Hi, I would like to ask your advise. I am going to file for ROC this June but as usual I am a bit paranoid so I am starting to gather evidences from now. What I want to ask is about my apartment lease agreement. The story is like this. I came to the US after my I passed my interview on Sept 5th, 2009. Before I got my visa my husband, who is the petitioner was living in the military base. So by the time I told him that I got my visa and was going to the US he was trying to find for a new apartment outside the military base. He managed to get the apartment for us, but since that time I was on my way to the US and he had to sign the lease agreement, so he just put my name in the lease but since I was not there at that time, so only his signature on the lease, not mine. But there is my name on it. Oh, but when we renewed the lease 6 months later I signed the renewal lease. Do you think it is okay?

The house is something I bought back in 2004 with my parents so there is no house/utility/etc with both our names but here are the rest of the things I've sent. Hopefully, no hiccups.

1. Form I-751 signed by the petitioner and spouse
2. Check of $590.00 for application fee
3. Copy of petitioner’s green card
4. NCDMV issued driver’s license of both petitioners
5. Marriage certificate (copy)
6. Joint checking and savings bank account statements
7. Joint Federal tax return transcript for 2008 and 2009 and copy of our 2010 joint US tax return
8. Joint NC State Tax Return for the year 2008, 2009, and 2010
9. 401(k) plan beneficiary forms of the petitioner showing spouse as the beneficiary
10. Beneficiary Designation Form for the 401(k) plan of spouse showing petitioner as one of the beneficiary
11. Group Life/Travel Accident Insurance Policies of spouse showing petitioner as one of the beneficiary
12. petitioner’s HSA Beneficiary document showing spouse as the beneficiary
13. petitioner’s employment benefits for the year 2011 showing spouse as beneficiary
14. Joint stock account statements for the year 2009 and 2010.
15. Car insurance renewal notice of the petitioner showing spouse as a driver
16. Joint 2010 Health/Dental Insurance documents
a. 2010 Dental Insurance claim history
b. 2010 Health Insurance benefit and statements
d. Hospital bills showing spouse as Guarantor and the petitioner as patient.
17. Joint Sam's and AAA membership
18. Copy of Discover and MasterCards cards showing a joint credit card account
19. Joint cell phone bills
20. Three sworn affidavits by mother-in-law, sister-in-law, and a friend, attesting to our relationship and marriage
21. Airline tickets, rental car receipts, hotel receipts, and entrance tickets, etc for vacation/trips to PlaceX, PlaceY, and PlaceZ
22. Pictures of vacation and with friends/family
23 Invitation card to our names.

You said you don't have a driver license... my husband doesn't either yet, but he did get a State ID. Then I just made a photocopy of my driver license and his state ID next to each other to show we lived at the same address.

(Congrats on the baby!! My brother's wife is having a baby in October too, and I am so excited to be an aunt :))

Thank you, yes I am excited about this pregnancy, that is why I do not want when my belly is getting bigger and I have to worry about dealing with USCIS :no: Oh, I am an aunt too, so I know how you feel :yes:

Yep, looks pretty good to me too. Some suggestions would be utility bills/loan documents in both your names. If you filed any medical claims under your husband's insurance, you can add the explanation of benefits for those. Also anything your husband has, showing you as the beneficiary (such as 401k, life insurance) and vice versa. That's all I can think of right now. Good luck!! :thumbs:

Stardust72, thank you for your suggestions, but unfortunately I don't have any utility bills with both our names on :( and I think I only have one medical claim that I filed so far, cause before that in the military we went to military treatment facility and it was free over there, just when I went to civilian healthcare provider that I have a claim to file for.

Hi,it is almost time for me to file for ROC. I am supposed to file it on Mid June this year but I want to start to gather the evidence now and ask for your advise. Your advise is greatly appreciated and it is open to all who have been through this stage or are about to send it too like myself.

