Once you're familiar with the process then bookmark that EZ guide b/c you'll be going back to it countless times to check on things!!

The second process after I-130 approval is the NVC. You can't file adjustment of status since you don't actually have status in the states (ie you don't live there).

Good luck! This whole process will take you about 9 months, but you're lucky b/c you'll at least be able to visit her (on VWP) and she will be able to come to you.

Although it's not a requirement anymore, include a copy of the beneficiary's birth certificate also. Some field offices are sending out RFEs and/or NOIDs for it, so it's a good idea to include it in the packet from the beginning.

The only reason to get a second joint sponsor is if the first joint sponsor's income does not meet guidelines. If your father meets it then there's no reason to get another joint sponsor.

As far as sending in W2s I don't have those b/c any employment I had was overseas and they obviously don't give W2s which is why I need to get transcripts.

Ok how about this. I file as Head of Household, IRS will process my return but will request my son's missing SSN before they send out any checks. HOWEVER, I'll still be able to request transcripts for AOS packet. Once I reach the states in August I'll get the SSN and send it to IRS and they'll close out my case.

Btw I had a look at getting an ITIN for my husband and yea, that's not happening. How am I going to get all the paperwork certified and stamped? Definitely not going through that process. This visa process is enough, tyvm.

Not ITIN, my son's SSN will take 6 months. If I had that then I could file as Head of Household, no questions asked. But I don't know if I even have 3 months for the ITIN. I don't want to get caught waiting for tax transcripts when it's time to submit AOS packet.

To everyone else: I don't really see why I would get in trouble for filing as single when I could get a better return if I was filing under any other status. Who's going to punish me for NOT taking tax breaks that I might be entitled to? The fact of the matter is that I've tried all the different filing statuses and my return is the same exact thing each time. Not only that, but I will amend everything to Head of Household status once I move back home and am able to get my son's SSN in a timely manner. Won't make a difference in the numbers thought. My return will stay the same.

KDH if I file for ITIN with 2012 return can I do efile for 2012 and then paper file for 2010 and 2011? If I'm going to have to paper file all three years I might as well start working on 2012 so that I can send them all at once!

Just to clarify, I'm the USC, he is the beneficiary. I have not filed taxes since moving overseas because I never made above the threshold, he is the bread winner. I am now filing back taxes for 2010 and 2011 for the visa process and AOS. My best option is to file Single and the only thing that worries me is if it could be used against us in the visa process.

So I know there have been so many threads about this topic but I have a specific question that I haven't seen answered yet. Basically I don't have the time to get an ITIN for my husband and also have the added problem that my son (a USC) does not have a SSN. I've looked into applying for one but it will take minimum six months processing time since we live overseas. :angry: So here are the filing statuses and my reasons for not choosing them:

Married filing jointly: Don't want to file taxes with husband's income
Married filing separately: No time to file for ITIN number
Head of Household: My son (USC) doesn't have a SSN, need it in order to claim him as dependent and qualify as HOH
Single: Perfect! Don't need any identifying numbers for anyone

My only concern is this: If I file as single on my tax returns will NVC and/or the consular officer take that as reason to deny the visa? I will file amended returns when I actually move back to the states this August but I need to file these now so that there is enough time to get them processed and so I can then request transcripts for the I-864. Also, no matter what status I choose my return is the same, so I'm not getting more or less money either way.

If I were in your situation I wouldn't wait to file and I would get a co-sponsor. The financial support won't come into question until halfway through the process so you'll have time to establish employment. I'd get the co-sponsor just in case the Consular Officer doesn't think you've been working long enough and rejects your affidavit of support.

They use a letter from your employer as well as pay stubs and sometimes they request bank statement to see the direct deposit of salary, but that's not a requirement, the first two are.

First a clarification: Service Center does not equal field office. So your case was first sent to the California Service Center since it has jurisdiction over your area but then it was transferred to NBC to help with work load. NBC might then transfer your case to the local field office that has jurisdiction over your area. Someone living in Virginia would have had their case first sent to the Vermont Service Center and then transferred to NBC and then maybe transferred to the Washington field office.

