US Embassy and Consulate DiscussionK1 VISA SUBJECT TO ADMINISTRATIVE REVIEW in MANILA EMBASSY.

There is only one solution is to get married in Philippines as there are very few selected for AR after being married.

I'm not sure where you get your data from, but I'd disagree with this statement (though I don't have the numbers to back up my belief). I would think it would be logical that the immigration folks would take a much more aggressive look at those that claim to be married already rather than those applying for a fiancee visa. Maybe the "AR" would come at the USCIS or NVC level, and BEFORE it reaches the embassy. Which is why these visas tend to take longer for approval.

US Embassy and Consulate DiscussionIm so sad. My interview not successful

AnneiyAndJacky,

The consular officers in Manilla are known to be quite strict on the public charge issue, and based on what you have said the officer made the correct decision that you do not meet the requirements.

Two things that you might try:
- resubmit the financials to include the fathers pension
- your husband might get a part-time job to increase the family's income

Yodrak

That's a much better solution to the situtation than throwing away money for an attorney who can't change the letter of the law.

US Citizenship General DiscussionPlease help....not sure what to do!!!!

Seems like N-600 should apply.  Check out the instructions here: http://www.uscis.gov.../n-600instr.pdf

It looks like the BF is number 1 under "who should apply."  But since this situation is pretty confusing, I'd strongly suggest a lawyer on this one!

US Embassy and Consulate DiscussionInterview Preparation?

I too agree with whatever has been said above.

If everything is in order, they really do not have a reason to deny you. Its the waiting before the interview that causes all the anxiety and tell your spouse to stay calm and it'll all go well. They aren't there to heckle you. She'll probably be asked very general questions, sort of crosschecking with the forms, and may be asked for photos. Good luck.

US Embassy and Consulate DiscussionInterview Preparation?
Carry ur passport, photographs, photocopies of all documets which u have submitted (in case if they will need),medical reports, vfs receipts. And main thing is carry evidence of ur relationship. Like wedding album, honey moon pictures ,other pics, phone/email/chat records and other things if u have.

Nobody know what will happen at interview. As in ur case u have all clean things, then it will be fine. Sometimes they can put u into AP,if they need more evidence for ur relationships or if they want some more background and name check. Sometimes if ur affidavit of support is not enough then they can ask for a co-sponsor.There will be some more reasons. But this happens only rarely. So dont worry.

As u have all things and u have good preparations to give answers of their questions, then u will be ok.Just go with positive energy like they will issue ur visa easily. Good luck for ur interview.

US Embassy and Consulate DiscussionI-134 Affidavit of Support

We ticked "intend" and wrote "I will provide room and board for Vanessa indefinitely. I intend to marry her within 90 days of her arrival to the United States." We had no issues and were approved without RFE.

I don't know where people got the idea it's an answer for Student Visas only.. i haven't seen anything to indicate that. I would not write "N/A" myself because the whole point of the document is to say that the K1 won't be a burden on the US government but I do know people who've done it that way with no issues, but also some who have (as stated above).

US Embassy and Consulate DiscussionAffadavit of Support

Thanks Otto, that was a great help :-)

Re my fiance's property, I think his mum is on the deed so you're probably right, it would be quite a lot of hassle...Thought it was a bit of a long shot...!

Forgive my stupidity but I just wondered how you calculated the 1080 hrs/yr which gave a slightly higher salary? I got a D for maths...!

I have been thinking about a co-sponsor for a while, and the person who is the most financially comfortable is my brother (he became a US citizen last yr) Would this be viewed as suspicious do you think? There isn't really any family member on my fiance's side I can ask, they either have big families or retired etc...

Hi they count 2080 hrs as whole year working hours, not 1080. They consider that one works as 40hrs/week and there are 52 weeks in a year,so it comes 40*52=2080 hrs. So Your fiace current income is 11.50*2080 = around 23k. They sometimes focus on this current figure & last year tax return figure (in ur case it $19500).This seems that it is above poverty lines. But if u want to be more safe & secure then you can use ur brother as a co-sponsor. As u said ur brother is USC,then why u think it would be suspicious??

In packet 4 they will tell u your interview date and ask and instruct u to schedule your medical. All you have to do is send the packet 3 check list to the consulate in Frankfurt and wait for the packet 4 then once u received p4 u can arrange ur medical.

Oh my!! How can they all in a sudden be booked all the way up to May?!

If you look at the Immigration Timelines here on VJ the last IV is for Feb. 5th and then it jumps to May...that's unbelievable!! sad.png

I don't even want to know when my IV is going to be then... :'(

I don't have any idea, I guess not everyone makes a timeline here in VJ.

And guess sometimes they just reply with a kinda answer to get rid of any other incoming emails or just to give u a concrete answer so you not bother them again by asking questions, or.... Idk

Yep you are right, I guess it isn't a bad idea to send them an email and at least know the reason.  Thanks smile.png

This is the response I got,

Consulate interviews are typically scheduled as a date becomes available.  This mean that the U.S. Consulate in Frankfurt is booked until May.

BTW, I don't know if I should do my medical examination or not as far as my interview date is given in May, and the medical examination results will be just valid for 6 months only.

I was reading your timeline. They scheduled your interview 4 months from now? I was seeing it was usually 3-4 weeks or did you ask for it to take place later?

