This happened in 2008, when we applied, same exact time of year. Maybe it will happen again, I know it's not fair, but We applied Feb 08 and were approved in a month, along with a few others, that was VSC that year.

K-1 Fiance(e) Visa Process & ProceduresOh so many questions!
1) MONEY/FEES: It takes 2-3 months from filing for the EAD to be able to work, and you can't file until you are married and have the marriage certificate in hand.
a) The 350 is just for the fiance, fee for the visa itself, but there's also medical, and police certificate(s) to pay for.
b) It cost my husband 180GBP but that was 3 years ago, plus vaccinations, which my husband went to his family doctor and got them for free.
c) It's 1070USD to apply for AOS, EAD and AP. There's no EAD renewal as once AOS is approved there's no need for EAD as the green card allows him to work. The green card that's received through AOS is conditional and good for 2 years. 3 months before the 2 year green card expires, you will need to file to remove conditions/renew the green card (ROC) this costs $590.

2) K-1 VISA ITSELF: He will have 6 months to Enter the US.
a) There are a few threads about shipping in the UK regional form.

3) TRAVEL: You apply for the AP with the AOS and EAD, the processing times are similar to the EAD. And the fee is included in the 1070USD.

4)You should be fine, just tell the truth and follow the instructions. I did all my husband and I's paperwork, K-1 and AOS, on my own without any problems.

I always thought on VWP that you had to return to your homeland to reset the clock?

I know when visiting the UK, it's not considered VWP, you get 6 month stay and the clock is reset every time you leave, no matter where you go.

As for the deny, don't believe it will affect the K-1 at all.

There's nothing really you can do to speed it up. Though London looks like it's speeding up, even if you put things together, you gotta wait. Wait for VSC, then your petition to be sent to London via NVC, then wait for London to send your fiance packet 3, only thing you can really do to make it go faster is prepare for packet 3 and send it off right when you get it, but you're still months away from that. Like someone else said, your fiance can get his vaccinations as they will still be current.

I got very lucky, as when we sent it off, they tried to speed up the pace at VSC, it didn't last long. Only thing we did to speed it up was send off packet 3 right when he got it, and I put all the paperwork together the day we got our NOA2.

The I-134 states how much your parents and you make. You each would fill out a separate one. Then you'd have supporting documents to prove that : Tax returns, pay check stubs... Since you don't make anything you wouldn't need supporting documents, just your parents would.

Welcome to VJ! and Best of luck on your journey. As of right now the I-129F Petition is taking 3-6+ Months to get approved. Right now you are waiting on the NOA1 which is your first Notice of Action. It's basically a receipt, saying they got your paperwork, once you get this and your check is cashed all you can do is wait. I wouldn't start getting things together until closer to the time your petition is approved because you want everything current for the interview.

Once your petition is approved you'll have time to get all the paperwork together. You'll need an I-134 from yourself even though you'll have a co-sponsor, and also one from your co-sponsor along with 3 years of tax returns/W-2s, A letter from their employer, a letter from their bank, and paycheck stubs also your co-sponsors birth certificate or passport to prove they're a US citizen. Your fiance will also need his passport, his birth certificate (Long form with his parents name on it, if he doesn't have it you can get that now), a police certificate from every country he lived in since he was 16, 3 US style passport photos, and some more paperwork which is asked for in packet 3 which you get from the embassy after your petition is approved. I'm sorry I don't remember what paperwork but someone else can help ya with that. Your fiance will have to go to London for a medical and then also for the interview. I know current/new relationship evidence is asked for but London doesn't usually ask for it. And the new letter of intent is needed if your interview takes place 4 months after your petition is approved, someone should correct me here, if the new letter of intent is needed, it might need to be notarized.

Things have changed with the payment of the visa, so I will have to let someone else step in here.

I honestly think not only backlogs but isn't waiting all these months apart from your love one the test the government wants to prove any relationship.

And if it proves anything, I didn't find this site until after I sent my K-1 out, I didn't put it together as cleanly as the guides here say.. no cover letter and my letter of intent wasn't close to the sample, yet I have one of the fastest NOA1 to NOA2 approvals (That I've seen on this site). So it has nothing to do with the preparation of the petition!!

Of course it is going to be different. When you were apart you had to try harder to make it work. Everything that they did before was to let you know that you are thought of between the distance. I know my husband loves me heck he married me. Men aren't the greatest at doing those little things but as long as they show they care in other ways.

My husband tells me he loves me every day! Guys show how they feel in different ways....example; fixing/checking your car-they do this to make sure the one they love is going to be safe. Yes as girls we would love the flowers but sometimes you have to look at the little everyday things they do.

