Hi Everyone, I am a bit quicker off the mark this time round and have managed to update you the same day.

Today Wednesday 8th Sept 2010 the I-601 Waiver Status PDF File was Updated

It has been 16 days since the last update and 13 days before that one, but this time it has been worth waiting for as they have given us a bunper update today, maybe all the adjudicators are back off holiday now and are concentrating on trying to catch up with the backlog from their vacations in August?

So anyway the highlights of todays update are:

2 UK based cases were added to the "Pending" pile this time around!!

7 cases have changed status to Under Review from Pending

This was an overdue update but considering their was 16 new changes made on this update I think we should forgive them.

The current USCIS average completed cases per week figure is back up from 1.2 to 1.3 this update.

Andrew--just wanted to point out that newly filed K3s are effectively dead, since early February. USCIS will approve them, but they are administratively closed at the NVC and the file turns into a CR1 visa.

Hello dear readers :P

Can anybody give a link or hint at I-212 processing times?

I have a wife to be in California and I'm Scottish. The main reason you're reading this is I was caught with a copy of my CV/Resume' at O'Hare in Nov 2008 and frog marched back onto a plane not to return for 5years . It was my 8th trip to see my Fiance. I had non refundable return tickets and not the slightest chance of earning money even if i'm qualified for H-1B speciality jobs that take 2 years to arrange. :(

I've completed the 2nd stage of "US security" ....passed my 15 minute($300+) medical exams that i travelled 1000 miles for. Then attended the interview (another 1000 miles)that was arranged after they legally recieved but lost my papers many months earlier, I got mucked around at the interview for 8 hours then 21 days later got told by mail I needed a 2 page I-212form instead of the I-601 form I was given at the embassy.

I promptly hired the company that comes up first when you google search "longest k-1 visa specialist in the usa". They are based in San Diego a few streets from where my Fiance lives, but that was based on a complicated I-601 form and they have added nothing to our case for the money they were paid :(

If the English speaking nations of both our nations could have sent a simple ackowledgement letter for the $545 fee and priceless info like 5 stacked inches of dated letters and envelopes to "prove relationship" amongst smaller things like passports and birth certicates, I wouldn't worry so much. The way the London US embassy has been so sloppy and unprofessional so far makes me expect they have lost everything.

Its been 3months since I sent everything away by 24hr embassy approved courier.......nothing. No cheap letter of acknowledgement, no taking the $545 fee or answer to 3 official attorney enquirys. Can anybody give advice? My attorney only commits to the statement of "things don't move as quick as we wish they would"

Has anybody got London I-212 Advice/Stories to share?

I don't suppose the immigration lawyers you used was a company called Holmes & Lolly were they? if so we used the same company to start with and what a waste of space they ended up being, lots of promises up front to get your money, then they got us to do all the work and after the K1 Visa failed and we had to proceed with a I-601 Hardship Waiver they told us that this was $3000 more and they could get it done by another lawyer that specialises in doing I-601's... We promptly fired them and decided to look for a better lawyer who advised us to go down the K3 visa route and then submit an I-601 as our case would be stronger and more likely to get approved, which it did.. but we wasted a year of our life listening to our first lawyers, we should have gone the K3 route from the start as it is quicker than a K1 and prove extreme hardship.

Extreme hardship is a lot harder to prove when the US Citizen id just your fiancee, if she was to come over to Scotland and marry you, you could then file a K3 and have a far better chance on getting approve due to you having a wife, maybe step children and a mother-in-law and father-in-law...

Just some food for thought..

As for I-212's i think they can take the same as an I-601 as they are adjudicated by the same team in the London US Embassy.

Hi Everyone, apologies for the delay of this update I have become a bit slack since being approved.. but I will continue.

Yesterday Monday 23rd August 2010 the I-601 Waiver Status PDF File was Updated

It has been 13 days since the last update and 18 days before that one, yet there no movement this time around apart from adding cases to the Pending pile, maybe all 2 of the adjudicators are taking vacations August?

So anyway the highlights of yesterdays update are:


5 UK based cases were added to the "Pending" pile this time around!!

No cases have changed status to Under Review from Pending

No cases were completed.

Just hang on in there, think of this process as a very long winded one and some are very lucky and manage to get away with a shorter timescale, my own thoughts on this is that the USCIS is like a bucking bull and we are the riders, some get thrown off quickly and they sail straight through, some get thrown off and hurt, they are the ones that get refused, and some manage to make it to the end but to do this some of the ones that got thrown off and hurt have to get right back on again.

