K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary 2011 Filers!!!

I'm doing exactly the same thing Eve and our stories are very similar. I talked to my boss about getting a leave of absence so I can still work when I get back for the appointments but they can't do that so I'll be quitting mid April and am giving up my apartment for April 1st and moving to mom's (when I'm not in Japan or the US) until the big move. Mark is working overseas and luckily I don't need a visa if I stay 90 days or less, so I'll stay until we get news from VSC - now my worry is that he will be in Japan when our RFE and or NOA2 comes and we will be delayed. Always something to worry about during this process it seems. Good luck with everything and have a wonderful visit (I'm visiting my honey in 3 weeks too!!!).

Now to do a bit more reading about the process of RFE and NOA2 and what happens when the petitioner is out of country, although we will be on a US Navy base so it's kind of American soil - he's a civilian too, Navy contractor.

Does anyone know how long you have to provide the info after you get an RFE? If anyone has links or info on this please post or send them to me. Thx :luv:

Your plans sound so exciting, being able to stay together in Japan!! Yea, apart from you going to Japan and me to the US, our stories are very similar  Hmm, about the possible RFE and the /certain/ NOA2, won't you be able to see all that online through opening an account on uscis website? I mean, the NOA2 will just wait for you until you get home (I think the beneficiary has 4 months to complete the Visa process after the US Consulate has received the package from NVC), so the only thing you should try to find info on is the RFE. Could you maybe have someone going over to pick up the mail and water the plants and whatnot back in the US? And if there was something there they could just fax it over to you or scan it and email it. Naturally you will not get any RFE's so no need to worry :luv:

Im so excited about going over to visit, and maybe I will just see how it goes at the POE now and work from there. It'll be so much easier to talk about these decisions together face to face anyways :-) Our plan is to do a little apartment hunting in D.C. while we're there, sooo exciting!!! Ive spent some time googleing for apartments in NW D.C. today and I feel like a slacker with the work piling up. oh well, it's Friday now and tons of time to Skype the next 2 days! (L)

Good luck to everyone! I see a lot of diverse filers here x] which is awesome, any Swedes? I see Finland 8D I went there last summer with Johan, it's a beautiful country and last year was the record high in summer temperatures lol even a Maynard like me was sweating. *cough straying off topic* anyways I hope things go well for everyone. I'm prepared for the wait though. The good thing about VJ is it prepares you for both the worst and best based on the posts from everyone. I sent my petition out this past Friday. I just got my acceptance confirmation e-mail today that it was forwarded to VSC. :]

hi there and Welcome!!! that's funny that you guys visited Finland last summer, because me too I took Josh to Stockholm just last summer when he was visiting for two weeks - luckily that was before we got hit by that massive heat wave :-) Did you guys do the whole ferry experience or did you fly over?
Ive been to Maine a couple of times and it is absolutely gorgeous there! Anyway good luck with your Journey!!

I don't know much about countries where a visa is required to travel to/from the United States, however I do know of many people who were in VWP countries who have managed to come visit without too much of a problem. Finland, from what this site shows, is a VWP country, so unless you have some other thing excluding you from using the VWP program, that's probably better than actually trying for a visa. My first time through the process (back some four years ago for my ex-husband), he managed to come over to visit just fine on VWP over Christmas through Chicago without any troubles.

The best thing to do is to have a return ticket, have all your evidence of ties to your country, and be honest. Never misrepresent yourself. Have documents showing you have a job and when you're expected to return, lease/property information, and anything else to show that you're likely to return. At the POE, don't get nervous or flustered. If they ask questions, just answer honestly and have information to prove this is just a visit. Getting denied at POE would suck, but it isn't the end of the world.

Alternately, could the U.S. side of your relationship come to visit Finland instead? That's what Kata and I plan on doing if I'm able to get time off of work. I'm hoping to come visit him in London for a week or so, just to break up the long waiting period.

