Another question...

I'm trying to do my Canadian taxes now. I read up on the form that Texanadian referred to (thanks for posting that btw-it was VERY helpful!) I see how I am suppose to prorate for the federal form (base amount) and did that with no problem. But I can't find the number to prorate for the provincial (Ontario). I see where it says it needs to be prorated and that the same rules as the federal apply, but it also says that the number for prorating may be different. Where do I find that?

Thank you again for being so kind to help all of us out. I have asked a couple of questions and gotten your answers. I have also looked through the other threads and tried to find other answers to my questions. It seems the more I read, the more confused I get. So, I want to put it the way I am interpreting it. Can you tell me if I'm on the right track?

brief summary of situation...
~dh is cnd, I am US citizen-both moved from Canada to US on May 31, 2008.
~He still received 9 checks (1 per week for 9 weeks) after we moved (it was a deal he made with his company in return for him doing a 'voluntary' layoff)-they were directly deposited into his Canadian bank account
~He received a check for his RRSP a couple months after we moved
~He started working here in the US in September 2008


My understanding...
~We file a leaving Canada form (what exactly is that? Is it in with the general forms? Is it completely separate?)
~We put May 31 as the date we left, but we still include all the money from the remaining 9 checks he received even after he left
~We fill in his Canadian income for 2008 on our US forms, but then file a 2555 for the foreign tax credit
~We fill out form 8891 for the RRSP that dh got (it was a very small amount)
~We can fill out the info for Canada on a program but have to print it off and send it all in to the international tax place


Ok, so here are the remaining questions...
1-Can I file turbo tax in the US? Or do I need to do it on the paper forms?
2-For the rrsp, we got 2 things for taxes--one notes a contribution amount and the period covered as Mar-Dec 08. What is this for? And why is it for a time period that we aren't even in Canada? The other is an NR4 and shows the gross income and the NR tax withheld. Where does this go? On the 8891?
3-Which form exactly are we suppose to be filling out for the US taxes?

I'm so confused huh.gif

I am a USC who was living with my husband (a Canadian citizen) in Canada. We moved to the US in June 2008 when he got his permanent residency. He began working in the US in August. So, I think I'm understanding that he has to file with Canada (first? or does it matter) and then file with the US, with proof that he filed in Canada? Or am I getting that all wrong? I keep reading about filing world income to the US, using his Canadian income. I don't understand.

Also, I don't work so does he file married, filing single and then I just don't file? Or does he file married filing jointly and then I just report $0 earnings? We have 3 kids if that makes a difference.

I have been asking around and reading the IRS forms, but nothing is clear to me. Then I remembered what a great resource VJ was and thought I'd ask the 'pros' wink.gif Thanks for the help!

Ours was GM too. We had to call the headquarters (as others have suggested) to get the compliance letter. It took a couple of weeks to get. When I called the dealership where we lived, they said they couldn't do it and we needed to call headquarters. So, I wouldn't chance using the letter you got from them.

Please forgive me if I'm asking a question that has already been asked. I've tried to read through some of the posts, but I don't understand EI in the first place, since dh is the Canadian, I the American.

So, in short, here is our story:

Dh just got his IR1 (by DCF) approved. We are debating rather to find a job then move or move then look for a job. Would he be eligible for EI and how do we go about it? And what is the best way to go, move first or find a job first? I'm gathering that it's before a job is found. Sorry if these are dumb questions, I'm totally lost with this! blush.gif

Oh and if it applies to us, how much is is and how soon does one receive it?

I guess the main problem I am having is that I was told to file an IR-1 but can't seem to find that form anywhere! When I click on the IR-1 package information, it pulls up the I-130. I was/am just confused as to why I can't find the IR-1 and how the I-130 is related to it. I have read through the guides, but it still isn't clear to me.

And I know where the nearest consulate is. I just wasn't sure if I could file there or if I had to do it in Montreal. But I see that only the interview is in Montreal.

Here's our situation...

I am a US citizen. I married my husband (a Canadian) 5 years ago and we moved to Canada. I became a permanent resident. We are now wanting to move back to the US to be closer to my family.

We thought we'd try to get a workplace to sponsor him, but from what I've been reading, that could be difficult. I didn't think there was any other way, as I don't work so wouldn't be able to sponsor him. But I've since found out that I can have a joint sponsor. So, now we're looking into what we would have to do. I was on another board and they directed me here.

Our main thing is that he needs to be able to work as soon as we get to the US. So, here are some of my questions...

1-With the IR-1-can we file all of that from here in Canada? Can we wait here until he gets his SSN so that he can then apply and find a job BEFORE we move?

2-Some have mentioned the DCF. What exactly is this and where can I read more about it?

3-Is there a 'kit' that I can send for with all the forms I need? I am having a hard time finding the forms and even knowing which ones we need to file.

4-I make NO money at all. Even with that, I can have a joint sponsor, right? And it can be anyone? Would they have to be at the interview in Montreal, or is that just my husband who would have to go?

5-How long does the process usually take from start to finish when going the IR-1 route?

