K-1 Fiance(e) Visa Process & ProceduresPhotocopies of K-1 package
Kk, so the copy of the package is just for safekeeping in case it gets lost? I am the beneficiary and my girlfriend is the applicant, and we are both in Canada right now so we put the package together ourselves.

Am I actually supposed to take an exact copy?? I have a lot of the ####### kicking around here but we sent an original document of my being on the honor roll at the university in her home town. I could amass a ton of continued evidence of our relationship, but reproducing the exact package we sent off woild be a stressful and unsure process.

So do I need it exactly?

I've read a bunch of people saying "make sure to get copies of everything you send away for your K-1" but the problem is that I didn't do this? What are they referring to? What would be in that package that is relevant to me after sending it away?

K-1 Fiance(e) Visa Process & ProceduresI-134, affadavit of support and co-sponsor questions

I'm preparing for my interview, when the time comes, and was wondering a few things about the Affadavit of Support.

#1 - My fiance's mother (my fiance is the U.S. Citizen) is going to be a co-sponsor or joint-sponsor or whatever. What do I do in this case? Do I just have her fill out an entire seperate I-134? What evidence should I collect from her? Is there some way to establish or represent that she is, in fact, a co-sponsor?

#2 - My fiance is currently jobless, as she's been with me in my country for some time. She is, however, looking for jobs and I am pretty well certain she's going to find one pretty quick. What do I do in this case though, because she doesn't really have an annual income, and won't even after she gets the job, inasmuch as she will only have a few paystubs. Do I take these with me? Should I multiply it out to predict what her annual income will be?

#3 - I thought that I read somewhere that I can co-sponsor myself as well. Everyone says my savings and financial standings have no bearing on the process, but I've read otherwise. Can anyone help me with this?

BTW, we received our NOA2 a week ago, just to let you know how far long we are into this.

Edit* We are going to live at her mom's house, so I think that factors in as well, seeing as not having to pay rent constitutes "income" from what I've read.

K-1 Fiance(e) Visa Process & ProceduresCompiling financial information for the interview

My girlfriend, who is the petitioner, is trying to get all of the information we need. She is getting her mother to co-sponsor, and so she tried to get the letter from her mother's employer outlining her mother's state of employment, wage, etc. Her mother brought back a letter, both signed and dated, but it's not in full sentences. It's just a piece of the company's paper (with a letterhead/logo) that says the mothers name, social security number, date of hire, position, and salary.

Does this thing have to be in full sentences or can it just be a sheet of the basic information the government asks for? Same with the letter from a bank officer - Can that just be a bank statement or does it have to be a full, written letter from a person?

I got my information here:

http://www.uscis.gov.../i-134instr.pdf

I also have her mom's last tax return and stuff too.

K-1 Fiance(e) Visa Process & ProceduresMORE help with I-134

Okay, so my Girlfriend's mom is going to be our co-sponsor (my girlfriend is the petitioner), because my girlfriend is basically just getting a job now, and we are already approved. We have everything we need from my girlfriend's mom, but I'm wondering about my girlfriend filling out the I-134. She's got an interview monday, and she's essentially assured to get the job, so what should I do? I'm with her right now, and am leaving right away, but should she wait to fill out her I-134, or should she just fill it out now, and she can later send me some cheque stubs to verify that she did, in fact, just get a job. She hardly has an "annual income" yet, inasmuch as she will not have worked for a year at the time of our interview. What should I do? Should I get her to fill out the I-134 now? Should I wait until she's been working for a while and then fill it in accordingly?

GoldfingerNot TellingCanada2013-08-09 17:59:00
K-1 Fiance(e) Visa Process & ProceduresMy fiance just got a job: Should she fill out affadavit of support now or wait?

You could go either way, since she is using a co-sponsor, but I would personally wait until she can show at least 2 or 3 months of working her new job. I think her being able to list her current annual income on the I-134 will help the CO's decision. Also, you do not have to put 0 for everything on the form. If you are not using assets, then you do not need to list them and can leave those blank.

Kay, so we should wait two or three months? The thing is that we are going through the vancouver consulate, which is apparently a pretty speedy operation if what I've read is true. I was hoping moreso we could just wait until she got a couple or three paystubs and go with that. I mean, I figure with a co-sponsor making more than enough, and her with a job, all should be well?

