I misread... sorry. I had twisted the information in my head. Anyway: yes, the wait between NOA1 and NOA2 has not been that long, and right now they are back to the average 2 weeks between receiving date and NOA1. BUT that does not have anything to do with the time between NOA1 and NOA2, which miraculously (because of the math done on the spread sheet) is still average. But that still means that between received date and NOA2 a long time will pass. A longer time than usual. And of course it will speed up again but still that will take time with all the back up they had.

Sorry, but i can't quite see where you got the 92 days from when you started counting in July 2007. I know only very few people who have their NOA2 already and for those it took a much longer time. I don't want to worry anyone but we need to be realistic here. 92 days would be a wonderful timeline at this point. Sorry, to be so blunt but we can't change the situation.

We've been "long" approved. We got the email on Feb 22nd 08. I think it all depends on how you do it. We called them, they told us it was all still within the normal times, we said it had been more than 6 months, a few days later we were approved. No idea how or why but it happened. And I think instead of hating each other for being approved at different and maybe "unfair" times we should support each other. Now our case has moved onto NVC and we've been assigned a case number and a few days ago the DS-3032 was sent out. So, all is good for us but my thoughts are with those who are less fortunate than us. I think about you all the time and I know how hard this time is.

VSC is NOT at mid-September. There are a few cases which have been approved but for most of us who filed between July and August it is still undetermined when our cases will be approved. We talked to our Congressman again and all he could say was that he would be watching the case. But nothing has happened so far. Not even a 'touch'- nada, nothing. So, we still have to pray and keep hopeful that USCIS will be working on our cases soon(ish).

Hi guys,
just a little update from us: nothing new. Our case wasn't touched since they cashed their check and sent us the NOA1. I don't see this thing moving any time fast. Their website says that VSC is working on cases from beginning of June 2007 (I-130 spouses) and that makes me think it will still be a while. By now I would be just happy to be able to settle with my husband early in 2009. Keeping fingers crossed that it may be sooner. Good luck to everyone. Lets try to keep on being patient and pray to God that sometime soon it starts to move.

Great news! We got our NOA1 yesterday. Its issuing date was the 12/26/2007 and our check was just cashed yesterday. I am jumping up and down for joy. All of you who are still waiting: heads up- something is moving. I'll keep my fingers crossed for all of you. All will be good!

Nothing new. And by now we don't expect to hear anything until the new year. Its sad and frustrating but I am lucky enough to have my husband with me for the holidays. And I will be going to the States in January- as my passport is still in my maiden name and I have no back record, plus I come from a pretty low risk, visa waiver country, I don't expect any problems.

Susie, I am sorry but I think your lawyer is wrong and just wants to calm things down. The question is how they will proceed once data entry is completed. But we will see. @Stefank: you filed for DCF though and have nothing to do with the backlog at the service centers of USCIS. So, in that sense, you're pretty lucky. We all have been waiting for a very long time just to know if they received our petitions at all. Right now they are somewhere between Vermont, California and Chicago. Where they'll go next: who knows?

I think hubby and I are the first ones in line here on VJ. VSC received our petition 08/03/2007- nothing yet. No check cashed, no receipt, no notice at all. We did contact our Congressman but with no luck so far. They said they would be looking into the case but who knows how long it will take for them to even find our petition in that huge pile. Plus, now that its been sent to Chicago who knows what will happen and when. I think a NOA1 would be a nice Christmas present. At least this way we would know that our case has been received and will be worked on in the future.

My husband contacted our representative, too. But so far we haven't heard back. Normally a representative needs a case# to inquire at USCIS but as our cases all have been delayed we don't have one yet. I don't know what they're willing to do now but it sure will be interesting. Congressmen, Senators and everybody else will be very busy over the next few months to sort out the mess USCIS made. I am sure our cases will take longer than it used to be over the past months and years. But all we can do is hang in there support each other and wait. My husband and I have decided that we will look into staying in Germany together if the process takes much longer than we expected. I hope though, that they get moving soon. As everything else is rather current they will have to start cleaning up the I-130s mess they have produced themselves.

Again: do not refile! It's gonna just make your wait longer. And who knows what would happen if they process and approve your first petition and then they find the second one months later in their mail boxes and might even call back your first petition from NVC to make sure that nothing was wrong with that one thereby making your wait even longer.

