I have a question that seems over looked.

Since it is coming on your 2 year mark.

Is that the last time you have seen your fiance?

If so that would be a problem for you.

The rule states you have to have been with your fiance within 2 years.

If so you should plan a visit with her again soon.

i can simply answer your question. me and my fiancee are dating for almost two years now and after 3 weeks we are looking at 2 years anniversary. my fiancee is actually here with me in the us. basically, she's having her 3 months vacation from japan. however, she must to go back next month before her i-94 get expired. NOW do yo think there's a problem of filing k-1???

radsr2002 you've been truly a helpful person and i thank you for doing so...

You technically could file a K-1 after knowing someone for one day. The restriction s having met them within two years not having known them for two years!

i would like to clarify myself. i have met my fiancee from sept. 2005 and this coming next month is the 2 years anniversary of having met her not knowing her. do you think im still qualify for k-1???

If you only met her once, then you must file the petition before the two-year anniversary of meeting.

If you are worried about not knowing her long enough, stop worrying. You misunderstood the reference to two years.

thank you pushbrk!!! base on your statement if i only met her once, then i must file the petition before the two year anniversary of meeting. why is that? is there any consequence? please help!!!

It's asking for an Alien Registration Number, if you already had been issued one from a previous visa. If you don't have an A# then state "none".

No, there will be an additional fee associated with the medical examination. Depending on which country the non-USC fiance is from, the fee for the medical examination can vary.

K-1 Fiance(e) Visa Process & Proceduresif NOA2 receive what do i do?
QUOTE (ZeeNusah @ Dec 14 2007, 10:26 AM) <{POST_SNAPBACK}>
Having a copy of the petition is so that your fiance can see what you sent to USCIS. You can just let your fiance know what it was you sent to them. USCIS is not going to return your petition. If you don't have the original petition don't worry about it.

A copy of the letter of intent is here: http://www.visajourn...r_of_Intent.doc

The proof that you send with your fiance to the interview does not have to be the same that you sent with your petition. At the interview you want to be able to prove your ongoing relationship so only include evidence from the time you sent the petition up to the interview. You can send originals if you want, but if you want the originals back make sure you have copies to give to the CO. What originals did you include with your petition? It is possible that these will not be necessary for the interview.

As for what to do after the NOA2, I would just follow the guides here on VJ.

Hope this helps smile.gif

Thanks for your big advice! I finally ease the pain when you gave me the add. for the letter of intent.

Again thank you Zeenusah for your help and reading my post...

K-1 Fiance(e) Visa Process & Proceduresif NOA2 receive what do i do?
Goodevening VJ members,

Latelty I've been thinking what do I have to prepare if I got the NOA2. I made a research through this site and I found out that I should make a copy of the entire I-129F that I sent out to USCIS. The problem is I didn't make a copy of it before I sent out, however, I can somehow mimic the papers if necessary. VJ members is that really important to send the copy to my fiancee after receiveing the NOA2, what about if I can't retrieve the entire copy? will it be a problem? I would definitely fallow the directions I found on this site after receiving the NOA2 but can somebody tell me how to make the letter (desire to marry your fiancee and your continued support of the K-1 Visa). Also base on direction I found, I have to send the originals of document proof that I've submitted for the I-129F for my fiancee's interview. Is that mean USCIS will send me back the I-129F or I really have to make another copy of I-129F with originals that I sent out. At this point I'm having a difficulty to prepare all the documents and understanding the concept, I don't know how to make this quick and simple. Can somebody please teach me what to do after NOA2. I dont' what to rush and not prepared when the NOA2 arrive. Even for just a little moment I want to have some peace of mind...

Truly appreciate even a small opinion!

Aloha,

I don't know that I have an answer to your question, but in the cold snowy weather here, I was missing Hawaii and just had to respond to your "Aloha."

I think that the police certificate is only good for like 60 or 90 days. I wouldn't do it until after the NOA2. As for the medical, I think that's only good for a certain time frame as well. I just don't know the time frames as I'm still waiting for my NOA2 as well.

I sent mine Sept. 4, I got the respond after two months and two days (November 6, 2007) you just have to wait because can't help it since the holiday is coming too. K-1 Fiance(e) Visa Process & ProceduresWhat Happens Next
So....Once the 129f is "approved", it sits at the "NVC for a couple weeks" and then is forwarded to the apropro consulate? Does anyone know, in the case of a 129f, what goes on at the NVC?