Yes, by tourist visa I meant the VWP - I wasnt sure if everyone here knew the program so I used the term tourist visa instead (sorry..). the VWP allows you to go and visit for the maximum length of 90 days during which you cannot work, get married, the usual stuff. Im sorry if I didnt explain myself very well :-( I am actually flying over to visit in three weeks (YEEEY!!!!) for a vacation, and I don't have any concerns about going through the POE for my visit. The thing is that we have talked about me going over for the three months that I can stay on the VWP to wait for NOA2 with him in the US. then I would just fly back here to go to the interview and get my K1 Visa before flying back over on the K1 to get married. In that case, I would give up my job and apartment before having the K1, therefore wouldn't have those documents proving that I have ties back in Finland. Which is true, I wouldnt really have any ties, other than my will to do things the legal and the right way (Josh works for the Air Force (as a civilian though) so it is extremely important to do everything by the book). He can't really take a 3-month vacation from his work to come here to wait it out with me, so that option is excluded... I dont know, Im just going through whatever options there are to make the insanely long wait a little more doable... We planned on my moving over late this spring (which would've been the timeline if they got the approval out in 5 months tops and we hadnt had the problem with the petition fee) and I have sorta kinda given an unofficial notice at work already  I have so many projects going on right now that a month's notice would just leave all my dear co-workers in a lot of trouble, so Ive promised to give them a heads-up as much beforehand as possible. My immediate boss knows what's going on and has been EXTREMELY supportive, giving me time off when Ive asked, and I thinks she deserves this.
Anyway, thank you for your advice!!! (F) Eve

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary 2011 Filers!!!
welcome to all our new January filers and good luck with your journey!!

Our little story can be read on my profile - it differs from all your awesome and incredibly romantic stories mostly in that we have known each other since we were 16 years old (we are both 31 now, as much as 3 hrs apart in age in fact which I think is pretty cool  ). Life works in mysterious ways (L)

Have any of you considered going over to be with your significant other on a tourist visa before getting your K1? We are contemplating this option since it looks like it will take as long as 5-6 months, if not more, to get the approval. The consulate here (along with everything else in Finland) will be closed for the whole month of July if not more, which would postpone my process here by another month again. My concern with this is that I've heard that they can actually deny entry at the POE if they in any way think that you might try to stay in the country illegally on your tourist visa. And that it is completely up to the person questioning you whether they believe you in that you are committed to doing things the legal and the right way. If they are suspicious they can just send your hiny back on the next flight over, at your own cost. Obviously I would quit my job here and give up my apartment etc before flying over and I'd just stay at friends and my parents when coming back to get the Visa, so the only proof of actually coming back to Finland would be my return ticket - which Im not sure I should even book in advance in case we by some miracle happen to get our NOA2 earlier than estimated. so many things here to consider....

anyway, me too I want to say that I truly enjoy the positive and supportive atmosphere in our group and it's so wnderful to be making new friends! Best of luck to you all!!!

Yeah... I know how that is. When we first sent the package and I noticed the wrong fee I thought we would have to wait more than a month to send it again... , I was on vacations from work... I had such a hard time just getting out of bed that day. Hubby to be was my rock and told me it was all worth waiting for and that we had each other no matter what. I had to learn the hard way to trust that everything would be OK. Im just hopping I'm able to keep it up... cuz I tend to lose patience xD ! but so far so good!

I did get the online status thingylingy, but we had a "special attention" sheet cuz of the rejection. I am not sure if that helped though.

We are here for you... we are walking together, so no worries... if you obsess we'll help ya! :P

we had the same problem as you guys, wrong fee because it changed just a day or two before we mailed it (and no, it did not cross our minds to double check the fees online :( ). We as well had the special attention sheet and I think that's why we eventually got our NOA1 so quickly. But, what aggravated me the most was that every sheet in our application had a stamp saying DEcember 1st on it, but it took them over a month after that to mail it back to us and inform us about this. I wish they could've just done it right then and there when they noticed our mistake... But, after the initial shock, tears and rage I have calmed down, somewhat...
Patience is not my middle name either - I actually think Worrier should be my first :D
Good luck to you!

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary 2011 Filers!!!

