K-3 Spouse Visa Process & ProceduresIRS Backtaxes + CR1 = Problems ??

My "husband" (not yet star_smile.gif ) owns the IRS quit a bit of money.
He does make enough money to sponsor me but we worry that those back-taxes could cause a visa denial/problems.
Do we worry to much?

I would worry. another easy reason to deny you

K-3 Spouse Visa Process & ProceduresHave you been issued a RFE in Guangzhou recently?
QUOTE (krieger71 @ Jul 31 2009, 11:10 AM) <{POST_SNAPBACK}>
Hello, Looking for any information you might have on recent RFE issues at Guangzhou. Most importantly is how long it took them to process your RFE and what the outcome was. If your still waiting, let me know how long you've been waiting. My wife was issued an RFE recently and all they asked for on it was for me to write a letter explaining about what happened with my previous marriage, why I got divorced in another country and what I liked better about my current wife vs my ex-wife. All the forms and paperwork apparently were good because there's no mention of any of them so it seems trivial considering that my current wife, who was issued the RFE, met me the US, we got legally married in the US and we have a son who holds a US passport making her the wife and birth mother of US citizens. Thanks

Your case looks easy to overcome but with GUZ, any mistakes can be costly.

they are probably looking to see if your wife is only interested in obtaining a GC. looks straight forward.

it's not a negative and you will need all the help you can get.
being married doesn't get you out of the woods. You still have to address the NOIR and it's in your records.
you still can get whited even through you are married.

Thanks, YuAndDan. Now, there was also the mentioning of all the materials sent with I-129F should be made copies of and sent to the fiancee. Do these also go with the I-134 and tax transcripts? Or should I send them earlier? I guess after waiting for so long for NOA2, I've gotten a bit confused in the process and need to get back on track. So please bear with me if the questions sound too silly.
Wait a few months for IRS to develop 2007 transcripts, then get the transcripts for past 3 years, then get the I-134 to your fiancee after getting P3.

where do you get the police certificate from. My SO grew up in shanghai and now works and lives in Shenzhen.

Also how about single cert?
Depends on where her household book Hu Kou shows residency, it should show Shenzhen if she reported moving to Shenzen she would visit the district PSB Public safety office and get the police cert (This is good for all of China) and then bring it to Notarial office in Shenzen for translation to English, The notarial office will also do single cert, and birth certs and translations.

My Yu's residence was her mother's home in Guilin, but she lived and worked in Yangshou about 40 miles from Guilin, She went to Notarial office and PSB in Guilin for the certificates.

Thanks YuandDan
And I assume the single cert can be obtained in Shenzhen where she lives, correct?

US Embassy and Consulate Discussionwhen to start prepare all the materials
QUOTE (YuAndDan @ Mar 21 2008, 04:58 AM) <{POST_SNAPBACK}>
For China it is best 2 prepare interview materials after the consulate has sent out the instruction packet (P3).

Required items needed after P3:
  • Notarial Birth Cert. + Translation. Get 2 or 3 of these.
  • Police Cert + Notarial Translation
  • Notarial Single Cert.
  • I-134 from petitioner along with financial evidence.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.
  • I-134 signed and notarized.
  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html
  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% or (100% for military) of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

for the Chinese embassy interview, we need to provide a police and single certificate.

How current must the certificate for single and police be?
Within 6 months or a year or some other date?

Thank you

As fresh as possible. I'd go for three months or less if I were you. They can both be secured within a month from the Gong Sheng Chu, so I'd wait to order them until you have the P3 in hand.

Thank you pushbrk for all you help.

I did get a reply from GUZ on how long the police and single certificate is good for. This is their answers

Thank you for your inquiry!

Please be adivsed that both police certificate and single statement
certificate is only good for one year.

Since she got it last year, 23 july 2007, the police certificate should be okay. Now I have to find out if she got her single certificate the same time last year.

Thank you again for you collective wisdom.......this is just driving me nuts!

wow, I was hoping 1 year...

we got our P-4 with interview date within three weeks....
we are trying to get the certificates but told it takes 10 business days to obtain and that would put it past the interview date.

I don't want to reschedule if possible but not want a blue slip also if don't have the required papers.

What do you suggest?

Also, if they reschedule, how long more would be the wait in your estimation?

thanks

How old are the ones you have? I wouldn't reschedule the interview because it might take two months. Can you pay extra to get the papers faster? It's China, so usually the answer is yes.

Worst case, I think you're better off turning the documents in late than rescheduling.

the police report is July 23 2007...I'm have to talk to her again to see if she has the single certificate.
I spoke with another and his sentiment is the same as yours....I shouldn't reschedule and because of the longer wait and told me that this is easier overcome than relationship blue slip.

I also spoke with another and they also said to 'persuade' them to speed up the process.....to get a yes....I hope she can persuade them.

Really appreciate your help.....really stressful this these dilemmas.

Thanks for your help

Hi there!

Had my interview at the US embassy YESTERDAY! wacko.gif I'm very glad to say that the visa was approved!

Here is what happened:

1. Interview at 9.30 am but arrived at the embassy at 7.30 am.
2. Stayed outside the embassy for ages whilst a 2-stage security check took place, a bit like the airport checks.
3.Allowed into the embassy after passing the security checks
4. Entered the lobby and given a number and told to sit in a waiting room heaving with other applicants
5. My number was called so rushed to the appropriate 'station' clerk, ie 'Number 71 go to station 8, please'
6. Clerk checks my documents: passport, birth certificate, 230, 156, 156k, support documents, police certificate.
7. Told to pay the interview fee at the cashier's station and return with the receipt
8. Gave the receipt to the clerk
7. Told to go back to the waiting room and await my number to be called again
8. Called after 30 minutes to see the consular officer
9. He asked me THREE questions good.gif YEP! Only THREE questions: 'How did you meet?'...'When did you lmeet?'and question about my profession
10. Told me my passport was needed to stamp the visa in....It would be returned by courier in 4 days.
11. Paid fourteen pounds to the cashier
kicking.gif

Hope this helps! But every interview is gonna be different in terms of the questions asked.

ps: Brought 3 FILES of evidence with me and didn't need them AT ALL! whistling.gif

GOOD LUCK TO EVERYONE! Don't worry! As long as you bring the papers they request and they are filled out correctly, everything will be fine.......RELAX and be yourself at the interview - the immigration person was very nice to me so I wasn't nervous at all innocent.gif

QUOTE (jester9999 @ Jun 6 2008, 01:04 PM) <{POST_SNAPBACK}>
Hi all I am new to the forum.

Let me tell you the problem that my fiancé and I have. We met in late August of 2007 online. In January of 2008 we decided to marry. February I sent in 129F and as of right now we are waiting for the Guangzhou Embassy to recieve it from the NVC. My problem is that I am 21 and in college and my fiancé is 29. In China they have their own forum like this called BBS or BCS. She has been on the forum for a while now and has found that a couple in a similar situation as us was denied because "the petioner was too young to support wife." While we do not know the entire circumstances of the denial, it scares both my fiancé and I. So my question is if there an age restriction and what is the point of the co-sponser if not to help support the immigrant because the petioner cannot? Thanks much.
