Police certificate is needed from all countries you lived in after age of 16. I believe that the way to get it from another country is to go to that country's embassy at least that is where I would start.

I filed for CR1 and that's what we would like him to have but @ a month later I put in an I129f just in case CR1's were going slow... not sure if that makes a difference either


If you pursue the I-129F route, then he would have to interview in Morocco since that is where the marriage took place. If you pursue I-130 or CR1 visa then you should contact the embassy (either by phone or email) and see if he meets residency requirements to interview at the Spanish embassy. It will be ultimately up to them if he can interview there.

If you are planning on doing a K-3 visa then you have to go through an interview in the country where the marriage took place, unless it was in the US. If you are doing CR1 then I believe some embassies will let you interview at the country of residence, but chech with the local embassy to make sure. Good luck

K-3 Does not cost anything. As long as you file I-130 and pay the fee, when you file the I-129F the fee is waived. As far as timing, K-3 might be a few months faster than IR-1. And with K-3 you do have more paperwork when she comes to US because you have to file for adjustment of status. With IR-1 she enters with a green card, so there is less paperwork.

Here is what you have to do if your fiancee wants to travel to US to marry you without her child. Once you get married in US you can file I-485 and you have to file I-131 for her to travel outside US prior to her I-485 approval. As long as she comes back to Russia within one year she can get a K-2 issued for the child and travel back to US. That is the trick K-2 visa can only be issued within one year of K-1 issuance. You can call or email NVC and give them your new address, just make sure to put case# in the subject line.

Yes you can get married while you are in US, however it would be better to come back to your country and do the K-3 or CR1 visa process, otherwise you might be faced with misrepresantation.

Your husband will get a chance to change his name when he is going through naturalization process (getting his US citizenship). They will ask him at the interview if he would like to change his name and if he does they do it for him through a judge.

They only require the most recent years tax return. Best to have the last 3 years tho. Probably will need such when she adjust status when she gets to the US.
Tax transcripts are the best. I just got the last 3 years from IRS and it only took about 6 days via snail mail. Call 1-800 829- 1040 24/7. If you're in a hurry they will also fax them to you.


I have been visiting the Kiev embassy about once a week for the last month. What they want for the financial support docs is I-134, 2007 tax return and 2007 W-2. If you have any questions about Kiev embassy ask away since I am staying here with my wife and her interview will be Sep 2nd.

Guys the rule is if you claim them on the tax returns you put them on I-134. Alimony, no alimony, child support does not matter if these adults live together or money tranfers hands.
