I didn't say you were making it up I simply said there is no guarantee what will happen and you don't know what will happen. The section you quoted about the waiver filing actually refers to filing for ROC with a divorce waiver before the 90 day window, it's to clear up that issue. The gentleman I mentioned that was late filing (with a waiver) had VERY strong circumstances for failing to file in time (personal reasons that I am aware of but not able to divulge) and I'm sure it was his letter that helped his case go a bit smoother.

There is no guarantee this person will go before a judge. If they've already been put in removal proceedings then yes they will, if they haven't there's a chance if their case is strong enough that they will avoid it. I'm simply letting them know that they don't have to dread the worst, plan for the worst yes, but hope for the best.


My friend, there is no guarantee of anything in this world. Everything is up to the discretion of the IO who's handling your folder & every case is different.
But what I'm saying is " Under her circumstances she will be rejected " , that is the LAW !..... I would be so surprised If she doesn't get rejected.

I'm not making up the laws, you can find information below, plus one of my co-workers & his wife has applied ROC jointly like 10-day late & they had to go to an Immigration Court in Newark, NJ
I remember it was very hectic, just a big headache...After the Immigration Judge has seen their baby boy, he has granted her status again, sent the decision to VSC & the case has been resumed as if they have sent a RFE.
They have not applied ROC from the scratch.


That post is applying ROC with a waiver. Late filing can be excused because of divorce !....

Below is taken exactly from USCIS website :

"If You Are No Longer Married To Your Spouse or if You Have Been Battered or Abused by Your Spouse

If you are no longer married to your spouse, or if you have been battered or abused by your spouse,

you can apply to waive the joint filing requirement. In such cases, you may apply to remove the conditions on your permanent residence any time after you become a conditional resident,

but before you are removed from the country."

If You Are Late In Applying To Remove The Conditions On Residence ( you're still married & applying ROC jointly )

If you fail to properly file Form I-751 within the 90-day period before your second anniversary as a conditional resident:



- Your conditional resident status will automatically be terminated and we will begin removal proceedings against you - You will receive a notice from us telling you that you have failed to remove the conditions

  • You will receive a Notice to Appear at a hearing. At the hearing you may review and rebut the evidence against you. You are responsible for proving that you complied with the requirements (we are not responsible for proving that you did not comply with the requirements)
  • The Form I-751 can be filed after the 90-day period if you can prove in writing to the director of the appropriate Service Center that there was good cause for failing to file the petition on time. The director has the discretion to approve the petition and restore your permanent resident status.

First of, let me tell you this. Your situation is not complicated. Late filing creates a big headache.
That NOA does not mean anything. USCIS issues NOA to everyone who correctly pays for ROC. Once her ROC has been adjudicated (right now sitting on one of the officer's desk),
she will be denied & put on deportation proceedings, but don't panic !....There is a way to get rid of this situation.
You will go to Immigration Court & tell your story before an Immigration Judge & I am sure he will remove the deportation proceedings & let you apply ROC again.
Then you will be under normal circumstances. Since you filed ROC recently, I am sure it will take time for an IO (6-9 months depends on Service Centers) to touch your folder but once IO looks at your folder, your wife will automatically be denied, that is the law. If she goes abroad in the mean time it can be so risky to come back to US, because once she has been rejected, all the privileges like work & travel will be frozen & she will be denied at POE (CBP officer can easily see her situation on the computer). I understand her mom is very sick but if she really has to go, tell her to make a short trip. The ball is in your court right now.

My current Permanent Resident Card is a 10 year card, resident since March 2002, expiring May 13th, 2012. I am renewing the card, so if anyone has renewed their card, does the USCIS check for 2 forms of ID, or is just bringing your current Permanent Resident Card to the biometrics appointment enough?


I have showed my license & Bio letter. If you don't drive, you can get an Non-Driver State ID from MVC in Dover, it will take your 1 hour, not only Bio App.,
but this type of State ID can be very useful, one good example is at banks.

We still have a year before ROC, but the way the timing works we will have only filed two years jointly, we will be able to provide one tax transcript
(2011) but 2012 will just be filed so we will submit what we can (w-2s, copy of signed forms). 2010 I filed single, since we got married early 2011.

However I have seen a lot of people saying to include 3 years of taxes. Since it was only a two year GC for a majority of us, how can you provide 3 years?
Just trying to figure this out.

We have plenty of other co-mingling docs- credit card, joint car, joint bank account, life/health/car/rental insurance, rental agreement, photos, mail, ids, etc...

Any one out there who only filled with two years? (Its seems obvious to me)...

You will be fine, even 2 years IRS Tax Transcripts are enough as long as you have other primary documents which show co-mingling finances during the span of marriage before the ROC.

No, my friend you are definitely approved but it hasn't been updated into the system yet, sometimes the IO has to get another approval from his/her supervisor in the case like yours.
That is why it shows pending. You believe the letter you've got in your hand not the robotic secretaries who answer your calls like parrots :D . You will probably get your GC very soon, most likely within this month.

