US Embassy and Consulate Discussionk1 visa reschedule

No, you should go for it, if the Embassy is open, and the flooding isn't going to be a problem.  My fiancee has her interview on the 27th also!  At 7:30am.  We aren't allowed to reschedule anymore without paying BPI again.

They should be able to send the medical results to your interview in time.  I wonder if they would allow you to hand carry them or not?

US Embassy and Consulate DiscussionMissed K1 Interview in Manila. HELP!!

The first email I received said, "Case Closed," so it really freaked me out.  We didn't have the "No Show" label.  Must have ticked off the official or something.  Hopefully it'll work out.  Took us over the weekend, and then there are always the Filipino holidays to consider!  Good luck, and I hope you get a hold of them real soon.

US Embassy and Consulate DiscussionMissed K1 Interview in Manila. HELP!!

We had a similar situation, whereas I had to call the Embassy in the morning of our interview and postpone.  Since we didn't have a back up date, I asked if we could reschedule online and was told that we could.  When we tried to schedule, our receipt number was invalid, so I emailed them.  I was told that we needed to send the jpeg of the receipt .  That took a while, but we did.  Eventually I called and was asked if my fiancee received the Letter of Eligibility.  Eventually my fiancee produced it and told me she received it.  Upon calling back I was told that the EMbassy would "escalate" our case and we would receive notice when we could reschedule.  We did this, and I noticed that there is a cancellation link if you need to change the date (you are allowed this only once).

I would suggest calling in order to really get things rolling.

US Embassy and Consulate Discussion3 weeks still in READY..

We were in "Ready" mode for 19 days after the interview, until one moment there was a whole flurry of activity.  CEAC started saying "Issued" and ustraveldocs, which never recognized any of my #'s, started working.  It took a really long time, but once it finally started moving it really moved.

Hopefully soon your checking and patience will be rewarded.  We were never told we were missing anything or had any more checking so I'm not sure what to tell you about that part.  Sounds like you are soooo close!  Good luck.

Hey.
I still haven't gotten my interview date, waiting on Packet 3.
Buuut, my fiance plans to attend the interview with me.
And I still don't have an engagement ring, we've been engaged since last July!
So it should be okay. I don't think the ring is a big deal.
I've heard that they ask about when you got engaged and all that. But the questions depend on the case and the interviewer.
You should be fine.
Good luck!

My fiance plans to visit me and attend the interview with me. Then we plan to fly back together. I hope this will all happen in June...
I'm going to be living on Oahu. I was actually raised on Maui though. I've never been to the Big Island, one day though!
I hope you will be able to fly back on the expected date. Good luck!

Just want to share my experience here from interview today in San Antonio. I had 10:00 am interview, thank god we (my husband and I) didn't have to drive for few hours. We got to the USCIS office 9:30, IO called me around 10:45. It was really easy, she didn't ask me for any documents but GC. She went through all the documents with me, she asked me to swore for the information that I gave to them is true. And than she give me the test; for the read and write test, she asked me to read 3 sentences, and than asked me to write 2 sentences that she dictated. For the civic test, She just asked 6 questions, because I got them right. Here the questions that she asked;
1. What is one right or freedom from the first amendment?
2. What are two rights in the declaration of independence?
3. Who is in charge of the executive branch?
4. If the President can no longer serve, who becomes president?
5. What are two ways that Americans can participate in their democracy?
6. Why does the flag have 50 stars?

Good news is I passed the interview, and waiting for the oath ceremony letter in the mail now. I hope will be arrive soon. Good luck for anyone here that will have interview.

congratulation smile.gif !!!
anyway, I would like to ask, I know that my journey to becoming US citizen is still quite long, but I would like to know in advance where and how did you learn the civic test? so i could start reading wink.gif thank you

US Citizenship General DiscussionAfter 3 yrs or 5 yrs?
I have been reading and observing some of the post in this US Citizenship forum. Right now I am confused thinking whether it is a better option to file for citizenship based on 3 yrs marriage or just wait after 5 yrs. The reason is I thought that this citizenship stage should be more simple than ROC stage (for the 3 yrs application). We don't have to send evidences like we do in ROC. Apparently I found some people submitted or got requested by USCIS to have to submit more papers than what are asked in the N-400 application form instruction. So my question is, to those who have gotten their US citizenship without any bad record in their background and have simple case, do you think it is better to apply based on 3 yrs or 5 yrs to avoid all the hassles?

