K-1 is for fiance(e) only. If you get married, file for CR-1. She'll have to return to her country, but it's your choice: file for K-1 and wait while you are engaged and apart ; file for CR-1 and wait while you are married and apart. Or move to her country to wait it out with her. :)

Seriously I think they only will out your application if you are approved for the expedite. We sent in an expedite request, it was denied but our petition was never 'touched' (according to USCIS website, at least). I really think that if they deny the request, there is no point to pull out your file.

I highly doubt you will get the visa by October. We are so shooting for an October wedding, but we filed in January. Don't book any vendors yet, but contact them! Explain the situation; see if they can accommodate short notices. Do some details for the wedding (ex. I just finished designing our invites and programs (only missing specific details to print them), got my dress, BMs dresses, favors, and other various things)! It makes me feel productive and I don't stress so much about the visa! Not having a solid date sucks, but being able to work on things seems to help me. :) and we are planning a bilingual ceremony so I have to do almost everything in English and then again in Spanish! Whew! Good luck!

Well, I also live in my fiance's country with him and when we go to his interview, we will also be bringing our rental agreement with both of our names, receipts for the rent payment, etc. BUT we also plan on bringing things that show we have a romantic relationship: cards (yes we live together but my fiance and I still give each other cards/letters for holidays and birthdays; I think that's part of being in a relationship!), pictures (we take a lot of pictures so no problem there), receipts from gifts that we bought each other, etc. I think I'm going to have his mom write an affidavit, as well as my parents even though they haven't met him yet, and maybe my sister (who did meet him). We are also planning a trip at the beginning of June (YAY! FINALLY!) so I'm going to keep many things from that as well. I want to show that, yes, we live together but we aren't "roommates" - we are a couple! So think about that, too.

Just have your fiance contact the senator in his state to see if they assist people with immigration petitions/cases. If so, they will probably send your fiance a waiver form or something, then they can be the liason with USCIS and give a call to the office there.

The others ARE correct that you are within the processing times, but if you hit your 5th month mark and you still have not heard anything (RFE or approval), then you can contact your Senator. I emailed mine and his aide sent me an email back asking me to fill out a form (I did this in anticipation and will not send the form until I'm sure that I will need his assistance). They also sent the form to my house. So you can simply call or email him/her.

Although we can't choose a wedding date, I've already been in contact with some of the vendors/venues (our reception will be at my parents' house) and told them our "potential dates" (like an entire two months, ha) and I looked at what dates they have available. When we have an interview date, I'll contact them again with what they have available to pick our wedding date. It's certainly possible to find places that you don't have to book 1 year in advance. I'm really flexible about our date and since my fiancé has 6 months to enter into the US, you can play around a little bit. (it also has helped me to do a lot of prep work for the wedding, as we are having a traditional wedding meaning not at the courthouse, so a lot of it I'm doing myself.)

Try to love the date with the vendors, I think that's your best bet. When I look for wedding things, I always tell them about the visa situation and ask them if it's possible to book with short notice. If they say no, I try to find some place else. It sucks that USCIS misinformed you. Unfortunately you cannot expedite the visa because of this.

I copied everything in black and white at my home copier, even my passport and birth certificate. I was worried we would get an RFE because my birth certificate wasn't a certified copy and I only sent in the bio page of my passport (later in the package I provided passport stamps, but I did not copy every single blank page). We didn't get an RFE but maybe some USCIS workers are more strict. I guess ours didn't seem to mind that I only copied my BC. I guess I was lucky. :P

I don't think it hurts. Our expedite request was denied and we were approved before 5 months. Really hard to prove humanitarian reasons, by the way. But give it a shot :)

seems like a tough situation, ur best way is to get married in albania, file I130 then see if u can get an expedite because of the situation you guys are in. It will take some time, seems like a long time but you have to do this right. You do not want any complications.

Living with someone and dating someone (foreigner OR from your home country - it's true for both situations) are totally and completely different things, IMHO.

Hi VJers,

My mom sent me her I-134 form to be our co-sponsor, along with her tax transcripts, employer letter, etc. (Honduras requires 1040, W2s, employer letter). The thing is that my parents have not filed for their 2011 taxes yet, but they filed an extension. So my mom sent me a copy of the extension application but not any W2s (obviously she does not have the 1040 as she has not filed the taxes). She sent her 2010 information as well (including 1040 and W2s). Do you think the embassy will be picky about not having the W2s? (Honduras people might know better, I know... but just wondering) My mom makes above the poverty limit, I've already checked and double checked. I'm just worried about not having the W2s for 2011. I don't have any either but that's because I'm working overseas, but I do have my 2011 tax information.

I didn't have my boarding passes from my first flight, so I sent in the itinerary. My other two flights I did online check-in so I had E-tickets. Actually the second flight I sent in a copy that I had in my email (not the ones that they initial that you go through) and I had no problems. I also included itineraries of all trips, passport stamps, and copies of any visas.

List both her last names in the surname/last name areas. That is how we did it for my husband on all forms. Sometimes we left 2 spaces between the two last names to make sure they knew the names were separate names, not run together and not hyphenated.