I just got a new job recently and divorce is imminent right now. I did get a 2 yr. conditional green card about a year ago and it is set to expire in a year's time. My question is, what are the chances I get a permanent green card after filing for the i-751 roc/waiver? Me and my ex entered the marriage in good faith and have substantial proof to provide to the USCIS. I currently am doing really well and do not want to get thrown back to my other country just because I will be going through a divorce.

Has anyone been denied of ROC after filing immediately after a divorce during their 2 yr conditional green card stage?


Success rate is high, of course if you can prove your marriage has entered in a good faith. You will likely go through an interview. As soon as you get a divorce decree, file your ROC with a divorce waiver. I also suggest you to join this group, here is the link.

First of all, DO NOT TRUST USCIS ON-LINE SYSTEM, it is not always updated & does not give details like a RFE but you can still believe old-fashioned mail delivery system by USPS.
FYI, there is no RFE stage in case status of USCIS on-line system.

I'm on the August, 2011 application list, but haven't yet received a response.
Judging by the associated thread, it should be happening any day.


I'll be leaving the country for a month in two days, and away for about a month.
Obviously, if I'm approved, everything is great. What would happen, though, if I instead got a Request for Evidence (RFE) in the mail while I was away?
I might not see it for a month after its arrival. How much time are you given to return it?

I'm sure you know me from August 2011 VSC list. You will be fine, even If you get a RFE (Hopefully not).

You will have plenty time to respond almost 3 months, let's say a RFE letter came right after you've left US, since you will be abroad for a month, you do have still 2 months to respond anyway.

Nothing to worry, I also think your case will be handled within this week & hopefully you will be hearing something right before the Memorial Day weekend. See you at the August 2011 thread.

Until then take care & have a nice trip !.... Btw, you'd better get somebody to check your mails just in case.

So, life has been shitty lately, but I'll spare you the details.

Long story short, I came home today after a very long day which included mailing my ROC ppwk, to find the paper that had the copy of my green card is sitting on my desk. WHY it wasn't paper-clipped with the rest of the papers in the packet I have no idea, but I'm not impressed.
Anyways, I KNOW I'm going to get an RFE for this. My question is, will they still go ahead and cash the check, and give me the NOA and extend my green card for the year for processing in the mean time? It's important to me that they do this because I'm planning a much overdue and much needed trip home this summer, and it falls right around the time my GC expires. I don't want to book my flights until I get the NOA and GC extension just in case something happens. Thoughts?


At the beginning, I mean at the initial review of your ROC package, they check the filing date is acceptable or not & then cash the check,
after that they mail you NOA letter & then ASC Bio App. Letter so on so forth....
If you ever get a RFE you will get it later on, not now. Good luck !......

Hi every one,

I thanks you all in advance for taking time to help me.

I mailed my I-751 petition on the 16th of April 2012 to the vermont center. My application was received on the 19th April and I received NOA on the 23rd of April dated 19th April. Then I almost waited a month for bio letter. Since I am planning to shift my family soon, I called the USCIS on the 15th of May 2012 requesting information about the biometrics appointment. They registered a service request for me. I did not request one honestly. Even though it was within 1 month time line they registered one because they said they did not see an attempt for scheduling one yet.

On the 21st of May I received bio letter dated the 18th and appointment date for the 11th of June. But on the 23rd I received another letter from USCIS also dated the 18th of May, stating that "Our records indicate that we recently requested that you go one of our ASC for biometrics. Your case is currently in suspense until you complete this process".

I am just worried with what they mean my "in suspense". Is this a usual letter or do they mean anything else.

Please let me know



Don't worry about that letter, it literally means "we can not go ahead & process your ROC until your Bio is done", that is the response letter to your SR (Service Request).

You go to Bio & get it done. Then wait 8+months for a decision if you're lucky :) VSC is extremely slow !.....

My kid received today his CG, based on my marriage. He came in the US after I did, so he filed for adjustment of status (from K2 visa) months after I did. I got married before he was 19 and after applying for adjustment of status I received a 2year conditional CG which expires on August 2013. Since he applied after I did (plus it took him more 7and 1/2 months to get his CG), his GC expires on May 2014 (two years from now and after mine expires).
When he will file for removal of the conditions for his CG, he will be 22.5 years old. My concern is about his age, because I have read somewhere about a certain age limit of 21, but I am not sure if it appliesd and/or affects his case
Are my concerns real?

You guys will apply separately, you are going to pay $505+$85=$590 each at different times. Altogether, it will cost you $1,180 (of course, if the fee stays unincreased until then).
You can file your ROC (depends on the date of your CGC expires) between May 2013 & August 2013 (of course before your CGC expires) &
your son can file his ROC (depends on the date of his CGC expires) between February 2014 - May 2014 (of course before his CGC expires).

