K-1 Fiance(e) Visa Case Filing and Progress ReportsTime between NOA1 Text to Hardcopy?

I was just wondering if anyone else had a significant wait? We got the NOA1 text message on August 13th, and 14 days later we still don't have the hardcopy. Is this normal? I do notice a lot of people get them within a week apart, so just curiosity here.

 

I looked at several timelines and I noticed that on average, people get the hard copy of their NOA1 after 15 to 20 days of sending the packet. I could be wrong... we're still waiting for the hard copy of NOA1 too. got the email confirmation Aug 23. i'm hoping my fiance will get it on Friday. (crossing my fingers)

You have 90 days to get married upon arrival to the United States. Your K1 visa is valid up to 6 months after approval. Sorry about your situation. I wish I can say something to make you feel better sad.png

Hello. I have considered hiring an attorney. However in the small town I live in. Their are NO immigration lawyers....


1. Do I have to use an immigration lawyer, or can I use just a family lawyer.

2. Does the lawyer have to go to the interview with us or can we go alone.

3. Will using a law firm have ANY benefit to it.






 

My fiance considered hiring a lawyer because he doesn't have the luxury of time to sit down and read and read and read. We asked for advice and someone told us that "a lawyer will just take you to the cleaners". If you have a lot of money to spare, sure you can get a lawyer but it's not necessary in my opinion especially if you don't have any issues (i.e. criminal records, overstaying, etc.). Doing it on your own will test your patience and tolerance but it's going to bring you closer. Everything you need to know is in this website and if you get stuck, you can always ask questions here and I'm telling you people are very helpful. It took us more than a month to file the petition but I'm glad we did it on our own. Its your visa so you should be in control. Maybe it's just me but I hate not knowing what's going on. Just keep reading until everything is clear to you. I read and read and read for weeks and I ended up dreaming about the procedure haha!

i did get my NOA1 hardcopy in the mail, where on it does it say your center?
and i thought that it had to go to CSC or VSC to get your NOA2. i live in alabama, so it would be Vermont for me. but can the TSC approve NOA2s also?


 
My fiance hasn't received the hard copy but on the email it says "Your case has been accepted and routed to the USCIS Texas Service Center for processing".

This form is wack there are so many errors, I can't even fill out my Fiance's complete phone number bc there are spaces missing... Does anybody know how we can file a complaint?

 

I wouldn't bother filing a complaint if I were you. My fiance is about to file the I-129F package then we found out that they updated the form. We were both pissed because the form is nuts! There's not enough space for the address and phone number. I don't like that they split it into two columns either. It's so confusing! Somebody else made a post about this topic and other people suggested to just use the older form. So, that's what my fiance is going to do! We're not gonna mess with the updated form.

I have never filed before for anybody, this is my first petition.

 

 

We left that blank since a waiver doesn't apply in our case. Read that part above that question where it says "If your beneficiary is your fiance(e) and a.) this is the third (or more) I-129F petition that you have filed and so on ...."

But to answer you question about  #18 is about having met in person within the past 2 years, USCIS wants to know the circumstances of THAT meeting. 

 

The question isn't asking about the evolution of a relationship.

Any other tips on sending this petition? What are some things you guys included ? Also if you dont mind me asking what did you put it in to send it ? like a binder ? or sheet protectors ?

 

We used sheet protectors just because we didn't wanna punch holes on the documents. It took us more than a month to send the package because my fiance is a little OC, he went over it like 4 times and made sure he did everything right. He caught even the littlest mistake and if we get an RFE, I'm sure he's gonna flip lol. I created a checklist, let me know if you want it. I'm not saying it's the bible but at least you can compare notes smile.png


 

Almost correct. The part I bolded is not quite though. I-129F petitions are not routed to one of the 4 centers. Not all of them process the I-129F petitions. When filling out I-129F form, what do I put in the middle name?

In our home country, Philippines our middle name is the maiden last name of our mother and sometimes you are given 2 names.. for example:

Given Name: Paul Joseph
Middle Name: Santos (maiden last name of the mother)
Last Name: Reyes (last name of the father)

But I heard in the US, middle name is "Joseph" and they arent very particular with the "Santos" only when they ask for your mother's maiden name, then the "Santos" will have to show up.

I don't know if I explained my concern clearly but we need help on this.

I'm wondering about this too. When we filled out the G325A and I-129F, I didn't put any middle name because technically I don't have one. The problem is- on my passport, my middle name is my mother's maiden name. I hope the USCIS people know that in the Philippines this is how we refer to names: Middle Name (US)= Second Given Name (Philippines) and Middle Name (Philippines)=Mother's Maiden Name (Philippines). I hope I'm making sense lol. Unless you are from the Philippines, I suppose it's hard to understand. 

 

I'm assuming you already filed your petition. Did you get an RFE for that?

 You need to make sure you are using the numbers on your telephone keypad that correspond with the 3 letters in fron of your receipt number for example mine was: WACxxxxxx9949, so I had to type in 922 (WAC) and then my 10 digit receipt number.

 

Arrgh no wonder it keeps telling me I'm not entering enough digits lol. Thanks for your help! I tried it now and it works smile.png

Not an issue.  Calling to USCIS is useless since they have not means to match your conversation with your petition package.

