K-1 Fiance(e) Visa Case Filing and Progress ReportsVermont processing timelines: Very frustrating!

my fiance filed the petition on 23rd august so reading these comments gives me an idea that its going to be around late feb or early march with the xmas break taken into account,a little more time to sell my home i suppose :help:

Hi,what does your receipt number begin with? The first 3 letters? I ask this because far as I know, all files that were sent in after August 15th were transferred to the National Benefits Center & are getting approved in about 3 months. I don't know if it applies to you; you may be luckier than you think.

All the best in the rest of your journey

You are so right.. :clock: In the meantime, everyone should try stay to calm. And to gather all your supported documents together to send to your significant other. If we keep worrying, we going to drive ourselves crazy.

Trying our very best to remain calm & sane. It's definitely taking a toll on me,though. 3 more days to 6 months. I think the only thing keeping me from losing it is having my husband with me. And also LOTS of praying.

IR-1 / CR-1 Spouse Visa Process & ProceduresAbout RFE's...

Well you have already submitted evidence so you will have to wait for your next chance to submit when you send your IV BILL packet in. many add extra evidence then.

As far as what kind of evidence. Why would you want to submit explicit stuff for a stranger to read. That doesn't prove a relationships jst proves you talk dirty. You want to submit a evolution of the relationship timeline from the beginning, the middle, the (marriage) and after. Not wise to submit anything and black out stuff. I am sure you have plenty of chats and emails not with all that. I mean its fine to submit some but well it shouldn't be every conversation.

But an RFE really don't know. If you get an RFE just like the list entails on the I-130 instructions on what could be used you should go back and review. All the chats, emails, Skype and letters are for the CO. The reason why I suggest you adding when you get to the NVC stage is this is the case file that will be in the hands of the CO the one that will do the interview. What would they have to go by that this is a bonafide relationship by what you submitted. You want the best and most decisive evidence in their hands don't you think!

Also you need to be putting some pictures in that packet there needs to be pictures of you two with friends and family. And especially the USC with friends and family. That's a must for anyone interviewing in any Embassy in Africa.

Thanks for the info...Submitting evidence during the NVC stage makes a lot of sense- had not thought of that earlier. We weren't planning on submitting the very personal chats, but we wanted to make sure. There's lots of pictures with my husband and mom/dad/sister/brothers/grandma...We have plenty of Facebook/ E mail chats too...about 300 pages worth. Now to the sifting process...

IR-1 / CR-1 Spouse Visa Process & ProceduresAbout RFE's...
Hello everyone, funny question- we're trying to prepare all our evidence over 2 years just in case we're RFE'd..question is,because some of the Facebook chats are X-Rated,lol, are we supposed to include them or omit just the "bad" parts?

Second question- at the time we filed the I-130,the USCIS website only asked for a certified copy of our marriage certificate- so that's all the marital proof we submitted. What are the chances of being RFE'd?

Why didn't we discover VJ earlier????? :bonk: :bonk:

Thanks all for your advise

IR-1 / CR-1 Spouse Visa Process & ProceduresNewbie....

Hi everyone,

My husband and I are new to this site and have found comfort in knowing we are not alone. We are in the 40+ bracket....yikes!! :/ I'm British and my husband American. We got married in April 2012 and haven't seen eachother since...ugh!!! We filed our I-130 in June and haven't heard anything since.....not sure if that is a good or bad thing, LOL!!

Anyway, wanted to say hi to everyone and am hoping to meet other couples in a similar situation geographically/same timeline. We sure as hell could do with the support!!

God Bless everyone!!

Welcome to VJ :) My husband and I filed in July so we're pretty close by...lol
You're still in the approval time-frame...between 3-5 months if I'm not wrong. We're also crossing our fingers and waiting

All the best to us all!

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit of Support form CR1/IR1
Hey y'all! So my husband is a USC who is a full time student on financial aid, therefore we shall be needing a joint sponsor for the I-864.

My cousin in Texas has agreed to be our joint sponsor...my question is, when calculating household size we'll count 3, right? (Her, her husband & myself) Am I right?

Another question, can she combine her income with her husband's for the income requirements?

Thanks for your responses in advance.

IR-1 / CR-1 Spouse Visa Process & ProceduresPhoto evidence
Any photos will work provided they have the two of you in them- I have some taken with my husband at a Christmas party at our office last year. Make sure that they're dated though.

My camera doesn't show dates when photos are taken but when I slide the mouse over the photo it gives an indication of the date. The more photos, the better.