David-and-Mae, just curious how was the story that in the end you and your husband were allowed to be seated together while you had your interview? I mean I know when we got to the service center the security guard only allowed us to come inside (like in my ROC Biometrics experience, the security asked my husband to wait outside)

Thank you ;)

NickD, wow, looks like your wife's experience in naturalization was almost the same as the ROC. I mean, I thought Naturalization, even though based on 3-yrs marriage, will be more simple and less documents to be submitted. I guess David-and-Mae is right, it really depends on the IO. Anyway, I see that your filing location is at Nebraska Service Center. Did you send it over there because of you're in the military? Anyway, thank you for sharing your experience and responding to my post :)

You are correct; the checklist in fact says, at the top, "Only if required, send...".

:P yes, you're right, I only focused on the sentence where it said "If you are applying for naturalization on the basis of marriage to a U.S. citizen, send the following four items" I didn't relate it with the very TOP of it :P

Thank you for answering my question Penguin-ie

US Citizenship General DiscussionCitizenship based on 3-yrs marriage
Hi, I am still one year more to be eligible for naturalization based on 3-yrs marriage but I have a question about the checklist of documents that need to be submitted. My question is if this marriage is the first time for both me and my husband, all we need to submit is just the other three items (#1, #2, #4)right? cause I am kind of confused that the heading clearly said "send the following FOUR items" and it doesn't explain if the USC spouse have been married before or not.

1. Evidence that your spouse has been a U.S. citizen for the last three years:
Birth certificate (if your spouse never lost citizenship since birth), or
Naturalization certificate, or
Certificate of Citizenship, or
The inside of the front cover and signature page of your spouse’s current U.S. passport, or
Form FS-240, “Report of Birth Abroad of a Citizen of the United States of America,” and
2. Your current marriage certificate; and

3. Proof of termination of all prior marriages of your spouse-divorce decree(s), annulment(s), or death certificate(s); and

4. Documents referring to you and your spouse:
Tax returns, bank accounts, leases, mortgages, or birth certificates of children, or
Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past three years, or
An IRS tax return transcript for the last three years.

I really appreciate if anyone can clear this up :)

US Citizenship General DiscussionApplication Number Changed?
My wife's N400 application was rejected based on "Home Address Field Not complete". Well it was ALL complete. We scanned and sent to our Senators Office and they contacted the lockbox. My wife received e-mail saying accepted and being forwarded to the NBC. It has been 20 days and still no NOA. I checked the receipt number/application number sent in the e-mail and it is different than the NBC* application number on the original rejection letter. Is this Normal - the application number changing like that? I can track the NBC* number that was on the rejection letter and it still says they rejected it. On Case Status the new NBC* that USCIS e-mailed us is not recognized. Up until now the process has been somewhat a breeze..Now in the home stretch it is seemingly getting worse.

We did file INA 319(b) as I am overseas on government orders and I have seen similar rejection notices from folks filing as we. But the application number change and no NOA yet worries me. Will call tomorrow but wondering if anyone else had this happen.

Chin is Up -

US Embassy and Consulate DiscussionK-1 Thailand
I just accompanied my fiancee to the US Embassy in Bangkok for her interview last week. She was approved and got her visa three business days after the interview.

Here is what else I learned. Make sure you have the original birth certificate and original I-134 notarized form and original Police report to give to the person doing the interview. I think if we didn't have the original documents, they would have had us come back at another time, so be warned to bring original documents with you.

What else, we got there at 7 AM and it seems that they don't necessarily call you up in the order you get there. A few ladies were rejected because their fiance's financial situation wasn't good enough and one because of insufficient documentation.

It was interesting listening to the K-1 interviews, as well as those applying for visitor visas. As others have said, if you sit close by, you can hear what they ask. My fiancee had a little tough time answering the questions, so I am glad I was there. I had to step up to the window and clear up a few items.

They do try to help, but my fiancee did not understand the the way the interviewer asked his questions. He asked, what year did you meet your fiance and she screwed up the falang year. If he had asked how many years have you known your fiance, she would have been OK. Just a small point, but if I was not there to correct this, she probably would not have gotten the visa.