Also, her mom covers her room and board, which I believe counts as an asset on that form, does it not?

I updated my timeline as well. Sorry everyone.

K-1 Fiance(e) Visa Process & ProceduresMy fiance just got a job: Should she fill out affadavit of support now or wait?

Just as simple as it sounds. We've been approved, she's the petitioner, her mom is going to co-sponsor me, and has filled out her I-134, and my girlfriend just got a job. Should she fill out the I-134 now with basically "0" for every field, or should she just wait until she has a couple of paychecks and some cash in the bank? Either way, she'll be able to give me some cheque-stubs to go to the interview with, to show we are not wholly dependent on the co-sponsor.

What should I do?

K-1 Fiance(e) Visa Process & ProceduresQuestions about I-134, Affadavit of Support

Hey, my Fiance and I are in the final phases before I interview (I am the benificiary, she is the petitioner), and I have a few questions about the affadavit of support form.

1.) I think her mom, who is acting as a cosponsor, screwed up the form a little bit. Can I use whiteout on that form to correct it, or should I just have her send an entirely different form?

2.) In the financial section of that form, she wrote in the value of her car, but I didn't get any proof of her car's value. Will that be an issue?

3.) Under my marital status, she wrote "SIngle/Engaged." Will that "single" line cause any problems?

Also, can I phone my consulate about these questions as well?

Also also, my girlfriend just got a job, and doesn't really have an annual income. What the hell do I do regarding her filling out that form? Does she just leave all the financial info blank? She can send me some paystubs and a letter from her employer.

Also, on the bottom of page 2 it looks like there are mutliple places for a signature? ####### is this the most confusing form ever!?

K-1 Fiance(e) Visa Process & ProceduresI-134 by fax?

My fiance and I are queuing up the documents she needs to send to me, and I realized: Can she fax me documents? In specific, could she fax me the following items?

- Tax Returns

- Signed Letter of Intent to Marry

- Phone Records

- Paystubs and Banks Statements

- Signed I-134

I ask because apparently the Vancouver consulate schedules interviews pretty quickly after you send in your Packet 3, and so I'm a little nervous to send out my checklist before the documents are in my hand. Moreover, faxing would save a lot of money compared to overnighting the documents. Also, it gives a larger margin for error.

Thanks in advance. *wipes sweat off of forehead*.

K-1 Fiance(e) Visa Process & ProceduresIs my financial support evidence good enough?

Kay, so I have a sponsor and a co-sponsor: My fiancee and her mother. Her mother makes the most so she is kind of the bigger sponsor, as my fiancee only recently got a job at wal-mart.

For her mother, I have her tax return from last year, a whole network of recent pay-stubs, a letter from her employer outlining her wage, nature of her employment, etc. If I need to I can get bank statements showing the amount deposited for the year.

For my fiance, she just got her job recently, so she has no previous tax returns really. I can bring along a few recent paystubs, a letter from her employer, and a copy of her schedule which outlines her hours for the next while. She basically works 30-35 hours a week.

How does that sound? Sorry I'm just really nervous about getting this stuff done and out of the way.

K-1 Fiance(e) Visa Process & ProceduresFreaked out about answer on DS-230 that I gave...

I submitted my DS-230 recently, and I'm kind of freaking out about an answer I put on it.

It was under the "List times you have visited the U.S." section. Honestly, this is a horrible question for me, inasmuch as I have relatives (aunt and uncle) in the United States, and so my family has gone ever since I was an actual baby. I am now 27, and recounting each yearly excursion is simply outside of my scope.

I phoned a lady at the National Visa Center to ask her about this, and she merely said "Just list any major visits you've made. They aren't talking about week long or two-week long excursions, but for months at a time." I, then, did that. I listed when I first visited my Fiance for three months, and then when I went to school in my fiance's hometown for four months.

However, I forgot that before I was on my student exchange, I spent about a month and a half there (if even.) I have a stamp in my passport as to when I entered, but no exit date. Will this be a problem? I'm not trying to commit some perjury, but just followed what the lady at the NVC told me.

is this worth concerning myself over?