When you log in (using an account) and you've got your case number showing, there is a date to the right of your case number that says 'Last Updated (mm/dd/yyyy)'. It will show you the last date that your case was accessed (ie. your last 'touch' date). It will change when your case has been 'Touched'.

thanks so much! I thought for some reason that was possible with the receipt number, but I guess all you can check for is NOA1 and NOA2. I don't know if we even have our NOA1 hardcopy yet as my fiancé's been on travel for work ever since early January and might not be flying back home until the end of newt week.. But since they take so long to send the hardcopies I should fine right? And have the correct NOA1 date taken from the uscis website with the receipt number? Thanks again - you are such a HUGE help  (L)

Hey guys!

This might be stupid question, but Im wondering how you know that your petition has been "touched"? is there something specific on the USCIS website if someone's fiddled our paperwork? I keep manically checking our petition reference number on the website to see if anything's changed and I should STOP.... thanks! -Eve (F)

We were sent to VSC :crying:

And so it begins...

You guys sent them the wrong fee as well? Im so sorry to hear that :-( But congrats on getting your email, Im happy for you guys!
Im wondering, why are you upset over having your petition sent to Vermont? Ours got sent to VSC too and based on what Ive read here Vermont shouldn't be any slower than CSC? It seems to me that any little thing makes me worry so much more

A NOA1 in two days? Now that's fast...We are hoping to get it in the next couple days!

It is "only" the NOA1 email, not the hardcopy. But, I imagine this is the official NOA1 date as that's what it says also on the USCIS website when I check our status with the receipt number. Or maybe Im wrong?
They had gone through our petition December 1st 2010 (we had stamps dated December 1st on each piece of paper in the package) and said they would push it to the front of the line to be mailed to Vermont as soon as they would get the correct fee.

Hey y'all! Me too I'm a January 2011 filer!! Well, we were supposed to be November or December 2010 filers, but had bad luck with the change in the petition fee which magically changed without prior notice a day before we mailed it. Sooooooo got it back in the mail January 7th, refiled with correct fee January 8th and got NOA1 January 10th.

Good luck everyone!

K-1 Fiance(e) Visa Case Filing and Progress ReportsAbandoning the K-1

We're going to just stick it out with the K-1 process. I don't know if I was MISINFORMED when I called USCIS, but... it's sounding like that was the case (or maybe I misunderstood what I was told--this is all fairly complicated). We got really good advice from the vast majority of posters (when we really needed it) and that is greatly appreciated. It's also been encouraging to see the posts from those who've been approved recently.. again, thank you..

Mycka, your fiancé could also fly over to the US to wait it out with you if you think that would be easier for you guys than waiting until the summer when you can fly over to visit him. However, as a heads-up, he needs to have proof of strong ties to his home country if he gets questioned by airport security.
I'm glad you decided to stick with the K1, it'll be faster than switching visa petitions at this point.

IR-1 / CR-1 Spouse Visa Process & ProceduresJust a clarification about translations

The only documents that need a translation are the ones not in English or in the official language of the country. In your case, the only translation you will need is for the document that is written in French. Any person who is proficient in both languages can do the translation and certify it with the statement below. So if you understand both languages, meaning French and the language you will be translating it into, then you can certify it yourself.

Translator’s Certification

I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

Hey Diana - thank you SO MUCH for this! It will definitely make things so much easier if I won't need an official, authorized translation :-)

they do not require translations, so why send them in? It is just a waste of money.

My understanding is that any document that is not in English or in the language of the country where the Visa is applied, needs to be translated?

Yeah, very true - the problem in Finland is that they don't do certified translations unless the target or the source language is one of the two official languages in Finland (Finnish and Swedish)... :-(
Eve&JoshFemaleFinland2011-01-19 09:56:00
IR-1 / CR-1 Spouse Visa Process & ProceduresJust a clarification about translations
Hey all!
do you guys know, if the translations need to be done by an "official" translator? I need to have a police certificate translated into English (certificate is from France hence in French), and as I have studied French and lived in France for a while I should be proficient enough to do it - at least in my own opinion :D - however not a certified translator, will it be enough if I translate it myself? *wow what a long sentence, sorry!*

The transcript itself is empty since I don't have a criminal record in France, but still the few phrases need to be translated I guess... Can I just add on the translation sheet a statement saying that I am competent to translate and the translation is accurate, sign it and date it and it will be good enough?

thank you so much for your help!! And good luck with your journeys!!