It doesn't seem like the interviewer looked at her packet at all, so all the good information to verify things probably won't be used, your faincee will have to know these things. A Thai person stood next to the interviewer, so if your fiancee doesn't understand, make sure she says so and speaks Thai if she has to.

As far as picking up the visa in Bangkok, this is done at 3 PM at the embassy. It takes all of one minute and is very fast. The day we went back, there were only 5-6 ladies there to get their visas.

Can't edit the previous post for some reason, so:

One thing that I did notice with the packet 4 (medical evaluation forms.etc..) was that the U.S. Embassy wants to know if the Thai fiancee was not married in an undocumented marriage (not registered with the Amphur). She needs to get proof of that. Yes, sounds very strange, doesn't it? How do you prove that she was not in an undocumented relationship. Luckily, my girl friend talked with the village "adan" or what ever they call the village head and she knows where to go and what document to get. That threw me for a loop, only in Thailand.

I emailed the U.S. Bangkok Embassy rearding having Thai documents stamped certified by the Thai government and this is the reply I got back from them.

"Thank you for your inquiry. Thai official documents do not have to be certified by Thai government. Normally, we require translated documents only in the case that the document is written in third language."

So it doesn not appear that you have to have them stamped certified. Anybody else had any experience with this? The original poster seems to have moved on.

Also, when your teelak goes to the national police center in Bangkok to get the background check done, it says to take two passport photo's with you. Well, as of two months ago, they take the pictures and put it on a computer, so they did not use teelaks photo's. Be aware, she will have to fill out some paper work and many of the ladies where having trouble with the forms and how to fill them out. The police folks working there are very nice and helpful though. This department was top notch, really good service!

Congratulations!

I have a question, what do you mean by "stamped certified"? I know you mention immigration office, however, would a translation service certification stamp be sufficient? if not, does my fiancee need to head to the Soi Suan Plu, Bangkok immigration office to get an additional stamp?

Thanks.

I'm still wondering the same. I know the OP said to have a few papers stamped certified by Thai Immigration, just want to make sure.

We just had a translation service give it their stamp for the birth certificate and house residence paper. If it has to be from the Thai government (immigration Office), please let us know and where you are supposed to get this thing stamped. Thanks.

#1. Make sure that your Thai finance’s Birth Certificate and House Residence paper be translated and “stamped certified” by Thai immigration. I read on this website someone wrote that the translation is only needed for when you get to the US, that the translation can be done in the usa, that all you need for the interview is the originals.>That’s wrong! Yes you need the originals and you need to get it translated now, before the interview. Also get it stamped by the Thai Govt.

#2. The DS-156 must be filled out online on the US govt. website.

#4. You need to go to the post office across the street from the consulate, behind the Sidhorn building to pay $100. dollars in order to pay for your K-1 Visa. You cannot pay for your K-1 at the consulate. Just go into the post office and tell them you need to pay K-1 Visa American Embassy, they will understand, they will give you a receipt. ANDREW

Andrew,
Thanks for all the information. I would have missed the above highlighted items and have a few questions.

What is the house residence paper that is referred to? Maybe I just need to search more, but don't know what it is.
Also, these paper MUST be translated and stamped by Thai Immigration? Where are they located, if yi remember (or again, maybe I have to search more.

Thanks for the heads up regarding the DS-156 form, I found the official form needed at https://evisaforms.state.gov/ds156.asp

If anyone knows why you have to go across the street to pay a fee at the post office, just curious what fee this is?

Again, thanks for posting these details! It can certainly save the rest of us hours or even days when going through this!

It took 2 months to get the NOA2 from when USCIS received the packet. I was surprised, as I was expecting it to take much longer.

US Embassy and Consulate DiscussionReceived NOA2 a few weeks ago, and now the Jakarta embassy has recieved the approved I-129F petition
It's been a little while since I posted on here, mainly because we've been just been playing the waiting game.

Well, a few weeks ago, I got the NOA2 in the mail. My petition for Syelvia got approved!

I got the letter from the NVC with the case number on it.

I received an email from the US Embassy in Jakarta letting me know that they received the approved petition, and they sent me a bunch of attachments. It looks like the only one that I fill out is the affidavit of support. The rest is for Syelvia to fill out.

Knock on wood, but so far this process has been painless. Thanks to everyone here for all the advice upfront when I sent in for the petition a few months ago.