Waivers (I-601 and I-212) and Administrative Processes (221g)Is there any hope for 221 (g)
From other posts I've read on this site, it seems to me that your issues are compounded. You're last and only visit was 1.5 years ago, there is no photographic evidence of marriage......the record looks iffy to someone who is charged to look for potential fraud. There are some very knowledgable folks here who will likely have good advice on what you might do. But any way these things can be changed (another visit, etc) seems like the place to start.

IR-1 / CR-1 Spouse Visa Process & ProceduresChance of wife traveling to the US after filing
What would be one's advice regarding this: my wife owns her apartment in the Republic of Georgia and does not need to work (and therefore does not). Her passport is Russian. Since there is no lease, and no letter from an employer possible, how difficult does this make establishing her case that she will return to Georgia if she were to visit here? I know any answer is speculative, but I'm wondering if anyone has had an experience with similar circumstances. So far I've just decided its not worth the risk of being turned away.

I believe accurate information is vital as well. So help me out here. I'm not seeing what you are seeing.

At the top of the page from this link: http://photos.state....nstr-iv-eng.pdf

Is the following statement :

"After you’ve been contacted by the National Visa Center (NVC) or post with an interview date, you will bring all the following documents to the Consular Section of the U.S. Embassy in Tbilisi on the day of your interview (emphasis mine). Please read this notice thoroughly. Failure to prepare properly for the visa interview will result in a delay in processing your case."

Then, listed below this statement is a series numbers (these being the "following documents" referenced in the paragraph above) enumerating what to bring: I'll copy the two I'm referencing.

5. POLICE RECORDS FROM A FOREIGN COUNTRY: A translated and notarized Police Record from a foreign country for applicants age 16 or over, including maiden names and former married names, if the applicant is currently living in that country for more than six months, or if the applicant has previously lived in that country for more than one year, or if requested at the time of interview. For further information, please read the Police Certificates title of the U.S. Department of State’s Bureau of Consular Affairs web page.

8. TRANSLATIONS: Certified English translations must accompany all documents that are not in English. Translations must be certified by a competent translator and sworn before a Notary Public. All certificates must be less than 12 months old when presented on the interview date.

Yes, I meant the NVC process. What you quoted was USCIS language regarding documents submitted with the petition, not NVC.

What I quoted was language directly from the embassy directions for what the visa applicant must bring with them to the day of the interview at the embassy. The link I provided explicitly states this.

It's fine, I really appreciate the help. Time to move on to the next item of business.

Can you provide a link to where you are reading this. I'm thinking it's out of context. That sounds like the exact instructions for filing an I-130, not submitting documents to NVC ....AFTER...the petition is approved.

Those are actually not the applicable instructions but you DO need the translation. Here's where to find the applicable instructions. http://georgia.usemb.../iv-family.html which are... Please, note that the beneficiary will also be required to present a police certificate, with English language translation, from every country (except the U.S.) where the beneficiary has resided for more than six months since the age of 16. The certificate must be issued under all names ever used by the beneficiary.

I am aware of the police certificate requirements, and we will be providing from all countries (just two in our case).

This is the website address for the embassy instructions for interview requirements: http://photos.state....nstr-iv-eng.pdf

It's a link from this page: http://georgia.usemb...rant-visas.html

The NVC may not require as many have said. But if I'm reading this correctly, I'll still have to get everything translated and notarized for the embassy.

Furthermore, from the embassy instructions:

I've been through that before while in Georgia. They look at me like I'm crazy when I ask them to I include the statement about the translation being accurate and the translator competent. The response I get is- you're paying to have it notarized to that effect, why the statement too? I ask to be humored. We all roll our eyes about rep tape. .

Certified, not notarized. Don't pay a notary. Just have the person translating write out the certification.

I'm going with the word used in the embassy specific directions for the translation of the police certificate, which is notarized. That's in addition to the translator's certification. This one I'm not making up or confusing with something else I read. I've got it in front of me.

Ok, I got it. And yes, I've looked at all these documents, but not recently. In my lame excuse of a reason for the confusion, Ive just been working too many hours lately. Thanks for the replies. My wife tells me she could get an apostille or have them notarized. She believes notarization is not enough. As I read the state dept info, it remains less than a closed case argument for her.

Being not exactly young and having made plenty of mistakes to learn from, I think it wise to have her do what makes her feel more secure. I ask because I don't want her to spend this money for the apostilles if a notarization or official seal on the original document is enough. But that may be a secondary concern at this point.