No need to translate the work places and addresses. We needed to use a supplement sheet for some addresses because the Mexican addresses in Spanish would not fit in the space provided on the forms. It was fine for us that way.


Good point... most of the Spanish addresses didn't fit on our petition either (or subsequent forms...) so I handwrite them all really neat!

Follow the example form here on VJ. It's really helpful. I have followed all the example forms here and seems that they are correct because no one has given me problems over them. My guess is that if you aren't working then you wouldn't fill that part in (with N/A instead of listening job title, employer, etc.)

NVC part is super quick and easy. Same thing happened to me. I was calling them many times to see if our petition had been received, than one day when the woman started asking me for our information, I mouthed to my fiance, "It's there! Yay!" and after she took all our info, she gave me the case number. She asked if I needed anything else and I was like, uh uh uh no? Haha ok thanks bye! Considering when you call USCIS it's kind of a drawn out process, NVC is so quick. Now just you have to wait to get your interview date :) :thumbs:

It shouldn't affect the visa eligibility, considering people in the US also get herpes. Just that she needs to get treatment to prevent/shorten breakout times and you can also protect yourself from getting herpes as well by abstaining from sex during any breakout that she has. Be aware that she may also infect you with herpes.

You only need to provide the information for the co-sponsor at the interview because the data is time-sensitive. Your co-sponsor needs to fill out the I-134, provide Proof they are a US citizen (copy of BC), tax return, pay stubs (if necessary), letter of employment. Each consulate had their own requirements. For example, my fiancé is from Honduras so they only require the 1040 and letter of employment and it can be signed within a year of the interview. Some are more strict or require more, so check the consulate's requirements. Remember that even if you have a co-sponsor, you must also fill out a I-134 and provide all docs as well.

It's totally possible. I also live abroad with my fiancé and have for about a year and a half. We filed for the K1 in January. We will go back to the States together as soon as he gets his visa. Just don't make any solid plans to get married at a certain time or date and you will be ok. If you don't have a job in the US, look for a cosponsor.

Ok i have read through your comments and i really appreciate the advice. I am now preparing a letter to send to the consulate. I told him this morning that we are done and i can't continue with him because he doesn't respect me. He said i am accusing him of things i don't know anything about. He also said that i can't end it how, because i already signed with the US Government to petition him. I told him that is not true , i can withdraw the petition and then he started to say why suddenly i am acting this way and all he wants is to be with me. So i asked him what would happen then if i came to Jamaica to live with him, he said jobs are hard to get and i wont make enough money and we wont survive and that i wont have my comfortable living and that it is not good that baby stays in that environment. He started to basically tell me everything that was wrong with Jamaica and why it wont be good for us and we wont be able to make ends meet. I told him i have my savings to start up with and he said that won't do because life is hard and the government take big taxes. What do you guys think? Thank you so much again for helping me through this time.

I think his reaction to you moving there really showed his true colors and true intentions. I think he is only making excuses so that you don't move there, just so he can get his visa to come to the USA. Listen, I moved to my fiance's country with NO job lined up and decided to stay. I also came with my savings (which weren't very much, to be honest) and looked for a job. I found not one, but two, jobs (quit the first one) and even though I make a lot less money than I would in the USA, and I'm not living the same life that I would in the USA, we DO survive. It's totally possible, no matter where you live, to survive on the salaries that the country gives, so sincerely I think he is only giving excuses for you not to come there. I would really careful with him and think hard about what to do in your position. My fiance never asked me to stay in his country, but I knew that being separated was too hard for us so we made it work that way. We have a good life, and we will have a good life in the US... I always think of 'home' and my 'life' being with him, no matter where we are or how much money we make, that our RELATIONSHIP builds our home, not where we live in the world. Think hard and think clearly! Good luck!

PS: We live in a dangerous country with a lot of violence, but that never stopped us from living our life to the fullest while we are -- even though the environment may not be "ideal" in some people's eyes, people DO raise kids and have families in other countries, it's not like people will only have kids if they live in the US or a "safe" place that they think is "ideal." You make a relationship work ANYWHERE!

Lol, seriously... you have some really good luck. Most interviews from Tegus are 3 months or more after the NOA2 date.
Anyway you don't need to bring that much to the interview, I had a ton of stuff and they only asked for the forms, police cert (only takes 1 week to get so ask your fiance to get it now), and the only evidence they ask for is pictures. Anyway you can send stuff to HN through DHL and it gets there in like 2 days.

I made a section in our petition that said "Proof of Relationship and Ongoing Relationship", made a cover page that listed everything in that section in the order that I put it together. I tried to stick to chronological, and mark it like "first trip" "second trip" etc. i put proof of ongoing because we were living together overseas and I wanted to show that type of evidence. Seemed to be fine, we were approved with no RFE and no prob at the interview.

You can file K1 while you are living overseas. We did it while I was living in Honduras with my (then) fiance. There was no problems... I provided evidence in our petition that we were living together in Honduras and proof that i was working there. We did need a co-sponsor though. I even brought proof of domicile in the US to our interview but she only asked if we were flying back together.

Honestly I think that if I was to file all over again, we would get married and file the CR1 only because then you get the GC when you land in the US and with the K1 you have to pay $1000 more for it...