It does not matter how old he is now as long as he has entered US before the age of 21.
Btw, he will inherit his PR from you, because he is not removing any condition actually but you are.
If you have been approved he will be approved automatically and vice versa, meaning that if you have not been approved he won't be approved either.

1- List all addresses where you have been living during the conditional period (after you have received 2-year Conditional GC).
2- You can send ROC at the end of June, but don't forget later you send later you get adjudicated.
3- Personal check is better because you can track it on-line through your bank easily.

US citizens can not be conditional permanent residents, hence you can list all your children in Section 5 of Form I-751 (US-born and/or non US-born) but you only pay Bio fee ($85) for your or your conditional spouse's non US-born children (assuming that the children has entered to US at the same time or within 90 days of their (Non-US) parent's arrival.)
The check amount was not correct, it should be $590 ONLY !... Yes you have made a mistake & USCIS officers followed that mistake too. By doing so you gave $85-donation to Obama Administration :yes: .

First, why don't you join August 2011 filers ? Without a divorce decree, nothing is official.
You will probably get your 10 year-GC & then get divorced, so you will be fine.
Bu if your wife have called USCIS & say something like "He got married to me just to obtain a GC" then you will be called for an interview.
If you have already sent plenty primary documents to remove your ROC then you will be approved. Now August 2011 filers are %55 approval rate, your file will be adjudicated very soon.
I am just making assumptions here without knowing your details. If you give us more specifics, me or any VJ member will help you better.

There is no such a thing like "Expedite Service", you have to wait for your turn. However, If you were a CSC filer or military applicant , you would have gotten your ROC result already.

Unfortunately, VSC is very slow, you will hear probably sometime in September 2012. Tell your employer hold on the contract until then. Good luck !......

If your daughter received her conditional residency concurrently with you, she can be included in your I-751 form. But you do have to pay the extra $85 biometrics fee for her. She won't get her fingerprints taken, but the bio fee is still required .
$675 total for the two of you.


Yes, engineer21 is right, you just have to fill Section 5 on 751 Form for your daughter if she is not an US-citizen & pay for her bio fee $85 but she is not going to do Bio.
Altogether; one check (in the amount of $675) & one I-751 form. Good luck !...... Btw, don't listen to USCIS Customer Service people, they do not know anything, they usually lead you in a wrong way.

Lol no you don't get expedited service automatically. I know MANY people who are military spouses who have not gotten any sort of expedite what so ever and I know a few who were DENIED an expedite when they requested it due to their MIL spouses deployment. Its completely case by case.

I want to clarify some points here, this OP, military person's adjudication is different from others, when you are in military, you automatically get expedited service, that is why it happened so fast.

Otherwise everybody knows VSC takes at least 9 months to adjudicate a ROC for a normal civilian applicant.

Is the I-797, Notice of Action actually an automatic reply to everyone that files an I-751? The attorney states that a clerk just accepts the money and issues a receipt (the I-797). And that once an examiner reviews her application, it will get denied.


You see I am not the only one who said that, even JP's Immigration Attorney did say the same thing. Like I said before DEPENDS ON IO'S DISCRETION !.....
As my stupid friend's case, he has not sent any explanation/apology for being late, maybe that is why his wife has been rejected, I don't know. There are double standards in every company, every office.
Every IO has been trained for laws & procedures but guess what, they don't have to follow exactly same paths always. I rest my case, thank you. Next subject please :D .

He was late by 10 days, but does not matter, 1 day or 1 year, LATE IS LATE !...
He & his wife had to go to Immigration Court in Newark, NJ.
In the end, Immigration Judge has removed her condition without re-filing ROC.

Hello;
As an experienced tax preparer, I know one thing when you are married, YOU CAN NOT FILE AS A HEAD OF HOUSEHOLD.
Since you & your spouse have filed as a head of household. You have had more deductions which you shouldn't have
done it. I'm surprised you haven't given an audit by IRS. Tax documents are the most important evidence for USCIS.
It is very good advise not to mess with IRS. They will make you pay with the interest !....

If you have gained your LPR through a marriage with USC, you have to wait for 3 years,
but of course you can apply for Naturalization 90 days before the 3rd year anniversary of Permanent residency.

You can go anywhere for anytime period If you are US citizen.
You do not have to come back to US except to renew your passport which can also be done at US Embassy.
There is no limitation or permission to get.

Like the other people said above, just wait for your RFE.

* I-864, Affidavit of Support, related:
* Submission of an I-864 by petitioner/sponsor
Correct version of the form
Submission of an I-854 by a joint sponsor

* I-693, Medical Exam/Supplemental I-693, Vaccinations
* Marriage/birth certificates and English translations
* Evidence of Eligibility (I-797, Notice of Pending/Approved I-130/I-129F, Evidence of Nationality, etc.)
* Legal entry