Whew! I think that's it for now. I'm sure I'll have more questions though. Thank you for ANY information you can give me! I went through the Immigration process 5 years ago when I moved and it was so stressful then. I'm finding those same feelings as I wade through all the information this time as well :wacko:

*eta* What is the I-130. I keep reading about it and seeing it. Is it just another form in the whole process or does it go along with the IR-1 or what?

I will be sponsoring my husband but since I don't work, I will be needing a joint sponsor. It will either be my mom or my sister and her husband. Well, her husband had a few questions before he would commit. I totally understand and wanted to find the information out for him.

1-If the immigrant got hurt and couldn't work, how does that affect the sponsor? I told my sister it wouldn't affect them, because it would just be the immigrant's responsibility to figure out how to support himself. Is that right? Isn't it just agreeing that they won't go on welfare?

2-He also wanted to know if the sponsor wasn't able to work for some reason, would it affect the immigrant.

3-Does it show up on a credit report for the sponsor that they are in fact sponsoring someone? My sister and her husband are planning on building a house soon and don't want it to affect their chances at getting a loan for it. I totally understand but had no idea about that, so I need to find out.

If noone knows, can someone direct me somewhere where I may be able to find the answers?

My husband is a Canadian citizen. I am a US Citizen, and a permanent resident of Canada. We are filing for his IR-1 Visa with DCF. I have a couple of questions...

We sent of for our husband's long form of his birth certificate. I called to ask if I could send in the packet without the long form. The lady checked and said yes, that I would just need it for the interview in Montreal since with the I-130, all they are trying to do is prove bonafide marriage. Does this sound right? Will this be ok if I don't send it in with the packet? I would still send in his short form and then have the long for for the I-130 interview.

It also says to have copies of birth certificates of all kids. One of our kids is only 7 weeks old and we haven't received the bc yet. Again, she said it was ok. Sound right? I figured I could just send in a letter stating why we don't have his bc yet.

Also, I've gotten conflicting information about this, but on the G325A, at the bottom, it says 'This form is submitted in connection with an application for: __Naturalization ___Status as Permanent Resident ___Other. I check Status as PR but then was told by several people to check 'other' and put 'IR-1 Visa'. So, I redid ALL 8 pages. Now I'm reading that it should be 'Status as PR'. What did you all check??

I just have a couple of questions in response to your answers. For applying for the SSN (or checking the box yes), that's what I had heard (about people not getting theirs) so I wasn't sure how to answer. Will it delay him getting one if we answer a certain way or will it not really matter? If we check yes and still have to apply, will that take longer since we should have already gotten one?

On the shortcuts, it asks for the case number (sorry, I should have put that in the first post.) But I won't get that until after my interview in Toronto, right? So, do I have to wait for that day (will I get it that day) or wait until they send me something? Speaking of that, what exactly happens that day? They approve the I-130 application I know, then what? Do they give you stuff then to fill out or is that sent? How does that work?

And that list you posted in the other thread has everything I will need to send back with the DS-230? So, if I send that back before the paperwork gets to me (but after I know they've sent it-how will I know it's been sent btw?) then I'm ok to send what's on that list?

Thanks trailmix! Yeah, I just wanted to make sure I was understanding the whole passport/report of birth thing. I thought I did when we had talked about it and then I read somewhere that they needed their passport to move to the U.S. But it could have been that the person just simply omitted saying the report of birth, not purposely. Thank you for clarifying, once again wink.gif

This form is really getting to me! LOL Maybe you can help me with a couple of other questions I have (and sorry if these are so elementary). I am trying to get things started ahead of time and because I'm not actually to that place in the process yet, I may be misunderstanding a few things.

On the actual DS-230 form:

1-#11, asks for address for PR card to be sent to if different than address in #10. I put my mom's address in #10 and I guess I would use that for the PR card? If so, do I leave it blank or put N/A?

2-Kinda the same with #14. It asks for address of spouse if different that that of applicant. Do I leave it blank or put N/A?

3-#33a "Do you want the SS Administration to assign you an SSN (and issue a card?" Do I answer yes or no?

4-#33b Consent to Disclosure - do I answer yes or no?

5-#34 "Were you assisted in completing this application?" It's for my husband but I filled it out. Do I answer yes and put wife, or do I answer no?


6-For the list of things to send in with the DS-230, am I right that they all have to be original forms? They can't be copies like what was sent in with the I-130? Or can they be photocopies of the original?

7-How soon can I sent in all of this (the whole DS-230 package)? Do I have to wait until I receive the package from them?

8-Is it ok that I downloaded the form and filled it out or should I be filling out the form that they send me?

9-I was reading the shortcuts from James. When can I do this? Do I get that number that I need after my I-130 interview? Can I do it then? And how much time does it save? If I didn't use the shortcut, how much longer would I have to wait to send it in?

Man, I think that's all. You all can't even begin to imagine (well, maybe you can) how much you have helped. I have had SOOOOOO many questions and all VJers have been so extremely helpful. I was just telling my husband today that I have no idea what I would have done had I not found this site. I have found out so many things that I don't think I would have found out as early as I did, thus losing us precious time in this whole process.

If we file for a consular report of birth abroad, that will be enough to move them to the US right? We don't have to get passports for them....or do we?? Is it advisable to just get the report of birth or is there some reason to get both?