K-1 Fiance(e) Visa Process & ProceduresNOA2 approved but Fiancee with me in the USA on holiday
Unless there are specific and completely different instructions for her Consulate in Thailand, she will be fine. The same thing happened to me (I'm the beneficiary and my future husband the USC), we got our NOA2 the week before my flight over to spend 2 months here in the US with him, thinking that it would take longer and that we would wait it out together.
I had my mother scan packet3 and email the scans to me just so I would be able to prepare for the interview while Im here, and I also emailed the consulate in Helsinki and told them about my situation.
If she gets her medical done while she's here in the US with you, make sure you go to a physician authorized to fill out the appropriate form (I forget the number, sorry :-( ).

Im sure they can give you advice at the Consulate if you email them

Good luck - and congrats on getting your NOA2 so soon!!

Kiitos kiitos. Oikeesti tosi kiva ja kaytannollinen saitti ja mukavan tuntuista sakkia. We're getting married here in Helsinki, mainly due to my mom's need to meddle, but also because K-3 seemed like a good visa option for us. I still have graduate from college this spring before I can go, so it seems like the timing of getting everything organized would work out sweet (fingers crossed). I'm both excited and terrified! Excited 'cos I can't wait to start my life with my love and scared 'cos you know the visa process seems really grueling. I guess that's all normal.

Hei to all Fellow Scandahuvians!

This site and especially you guyses posts have already proved very useful and we hope to share our fun times with visa process here and get and offer advice and support. If anyone's situated in the Puget Sound area, let me know, as that's where my future hubby lives.

IR-1 / CR-1 Spouse Visa Process & ProceduresPassport at the embassy
Hi you guys!

So I have a question:

Does anyone know how long they can take issuing the visa after the interview?

I've had my passport stuck at the embassy for 14 days now, and they keep telling me that the consul is too busy to issue the visa and that the visa is not done yet.

The actual visa interview went fine, except that it seemed like the guy wasn't that interested, he didn't want any additional papers, or to see any evidence I brought. He just asked me a bunch of mundane questions and that was it.

Thoughts, guesses, insights would be mightily appreciated. helpsmilie.gif

Even if your loved one isn't in an country having some instability and military action, or anything, you still sometimes worry about the awful things that might happen to them. It's so heart-breaking to even think about, that I can't begin to comprehend what it might feel like. So cmnb I'm pretty sure everyone would be nothing but happy if you guys got expedited processing.

Rajaa, don't loose hope, who knows, maybe there's someone picking up your petition right now, going over it, stamping it and putting that NOA2 in the mail. yes.gif yes.gif yes.gif

All Right this is what I have been thinking about since that touch on 21st and this recent approval of a may fellow filer:

Nightsurf's NOA1 dates to May 8th and Snorkies' May 10th ----- both CR1 filers at CSC. Their petition was sent in the last week of April and first week of May. Considering these dates and taking some help from my Imagination, could it be possible that the CSC has actually started working on May filers and our time will come soon too?

I totally think they have started processing us guys! star_smile.gif I was freaking out because you know, no touches, no nothing, and just as I'd noticed that Nightsurf had gotten theirs and gone "maybe that means something", we got ours. The dates the petitions were filed are just too close for it to be a co-incidence. So let's watch those who are next in line and hope for the very best good.gif.
Oh and hope the NVC is feeling productive smile.gif

We're one of you guyses as well (that is so not grammatical!). Got our NOA1 on May 8th. I haven't gotten around to figuring out how to post our timeline on my signature yet. Will do.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling taxes for 2008 jointly?
helpsmilie.gif Hey ya'll! I'm wondering if anyone can help us this busy tax season.
I entered the U.S in early February and thought that since tax year is over my husband will pay his taxes as per usual and I have already paid mine back home and nowhere where we informed that we'd need to file jointly...UNTILL MY HUBBY STARTED TO DO HIS TAXES! So my questions is: how on earth do we do this? Thoughts, comments, ideas, encouragement? helpsmilie.gif