As a person that came here for my SO you have to be very thoughtful of there feelings. For me I left my county, family, friends and sometimes that takes time to get use to. I don't know about what he said but maybe that is what flowers mean in his country. Best of luck! biggrin.gif

You will be fine! I was in the usa for 2 1/2 months and my noa2 approval came thur while I was there. I didn't have any problems.

And I do have a marriage certificate approved by the Canada and lawyers permit to get marriage. Is this enough to prove them that I met my fiance for the past two years?


First of all when appling for a K1 visa you needed to provide as much proof as possible of your realationship
like: photos of you and fiance, photos of your fiance,you and other people, phone records showing you called each other, travel recipts,passport stamped, airline tickets, emails to each other, cards or letters to each other, his travel receipts, statements from people(family/friends) saying they have met him or have me you.
etc

Maybe you should appeal it and provide more documentation! If you are applying for a K1 visa why did you get a marriage certificate in Canada, you have to get it the place the county you are getting married.(If your appling for K-1 Visa, that is so you can get married in the USA) To my knowledge, depending on state your marriage cert is only good for 60 days.

I was also told I had to tell USCIS that we were married. but I never heard that before. I thought being on a K-1 was enough said that that's what happens on a K-1. I am unsure if this is true.

We would have eventually gotten married just not near as fast as it happened this way. but saying that I am extremely happy with married life!!

I'm not the immigrant in this situation, but my husband will agree with a lot of your points about Americans. He complains to me daily about Americans and I am one! lol but I don't really know what to say, as I see it myself. It's not Americans in general but some just aren't very educated when it comes to life outside of the US. I've learned more in the last 5+ years with my husband, traveling than I did in school. I learned that life doesn't revolve around the US and that honestly, the standard of living may be higher here in the US, the happiness is that much lower.

My husband want through this point and we have overcome it. I think it's something not talked about around here because most think things will be great once you don't have to say goodbye or have miles between you. I thought things would be amazing once he moved here and we had nothing to worry about but I was wrong.

Things got rocky for us as well. Almost like he resented me for making him leave everything he knew back home. He got very homesick and missed his life. It took a good 2 years for him to settle down and start calling this his home. We also live with my father, and are saving up to buy a house. I think that was the hardest part, not having our own place. But we've gotten over that.

It took time but now he has his own life. He's not just a part of mine. Once he got a job and his license things changed. Have you thought about moving within the US to somewhere with more jobs in your/your husband's fields? We live in the capital city of PA so the economy has been on the up around here.

My husband is a Green Card holder, through Marriage (K-1). His GC expires July 2011, so we're due to ROC next April. Now I haven't really looked into this yet or the time it takes, but we're thinking about planning a trip back to England to visit next summer. What happens if his 10yr GC isn't approved before July and before We go on this trip? Will this cause problems? Is this something to worry about? Or is the NOA with the expired GC enough evidence?

Our 90 days open April 15th, I was just wondering how important it is that we apply that day? Also if sending it say 2 weeks later will make a huge difference?

Also not that anyone will know for sure, If a government shutdown happens should we still send in our ROC or will it make any difference to wait until everything settles down. I know that the last time the government shutdown happened, the government was shutdown for 3 weeks, so that would affect us if it happens for any length of time.

Hubby had his bio at York last month, we didn't do walk in though we went a few hours early. Only 1 person was there and she didn't have any ID so she had to leave and come back, nothing was said about being early. It's an hour drive for us, we're in Harrisburg. So we didn't want to risk it, but I got the impression it's no big deal if they aren't busy, they were just happy my hubby had everything he needed plus some. As We took passport, PA drivers license, green card, apt letter, NOA1 and birth certificate, though we only needed the apt letter and ID. There's no security guard at York, you just walk in and check in then fill out paperwork and then they take you when it's your turn, took 5 min.

We had less than this as we live with my father so no lease or even bills in both our names. We have car insurance, joint taxes and a joint bank account, knowing we didn't have a lot we included 6 affidavits. We were just approved last week with no interview or RFE. I also included in the cover page as to why we didn't have bills together or a lease/mortgage.

But with the lease which is very important, your evidence looks good to me.

We had about the same, as we also live with my dad. We didn't have the health insurance or life insurance but have car insurance together. I just included a few more affidavits from friends and family and proof of same address. We didn't have any problems with it, took long but everyone's take long for ROC. As for the debit cards, we didn't even think to show them, just showed statements and proof we both use the account, checks going in and out. Looks good to me.. best of luck!!

Biometrics done today. Got there an hour early, no one there at all, went right in and was out within 10 minutes.

Never seen anyone do walk in at York (PA) ASC but with the attitude they had today, I don't think walk in would be a problem, no questioned asked about arriving early, they looked bored really. It was an hour drive for us so walk in wasn't worth the risk.