Another question....

It asks for all the places he has lived since he was 16. He can remember the places, but not the actual months/years. He moved a lot a lot a lot when he was younger. So, are they super picky about this or if he gets a month or year wrong, will it be ok? I don't even know if they try to check that stuff but I don't want to do anything that will mess us up.

This may be a dumb question, but when it says all those immigrating with the person, does that include me and our children? I am a US citizen, so that wouldn't include me, right? And what about our kids (who were born in Canada, but will be recognized as US as well). I just didn't know if 'immigrating' was being used in the literal sense or if it just meant moving with him.

Ok, so about 18-19 years ago (yes, looonggg ago) my husband (intending immigrant) had some charges brought up against him. He was aquitted (sp?) of several (things like fighting and such). But he was convicted of 2. One was issuing death threats (he said he would shove a beer bottle up someone's 'you know'...they considered that a death threat). He got 1 year probation for that. The other was that he ripped a public sign off a fence or something. He was convicted but was told if he paid for the sign, it would be let go. So, I'm not even sure if that will show up or not.

We just got his fingerprints done and sent them off to have the criminal check done.

When the record comes back, will it be sealed or can we see what's on it? We have to get court records for those convictions and he's not sure of the dates or places and I figure they will be on that report. He's also not sure of that one and know that will be there too.

As far as court records, are they just for the convictions or does he need Certificate of Aquital (sp?) too?

And will it be a problem with that one threat? When I called the court to get the records from them, she acted surprised that he wasn't applying for a pardon. Should he have? Or will it be ok since it was so long ago (he was around 18 at the time)?

Does the driver's license have to be current? I do have an old one with that address, but it was from years ago.

When will I need to show all of this stuff? At the interview in Montreal? And do I just show the bank statements? How many? Also, can they say 'In care of' and then my mom's name? Or do they have to be in only my name? Just wondering because my mom's postmaster sometimes doesn't deliver things there if he knows the person doesn't live there.

Another thing, for the birth certificate for the joint sponsor, when will we have to show that? My mom just informed me that she only has the card version so we're going to have to order hers and it's saying 6-8 weeks. Just wanted to know when we will need to actually present that.

As far as proving domicile...I had read over that stuff on that link, but am still uncertain what I need to have to prove it. Do they want to see copies of bank statements with the address on it or what? And is all they are looking for is just my name with the U.S. address? Or do they want to see account activity or things like that? And do they need to see them over a period of time or just a recent one?

I guess I will have my address changed at the U.S. bank I have and with the student loan place I have. Will that be enough for them? What have others done?

Thank you for that link (good information!) and for the info.

In that link, it says if you were not required to file a tax return, you can just state that and send a copy of the instructions from the IRS publication that says you were not required. Are you saying that I still have to file?? Since I made $0, I am not required by the IRS. Am I by Immigration?

Domicile-How do I go about establishing that and what do I need to take (or send in) that shows that? I used to live in the place my mom lives now (she moved in when I moved out), so I had been getting my mail there still. But over the years, and after her sending things back all the time, they have stopped sending/delivering stuff there. So, what do I do to establish domicile? I have a bank account down there but the statement comes to me. If I get the address changed, there is a chance it wouldn't even get delivered. What do I do????

I haven't earned any money since 2003. I know I'm not required to file but had read on here that a lot of people were, just to be able to show Immigration that they did file and that their income was in fact 0.

So, I decided to just file 2006. But after I send it, it dawned on me that I filed 'single' wacko.gif So, I called today to find out how to change that. The guy was so rude and kept saying 'this is rediculous, you don't have to even file, you've created your own problem.' Anyway, FINALLY he put me on hold to find out what I should do about filing single. But somehow it started me back at the beginning and I was back in line to talk to someone. GRRR! I waited some more and finally hung up because I was so frustrated.

So, my question...can I just tell Immigration that I was not required to file because I didn't make anything? Or should I get it straight with IRS and take my tax return to show them in Montreal?

I wish now I would have just not filed at all. This is just a mess!

For those who told Immigration they were not required to file, did you get a letter from IRS stating that? Or did they just take your word for it?

Carla-I have searched and searched about Moral Turpitude and can't seem to find a for sure answer. I just don't know what to do. It's so frustrating. We haven't been able to find out if those crimes are considered MT or not. huh.gif And do you know how I get a copy of the police report?

blue-Do you have any idea how I would go about finding a lawyer that would be able to help us figure this out? I don't even know where to start.

If we did have to file a waiver, do we fill it out and take it with us to the interview? I have been trying to read about it, and that's what I concluded. Am I totally wrong? Is there anything else we have to do?

And does anyone know what I fill in on the DS230 where it asks if he has committed crimes of MT? We don't know if it's considered that so how do we answer that? Or how do we find out? And if it is considered that, will they not even look past our packet 3 if he checks yes to MT?

This is what dh got from our local police station. We are still waiting for the fingerprint version. But from this, does it look as though he'll need a waiver? And what exactly is the process? Is there a link to it? I haven't had much time to look around in this forum to find anything. Someone from one of the other forums directed me over here.