 

Send a corrected form IF you get an RFE.  Otherwise, send a corrected form to the interview.

 

I'm trying to get a hold of a customer service representative right now but all I hear is that automated response. it asks for the receipt number but it always says i didn't enter enough digits. i swear i'm punching in 10 numbers! i just want to make corrections before we even get an RFE :(

Thanks for this post. We actually have the same problem now, well kinda! I didn't write anything on the middle name field because (technically) I do not have one. I only have one given name. the problem is in my country (Philippines), they refer to the mother's maiden name as the middle name. I followed the format on how they write their name in the US. you're not going to include a cover letter? what about boarding pass and airline ticket? you don't need to include your pay stubs and tax information to the I-129F package. For the birth certificate, only the petitioner's is required at this time.

OMG!!! The wait is killing me, I'm sorry I am very anxious over this whole process!!!! I am trying my hardest to be calm. Hope I am as lucky as you and have mine processed quickly. Our anticipated wedding date is July 2014 but we are ready to move it as needed.

 

Relax and get yourself busy with other stuff. Try not to obsess about other people's timeline. you're just going to drive yourself crazy when you read others  getting approved here and there especially when they have filed at a much later date than you did. I'm speaking from experience hahaha! There's nothing you can do anyway but wait. Some people got approved in 19 days and some have to wait for as long as 5 or 6 months. That's just the way the cookie crumbles ;)

     Good afternoon all and thank you for all of the advice and positive responses. I'm sorry to keep everyone in suspense but I needed some quiet time after an emotional past couple of days. As I said the reason I delayed bringing Kelly to the United States was I lost my job during the visa process. I still haven't found work (I'm surviving on unemployment and savings) but I decided at the end of October to bring Kelly to the US so the visa wouldn't expire. Kelly has been very supportive throughout my ordeal (she has been out of work as well). When I arrived in Colombia and Kelly told me the visa expired earlier than I thought my first instinct was to get on VJ and ask you guys for help. As I was on the internet trying to change our flights I started thinking about the life in America I was bringing Kelly into and how my father told me a long time ago to get your financial situation straightened out before bringing a woman into your life. I'm not working and I'm living in my parents house until I find a job. My parents said it was alright for Kelly to stay there but it's not an ideal situation. After much thought I decided it would be best to not bring Kelly to America and figure out our best option to bring her when things get better in my life. I knew this decision would be risky because Kelly would have every right to break up with me after being so patient and supportive throughout this process we started in August, 2012. When Kelly arrived at the hotel I tearfully told her in my best Spanish my plans and expected her to be angry and end our relationship. To my surprise she said even though it's a last minute decision and she's disappointed, she understands my reasons and she said she wouldn't leave me and she'll wait again through another process. She knows how hard I've been trying to find a job and she is not the type of woman to walk away from a man she loves and treats her so well. We both cried and I thanked God for blessing me with such a special woman. I won't let her down again! This morning we discussed the benefits of the spousal visa and talked about me returning in a few months and getting married in Colombia. I have 2 job interviews this week so maybe we'll receive the blessing we've prayed for. Of course, I will keep VJ updated on our immigration journey.      

 

Wow almost like my story. My bf visited me here back in 2008 but sadly, we had to postpone our plans because he wasn't making enough for two. let's just say reality kicked in. so, he went back to school to finish his degree, bought his own house, found a better job, straigthened out his life and almost 5 years later we saw each other again in Singapore and had the best time of our lives. now he has a great job and we couldn't be more ready to tie the knot. I'm so glad I waited for him. best decision i've ever made. I'll have my medical exam and interview next month then fly there in the US in April then get married in June (hopefully on our 6th year anniv.) 

Good luck to you and your girl. Stay strong and remind her all the time that you love her and you're doing everything for you to be together. You'll make it as long as that's what you both wanted.

"Are they really heartless people interviewing?" You see it's not about being "heartless". Rules are rules and we all have to follow them. You can't be emotional about this. My fiance and I had the same concern. We didn't see each other for 4 years (someone please give me a pat on the back!) because of different reasons and we were thinking- file the K1 visa then meet up later. I did my research and it seems like there's no way around it. So I waited and we finally met again in June. Our second meeting was only for five days but we did what we have to do because we know we can't file the visa unless we meet again. People who responded to you are right when they say that the "have met within the past two years" rule is iron clad.

(As amended by Executive Order 227)


Also she may contact National Statistics Office for her divorce papers to attached in marriage contract before, so she will be cleared in the Philippines.

She is a permanent resident of Japan and divorced in Japan, no need to get an annulment in the Philippines, her divorce is recognized by and valid to USCIS. Japan is her home now, so the Embassy or consulate in Japan will handle the process.

She's still married only in the Philippines, otherwise, her divorce is as "good as gold" to the rest of the world. No lawyer is needed unless you have a complicated case.

My filipino Girlfriend resides in Japan under a permanent visa. She was married in Japan and has a daughter by a Japanese man. She was divorced in japan two years ago. Under Japan laws she is legally divorced . Under Philippines law there is no divorce procedure only annulment. Will she be required to undergo the annulment procedure before we can apply for a fiancee visa for the USA. Since she is living in Japan can we apply for the fiancee visa there. This situation is confusing to me. Any advice is greatly appreciated