Here are some evidence that I already have and plan to get one soon:

  • Power of Attorney from him when he was deployed, giving me the right to enroll in DEERS (Defense Enrollment Eligibility System)so that I could get my military ID card and eligible for Healthcare insurance by TRICARE
  • My husband's Post 9/11 GI Bill application which shows my name as the emergency contact and our relationship as spouse and our same address
  • My husband's school application which shows my name as spouse and emergency contact
  • Itinerary and plane ticket to Montana together in 2010 to visit his parents
  • Photos that has our pictures together and family
  • Affidavits from 2 people who have known us
  • Miscellaneous copies of documents from Department of Defense showing our names and relationship and address
  • Copies of letters and cards to our address
I think that is all I can think of and I am planning to submit. I do not have driver's license cause I can't drive so there is no car insurance or title either, and no child's birth certificate, cause our first child is due this October :)So, what do you guys think? I really appreciate your suggestions.

I just sent my package today, and what I can tell you is that you have way more evidences than what I had.
One advice I read here on the forums and I think is important for you and everyone else to consider:
Every case is singular and unique. I really believe you have plenty of evidences and should not be concerned.

Hi MichaelOlesea, thank you for your response. No, I do not have State ID either. I am planing to change my last name during this ROC stage, so I'm trying not to make a new ID with my old name just until I get my GC with my new married name. The only ID is the military ID, that shows my husband as a sponsor, his rank and his SSN. But I guess I will include a health insurance claim print out that has an address and both of our names :) thank you again, hope you too will have a smooth ROC process.

Sounds like you have a good amount of info together. Only other things I could say is maybe you can send something that proves you are pregnant and possibly if you have any Christmas cards or wedding invitations addressed to you both...or maybe some utility bills like electricity, cell phone, or water if you have it. :) Good luck!

Hi Amanda&Raad, thank you for looking at my post and your response to it. That is a good idea, I am going to try to get a letter from my doctor that I am pregnant later this month. Yes, I was going to include a wedding anniversary card from our family and also there was a check addressed to both of us. I want to get the cell phone bill, but when I opened the Verizon website, I am having problem with finding where I can get a print out that has both my number and his. What is your phone provider? maybe you can give me an advice. :) Thank you again !

Have you looked at the ROC papers and whats needed? There is no sponsorship and no income needed.

You may want to look at ROC guides.

Hi, I would like to ask if the sponsor's income has any effect on ROC approval. My situation now is that when I was granted the 2yr conditional GC my husband was in active duty in the Army. But then since November 2010 he joined the Army National Guard cause he is going to school and we live mostly using the Post 9/11 GI Bill. He only works part time, and I don't work since I am pregnant now. Basically, being in the National Guard has he gets less income that when he was in active duty. I am going to file my i-751 this mid June. Do you think this kind of thing (lower income) will affect the ROC? Also I would like to ask if it is okay for me the non USC to use the WIC benefits? Thank you so much for those who care to read and help me :)

Hi, I already have some of evidences for my ROC packet. But I can not make a decision whether to include these stuffs or not. Just wondering if you guys can give me your opinion. Here they are:
  • Baby's ultrasound photos
    Now I am having our very first child together, the pregnancy is 19 weeks now, so I have 12th and 16th weeks ultrasound photos.
  • Car insurance
    This is joint car insurance that has my name on it as well as my husband. My concern is just this joint insurance starts not too long ago, which is on May 2011 while I am about to send my packet this June 13th. I was just thinking probably USCIS will think what happened to the previous month and year. Well, that is just my thought.
  • Verizon bill statement
    We have a family phone plan for the two of us. But in the online bill statement there is no my name on it, just my husband and our phone numbers. We both can not figure out how to put my name in the statement.

So, what do you think, which one should I include and not? Thank you so much!

Guys, I just got an affidavit from my mother in law. The affidavit looks good, it states that she made this affidavit for me (in my full maiden name) and my husband (full name). But when it comes to the part where she described her relationship with us, how she knew me and so on she addressed me with my nickname :bonk: . The same nickname when she called me when she sent cards to me.

My question is...is it okay? should I just leave it like that or should I put my nickname in the I-751 form referring to other names used ???

Please..please..please..I live in Hawaii and she lives in Montana, and I am planning to send my packet on Monday next week. Need your advice. Thank youuuu

It is really up to you. Since I put tabs at the bottom of the papers I submitted so I did make table of content to make the IO find the documents easier. I received my 10 yrs GC exactly after 3 months. Good luck!

Yaaaaaay :dance: this morning I got an email from USCIS that today, Sept 7th 2011, they ordered production of my new green card. I am so happy :dance: Now I can relax and wait for my baby boy to pop out this late october :P Well, I will post again when I receive the card in my mailbox.
