US Citizenship General DiscussionIs it me or my local office that's wrong??
Received notification from my local office that my husband is not eligible to apply for naturalization until September 26, 2009. That is the date on his green card. Because we have been married for over 3 years, we sent in his paperwork 90 days prior to the date of September 26, which was June 28. It was received in Texas on July 2. They have also cashed our check!! So apparently they are overlooking the part on page one of the N-400 instructions that says: "based on three years as a lawful permanent resident married to a US Citizen, you may apply for naturalization up to 90 days before you meet the continuous residence requirement." Obviously like anyone else we can't afford to lose $675 because someone is an idiot. So much for not allowing this last leg of the journey to stress me out!! All this happened late on Friday, so I guess I have to wait until Monday to try to sort it out. Any suggestions? I'm thinking of going right to the top and heading into my US Congressman's office Monday morning.

After spending the last 4 1/2 years trying to figure out the US immigration system, we have finally received the date for the end of our journey. My husband will be sworn in as a US citizen on January 22, 2010. It's so lovely to receive word of this right before Thanksgiving. There are many people on this board who offered a lot of wisdom and support to us over the last four years and we are very grateful. To everyone dealing with the USCIS whether you are just starting off at the beginning, are slogging through AOS, or are on this forum waiting for an oath letter I say to you good luck and Godspeed.

I don't think we have a choice here.
"Files* the Application for Naturalization, Form N-400, ON or AFTER October 1, 2008, will take the new test." - USCIS.


My husband was told at his biometrics he could choose between the old test and the new test. This isn't the first time I have gotten conflicting advice. It's not like I'm new to this- we've been doing this for years. I think I'm just fed up at this point. Wishing you all good luck- I'm done posting.

I had the same concern because in the application you state that you have been resident for three years so there is a conflict. I asked them and they said technically you are eligiable ninty days before the three years, Congress wanted the proccessing time to be deducted from the three years.
I have applied and everything seems fine.
They are able to approve you.


This is interesting to see discussed because I was wondering about that as well......I mentioned this earlier in the process due to what I was told by my local office. I am glad to see people getting interviews so quickly- regardless of how much you try to tell yourself you won't allow yourself to become stressed, you still do! Anyway congrats to everyone who have received their IL's and hope the rest of us get them quickly!! Funnily enough, my cousin has become engaged to someone who lives in the UK, and I just pointed him to Visa Journey, so he's starting at the beginning of the process right now. I have offered to help him, but having support from people going through what you are going through at the exact same time is really helpful I think. I am very grateful for all the help and support my fellow VJ'ers have given me. Thanks guys.

Congratulations Jayde. My husband just left for his biometrics appointment. I just told him we'll have to get really serious about studying for the civics test now. Up til this point it's been for fun quizzing people when they come over and seeing who gets what correct. It's time to buckle down now and get this right.

Thanks for all the replies. I don't mind waiting, I just wanted to be sure that my local office wasn't just giving the congressman's office a load of garbage. Sorry but I do not believe in any way they know the rules and follow them. Like the rest of you, I've been doing this basically non-stop for 4 years and have had nothing but problems throughout. I made the "mistake" of doing US immigration after going through the UK immigration process. That was so easy and stress-free it's like night and day. So I guess my take on it all has been skewered a bit by being spoiled the first time around! Anyway, thanks again for all the input. I feel better now!

Can this get any more ridiculous? When all the hoopla happened last week as far as whether or not my husband's application was acceptable, we contacted our congressman's office just to get it all straightened out. In the meantime, we did receive the NOA1 as you all know, and yesterday we received the biometrics letter with an appt for next Friday. Anyway, today my husband receives a call from the congressman's office stating that they have spoken to our local field office, and although they can accept my husband's application and process it, he can not go for his interview until he meets the residency requirement, which is September 26, 2009. I have never seen anyone else post about this. I was all over the USCIS website and never saw it posted there anywhere. Maybe it will take 90 days to process anyway, but I have never heard that they won't give an interview til that date is reached. Anyone else ever hear about this? How many June filers are filing with the marriage residency 90 days prior to your green card date? This is just so typical and ridiculous I'm ready to go crazy!!

Would someone mind telling me what their NOA letter said on it? I wrote earlier about receiving notice that my husband was not eligible for naturalization until 9/26/09 (that is his green card date). Today I received TWO NOA's in the mail dated July 6. They are both the same. I'm now wondering if someone realized their error and corrected it? This NOA has the statement: The above application has been received by our office and is in process. Our records indidcate your personal information is as follows:
Date of Birth: (correct date)
Address where you live: (correct address)

Please verify your personal information listed above and immediately notify our office blah blah blah.
Upon receipt of all required Records Checks, you will be scheduled to appear for an interview at your local USCIS field office.
Also it states Payment INformation as well (balance $0.00)

Please, can someone tell me if that is what your NOA's looked like? Can I assume that it has been accepted?

I posted this in another section but just to highlight it here in the June filers section- the local office sent us notification that my husband is not eligible for naturalization til Sept 26, 2009!!! And they cashed our check!! We just got this notice Friday late in the afternoon so I guess I'll have to wait til Monday to straighten it out. Someone please talk me down: green card dated September 26, 2006, married for more than 3 years, continuous residency since green card date, filed for naturalization 90 days prior to Sept 26 which was June 28- they rec'd it apparently on July 2. HELP!!

Some of the names I recognize from previous threads- it's been a long 4 years since I first joined Visa Journey trying to navigate our way through the various paperwork needed for our family to be together. We're finally at the final hurdle- naturalization. After the stress of removing conditions, this is almost anti-climatic. (almost!) Good luck to all of you!