After all the USCIS's role is to keep everyone they can out of the USA, some make it through easy as they are squeaky clean, others like myself have some past problems and they used these against us to make us wait 2.5 years, you are more unfortunate than us as some of your documentation is not available, so this gives them even more reason to try and slow things further.

But from what I have read on this forum and others, is that there is still hope, the AAO do overturn decisions and this will surely be what happens to you in a while when they manage to reach your case, now that you have a decent immigration lawyer and more support documentation for you extreme hardship case.

Anyway both Traci and I are going to keep in touch to make sure that you always have someone to talk to that has gone through the same thing, I am just glad that our case did not get refused and sent to the AAO with yours.. but just keep in mind we are here for you.

Hi, Sorry for this short update post, as I am away from my main PC, however my wife Traci sent out a post when the update first appeared.

Now I have updated the Spreadsheet and put this together:

Thank you so much for the congratulations comment, it has been a long time coming but at least a few of us have now reached the end of the I-601 process.

I guess most of us on here feel very sad for the way Julie was treated with her case, I just hope that now she has continued to persevere and re-submit/appeal the decision and is now using a good lawyer that her outcome will also be positive within a few weeks/months.

We are already married, and had gone for a K3 originally, this ended up turning in to a CR-1 at the Interview when I was denied, the waiver has now overturned these objections and they are now finalizing the process so they can issue the visa, but as we only have 3.5 months left before our second wedding anniversary, we have decided to delay entry in to the US POE until a day or two after our anniversary to avoid having to go through the AOS and having to be under the restrictions of the CR-1.. So hopefully when I do arrive in the USA at my POE which I have decided to be San Francisco I should be issued an IR-1 (10 year green card) and have no more USCIS hassles.

What about you, how is things at your end?

For those of you that are lucky enough to get through this I-601 process, then you will receive a letter from the USCIS office telling you your I-601 petition has been approved.

Of course I have had to remove my details and replace them with a famous fictional character.

This is only intended to be informational, as I promised to let you know exactly what happens after the phone call comes... I am very sympathetic to everyone else's case, that has either been denied or is still currently going through this process so please do not see this as bragging or boasting in any way.

WE GOT APPROVED !!!!THANK GOD!My husband got his "letter of approval"in the mail today,saturday from mr Elliot cook.we were approved back in may our case sent to DOS then 2 weeks later sent back to USCIS pending further information from me which i sent on july 2nd ,so it went back to under review on jun12th.Our case has now finally been completed july 14th and APPROVED and sent to DOS for visa issuance.My husband hasnt been contacted by phone on what to do next but we wait till monday.Im sooo happy .YAY!!!! :dance:

I laid in bed last night & I prayed so hard for you guys. It must be so nice to have a plan.

Don't you think it's really unfair that you have to pay for all of the PCC & medical again? It isn't your fault that the process took so long. Although, Andrew, I suspect that you'll happily fork over the cash at this point! I know I would, even if it meant selling the furniture! :lol:

Thanks for your prayers, they seem to have worked... so say thanks to the big man next time you pray :D

It is a bit unfair to have to pay for the Medical £200 and the Police certificate £40 (£35 + 1 copy @ £5 just in case), but these are required at the Point of Entry, and as my police certificate had run out on the 16th July 2010, this needed replacing, which can take up to 2 weeks.

As for the Medical, this was only needed if I want to delay my entry in to the USA, as it was valid up until Mid August, so if the police certificate and passport were sent in and the visa issued by the 1st week of August, this would have only left me with a window of 1 week to organize a flight and finish up all my stuff in the UK, so it was far better to spend the extra money and have another one done, this allows me to enter the US in November 10th after our anniversary, so we can get an IR-1 visa (Valid 10 years with no restrictions) rather than the CR-1 (Valid 2 years with restrictions).

Many thanks for your support and comments over the period that we have known each other, and we will stay in touch.

Anyway of course we are both hoping that you have a positive outcome as well, as your case completed on the 16th July, you should be contacted by phone if successful by Thursday 22nd July if they follow the same time period that they did for us, it was 4 days after we were shown as completed on the PDF file (Mon 12th July) then I was contacted by phone.

Personally I think you're right to wait for your anniversary - there's a huge difference between choosing to stay in the UK for a little bit longer with a date in mind, and external factors with no end in sight.