Now for some questions:

1) For proving assets on the I-134, can I use my IRA rollover? I have money sitting there in cash. Not sure if there's any stipulations for that, since the money is there and can be withdrawed if needed for hardship.

2) In 2007, I worked as a w2'd loan officer for the 1st half of the year, then as a self employed mortgage broker for the 2nd half of the year. I'm assuming that when I claim my annual salary, I can use both of those, and just add my w2 income to my 1099 schedule C net profit, and call that my annual salary. Does that sound right?

3) I've heard people mention showing proof of ongoing relationship, but I haven't seen any documentation that we're getting popped to provide anything. Is that something I still have to furnish, or would that have come up already, if I didn't make a strong enough case in the initial packet? Not worried about anything, and she'll nail the interview, but I'd definitely like to take the path of least resistance & handle anything before it comes up.

Thanks for all the advice!

US Embassy and Consulate DiscussionI-134 or I-864?
Send both just in case. (I-134 & I-864)?
Heads up all!
Not to cause alarm but I went to the NVC website http://travel.state....forms_1342.html and at the bottom they declare “Important Note: The NVC cannot accept Form I-134 for immigrant visa processing. ohmy.gif The NVC only accepts the appropriate I-864 form(s) listed above.”

I realize this is two separate entities, and two separate forms. I did not send my I-134 with the Petition to USCIS, and I have sent nothing at all to NVC; it goes from USCIS to NVC. K Visas require the I-134.

The Embassy/Consulate in Colombia site says they want the I-134 Affidavit of support.

I am sending the I-134 with the package to fiancée for her interview and as a precaution I am also including the I-864 for her to carry just in case they ask for it. Better safe than sorry! wacko.gif

Thoughts? Concerns? or just heads up take your pick!

US Citizenship General DiscussionN400 Interview (VAWA)
I was married to a USC for 4 years who abuses me for the time of our marriage. Since I am a foreigner here, I do not know any better. In January of 02 I got married with my USC husband all is well until his gambling problems took over the relationships,I work day and night and all he does is get my paycheck and deposits it to his account to sustain his habit. If I do not give in to his wishes he would hurt me. I was abuse in a way that I would not want no one to encounter. He left and divorce me, and since I am so ignorant at that time. I was left with nothing. Not a penny, not any clothes and worst no paper work as to which stage am I on my Immigration. To make the story short, I was left with NOTHING, and do not know where to start. In 2006 I found a lawyer that was willing to help me build my case and that is when we file I-360.In Jan of 2008 I gain my GC. Since my X husband is a USC i was told that i do not have to wait 5 years and that I am eligible to file My N-400 on Oct 2010. Which I did,And now my long awaited interview is set third week of March 2011. I am very nervous as to what to expect on this interview.I have studied my history of the United States,My only worry is in Aug of 2009 I remarried, woud this be a problem?Does this mean I do not fall on the 3 year rule anymore? Does this means my waiting will fall onto 5 year rule now? I was hoping that I can find an individual with the same case as mine. Your response will be greatly appreciated and would mean a lot to me. May we all be blessed on our future endeavor.

US Citizenship General DiscussionInterview Experience

Know your N-400 extremely well and the reason why you answered all the questions the way you did is the very first thing. And better to provide too much evidence than not enough. Be able to quickly snap back answers to the civics test, English test is nothing short of a joke. If a decision cannot be made at this time, ask politely why. My stepdaughter didn't do that, maybe that could have been cleared up then and there. If passed, politely ask about your oath ceremony and when you can expect to receive it.

Always some kind of bug up their butts, two years ago was a worthless utility bill for evidence, today is traffic violations or parking tickets and proof you paid for those. Neither was in any of their instructions or in the M-476 manual. But they can do anything they want to.

Was prepared for my wife, she asked me why I put her name on our electric bill, even after all the evidence she provided, was asked for that piece of worthless evidence, her IO's mouth dropped when she handed that over. Wasn't prepared for showing proof of small traffic violations for my stepdaughter, like an 86 buck fine and proof she paid that, that I feel started the whole thing. But then in her letter, was we don't need proof that fine was paid. Had to answer battery charges instead when she was 17 months old.