No I didn't want my interview to be late and IDK why they scheduled it 4 months later... I was wondering to ask someone if it makes any deference! or is it normal bcz I have also seen that it usually takes 2 - 4 weeks or less.

Asia: East and PacificManila customs question
For my two trips through MNL, I made it through immigration and customs in less then 30 minutes. Now, leaving through MNL is another story all together. If you travel light and don't check bags you'll have no problems. Getting bags checked and then picked-up in the RP is an extremely painful excercise in patience. Of course, you may have to take a cab or shuttle to the domestic terminal to catch your flight to Cebu, that could take a bunch of time. I'd say plan on that taking you AT LEAST an hour, if not two.

Asia: East and PacificContacting Manila Embassy
I'm sure this has been posted a bunch of places, but I failed to find it, so appologies for my redundancy. In checking the Manila embassy web page, I found an eMail address and fax number that won't be answered for up to six-weeks. And they have a call center number of 1.888.877.9888 listed for people to call for general questions about status of your case, but nowhere do I see a telephone number to actually speak with someone "in" the visa center who can answer a specific question about a concern I have about our application. Does anyone know of the contact number to speak with someone at the embassy who can talk specifics and answer questions about our "unique" situation?

Asia: East and PacificSending money to the Philippines

I use a debit card from my credit union. It cost $1 per transaction, but is limitted to about $75 (PHP 4000) per transaction by the operator of the ATM.

If you do this, make sure that the debit card is on either the PLUS or CIRRUS network.

With my card, it takes a minute to shift money from 1 account to the other, seemingly. But in reality, it is not available to withdraw until the end of the business day at the credit union.

Not that it matters much. I keep about $450 in that account, and she rarely goes through 100 in a week. It can be very cheap to live in the Philippines.

It's about time we see your "brand" of wisdom on VJ!

I've used Visabuxx for my gal. The set-up fee is $12 and than it's $3 per transaction no matter how much you put into her account. Nice thing about it is the fact there is no wait-time for the money to be in her account once the initial linking of your account to the buxx card is established:

Asia: East and PacificFood, virus, sickness in Philippines?
Somehow, I've made it in and out of the Phil. three times without getting sick. And I was hardly playing it safe. Drank the tap water, ate from street vendors, all the stuff you aren't supposed to do, and I never got sick. I got sick after the third trip, but that was more likely due to the 23 hour flight, having to be cooped up with sick people hacking, sneezing, and otherwise spitting stuff-up on the airplane. Personally, I think the chances of getting sick are far greater on the plane flight over there, then actually being there.

Flights to anywhere in America basically. One-way from MNL to Portland, OR around $650 or if your going to east coast, the one-way fare on NWA.com is something like $720 to Harrisburg, PA. One-way going the other direction is a totally different story however.

Asia: East and PacificDS 156K question

Look directly under section 5 : ( it did not copy directly ).
THE FOLLOWING DOCUMENTS MUST BE ATTACHED IN ORDER TO APPLY FOR A FIANCE(E) NONIMMIGRANT VISA.
Evidence of Engagement to Your Fiancé(e)
Evidence of Financial Support
NOTE All of the above documents will also be required by U.S. Citizenship and Immigration

The whole chain of evidence and where it ties in is not very clear - It feels like a revolving door or a cicrular argument

As part of the K1 packet info sent to her in the Phil., in addition to all the required forms, they list a buch of "stuff" that must be supplied, including "evidence of relationship." I wonder if they expect a seperate set of "proof" attached to the form in addition to all the other "stuff" I'm sending with my fiance?

Asia: East and PacificFlights from Manila to USA

I had read someone here on VJ stating that immigration will have a problem with a one-way ticket for a K-1 visa. Is it possible to just buy a one-way and save the money?

What's the alternative? Buying an open-ended round-trip ticket that is valid for how long? The rest of her life assuming the marriage works out the way it is supposed to? I'd think a one-way ticket is the only reasonable way to go since you may be buying the ticket within a few days of use. One-way to from Phil: $650, round-trip: $1800.

I don't understand the CFO seminar requirment to renew passport. My girl on Monday went to the passport office and requested hers renewed. She will pick it up on Wed. They didn't ask for a CFO stamp. Though it is possible that she already had the stamp bcuz of tourist visa a couple years back.

Asia: East and PacificCFO outstepping their bounds?

I'm surprised that your petition was even approved since the minimum age for marriage in the Philippines is 18. I was under the impression that you had to be eligible to marry according to the laws of both countries. I can understand that the CFO would withhold their stamp until she is of legal age to marry according to Philippine law.

When I-129F was filed, they probably look at whether both parties were legally able to marry in the state he lives in. Often you can get married at 17 with parental permission. Don't think our govt. cares much about the Phil. laws of marriage when proccessing the application. BUT to get her here, you also have to be "legal" in the RP before she is allowed to leave.

- For those who have received your interview date, how many days is it from your NOA2? (based on viewing other timelines - I was under the impression that 4 months was about the longest waiting time)

The "pre-interview" letter the USE sends beneficiaries once the physical file arrives used to say "average wait time of 120 days". But I believe this has even been extended out to 150 days now. Not sure why the back-log.