We decided this morning to wait so that we can get the 10 year Green Card, plus it fits nicely as we do not have to rush, it also allows Traci a nice long 6 week visit to the UK in between the waiting period.

The Certificate has been ordered with one additional copy (Just in case) as the embassy have a knack of losing such documents, so for £5 more for an extra copy it is a no brainier, and my medical is booked.

Your right though, now we have confirmation that we have been accepted, I can now plan holidays, money transfer, visits to family & friends, sell my car, sell other items and be over in time for Thanks Giving and Christmas.

Today is the 15th July 2010 and the I-601 Waiver Status PDF File was Updated at 12:34pm GMT

This is a massive update in comparison to previous updates, they have changed the status of 13 cases.

And our case has been completed in this update along with JNurse68's case, however we are still unaware of the decision made yet as we have no formal paperwork or contact from the USCIS? But I will update you all when we know and let you know of any hurdles we have to jump through to help anyone else in future.

So the highlights of todays update are:

3 UK & Ireland based Cases in total were added to the "Pending" pile making a massive total of 54 UK cases Pending!!

3 UK & Ireland based cases were added to Under Review from Pending which now leaves 5 UK based cases Under Review!!

Well this was a great update for everyone today as the movement of cases was spread amongst New, Under Review and Completed but also a large amount compared to most other updates. Today 7th July 2010 the I-601 Waiver Status PDF File was Updated

The last update that we received was on Friday 25th June 2010 which was 12 days ago now, this update brings only the addition of 7 new UK & Ireland cases added to the Pending section, there was no other movement of cases to or from Under Review or Completed...

So the highlights of todays update are:

7 UK & Ireland based Cases in total were added to the "Pending" pile making a massive total of 54 UK and Ireland cases Pending!!

No cases were changed to Under Review which still leaves 8 UK based cases

Well this was a good update for new Waiver filers but still no good for anyone already on the waiting list as Pending or Under Review. Lets hope USCIS can update us again on Friday with some proper movement of cases rather than just adding a few to the list and calling that an update !!!.

I am unsure if JustJ's link applies to waiver processing at any other consulate other than Ciudad Juarez.

And from reading other parts of this community, it sounds like several bits of information have been rearranged on the website of the London Consulate.

I think that you will find that the Ombudsman's report covers all foreign USCIS offices, however the majority of the cases (I-601 & I-212) come from the CJD field office in Mexico, in fact 86% of all I-601's filed come from just this office, so the study was carried out based on this office but with a note to Congress to make this applicable to all field offices.

So they just chose the largest office to use for the study and then offered recommendations based on their finding from this office but with a view to role it out to all offices as the savings to both the US Tax payer and the time savings to the applicant are significant.

Hi Everybody

It is such a shame that USCIS could not have updated us on any progress before the 4th of July as this creates another Monday holiday at the embassy in London, so I guess that as they did not update us this Friday just gone, that we will have to wait until Tuesday to Friday next week to find out if there has been any further progress.

I would like to take this opportunity to wish everyone a happy 4th July and that I hope you can still celebrate this day even with your loved ones so far away.

Anyway, it appears that there are changes being made to the I-601 process as JustJ highlighted, the movement of the PDF file to a different domain may be the first step in this re-organization, however it looks like they are going to centralize this process and make the Waiver applications track-able on a website along with other visas. The centralization of this project would remove the adjudication from the Embassy to the USA, possibly Washington, whereby they can maintain standards and uniformity as it is a bit of a hit and miss affair with Mis-rep charges etc, some get through and some do not? So maybe this will be a good thing for future I-601 filers and possibly us as well?

I will alert you as and when the file gets updated in the new location.

I have just finished adding a few extra touches to the Waiver Spreadsheet.

1 - I have added a section on the right hand side that shows how many cases were completed on a month by month basis.
2 - Above the monthly completed cases section is the new monthly average figure, currently at 5.63 Cases per Month.
3 - I have added a section below this on the right hand side of the spreadsheet showing how many days it has been for the longest completed & Under review cases.
4 - Extended the spreadsheet down further to incorporate the extra pending cases that are being added weekly,(After all I expected to be completed by now).

I hope you find these changes helpful, if you have any ideas or want a feature added, please drop me a message and I will see if it is possible to add any of your feature requirements.

