the Packet3 papers in January when we got our NOA2 using my old address. I've since moved in Feb to my new house, and I've redone all the forms so everything consistently has the new address on it.


Basically, your guidelines should be:
1. Never lie. Both when filling out forms and at the interview, state your true plans and intentions regarding where you intend to live (Hawaii or Guam), and on any subject they ask about. You don't have to volunteer information not asked for, but never, ever, ever misrepresent your situation.
2. Where possible, make all the paperwork consistent. Try to have just one address on all forms. It will remove unnecessary questions in the mind of the interviewer, and lead to fewer explanations necessary by you for why there are different addresses. However there could be a valid reason for different answers. E.g. - if your fiance is currently residing in Guam, but you already know the permanent address you will live in Hawaii, then you could put different answers on I-134 (Guam) and DS-230/156 (Hawaii).
3. If you think that providing Guam address gives you a better chance at qualifying for the support thresholds, consider staying in Guam until past the point of your immigration, and then move elsewhere (e.g. Hawaii) later. Even very shortly later - like a month after you've immigrated. That lets you stay truthful in the process, claim Guam as your fiance's residence, and still satisfy your personal goals to live in Hawaii.

He previously is from Hawaii but since last year, he is staying in Guam. All of the papers when he filed the petition is shows Guam address. How if the papers will show Guam as the address up until i get my visa, enter Hawaii, get married in Hawaii and decided to live in Hawaii and adjust the status in Hawaii having enough income when I adjust my status. My only concern is, his income on the affidavit of support is just enough based on guam's guidelines. I wanted to get my visa first without changing Guam's address to Hawaii, fly to Hawaii and adjust the status in Hawaii based on Hawaii's guidelines this time. If they say, howcome you've never been to Guam when you're fiance filed the petition in Guam? We could say that after getting married in Hawaii, we've decided to live there instead.

K1 visa is a single entry visa right? What happens to those people who is from the mainland with lower poverty guidelines that wanted to celebrate their marriage and honeymoon in Hawaii? How can they fly to mainland considering K1 is a single entry visa?

Hello my felow stucked friends,

My fiance filed my k1 visa petition when he was in Guam so the poverty guidelines he used is based in Guam as well. Today, we have decided to get married in Hawaii and stay there for a year or two instead of Guam. After my medical today, I was instructed the CD of my medical results will be sent to my port of entry.

I remember when I was filling up the forms on my medical three days ago, it asked me whats my petitioner's address in the US, so i put the Guam address. and asked what is my port of entry, I put in Guam.

During the releasing of results earlier, the nurse had me double checked the address for letter correspondence and it has the Guam address. I was hesitant to tell the nurse that we were thinking of living in Hawaii instead. Hawaii's poverty guidelines is way higher than in Guam. Im afraid that it might complicate during my interview because my fiance's income tax shows just enough for 6 persons based on Guam's guidelines not Hawaii.

Can I change the address when I get to the US?

Hey you guys!! I was able to get a hold of an agent without calling the paid Call center service here at our US embassy manila. She said that they got an electronic notice that they just got my case today however, they still dont have the case yet. I really dont get that. It may be something like just on their computer it shows that they got a notice and will still review it. I asked when do i need to call back like next week, and the line got disconnected.

To track DHL packages, I just did a search for 'DHL' on VJ website, there are many discussions about it.

i called USEM call center today and they still dont have it. even if DHL shows that whatever was sent last friday was recieved yesterday. I even asked to talk to the supervisor because I bought an $18 pin just to talk to them. US embassy manila shows that the $18 pin can be used for 3 calls. So i budgeted my calls having the first call to ask wheather they got the forwarded case from NVC, I was planning to have the second call to set an appointment by thursday and the 3rd was supposed to be when i needed to make a follow up on the visa after my interview. I was surprised that the agent told me that the pin is only good for 2 calls. That pissed me off and made me look for a supervisor.

I showed this supervisor where i found the information, and she agreed and apologized. that was a misinformation! i was forced to email a complaint because of this,

Anyway, after NVC forwards the case to the consulate, when is the best time for me to call if they sent it last friday february 13 to set an interview date?

Yes, I saw that too, about it being delivered. The only thing I'm not sure about is whether those are really our cases.
If you scroll back, you'll see that Todd mentioned that I looked for the wrong shipping reference "EXP 12 MAR 2009A" - should look for 13 MAR instead, and it will go out in today (Monday Mar 16) DHL pickup. I'm not sure about that, since in past posts on VJ about DHL, I've seen the instructions to enter the PREVIOUS day reference to the day we were told it was released. That's what I did.
Anyway, either it's there at the embassy, or it will be very shortly.
I wasn't planning to call the embassy. I was just going to wait till my fiancee tells me that she gets Packet3 from them.
I've already sent her everything - I134, tax returns, etc. And she' s already done the medical, police, single status long ago (back in Jan when we got our NOA2).
So I hope we can turn around the Packet3 very quickly, and get our interview scheduled.

so if she had her police certificate and medical a long time ago, does it have expiration date? cuz mine has. My police certificate expired march 16, 2009 so i have to get mines again. I did my DAY 1 medical today. becuase here in the philippines, medical is done like 2-3 days or even longer. However results will expire in a month or 3 months i guess. so you have to pay again if it expires. i wanted to call today and check. will let you know laters. hehe

hey uscan, thanks!! this is so great. i always stalk your timeframe because we have almost the same day when we were stucked @ NVC and luckily left NVC same as well. Im so happy that both of us are out already. You would not belive that i called 5 times today to confirm?? hahahaha. funny. i cant belive it thats why. Guys, thanks for all the support. I will prepare the dcuments already that i will be needing for interview. I have a few case wiht my credit card company because i owe them money here and havent paid for a while so, they im afraid they might hold me if they will file case against me. though i have all the police clearance that I need. i just cant pay them because life here in manila is realy hard. i got layed off from work so that is the reason why i was not able to maintain paying my cards. But i wnt to fix my issue with this card but still dont know how. I;m sure embassy will be able to see pending cases if they will file one against me.

i called again because im not contented with that answer earlier. and she put me on hold for like 5 mins. and when she went back, she told me that review and processing at the NVC is all completed and will be sent to manila in 2-4 weeks. is it really 2-4 weeks? but IM OUT OF AP ALREADY. !! i guess the count for 52 days is true. friday the 13th!!!!

I called today. the representative said my case is out of AP but for some reason it went back. I dont know what they mean by that but as of the moment its out of AP. and there is no time frame for that. what the hell is that!! is that AP part 2?!!!!!! the hell! today is my 52nd day but i thought it will be different. anybody heard that before? or should i call tonight instead before they close?