1. No, you won't hear from them unless you get an RFE or when you're approved, are you checking your case status online? http://www.uscis.gov/portal/site/uscis input your case number in the top left, you'll be able to track you case that way. Also, you can make an account and set it up to receive email and/or text notifications whenever there is an update to your case.

2. That's not something we can answer, no one knows why cases are transferred to field office since some cases are approved at NBC and some at the field office.

3. Go here: https://egov.uscis.g....office_type=LO and input your zip code at the bottom, that will give you your field office. That is where your case will go if NBC transfers it to a field office.

4. Were not really sure about average time b/c it depends on if you're transferred to a field office and each office has different processing times that are not published.

5. It should show NBC although NBC only just started accepting cases on Aug 15 so I wouldn't count on the information on your timeline, and you also have to factor in the chance that you might get transferred to a field office. But you're not being processed by CSC so you're skewing their data by listing yourself as CSC. ;)

Ok you've asked a lot of questions and it's kind of jumbled so I'm going to do my best to answer, sorry if it's not clear:

Where do you live now? You mention that you're getting married in Bahrain and that your fiance will be moving back to the Philippines, but what about you? If you're in the states now you shouldn't have any problem with domicile since you'll only be going to the Philippines to wait for the visa, you're not actually moving there to stay. My advice would be to have someone in the states that can get your mail though so that you can ensure receipt. Make sure on all forms that you list your residence in the states when it asks for your address. Take a look at the I-864 and you'll see where it asks what country you reside in, you'll answer USA b/c that's your residence. Same with your father. I'm not sure about this but I don't think domicile matters for the joint sponsor, only for the primary sponsor (you). Domicile does not necessarily mean physically present, it means the place of residence, the place you call home.

You won't be able to file with the embassy in Manila since you have to be a legal resident there for 6 months. Not visiting for 6 months, have a residence there.

If you didn't make any money in 2011 then you don't have to file taxes, but you'll have to include a statement about why you didn't file taxes when it's time to submit the Affidavit of Support. It also helps to include a copy of the IRS publication for that year that states filing thresholds, which you can find on the IRS website.

You said that you guys communicate through text and Skype and that you can't bring that in. But you can. All you need to do is print out your call long on Skype and also there are ways that you can back up your texts from your mobile to your computer and then print them out. If you use whatsapp you can do that too. It'll be pages and pages of stuff but it's evidence.

Also, 4 pictures are not nearly enough. You haven't given us a timeline of your relationship so I'm not sure how many pics you have, but you mention him coming to visit you 4 times. You need to print pics from your wedding as well as two or three pics every year after that if you have them in different times and places. 40 pictures during the same outing will count less than 20 pics at different places and times throughout your relationship, clearly showing that your looks (hair/makeup/clothes) are different. You don't have to print pics normally, you can put them on paper and print them from your home printer. Or send them to him to print.

What about financial co-mingling? I know that's hard to get when you're in two different countries, and the CO knows that, but some people here have been able to put their spouses on saving accounts and other types of financials. Even adding him to your car insurance would help.

I hope that gives you some ideas for more evidence of your relationship. As for evidence of his identity I'm sorry I can't help you there, you'll have to research and try to figure out how you can prove his identity; I'm sure there are ways! A consult with the lawyer Darnell mentioned would def be a plus regarding this!

You shouldn't have any problems since you don't work as long as your father makes enough to support his dependents as well as your husband. Read the instructions for the I-864.

You have to have a job that will support your and your husband for 125% above the poverty line, or you need to get a joint sponsor that is able to support him in addition to their own family. Read the Affidavit of Support instructions, form I-864, on the uscis website for more details.

Ok according to your original post you're describing that your husband has a job and makes enough to meet the poverty guideline but you're getting a co-sponsor b/c the tax return don't reflect that? If this is true, then you don't need a co-sponsor. It's current income that matters, not past income. If your husband has been working for a good amount of time at his job and his annual salary meets the guidelines then you don't need your father in law to co-sponsor.

You can change your address on the uscis website once you've set up an account, change it to an address in the states, your parents or someone you can trust who will take care of your mail. On the I-130 did you put your address in South Africa? If so, you'll have to make sure that when you get to NVC they send all the paperwork to the consulate in Amman instead of South Africa, otherwise he'll have to have the South African embassy fwd his papers to Jordan or he'll have to go to South Africa for the interview!