I ask because I am curious as to if there are any other forms or fees that need be taken care of iE: Financials etc. Isn't there like a 134 or something that need be signed, notoraized and returned to the NVC...or is that presented at the interview at the consulate??

I guess the easiest question is: Once we recieve the approval....do I need to do anything else (on the USA end) or can I travel to see my SO without fear of an un-answerable letter sitting in my mailbox?

Hope I didn't thread-jack but felt my question didn't warrant it's own thread.

thanks!

Kang Lang...wow, 17 months apart? That's just wrong! But you will never have to wonder if your love is real or not...that's for sure!

As for Brian Wright...yes, he will work with you (ala carte;). Tell him you are in a similar position as "n2ojones" and ask how much he would charge to fine-tooth the details. I too started out with someone else... but then fortunately found Brian.

Congrats again and I wish you well.

Kang Lang,

I-129f petitions are not entered into the NVC's automated information system - they don't spend enough time at the NVC, and the NVC doesn't do anything with them except forward them on, so it's not worth the effort to put them into the system.

Yodrak

FINALLY!!!!! Decided today after the automated system told me no record existed of my case at the NVC to speak to a live person (who was incredibly nice btw) that my petition reached them on 18 April and was sent to BKK on 20 April. Fingers crossed now that we can be reunited on his B'day in early July!

They don't give any sort of notification, Yodrak? It don't sound like Kang Lang got anything. It seems e-mail would be more efficient than having us all call for a status check...right?

Hey Kang Lang, congratulations!

You and I are only a few days apart, so your news, (I hope) is good news for us both. We are also in a similar position. Well, actually my wife speaks and reads English quite well, but this far along why take any chances?????

So I am using Brian Wright of mythaifiancee.com I have had many e-mails with him and have also spoke with him on the phone a couple times. Smart, considerate and ONLY does US visas. You don't want to find out how important that is. I found out the hard way.

Well, Yodrak, I'm no stranger to confusion...or finding my foot in my mouth...

After re-checking your timeline...I see it was more like 7 months. I was confused by the "377 days for 130" remark. In fact, I still am.

But that shouldn't detract from my expressed sentiment; Because of you, I was able to identify the fact that my "visa agent" was little more than uh, ambitious....

....but now exposed (and disposed). Thanks again.

K-1 Fiance(e) Visa Process & ProceduresSAWASDEE 2

n2ojones,

Your timeline indicates that your wife will be applying for an immigrant visa. If that is correct, then you will be receiving an invoice from the NVC for a $70 I-864 processing fee. After you pay the fee the NVC will send you an I-864, which you will fill out and return to them with the necessary supporting documentation. The NVC will verify that all of the necessary supporting documentation has been provided. If they think that something is missing you will get a letter requesting it. The NVC will not examine the content of materials to determine what your income is and whether or not it is sufficient - the consulate will do that.

Your wife should be prepared with updated supporting documentation, as may be appropriate, at her interview. For example she may be asked for your most recent pay statement to verify that you are still working, and for the same employer, as when the I-864 was first submitted.

Yodrak

Hey Yodrak, I have read every post in this thread with special attention on yours. Allow me to say that if this (excellent ) website does not have you on the payroll...they should. Like so many others, I REALLY appreciate the info and insight you provide.

...and if you are feeling very tolerant, could I ask you to please expound on your reply. My concern is that the NVC does not have any of my financials (to date) to document. When you say they are making sure the documents are complete, do you mean in the form of questions?

I was under the impression that I would be turning my financials in at the interview...but that don't make much sense either. Seems it would take quite some time to go thru all that #######. If you can point me to a thread that explains the steps ( I hired an agent) I would quit littering this thread with my assanine questions. Promise.

Thanks again!

Wow...I wonder what the mix-up was. The NVC had our case since Feb 18th when I called on March 28th. At that time the recording said they had sent our case to the embassy in BKK. Next thing I know, iget the bill for the processing fee and they had changed the recording reflecting this.

So now I will have to wait for the 864, fill it out and return for them to check-out BEFORE they will send our case to BKK? Damn.

And like an idiot, I listened to our agent in Thailand who instructed me to "immediately send all my financials to his office in Thailand". I was in such a rush to do so, that I did not make copies of (all) of those documents.. It cost $90 bucks to send the package fedex and now it looks like I will be needing it back to fill out the 864.. Now with Sonkran who knows when I will get it back. What a mess.

