Removing Conditions on Residency General DiscussionRemoval after divorce
If they (USCIS) don't see enough evidences they call for the interview in order to see
if the marriage has been entered in a good faith at the beginning & completely Bona Fide.
You do not have to hire a lawyer, that is just wasting of your money. I am sure you can
defend yourself. Gather all evidences as many as you can. You had better get some affidavits
of mutual friends of you & your eX.
It usually takes about a year to sort this application out because you checked waiver due to divorce.

Next time please give your Timeline.

First of all, RELAX !.....
Probably following is going to be happened :
As soon as they cash your check (without even checking the completeness of forms), they are going to send NOA which will say 1-year GC extension. Your husband can not enter the US after his GC expiration date without NOA.
Your husband can travel with his passport, expired GC & this NOA together. Instead of showing GC at POE, he is supposed to show NOA too along with the expired GC.
Anyway, when they find out some forms are missing, they will RFE you later. So don't have too long vacation & make sure somebody you trust will be taking care of your mailbox so he/she can contact with you in case of USCIS sends some important documents.
Btw, if you don't respond to a RFE in 45 days your application will be denied & you will be placed onto route of deportation. GOOD LUCK !.....

I don't want to repeat myself here. Other people explained situations very well above.
Adjudication Officer @ VSC usually calls for an interview if He/She is not satisfied with your RFE.
Don't be panic, just go to the interview with a lot of supporting documents happened in the last 2 years after your CGC was approved.

First of, you fire the tax preparer & don't attend to meet with her on Thursday. She doesn't know anything. When you do "Married Filing Jointly Return", you get the max. benefit. Secondly, you can not be Head of Household, when you are married !.... & at the same time he can not be SINGLE when he is married.
Not only you will have problems with USCIS but also IRS too. Why ? Because you can not change your marital status annually just because you feel like it. I can assure you that it is going to raise BIG RED FLAG for USCIS when you apply for I-751 (ROC). Look at IRS definition of "Head of Household" !....

Head of Household Generally, you may claim head of household filing status on your tax return only if you are unmarried and pay more than 50% of the costs of keeping up a home for yourself and your dependent(s) or other qualifying individuals.

First of all, she can not stay more than (12 months total for Permanent Green Card & 18 months total for Naturalization). However, after she removes ROC then she can apply for commuter status, then she can stay as long as she likes until she becomes an US citizen.
So, you do the math. You can show your mom's address to file I-751. However, she should be here, in US to go for biometrics. If you get an RFE, then you have to mail more documents in by signing the RFE form. You have to prove that you have been working abroad & living with your wife. You have to show some sort of proof that you have been living together, a couple of joint bank accounts & jointly filed taxes. The bottom line is, you can file & live abroad but it is going to be more hassle & difficult compared to being lived in USA during this 2-3 year critical period. You guys, get ready to take so many flights between US & S.Korea :yes: .

Can you list some of these international airports abroad where the letter is not understood? As one who has re-entered the United States nine times and from various airports with the expired Green Card and Extension Letter, I find this claim a little dubious.

Specifically, it is the aiirline you are travelling with, not the local airport authority, who determines your boarding privileges. In my experience, ALL of them have been properly educated on the Extension Letter and accept it without question.

Very easy... Istanbul, Turkey. It happened to one of my friends. You go there, you will see how many check points you will go through. I won't even remember how many times last time :) I used the term "the international airports" in general, of course airline personnel & airport security people will check your documents.

I wont be going to Brazil, i'll go to France for a semester in school, which probably wouldn't allow me to come back in the middle of it to take care of my immigration stuff. :(
I think it may be more prudent for me to postpone and wait until everything is resolved, with new green card in hands to avoid any "surprises".

You're welcome !.... Some people don't feel comfortable to travel with the Expired GC + 1- yr. Extension Letter. I don't blame them because They don't understand the Extension Letter at some International airports abroad.

In this case I should probably postpone the trip in 2013 just to be on the safe side. That's a bummer :(

Before you postpone anything, if you want, you can still go to Brazil in January with your Expired GC+ 1-yr. Extension Letter, ( will be valid until June xx, 2013) No problem. While you are abroad If you have an interview, you have to come back to US. If you receive a RFE you have to sign the paper.

If you receive your 10-yr. GC while you're in Brazil, you can still enter US with your Expired GC + 1-yr. Extension Letter before the expiration date or have your husband mail the 10-yr. GC to you in Brazil if you like to come back to US after expiration of the 1-yr. Extension Letter. If you feel comfortable that way, you can do it too. Good Luck !.....

No, not really. The earliest day you can send in June 04 anyway. Let's say your husband will be mailing on that day, NOA comes usually 7-9 days, Bio app. notice comes usually 3 weeks, Bio app. date usually comes 5 weeks after NOA, so you are looking at the Bio app. date is sometime around July 20. If you want, you can go earlier than your original Bio app. date.

So anyway, you will be June 2012 VSC Filers, if you look at the list for June 2011 VSC Filers, you will see they have been approved between 8-9 months. Let's say 8 months for you, so you will be approved mid February 2013, add another 2 weeks for GC delivery, you can get your GC at the beginning of March 2013. So it means you can not make it in January 2013.

