You need both but the real deal is at the embassy showing continued relationship.
At UCSIS, you just have to meet the minimum and pass Background check.

The embassy will require the 'Hard' evidence. this is where they 'meet' your SO in person and as Judge and executioner, has your destiny of 'bliss' or 'hell' in their hands making a decision in seconds that will affect your forever.

I would definitely take a trip and save all your proof and take tons of pictures.
You could get married and then file for a spousal visa..that may be more convincing than re-doing the K1. I've seen success stories where people have done just that.
Refiling now without having any more additional proof and especially not seeing one another in almost 2 years....
I think it's best if you make that trip.

Good advice but there are a couple problems.

First, you must understand why you failed the first time. I suspect it has to do with your past relationship to some extent. If you are also Chinese with family members in both countries, that will have been a factor. If your fiance is from Fujian province, that will make things more difficult. If you both are, even worse.

Second, you have an age problem with the 19 year old. He/she cannot be considered your step-child because you cannot marry the mother before the 18th birthday. They could get a K4 visa but not a CR2, however they would not be eligible to adjust status after arrival. The child might come temporarily but would have to return to China unless they managed a student visa or married a USC while here.

If your relationship is indeed, bona fide I'd pull out all the stops to get the attorney working yesterday, so the K1/K2 gets reconsidered favorably. A 19 year old can adjust status from a K2 visa but not from K4.

If your fiancee country is similar to china, she should be able to obtain a certificate from the government acknowledging she is single and eligible to marry.

The chinese government keeps track of who is married so they are able to issue a single certiifcate.
Ask you finacee, she should know.

Looks fine but remember GUZ is very tough......USCIS maybe fine but you still have to pass the interview.
I would have as much as possible....this is what GUZ will start with. the more the better

I know a couple CR-1 living in China right now, they met while students in Japan. They are having a hell of a time getting any police report from Japan. At first, they were told they would have to come in person to get it but he could not get a visa to return to Japan........

As for marriage. I believe you will have to interview in the country that you got married in so that might add to the problem.

Also, I understand that you might have to provide a police report where you live over six months so it would be a good idae to get one before you leave.

unless you or your SO have political pull, your chances of getting a tourist visa is like a snowball in hell.

Just getting a K-1 approved by GUZ is 50/50. GUZ is by far the hardest embassy to obtain any kind of visa let alone B-2

and if she happens to slip through, she will probably be turn back at customs.

Finally, this may add another layer of difficulty to your k-1 petition. i wouldn't chance it unless your last name is BUSH or HU

pretty sure you will need a police certificate from any country where she lived more than 6 months since her 16th birthday.

if I were you, I'd spend the extra cents, like yahoo! call out, 1.5 cents a minute or skype at 2.1 cents a minute plus connection fee and call her periodically. You then have a fool proof call long. It will show what numbers you called date and time and length of call.- like her mobile number

the most you'll spend is a few $ per month. It may save you considerable grief when you get to the interview.

Like insurance, you buy it even though you don't need it. and for a few $ per month, for the next 9 months, it's priceless.

If you get dinged, and china is probably the most difficult embassy to go through, you will regret not doing it.

It won't probably make much difference. but either way, she won't be able to travel to the US unless she already has a travel visa in place before you filed.

If you try to get it afterwards, it most likely will not be granted.

I personally know many that should have passed, flunk and others meeting the minimum pass. How else can you explain it?

so cross your fingers and pucker up when you interview.
I wouldn't be surprised if the failure rate is higher than the pass rate.

it has been three days ago since me and my fiancee arrive here in the u.s but it seems that everything is not right. she came here with i-94 (three months stay) however, one of the agent in the airport found out that she has a fiance here in the u.s that she visit all the time she comes here. now the problem is she got stuck at the airport and being interrogated by one of the agent that works for immgration. she stayed at the airport for more than 2 hours and they keep asking her if she is getting married, i feel uncomfortable at the moment because what about if we did. would the agent do something to stop us? and if we are, why would the agent let her in the u.s? is it because the agent notify the immigration center to alert them that there's a couple that about to do a fraud.

please need your strong advice? all of your answer are strongly appreciated... THANK YOU!