IR-1 / CR-1 Spouse Visa Process & ProceduresPetitoner with a criminal record - is this grounds for denial?

Hi everyone i was hoping someone might be able to help me with some information on whether the visa will be denied or not.

i am the us citizen and my fiance (from australia) plan to get married next year and apply for the spousal visa. what we are worried about is that the spousal visa will be denied because of my criminal past.

I have two felony charges from 10 years ago of possesion of drugs (just small for personal use, wasnt charge with distrubtion or intending too) and also one domestic assault charge for pushing my ex into a wall. I am not proud of that but want to fully detail my record in order to see if anyone is able to help and let us know if this will be denied. Then a few years after that I was pulled over and becuse I had a gun in my car, I was charged with felon in possesion of a weapon and was given 7 years.

My fiance is fully aware of my record (we actually originally met on a prison pen pal website) however will my record cause our visa to be denied even though her record is completley clean with the except of a speeding ticket?

If someone could offer some advice not judgement it would be very much appreciated

Hi,

The background check is mainly on your fiance/ wife, not you. That's why there are people who even file petitions while in prison.

As for the income requirements, please check this link with the updated 2012 Federal Poverty Guidelines http://www.masslegal...delines-article

To calcuate the household size count yourself, your spouse and whoever else lives in your household. Hope this helps.

IR-1 / CR-1 Spouse Visa Process & ProceduresI have a question

i send a birth certificate of beneficiary when i filled the I-130 because she had a name change, so if in case i send the original one to USCIS, do we get it back at the interview stage.

If you can get the copy certified, then you're better off than sending just a plain copy. The officers at the USCIS need to know for sure that it's a true copy of the original.

All the best on your visa journey!!

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 awaiting Decision

Hello again, VJ!!

This is where I currently am at:

USCIS National Goal - 5.0 Month(s)
USCIS National Average - 7.9 Month(s)
Vermont Service Center - 5.0 Month(s)

With the end of November just one month away, should I contact NVC to ask about a time frame?
Or should I wait until the Vermont Service Center's 5 months are up before calling?
Or would calling in this situation even help?

Thanks!

We called the USCIS recently, they told us the usual "You are still within processing time"...so we have to wait until Dec 16th (exactly 5 months) and if by then we're not approved, then we'll send an e-request. But calling the USCIS before the 5 months are up is basically pointless.
It also depends on which service centre your petition is sent to- like you, we're at Vermont which is well known to drag its feet when it comes to approving petitions. Oh well!!!
As someone said, the NVC does not know anything about your case until your approval. Hang in there, I feel you!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresPaying someone to do cr-1 visa for me?

So I was wondering has anyone here ever used a company to do their cr-1 visa for them? I am feeling extremely overwhelmed with the whole process...I probably won't end up paying someone though.. What are your guys opinions on this?

Hi, this is a totally personal decision for you to make. Most people on VJ have filed their own petitions & followed through the entire process with the support of the VJ community.

My husband & I filed the CR1 for ourselves but after approval an attorney is doing the rest for us. However, we're still completely aware of what is required & we're in touch with the entire process. For personal reasons we just decided it was worth it to get an experienced attorney to handle the rest of the process (especially the NVC stage/ contacting our joint sponsor e.t.c). Meanwhile we're compiling all our evidence in preparation for the interview part.
All the best in your visa journey!!!

K-1 Fiance(e) Visa Process & ProceduresHow to file for K1 when my fiance is in jail?
I don't have any immigration-related advise to give you but I can offer my moral support- I think it's admirable for you to be in the relationship for the long-haul & to want to go through the entire process of paperwork in your current situation.

It's very unfair that some people on VJ are judgmental and self-righteous
Love conquers everything; that's one thing people have to understand. And just like Jesus said "Let him that is without sin be the first to throw a stone".

Take heart, make sure you do a double-checklist of what is required and all should work out.

This is good info. Thanks dwheels76. I will see if I can get tier 2 on the phone.

Anyone else have first-hand experience getting status updates from a live person?

My hubby and I had the same problem calling the USCIS- so we went online and found a trick. When you call the number, don't press anything at all until it goes through to a Spanish-speaking operator. Then after they're done introducing themselves, say "English Please" then you'll be transferred to another operator. It sounds silly but it works. :hehe:

Try it!

Hi, I feel your pain. My husband & I wet through all that.

Here's the attorney helping us out after our approval;she's pretty affordable & you can negotiate the fee: Gardner & Mendoza Attorneys