They updated the list on Wednesday, and added some information regarding what cases they are deailing with, based on the date they received them (currently Feb 23rd).

JustJ said that they've incorperated I-212's on the list now as well.

Thanks for the link, I have checked it out and your right it has been updated, however the normal PDF file that I have been monitoring has not been updated? can you let me know how you managed to get to this link, as the other one I use is directly off of the US Embassy site in London, if you could let me know the page you go to to get to this link I can make sure I monitor this as well as my normal PDF file.

Also I have looked at whatever changes there are between the two different PDF files, it seems that we have a lot more Pending cases on the new PDF file, this may indicate the extra I-212's that it says it incorporates.

Anyway I will update the spreadsheet to incorporate the changes later tonight when i have time and then i will publish the changes here.

Ok it has been a week now since the USCIS updated us last time, so lets all hope they send out an update today to at least make them weekly and not the fortnightly or three weekly that they did just recently.

So lets all hope that they update us today, with some positive moves would also be nice.

The only 'criminal past' that i have (that i know of) is a speeding ticket :hehe: and that (from what i can read) isn't a CIMT.

Folks... what does that PDF actually track? Is it people who are have got a 221(g) or people who have a 221(g) and have subsequently applied for a waiver?

Aslo, how do the case numbers work? There are 11 numbers and no letters in them rather than the 10 numbers and 3 letters as so (LND 2008 801 002)? If you drop the 3 letters we are still 1 digit short.


Hi and welcome

First of all I will say that no one seems to know how to work out the new number scheme used by the USCIS, apparently they had two different systems and they have now merged them in to one system, or at least that is what I read somewhere, the old 13 digit case number scheme is easy to work out, just Goggle "USCIS Case number definition" and it will show you, however these new numbers are different.. All we know about these is the first 3 Letters are the Embassy ie LND = London, the next 4 digits are the Year that the application was opened, however the year runs from October to September so a case that was started in November 2008 would have a 2009 year applied to it, as for the other two lots of 3 digits we do not know?

221(g) is Administrative Processing AKA the "Black hole", people on here like Treehugger are currently in this position, you can end up in AP for many reasons and the USCIS do not have to explain exactly why or how long it will take, hence the fact they do not publish a list like they do for the I-601 Waivers that they produce their PDF file and I then turn it in to a spreadsheet to make it track-able.

I have a of question for you.

You have stated in your Time-line that you are in AP, yet you also have a fixed date of getting married? How do you know that the AP process will be over before this date?


If you have no past criminal issues, then you should be able to get your K1 with little problem, however if you have ever committed a CIMT (Crime Involving Moral Turpitude) in the past then you may have to go the I-601 route, as this is what most of the people that require I-601 waivers are on here for from my experience, well that and also getting slapped with a Mis-rep charge if they have traveled to the USA on the VWP without saying YES to the box that asks if you have ever committed a CIMT.

Please let us know how you get on and I hope for your sake the AP goes through quickly so you can get married on you planned date... As I know it did not work out that way for us...

Hi Everyone

The USCIS has decided that because we have been kept waiting long enough for the last update (20 Days) that they would now furnish us with another update 3 days later (Friday 18th June 2010)


So the highlights of todays update are:

2 Cases added to the "Pending" pile making a total of 39 UK cases in total now !! (STK2007 761 001 & LND2008 843 014)
2 Cases were added to the "Under Review" pile from "Pending", this brings the total UK based Under Review cases to a total of 9 including 1 Scandinavian case (LND2008 801 002 & LND2008 754 020)
2 Cases were Completed.. One of them is Scandinavian and the other is a London case (STK2007 761 001 & LND2008 843 014)


Well this was a welcome update and my hopeful prediction came true for once, however there has been no movement for any of us at Visa Journey that I know of, unless I am unaware of your case number in which case if you email me I will add VJ User and your Initials to the Spreadsheet.

I wish this update went a bit further to make up for the lack of progress in the last one that we waited 3 weeks to get, however that was not to be, lets just hope that the USCIS now start updating us on a more regular basis and try and complete more cases to up their average cases per week figure from the 1.3 at which it stands currently.

Hi Everyone

The USCIS have updated the I-601 Status PDF file again today Friday 18th June 2010

I will give you more info when I look in to the update further, but it looks like 2 New cases, 2 new Under Review and 2 more completed cases, 1 of these Scandinavian and the other from London.

I will update you all shortly.