I suggest you had better get ready to change your plans, I bet you there is no way VSC will remove your condition in 6 months !......You don't know they are extremely slow.....

Filing window opens 90 day before the 2nd year anniversary of Conditional Green Card. It does not mean you have to file on that day, you can file anytime between to be exact June 04, 2012 & September 01, 2012.

If I were you I would file it after I come back from Brazil (After June 15, 2012). Btw, if you file it earlier than window-opening date, USCIS rejects the application & mail it back to you.

You have to complete Part 5 on I-751 Form for your son.


You have to pay = $505 (I-751) +$85 (Bio)
Your son has to pay = $85 (Only Bio)

TOTAL $675 ( You can just write one check).

FYI, your Bio Dates are going to be same so you guys will go together.

Hello everyone. As i stated before i had hard time finding an atty to process my papers but i got lucky and found one. We mailed the papers with the evidence and after 2 weeks received my NOA1 saying that i am extended for one year and needs to wait for biometrics. But, today i got a letter I-797 Notice of Action under the case type it says "CRI89 APPROVED REMOVAL OF CONDITIONS (I89) and underneath of Notice type: It says "Receipt Notice". What does it mean? Please let me know if anybody get a mail like this.. It's confusing for me. Thanks


It means they have received your petition "TO REMOVE OF CONDITIONS OF PERMANENT RESIDENCY (CR 189)". It is an acknowledgement receipt.
ROC form is called I-751 but actual ROC process is known as CR189. Sometimes USCIS makes mistakes they send repeated receipts or occasionally none.
I have personally never heard Approval without Bio. Good Luck on your Journey.

Now we have started English 101 :yes: . Everybody knows what it is. We are just playing with the words. Points are taken, well understood.
Of course, earlier you apply for ROC earlier you get approval hence earlier you get your 10-yr GC.
In my case, I couldn't apply earlier because we had to go to my old country & visit my family.
As you know you have to be here for Bio or any possible RFE or any kind problems, that is why I didn't want to take any risks.

Not quite - as CINO says, 90 days prior to August 26 is May 28.

And you can file ANY TIME within 90 days of your greencard expiring. Just make sure your application is received before the expiration date.

I don't quite understand why so many people think they should file 90 days before the expiration date on their GC.


I think you have misunderstood or you want to understand in a wrong day. I did not say "You have to file on exactly on this day i.e. May, 28 2012", I mean the earliest day (1st day) which filing 90-day window opens.

I did say the earliest day is May 28 !....

For example me, same date expiration but a year before which is August, 26 2011. I DID FILE ON AUGUST 12, 2011 which makes it about 2 weeks before. I don't think I am wrong and also I did not throw this day from my stomach, I have taken it from USCIS web site. It is funny, we have the same day but different year, mine has already expired on 08/26/2011.

By the way, you do not apply to renew the GC separately, but you are required to apply to remove the Conditional Permanent Residency (I-751), once that is approved you will get your 10-yr Green Card anyway.

I totally agree with "Brother Hesekiel". If you are not going to travel for about a year, why do you need actual Conditional GC to do ROC ? If you have saved the photocopy of it, send it with the ROC Application. You don't have to give $450 unnecessarily. Hence, once your ROC is approved ( Statistically; according to your filing-date-to-be CSC probably in December 2012 & VSC probably in March 2013 ), your 10-yr GC will be coming to you anyway !...

If you send IRS Tax Transcripts, you will be approved. By the way, IRS Tax Transcipts are offical document which shows you guys have filed,

USCIS does not accept the copies of other Tax Return Document forms as a proof. If I were you I would ask for the last 3 years (2009, 2010 & 2011) because you will need them again If you file for Citizenship (N-400) sometime in 2012.

So, do not send the original IRS Tax Transcripts, make photocopies & send. Good Luck !...

How long does it take to get the actual green card in the mail after the approval? They say 60 days but i presume it's less?


If you look at the other people's dates after their approval, everybody has got different GC receiving date but statistically it takes between 7- 30 days.

Cards are made by a private company in MO. So it depends how busy they are too.

File ROC (I-751) ASAP with a waiver. Like the other people said you don't have to wait until filing window (90 days prior to your 2-year Conditional GC expiration date).

In the meantime, gather all the evidences that your marriage was a bona fide one. You must have a divorce decree to file & get ready for most likely an interview.

my friend got her GC in january 2011 , she is married and has a kid from her husband but she wants to divorce from him coz of mentally and physically abuse . she can apply to ROC in sep 2012 but she cant handle him anymore . Can she divorce and apply to ROC after she got divorce degree or before this degree ? is it too hard to apply alone with waiver or kid is strong evidence ? she scaried that if she divorce from him its hard to get 10 yrs GC . and her husband said u should wait that 90 day window . but she is so tired from his abuse . whats her chance to get her 10 yrs GC ? It means she has Conditional GC until January 2013, If she would be married at the time of filing ROC, normally she would file it between sometime in October 2012 & January 2013. (ROC Filing window opens 90 days prior to you Conditional GC expiration date). Recently, I have noticed that there is a big confusion on VJ about ROC filing date. it does not mean you have to file on that day as soon as window opens, you have 90 days to file.
I will give you a real example of my filing. I am still happily married. My Conditional GC expired on August, 26 2011, I would file the first day which the window opened on May, 28 2011, (USCIS uses this calculator http://www.uscis.gov...Calculator.html ) but I didn't. Because we were going for a long vacation; I did file ROC 2 weeks before on August, 12 2011.

