I might be freaking out too much

but i've seen couple people get their nvc numbers and they were approved later than us :blush:

when we call nvc they say they still don't have it in their system, and to wait up to 6 weeks :/

Just to be clear, we're trying to determine for certain whether only the I-130 was filed or both I-130 and I-129F. If both, then there would be two receipt notices, one for each petition and with different case numbers.

only one petition was filed and one receipt # received for the I-130.

they don't get 2 different receipts - they get a copy of one receipt. That means - one- same number.

Your case number... should be on your NOA2

IIRC, even with a G-28 in play -

Lawyer and petitioner BOTH receive I-797-C receipt notices.

so that'd be 2 notices of receipt, 2 different receipt numbers, way (i do mean waaaaaaaaaaaaaaaaay) back when.

Is it clear, though ? can track down the receipt number for the I-129F ? if can do that,
then can track 'it' at NVC, with a NVC Human,
then again at DoS, with a DoS Human.

Whatcha got, really ?

I can't track the I-129f because i haven't received any Receipt # from it.
I call NVC about the I-130, because we only got a receipt # from that petition. & they still haven't received anything

I'm still waiting for the e-mail from the lawyer and his paralegal, I asked him what kind of visa are we suppose to be expecting.

When we filed my husband only signed the I-130 and paid the $420 fee. There was nothing said about the I-129f.
I emailed him and his paralegal but no response yet. My husband also called him but he was in court so he told my husband he will call back :angry:

CAUTION! The attorney seems to be engaged in processing a K3 visa instead of a CR1. If that is the case, there will be no correspondence with NVC. They will need an affidavit of support but it will be the I-134 carried to the interview, not an I-864 sent to NVC. Until the actual visa category being pursued is clarified, speculation is not helpful.

pushbrk, do you have any links that give information about a K3 visa so i can learn more about it?
I will be contacting my lawyer and asking him to give me every single information about our case and what kind of visa it is.

Maybe the lawyer meant that you won't have to pay anything or deal with the NVC because he will deal with it all. I have some friends who are using a lawyer and the lawyer does everything for them including paying the bills (obviously they are paying the lawyer quite a bit) but they aren't doing much and aren't on this site all the time! they had some other issues but they got their interview for next month!

If he was paying for us than I think we wouldn't have to pay the fee for I-130 petition when we filed

The above description matches a K3 visa case. Did your husband also file an I-129F?

He never did. I think we would get a notice from action if they filed for I-129f.
We only got NOA1 & noa2 from the I-130 petition

Lol..... your lawyer is making me crack up.

Your lawyer clear has no idea about immigration and it sounds like he has not handled any cimilar case in past.
Without a sponsor, you would not be getting your conditional GC....lol
You have to prove that before hand so you will not become a public charge.

I'm still confused why we consulted with such an idiot.

It would be a conditional 2 year green card, and you would have to file to REMOVE CONDITIONS in 2 years...
But the K1 visa are the ones that go straight to the embassy, and then through Adjustment of status in the US...

seriously!!

I am so grateful to this site and the wealth of knowledge!
I have a friend who filed through a lawyer and all she can do is sit and wait on the word from them...
At least filing yourself you have complete knowledge of where your case is.

It is not conceivable that an immigration attorney would make such mistakes. Is he not an immigration specialist or is it possible that you have misunderstood him?

I don't think so. He clearly told my husband that the case will be forwarded to NVC and then to the consulate in Warsaw. After 4 weeks I should be getting my packet for the interview and biometrics. He said nothing will be paid or sent to NVC. When I arrive to US I will adjust my status from and will be getting a conditional green card, and that's when I will need my sponsor & Affidavid of Support.

Fire his A**. My best friend had a lawyer that had no idea what he was doing and it kept her away from her husband for 3 1/2 years. We got fed up and I helped her do some research. 3 months later he had an interview and visa in hand! IF you are approved from USCIS, have your address changed from your attorney's to your address. Follow the steps here on this website. Most VJ members don't have attorneys and many have gone through the process just following advise from previous members.

I don't think my husband used his address because our NOA2 came to my husband's address.
We tried getting some help on filing all the right papers to NVC but he's obviously giving us the wrong information.

The lawyer also said that I don't need a sponsor right now because I will be getting a conditional green card when i arrive in the US, and after that when we will be trying to adjust my status to pernament sponsors will be needed.

& that is exactly what I thought, I have read many posts on this forum and probably learned more then he knows. I have sent the documents my husband will need for NVC and he told us to sit and wait. I don't think he understands what being away from your spouse means, and sitting and waiting is not an option. I will laugh in his face if i receive a NVC# and bills to pay, and will definately fire him. He just got me really frustrated and confused with everything!

He said to chill out and wait 4 weeks for consulate to send me something. #######? can that be the case? :huh:

Supposibly NVC has all of the documents aready and we don't need to send anything to them. By the way, we filed for i-130

I will go to where Justyna lives (Aleksandrov - near Lodz) we will have a wedding party with her family then go to Zakopane for a week and Wieliczka and Krakow, then come back to Aleksandrow and visit.
I hope your case goes quickly. I see people are getting approved who filed same time as me now.

Hi Gosia,

How are you? Only thing I found you can go at the top to immigration timeline, CR1, and filter by country. Latest entries from Poland were a year ago and who knows how quickly they filled forms etc... But it appears 3-4 months was average. You can take a look.
BTW I am leaving Wed. for Poland, I can't wait.

police reports

it was a ticket for driving without license, i got the supervision for that and it ended. the court record says what i got, what penalty, how much i had to pay, and when the supervision ended.
if nvc ends up needing it i will send it to them, if not i will have one ready for the interview. I already requested a criminal background check information from Illinois Police.

I lived in America 4 years on a student VISA , and can also confirm you def don't need a police report from USA I only sent the one from my home country
