i would like to thank everyone of you here on VJ forum. i knew from the beggining this plan is extremely difficult but for listening each everyone of your advice my plan might go in diffierent direction with a simple way. this coming next month (june) she will be here with me for 90 days and within those days i will figure things out or may be i'll visit some of the agency here in Hawaii to help me the easy way out. i'm possitive they will offer me the k-1 but let see what's going to happen by then. once again for those of you gave me a positive advice "thank you" i truly appreciated.

i would say this is going be the tough challenge for us and in fact, i already prepare myself to what's going to happen in the future. my plan hasn't change at all, we are getting married this coming summer because that's what i promised to my fiancee. getting married is not hard as i thought it was, i admit i'm getting excited, nervous and all kinds of feelings can't explain but i would say the documents is the number 1 priority. all of my friends from japan, taiwan, korea, philippines and singapore were telling me to file a "fiancee visa" becuase they said is a lot quicker than the other. people say i should get married here in the U.S and let my wife to go back to japan to wait for her i-130. to be honest i just don't want her to go back to japan. men this is troublesome, she already quit her job and she has been worried about the documents more than i do.

if there's a good result to my journey i will definitely share it to everyone here on VJ forum, so please wish me luck...

my 1st question is after we get married can she possibly file an i-130 to claim a greencard?

You can possibly file an I-130 and all the rest, but you may very well run into lots of problems, since what you are trying to do is immigration fraud.

Actually, if she enters the US with the intention to marry, marries, and then leaves the country to apply for a spousal visa, it is not fraud. If she enters the US with the intention to marry, marries and applies to adjust status to permanent resident without leaving the US, then it is fraud. Just a clarification . . .

Also, if border guards at the POE suspect that she is planning on marrying in the US - whether she intends to leave or not - they may not let her in, expecting that she will attempt to adjust status from within the US and commit fraud. It is not illegal to marry and leave, however, the guards expect the worst of people when they are crossing the border and do not give anyone benefit of the doubt. Just so you can be prepared . . .

my fiancee from japan is coming heren in june 2007 without a visa or what so ever. prior to u.s immigration japanese citizen are able to stay here in the u.s for 90 days. im a u.s citizen and im planning to marry my fiancee wthin the 90 days, probably this coming july or august 2007. my 1st question is after we get married can she possibly file an i-130 to claim a greencard? 2nd can she stay with me without going back to japan while we work things out? what should i do wtih this matter?

Your debts are not a factor. Your income is. If you've worked for the same employer 4 years and earn over the I25% poverty level for your State, you qualify to sponsor.

Actually reading the I-134 instructions then looking through the form itself would have told you that. I highly recommend it.


Okay I just don't quite understand the "sponsor's household size" part. For what I understand, since I'm going to sponsor only my fiancee that means in the first category meaning my household size is (2) is it?

The medical forms are in packet 4, or as stated you can see what they look like if you go to the link supplied in a previous post.

My finacee went for her medical exam last week in Bangkok, Bumrungrad. The fee for the medical screening is 2400 baht, not 2000 baht as stated on the form. She doesn't have any medical records for shots, so will have to get the full set. She got 3 shots this time for 2499 baht and the blood tests cost 400 baht (over 5000 baht so far).

She is supposed to go back in a month for a second set of shots. Not sure which shots she got, will be there next week so maybe I can update. As others have said, she was given a sealed package with the results of her medical screening and told not to open it, just give it to the embassy folks when she went for her interview. I think this means everything is OK, or they would have told her, but since ####### applies here, don't know.

For Thailand, the medical forms are in packet 4. Looks like it used to be called packet 3. Go to this link, in the Bangkok U.S. Embassy website and select medical exam documents. ugh! in the few days since I posted this question, the fares between Bangkok and U.S. have gone up an average of $1,000! I shoulda just pulled the trigger.

I'm getting hit with the high summer time rates for flights where I live also. I want to get my fiance here from Thailand the end of July when I am there, so she can fly with me. If I were to wait until September, it would be a lot less for a flight! Also, it seems when you purchase a ticket from Thailand, the additional charges they add to an airline ticket a quite hefty compared to what they charge in the US.

Something I wasn't sure of. It sounds like for an immigrant K-1 fiance visa, it is fine to only purchase a one way ticket. It doesn't have to be a round trip ticket. Didn't realize that until I read this thread.