But her case is different from mine, she will be divorced. When you get divorced during the conditional period, as soon as you get divorce decree you can apply ROC with a waiver anytime (Between the day you get divorce decree & your GC expiration date), in other words you do not have to wait until October 2012. If you ask me, earlier would be better. You want to get it over with ASAP. You can not apply ROC without a divorce decree even if you do, you will get a RFE. Don't forget it takes 9 months without an interview to remove a condition if she sends ROC to VSC. Tell her to get ready for most likely an interview. So her case will take 1 year+ if she is VSC filer. I am sure she will be OK because they have a kid together, it is a very strong evidence that the marriage was a bona fide one. I have just been informed that I will need to get a new Canadian passport prior to traveling to Turkey at the end of April. My application for the i-751 is also being sent out at the end of April. Will I have problems coming back into the country if I get a new passport, leave the US to go abroad, and then try to come back into the country PRIOR to sending the I-751???I am so worried. Any help would be greatly appreciated!


It would be easier to answer your question if you give us the expiration date of Conditional GC.

Sadly my husband (US citizen) passed away unexpectedly last week. I am a september filer, and wondering what to do next. Unfortunately, I have to wait 6-8 weeks till a death certificate is issued, so I have no certified evidence of his death at the moment. Should I just wait and hope I get approved without and RFE? Let me know what you guys think

I have seen that you are VSC September Filer, so you have a couple of months time to be adjudicated. The easiest way to update your situation on file to send an e-mail to VSC or If you prefer & have a time for it you can do infopass too.
The case like this you might be approved without any RFE & any interview. Like the other people said they might ask you send his Death Certificate to them for a record in your folder.

These docs are fine but the most important question is " Are you really married & do you guys live together ? ".

If the marriage is bona fide one, there is nothing to be scared of.

If I were you I would ask IO why we were asked for the 2nd interview.

However if you can not prove the marriage which is bona fide one & in fact it is not bona fide. Don't forget there is no perfect crime, you always make a mistake at somepoint.

hi everybody !!!

its been a while after we send the i751 petition to uscis!!! so year ago we recieved a letter asking ask to appear for an interview and bring the regular stuff required by them.we went with my wife and everything was ok until the officer told us that my finger prints are expired!!year latter a recieved a biometric letter for september 20 2010.after i did my finger prints we recieved another letter for interview which will be a second one for the i-751 .is there anybody that can give me any kind of advise or help what we should do when we go again and what we should bring with us!!!thanks !!!


I totally agree with Steve D. It is absurdly ridiculous. First of, I have never heard 2nd Interview for ROC.

There is a big misunderstanding somewhere. It has been taking 2+ years for ROC, that is very very rare case. That is true, Bio expires after one year.

I guess USCIS has messed up your case at some point or they have lost your original ROC documents.

We will better understand your situation If you give us your timeline, which service center & your interview date.

I wonder If you ever got extension again, stamp, another extension letter etc.. Please explain your case in detail. To be continued .........

They take $85 for biometric fee from everybody regardless of age. Go figure ???

But he is exempted because he is under 14. Only your wife has to do her bio.

Look at list below who're exempted from Bio :


1- Foreigners admitted on A, G, NATO visas

2- Children under the age of 14

3- Persons over the age of 79

4- Taiwan officials who hold E-1 visas and members of their immediate families who hold E-1 visas.

5- Certain Canadian citizens and Mexican citizens

If I were here, I would do (not to complicate things further) as follows step by step :

1- Get divorce finalized & obtain "Divorce Decree",

2- Apply ROC (I-751) with a waiver ( sending documents that they have entered the marriage with a good faith & the marriage is a bona fide one)

By the way, there is no certain time requirements for filing ROC with a waiver. You can say filing window will be opening as soon as she gets the divorce decree,

3- Go bio & receive the extension letter,

4- If there is a RFE, repond to that with more evidences including exhusband's affidavit,

5- Go to the ROC interview (more likely in her case),

6- Get the approval letter & 10-year GC,

7- Remarry & be happy :)

8- Apply for US Citizenship ( after 5 years being LPR, the earliest she can apply 90 days before the 5th anniversary of her residency).

First of all, this is not a big deal !.... You just follow your Bio app. In the mean time, if NOA comes then no problem. If it doesn't come for a while, It is possible that it has been lost in the USPS.

Like the other members said, make a INFO PASS appointment, get your passport stamped for a year in the place of the Extension letter, same things anyway.
