IR-1 / CR-1 Spouse Visa Process & ProceduresWant to make sure im ready this right
So basically that information is outdated?

...Why don't they update their site then? And to clarify I am filing for a CR-1 Visa, but was just reading the website and it said that I COULD file for a k-3 in the meantime, while the CR-1 processes.

IR-1 / CR-1 Spouse Visa Process & ProceduresWant to make sure im ready this right
Hello, I am in the final steps of preparing to file for my husband for a CR-1 Visa. I was on the UCIS website and saw this tidbit:

To be eligible for a K-3 nonimmigrant visa, an individual must:

Be married to a U.S. citizen
Have a pending Form I-130, Petition for Alien Relative, filed by the U.S. citizen spouse on his or her behalf

http://www.uscis.gov...000082ca60aRCRD

This means that once I file for the I-130 , I can file for a k-3 for my husband so he could work here while the immigration process was going through? Just want to make sure I didn't miss anything.

It's not that big of a deal if you have other proof. Most recently married couples dont. Plus it's Canada. Lol. People have been approved by submitting no more than the marriage certificate. Not that it's recommended to do that but I wouldn't stress about the lease.

Ah okay, thank you so much!

I was stressing because they suggest all this "hard" proof, and Im like FFS, we just got married D:.

I don't own a car or have life insurance :(. I am going to talk to my landlord again tomorrow, to see if I can't explain the situation to him more.

Eek sorry one more question! As it pertain to proof-- my landlord is giving me a hard time about adding my husbands name to the lease as he doesnt have any US tax information yet. Should I try to assemble more proof since it looks like I wont be able to show his name on the lease?

Thanks so much again.

So for the lived together I should put N/A?

Also, my husband is moving soon (in about 1.5 months). I am filing within the week however, and he does not know where he will be moving so I am listing his current address. Is there a way to update his address in the middle of this, so that he receives the proper forms? * I could list his parents address as the mail would definitely get to him then, but he doesn't live there anymore.

Okay, thank you! In regards to living together then, we haven't had a time period, unless I list when he was here for 4 months here last year. (Though he was for all intents and purposes in the USA until he had to go back or until he found employment). Should I just say N/A? We're both young (23) , so we haven't had the luxury of living with each other for extended periods of time, particularly because I'm in graduate school.

On that note: Should I list Im in grad school somewhere? It explains why our trips have been so short.

IR-1 / CR-1 Spouse Visa Process & ProceduresProof + few other questions
Hi there! I have a few questions:

1.) When listing the dates of employment on a separate piece of paper, should I type out the month, ie: may 2010, or 05/2010?

2.) Also on the I-130 form, where it asks for employment # 15 that is MY employment correct?

3.) When listing last date live together (I-130) #21, should I list the last time we were together or does it have to be for a substantial duration? I ask because I just went to see my husband a few weeks ago, but I could only stay for a week because of university. Prior to that we were together for a month in which we got married, and the longest we've ever lived together was for 3 months last year.

4.) Proof: I plan to submit a credit card that is a joint account, a lease on my apartment in which his name is on it. We've only been married since January, so that's as far as hard proof goes for the items recommended. We have been in a relationship for 5 years however, and I was going to submit photos, phone bills, airplane stubs etc. Is this sufficient, or should I try to dig up more stuff?

Thank you!

IR-1 / CR-1 Spouse Visa Process & ProceduresHow should I file my taxes?

So uh question. I got Married in Jan of last year, so according to everything here I should put: Married, filing separately?

I make peanuts anyway from the odd job. All my taxes are done by an accountant, but he told me it doesnt matter what I put because I get no income help from my husband, and because my husbands not here yet.

My interviewer told me I was basically approved pending sending them another records check since they didn't like the one I had with me. She said it should only take 1-2 weeks and once they had it in their office it would go forward a snothing had happened. She asked me to mail both the check + passport.

No, but I only checked my status at the end of the day. On my end, passport arrived at loomis branch, being shipped out tomorrow to my husband's address (he lives  5 hours out from it lol)

Thank you! I am really hoping you're right :D

Thanks for the encouragement. I really do appreciate it :D

My fiance will be flying from Pearson too so I am glad you posted this. We figured 3 hours to be a reasonable amount of time, but I will tell him he might want to make it 4 hours! He doesn't like to be rushed either. I don't know which airline yet, because we obviously can't book the flight yet.

Congrats on your arrival to the U.S!! I am just impatiently waiting for it to be our turn.

Question: Do you guys think I should send the Consulate an email? Do you think it would make a difference? I know both of you did and your statuses changed to Ready just a few days later. My fiance says to just wait, but I will do it if you think it helped! We really want him to come around July 28th which will approach pretty fast. Its only been 2 weeks, but I am getting nervous!

I don't think the email made a difference, but you can never be sure how they work.

Thanks for the waybill info, my visa changed to issued (you should receive in 5 business days thursday). Still no waybill yet, so I guess I'll get it today.

I am the only one left waiting out of our little group now. Next week is a full week (NO HOLIDAYS!) so I am hopeful! :D They have only physically had our paperwork for a little over a week, but they have been awesome with taking care of business so that makes me happy!

You'll get it next week!

I kind of feel like they picked up speed since last week hahaha.