I just went through lots of posted information- geez I forgot how much time and energy it takes to do this stuff!! crying.gif I'm definitely out of the loop. Anyway, I saw that it said you can apply any time during the 90 day window (I had thought it was a strict deadline). I'll wait til we get back and then mail it out. Once again I have to say thank goodness for VJ!!! And thank you for your reply.

Removing Conditions on Residency General DiscussionQuestion about Biometric time frame
Well, after living stress free for the past 18 months, here I am back at VJ looking for advice as we get ready to remove the conditions on my husband's two year green card. I have no concerns regarding documentation- I've been saving everything for the past 2 years, we have children, and are in a loving and committed relationship. My question involves the biometrics. 90 days prior to his green card expiring puts us at June 30th. We are going on vacation for nearly 3 weeks in mid-July to take the children to visit his family in England. It looks like a lot of people are getting their biometric appts within a month, which could potentially put the appt during the time when we are gone. Should I mail out the packet a few days before we leave on our trip (even though it'll make it "late") to try to ensure that the biometric appt won't be until after we return in early August? We're sending the packet to the VSC. Any suggestions would be greatly appreciated!!

Thank you for your input. It alleviates my mind a bit. We were living in England for part of our married life- other joint accounts were located in the UK. I could give them that stuff if I get an RFE but I didn't really think they'd be relevant. I only really started saving things after we applied for the green card 2 years ago. I thought 2 years worth might be a bit of overkill- I can go through and pull 5 or 6 examples of each to make it less fat!

I put in loads of things in just one or the other's name just to show the address. Where I live in upstate NY, our utility company won't put two names on an account. Also the same with Time Warner- I've asked for both names on the bill and told they can't do that. Unfortunately, the house is owned by my husband and I am not on the deed. This is for purely financial reasons but if anyone out there thinks that will be the make or break thing, we can add me to the deed without any problem??

I woke up at 2 in the morning in a cold sweat suddenly worrying about this- stayed up for 3 hours putting all of our paperwork together. It is about 3 inches thick. Please tell me what you all think:

-copies of his green card and passport
-copy of our daughters birth certificate
-copy of letter addressed to us both from state senator congratulating us on birth of daughter (silly I know but it has our joint address on it)
-copies of 2006 and 2007 joint taxes
-copy of letter informing us of economic stimulus check
-copies of joint savings account (2 years worth)
-copes of 2 joint checking accounts (2 years worth)
-copy of deed of house (it is only in my husband's name though)
-copy of homeowners insurance in both our names
-copy of my 401(k) paperwork listing husband as sole beneficiary

Sometimes I look at it all and think it's ridiculous over-kill...then I look at the other posts on this forum and I get scared. I love my husband, we have a family together- I'm petrified of some nameless, faceless person in an office going through our personal papers deciding whether we've proven to them our family can stay together or not! Anyway, even though 90 days was up the end of June, we are going to England to see my husband's family and so that he can be the best man in his friend's wedding on July 15, so none of this will be mailed out til August 2 when we return. Green card expires September 26. We are applying to the VSC, so even though it would probably be ages til he gets the biometrics appt, we aren't going to take the risk that it comes in while we are away! Thanks in advance for any input!!!

I may have included 2 photos- like you my husband and I don't have too many of us together. When we are at family functions or on vacation, most of our photos involve either the children, or one of us with the children (while the other takes the picture). I wouldn't be too worried about it.

Every time we travel out of the country to visit my husband's family in the UK, my husband gets grief coming back in ie. taken to the windowless room. This last time it was "have you ever overstayed a visa?" Um, NO and regardless what difference would it make NOW with the green card?! ARGH. It's one of the main reasons we're doing naturalization as soon as he is eligible (June '09- he'll probably have his US passport before he gets the 10 year green card!)

Those of you who haven't had problems at the POE should count yourselves lucky!! My British husband has never entered this country, even with his valid greencard, without some sort of hassle. I'm so fed up I could scream. We are applying for naturalization as soon as he is eligible in June so we don't have to put with this immigration ####### anymore.

OMG- I just looked at the CSC timeline- people who applied in JUNE have been approved. I've stayed off that thread so as not to upset myself, but having just looked I'm insane with annoyance!!!! People at VSC waiting for a good solid year or more and people at CSC being approved in a few months?! Seems like they would want to return to their homeland to be with their family. Chances are they'd end up on welfare here anyway and depending on our government to support them, God knows we have enough of our own here doing that. You have GOT to be kidding me! What about people like my husband- who now has an American child (dual British citizen) AND an American stepdaughter?! So he should just go back to the UK if I was to die tomorrow with our American child and leave his stepdaughter who he loves and who is also the half-sister of his child behind? So my full American child should lose her mother, her stepfather who she adores and her half-sister? And since my husband supports us all with his extremely good job, why the hell would you assume he (or any immigrant) would end up on welfare? You are a complete idiot.

We must be the unlucky ones- but every single time we've left the country, my husband has had problems re-entering. Since his green card is expired and we're "lucky" enough to have his I- 751 processed through the VSC, we will not be taking the risk of leaving the country until it's approval. Those of you who have never encountered any problems- consider yourselves lucky. Nothing like being treated like ####### when you have a valid green card while travelling with your American wife and two American children!

This is actually getting exciting now- I hardly ever come onto the forums anymore as it's too depressing waiting around for this to be approved........my husband's RD is August 7..........going by the theory on here, maybe he'll get transferred to CSC in a few weeks....that would be fantastic!! There's hope for a trip "home" to see my elderly father-in-law this summer after all...................(we weren't even thinking of planning anything d/t not knowing when this would be approved and the hassle we got last year re-entering at JFK.)

Why can't you just say what your filing date was so that people don't have to go troll through another thread? It would have been just as easy to write that. A lot of people on here are looking at those of you who have been transferred to the CSC early as test cases you know.