Trying to think of what they will come up with next, maybe you should bring your birth certificate even though they don't ask for it to prove you were not a member of the Nazi party in 1933. But if you were of legal age at the time, that will make you 99 years old today.

Just had my interview for my citizenship and i got approved, if you read the guide you should be fine. Goodluck, I will be having my oath taking on the 10th of this month.

US Citizenship General DiscussionVAWA - citizenship after 3 years but remarried - HELP

Hello,

I have a question regarding VAWA and US citizenship.

VAWA petitioners who received their residency through VAWA and want to apply for US citizenship are eligible three years – not the usual five years – after receiving residency. Of course, these victims of abuse need not live with or be married to the US citizen or legal permanent resident spouse as far as I know. Am I correct?

Now, here is the actual question. Let’s say that the VAWA individual divorced after receiving the residency, and has remarried since then. Will the VAWA individual still be able to apply for US citizenship after 3 years through form N-400 even though the individual remarried another person and is married to this person right now? Also, would it make any difference if the married person is in the US as an F1-student?

Thank you for your help!

I have been a VAWA applicant and was approved, I got my greencard in January 2008. Got remarried and in 2009 and got my citizenship of May 2011. All I can say is, Vawa applicant can get their citizenship if they remarried with a US Citizen. In the event that you remarried with a LPR you will have to wait 5 years. With the F-1 status, honestly I cannot tell. I was a little hesitant as well if I can apply for my citizenship after 3 years and gaining my greencard through VAWA but with research and all I found an answer to my own question. I even called the the 1800 number to double check, and I was told to wait 5 years, and then I introduce him to the INA 319(a):

Any person whose spouse is a citizen of the United States, 1/ or any person who obtained status as a lawful permanent resident by reason of his or her status as a spouse or child of a United States citizen who battered him or her or subjected him or her to extreme cruelty, may be naturalized upon compliance with all the requirements of this title except the provisions of paragraph (1) of section 316(a) if such person immediately preceding the date of filing his application for naturalization has resided continuously, after being lawfully admitted for permanent reside nce, within the United States for at least three years, and during the three years immediately preceding the date of filing his application has been living in marital union with the citizen spouse 1/ (except in the case of a person who has been battered or subjected to extreme cruelty by a United States citizen spouse or parent), who has been a United States citizen during all of such period, and has been physically present in the United States for periods totaling at least half of that time and has resided within the State or the district of the Service in the United States in which the applicant filed his application for at least three months.

He put me on hold and when he came back he apologizes and said that YES I am correct and I am eligible, hope this helps, and goodluck. Make sure you keep a copy of your N400 for your reference.

I would guess it's where you live at interview time.

That's what I was thinking, just need to be sure!

Thanks good.gif

Sounds like an I-864 question and perhaps answered in the "K-1 Fiance(e) Visa Process & Procedures General Discussion" section of this board. Have to say, when I met my wife and we wanted to get married, didn't expect anything like the I-864 and that form seems to contradict the entire action of the I-751. I mean the I-751 is suppose to discourage you as a USC sponsoring citizen from marrying an alien just to bring you into this country. But with the I-864, you are putting your head in the noose so to speak as even with a divorce are held liable for that person. And the I-864 is only the tip of the iceberg if you live in a state where prenuptial agreements are not recognized in a divorce court. A USC would be nuts to marry an alien for the prime purpose of bringing them into this country. But that isn't enough for the USCIS, have to provide all kinds of proof, and all over again for the N-400 to gain USC for that LPR that status wasn't easy to get in the first place.

Anyway, if you don't have enough bucks, can't even pass the first stage, so much for that old proverb where two can live cheaply as one. I just hired a good immigration attorney to handle all this stuff, did that after lots of checking, had other things to do, a job, my own kids, and the time I wanted to spend with my wife to be. But was a shock with first the I-864, then after all that to only receive a conditional green card with the same proof again for the I-751, then to have to go through the same stuff again for the N-400.

Sounds like 3,000 bucks per year is cutting it close, that's about 60 bucks per week or 12 bucks a day. But maybe not easy to do in todays economy.

I'm not at all sure what your talking about this not about a K1 I-864 I-175 or " don't have enough bucks, can't even pass the first stage"

This is a topic on 2008 Poverty Guidelines and my move from Hawaii to mainland ohhh and i'm doing a k3 so I think i'm in the right place?