Thanks again, Yodrak. As bad as they are, I really do appreciate having the facts (for a change).

K-1 Fiance(e) Visa Process & ProceduresSAWASDEE 2

n20jones,

The NVC checks the financial package for completeness - is all the required documentation present. The consulate checks the information in the documents to determine whether or not the financial qualifications are met.

Yodrak

Hi again,

After being told (by the NVC recording) that our package was "sent to BKK on 3-26"..it turns out it was not. They sent me a letter saying they could "not process our petition because the $70 processing fee was not paid". Their message was changed to reflect this as well.

So Obviously I sent this money to the NVC immediately and my question is this: Does the NVC go thru my financials in NH...or does that happen in BKK? I ask because I have not (yet) been asked for my paperwork (taxes etc) so we could be in for a VERY long wait, if this is the case.

Man...what next?

Thanks in advance.

Hey George, mai pen rai...I should be the one apologising for being such a dumbass. I am really confused now..

.and Reach..I appreciate the information about mythaivisa...and thanks for your honest appraisal.

That's kinda' what I have now though...an agent I have to double-check. My wife will be fine with everything after the packet 3 is filled out. She feels she can do that as well, but I don't want to be all pissed at her if she messes up (!) I just got back to Hawaii (and my business) and just don't have the time after being gone almost 4 months.

OH!...The "static with my wife"...nid noy, LOL. She's just a bit TOO jai yen for her own good. She also thinks we should stay with this agency...."because we have already paid them".

Man, what a mess. Soooo close, too.

Can someone tell me if I-134 is supposed to be notarized and does it get turned in along with the police report and medical at the day of interview....or does it have to be sent in with packet 3?

I know I should be reading the instructions...and i will, but this flare-up with the (already paid in full) visa agent, has caused some static between my wife and I now as well...I need this info fast to calm her and prove my point...this guy does not know what he's doing and we are sure to be refused if we continue with this bonehead.

More than likely he is reading this...which is good,...maybe he'll accidently learn how to process a visa.

Please help

n2ojones,

If I’ve read correctly your wife will be applying for an CR1 visa based on the approval of the I130. If this is the case you would have had to send an I864 (Affidavit of Support) to the NVC prior to them forwarding the case to the embassy.

The Embassy’s web page has changed but it used to specifically state that I134’s were to be used for K1 & K3, and I864 for CR/IR1.

If however it’s causing big static between you and the wife, I suggest you say “ok yes dear” and send her a notarized I134.

best of luck
Chant & Noy

Huh..I am definately confused now. We (the agent) sent both the 129 and the 130 for processing. The 129 was intially rejected because...uh, because we (the agent) failed to include the check (I kid you not). I ultimately sent them the check (and a letter) but have heard no more about the 129.

During this time, we got the NOA for the 130. They then sent our case it to th4e NVC. I called NVC in NH on March 28th and the recording gave me a case number and said our case had been sent to BKK on the 26th.

BTW, we were legally married in Dec.

So, if the NVC forwarded our case already...do I still need the 864...or do I submit the 134 at time of interview. I suppose the agent COULD have sent the 864 with our other stuff...but I have no idea how he got my financials (if he did).

This is the first I have heard the term CR. I appreciate your help....ALOT!

Thank you, George!

Hmmm, It would appear the office number is invalid but I got a voicemail greeting on the mobile. Hopefully he will get it and call me back!

So, I was right (a first!) the 134 is presented at the interview along with the meds report and the police report...correct?

..and thank you for explaining the 134, it looks like it requires a notary but there is no space indicated for the stamp. This guy wanted my finacials...but never sent..or asked me for the completed 134. I hope Bill White calls....we are so close.

K-1 Fiance(e) Visa Process & ProceduresWhy is my processing time getting extended?
I posted on another thread, but I filed I-129F August 2, 2007 and am just getting approved for NOA2 (electronically). I am still waiting for the NOA2 letter though, so 6 months for that part is what I saw from the California Center.

USCIS claims to have had a flood of applications for Visa's the end of July 2007, just before they raised the processing fees in August 2007, so this along with the holidays seems to have extended that part of the process. From what I have read, the rest of the Visa process will vary, because you and your beneficiary have to fill out forms and get paper work done, so that will vary and depend on how quickly that goes. Good luck and relax!