(weird under the blurb for issue it still says the AP jargon but I assuming that means they are printing it and all that stuff). So uh, how does Loomis get in touch with my husband now? It says

Passport Delivery Information

If your visa is approved, the Consular Section will send your passport to the Loomis branch you selected at the time of booking your appointment (shown above). Log in to your account to retrieve your waybill number."

But I am logged in. Anyone know? ( I should go ask in the Canada forum I guess!)

Actually the status goes Ready-AP-Issued so for us it will go AP-Ready-AP-Issued....confusing but thats how it works LOL. Its just me and you now Sashy! We can do this. Good news for us soon too! :D

This probably means they officially logged that they received it :). Congrats to k1 applicant!

Interesting bc it means theyre sort of going out of order, bc they received mine on the 17th and yours on the 19th. 3 weeks post interview for me, but hopefully i hear something by the first week of july.

I'm escaping technology for the weekend. I'm going to go to the cottage where I can't connect for a few days (I'm sure we're the only crazy people in the world that wish weekend would hurry up and are mad at weeks with 2 holidays!!)

This forum was talking about a 202 number that you can call to try to get some info on your case. I tried to call today and they said it is no longer assigned. Has anyone heard any more about that?

That's all I have for now. I'll stay in touch!

202 would be DC... I haven't heard anything like that. And yes I hate weekends truthfully now but in some ways its okay, bc it means I cant check the CEAC website...

Maybe I should limit myself to once per day too, its really brutal.

Me too. I'm hoping 8 weeks is a worst case scenario- NVC was telling people 2months to process their emails, but it always took 24 business days.

But fi they say 8 weeks then at least I have an "end of" timeline. I really wish the officer i had would just do mine out of order, she was so sweet and insisted it wouldnt be too long and it wouldnt out of the ordinary (because I nearly cried in front of her).

I also wish they had the option to notify you when theyre done, like USCIS does via text. Part of the worst part of this process is checking my status everyday and seeing "AP". I die a little each day.

Well I just got a disheartening email.

'Thank you for sending us the requested documents.

We acknowledged receipt of the documents on June 19th, 2014 which have been added to your application for further consular review. However we regret to inform you that the U.S. Consulate General in Montreal is currently experiencing a huge volume of return mail to process. We are doing our best to process the incoming mail as fast as possible. Please expect up to an eight week processing time before you will be contacted with further information.

Meanwhile, you are welcome to regularly visit https://ceac.state.gov/CEAC/ if you wish to verify the status of your case online.

We hope this information is helpful in guiding you in the processing of your immigrant visa application.'

Does this mean even with a ready status I shouldn't be expecting anything more for a while. If anyone's had a similar experience please share.

Sounds to me like someone jumped the gun with your "ready" status. Usually ready just means it takes them a week to finalize everything and stamp it out and stuff (this is what happens if everything is good to go at interview). 8 Weeks really.... well at least they got back to you. I emailed them friday and stil haven't heard back.

Waivers (I-601 and I-212) and Administrative Processes (221g)AP - Canada

Abby and Andre-- I was missing my fiances 2013 tax return (I should have been on this forum sooner to realize it was still required even though on the documentation outline for the affidavit of support only listed a letter from his employer since he is employed though an international company).

Sashy-- I can empathize with you frustration. If my family was kept apart for over a year I would be beside myself. It is only the two of us and unfortunately I'm one of those people who has been denied travel to the USA while this visa is being processed, so 5 months apart has been a tough enough experience. I can't even image how hard it would be being apart for a year.

I can't understand how they decide to go about processing peoples applications, there seems to be a k1 out there who submitted at the same time as us and still haven't received a 2nd notice. The best I can offer is I will keep you in my thoughts/prayers for a speedy acceptance!

Thank you, it really helps.

My tone came off overly frustrated because were both really done with waiting-- and because ours was just for a police certificate, its not even that we didnt have one, they just didnt like the fact that it was done online. Everything else met the requirements for the documents, and the only reason I only had an online one was bc HRM told me it would take them MONTHS to produce a physical one! My husband has moved since then and his current town had no problems producing a normal offline one for us.

Also bc they've had both the cert + his passport since the 10th and no word :|.

Not to put a damper on you, but I have been waiting since LAST April. I find it kind of insulting that fiancee visas are going that much faster :/. I just emailed the consulate asking for confirmation of receive +  a status update.

Thank you guys for responding, it makes me feel hopeful! I am an IR/CR visa so I might be issued a little faster than you (Ive heard family/marriage visas take priority) but I will update you all when I learn things. Hopeful for all of us, because it all seems like such little issues.

Im really sour about mine because NVC said it was okay and because my cert said it was conducted by the Halifax RPM, and it says it checked the national canadian database. So it fits all the critiera but because it was done online they didnt like it :|. Oh well, come on montreal <3.

Hi Sashy

Can you keep me posted. Similar thing happened to me last week so I'm hoping my visa will be approved faster than the 6-8 week timeline. My status is still AP but was last updated today which I'm hopeful means someone at least touched my case today.

Will keep my fingers crossed for a speedy approval.

Yes, please keep me updated as well! The officer told me only 1-2 weeks/not that much of time once they receive it.  I will let you know! It wasnt touched today, but Im hoping the touches were 1.) received the package and 2.) assigning it to someone