I'm going through this the first time, just like everyone else, so experience is in short supply.

Our situations are a little different, I have submitted an I-129F fiancee visa application and received a NOA1. Apparantly, that means the CSC got it, now I am waiting for a NOA2, which I believe should be the signal to get the I-134 notarized or signed by USCIS and then send it to the address they request (national service center?). I think they then forward it to the embassy. Same for everyone so far. A copy of the financial information was suggested on the forum also.

As far as what documents to have with you when the I-134 gets notarized/signed by USCIS and then sent in, I just gathered what the forum recommended:

last 3 years of 1040 tax forms with any W2's
transcript of last 3 years tax returns (can get via automated telephone system to IRS)
Last several months statements of any savings, checking accounts, IRA's, etc
A letter from the company that has my IRA stating when I opened the account, how much I have, etc...
last 3 years beginning statement from the SSA stating what SSA disability benefits will be, minus insurance (sent out every December/January)
If you own a home, mortgage statements (how much you owe)
property tax statements as proof of property value (how much equity you have)
and as I stated above, a list of itemized personal property, if you really need to do this to qualify

I haven't heard back from anyone that has actually had experience with this, so went down to the
local USCIS office with my I-134 and most supposting documentation to get signed. They weren't too concerned what was answered in question 7 and it's also on the I-129 also.

They do want to see proof of whatever $$$$ figure is put down. I understood that, but missed the following, on the I-134 is a line for personal property, I think I put down $40,000, but for some reason, didn't think to provide any proof. Basically, for this item, they just said put together a list of what you have and add up the numbers, car - use Kelly Blue Book, clothes, furniture... Don't let that get you! Anyway, I was a little too early to get the I-134 signed, but got many other questions answered.

The rep also pointed out that down the road, when filling out an I-485 Adjust of Status, yes it is $1010, but if you want to get advanced parole I-131, it does not cost any more and is included in the I-485. She circled the last paragraph on page 2 of the I-485 which states this. That's good news.

Need info on what we should do concerning a document requirement for the DS156K. (Son's brith certificate)

My girl had a child,when young, and the father of the child and his parents took her child. She moved back to the province to her family. Since she had the child, she has not talked to her baby or seen him since, over 10 yrs ago.

On all documentation for this visa, we listed she had a child. She has no intentions to bringing or finding to bring to US. She doesn't know where the child is.
We had to list because she did have a child and we didn't want to lie on any documentation.

We have all documentation prepared for the interview and medical, but the DS156K ask for her son's birth certificate. This she does not have. When she went to check for it, the parents of the father's son, lied on the birth certificate. Basically, the document is #######.

My questions is what should we do?
1. Just wait until interview and when asked explain the situation. OR
2. Type this in some word documentation and have her get it notarized of what happened. OR
3. Bring the garbage birth certificate of her son and explain why it is all wrong. (mothers age and where born son at)

My fiancee just recieved her packet 4. The packet still reads to make sure the bank validates the DS156 form. Now I read somewhere in the forums that it was suppose to be on the DS157. I know we will keep the receipt and all but which is correct?

Do we follow the packet the embassy sent which states validate the DS 156?
Do we just show the bank a copy of the appointment letter from the embassy so they know what the payment is for?

My fiance stayed in canada as a student from April 2007 to August 2007, then stayed in hawaii as avisitor about three 3 months, Aug 22, 2007 - Nov 2007....then she went back to canada from nov 2007 to jan 2008....she stayed a total of 6 months in canada...does she still need a police report even though she did not stay consecutively in canada for six months?.....

I've gone over Items 1 to 41 of the DS-156 (Non-Immigrant Visa Application) form and I have queries on a number of items:

1. Question No. 8 - Other Surnames Used.

Query: If a person was previously married (now divorced or annulled), does she have to write her old (married) surname?


2. Question No. 26 - How Long Do You Intend to Stay in the US?

Query: How did you answer this question?

3. Question No. 32 - Do you Intend to Work in the US? (If Yes, give the name and complete address of employer)
4. Question No. 33 - Do you Intend to Study in the US? (If Yes, give the name and complete addres of the school)

Query: If you intend to do both but do not yet have a prospective employer or school, how would you answer Questions 32 and 33?