Looking at illegal immigration makes the legal way look like joke. BUT would it be appealing for a spouse of a UC to be an illegal immigrant? Honestly, I don't want to end up working illegally for $1.50 as a dishwasher somewhere. What did I get my degree in Germany for if I were to do that? I want to work legally and therefore nothing is left for me to do but wait it out!

More discouraging news, they updated the NOA1 notices and nothing... yet again it looks like USCIS didn't do one bit over the past week. But then it was thanksgiving week- maybe better luck next week.

Do not refile!!!! Instead of being at the head of the line you would be at the end. VSC received our petition 08/03/07 and we have heard nothing nor has our check been cashed. BUT: its in the pile somewhere! Just wait. If you haven't heard from them after 15 weeks contact your representative. Or try contacting USCIS after 90 days but they will probably only tell you that your petition is in a box somewhere in their mailroom!

No need to worry. CSC is stuck at the end of August (see above) and VSC just started moving again but is still caught up at the end of July. Just keep on waiting there is nothing else you can do. My husband and I are closing in on the 15 weeks- lets see if they make it. Otherwise we will have to call and contact our Congressman, Senator and who else we can think of.

I think this is not about destroying marriages. They have made a mistake, they admitted it, they admit there is a back log. Now all we can do is be patient and wait. This is hard but it is better than not being with my husband at all. I enjoy every day of being married although we can't be together (Physically) right now. All will work out and all will be good in the end.

On the but side: Another week has gone by without any progress.

The reason is that there was a communication mistake between the Department of State and Homeland Security. As said before they had to change priority away from I-130 petitions because (at least this is my guess) the non-immigrant workers who were now allowed to file all have lawyers and those will be willing to sue. Who of us immigrants has a lawyer who would be able to threaten with a law suit? Hubby and I certainly don't because we don't have the money. And those non-immigrant worker petitions have companies behind them who pay big bucks for those petitions and for taxes etc. Therefore the spousal cases have lost priority. In any case this should not be reason to give up hope. USCIS is almost up to date with all the other petitions therefore they will have to start working on our petitions again a) because otherwise they have no work to do wink.gif and cool.gif because the 15 weeks are drawing nearer for the July/August filers and I don't think USCIS wants to deal with a lot of congressmen inquiring about their work methods. smile.gif

So, what you're really saying is that in your case the outlook is not all too positive. I am sorry to hear that. But please, we all deal with the same slow process here but still each of us is affected differently. There are NO quotas (as far as I know) for spouses or children of US citizens. We are NOT affected by the number of available visa numbers. All we are affected by is the mistake the department of state and USCIS made by allowing thousands of non-immigrant workers to apply for their greencards earlier than usually possible. Meaning they are now prioritizing those cases which is why there is no movement on the I-130 petitions. Plus, we are affected by the larger number of petitions due to the raise of fees at the end of July.

I don't think it is time to panic yet. All the July and August filers are getting closer to the newly set 15 weeks for a NOA1 mark and as we do USCIS may either prepare themselves for a lot of complaints and congressmen getting involved or they will start moving along again. In any case. Once our cases are in the system it should not be much worse than the usual wait. At least it doesn't look that way yet. Lets not panic and keep our hopes up.

So shocked to find that as of October 26, Vermont Service Center has only completed initial data entry and issued receipt notices for I-130 petitions received on or before 7/24/07. VSC was stuck at 7/29/07 for I-130 NOA1 for over 6 weeks. Now the date fell further behind. Can't believe this!!!!


I'm expecting 6 to 8 months for a reciept , and likely 2 to 5 year wait afterwards.

I see no reason to think things will improve.

The nation does not want legal immigrants of any type and is stamping its food down to stop all immigration. (unless you are illegal and can work picking grapes for $2 an hour).

We are US citizens and we have no rights.


Where did you get the information about 2 to 5 years? As far as I know the process has never taken that long for most nations. A while ago it was over a year but it seemed only in rare cases did it take longer. Why do you have to scare and worry people who are already stressed out about the situation? There is no reason for that. I think we should support each other and not add even more stress to the whole thing. USCIS has already admitted it is going to take them longer. There is no reason to make up stuff about waiting times when there is no proof!

I think a week or two. But I am not sure anymore. All I recall is that there was a sudden quick movement before CSC also came to a complete standstill. Let's not give up hope. I just pray that nothing will now be wrong with the check or with anything else. Think positive!

Yep, they're moving backwards now.... lol.... But on a good note: the last time CSC went backwards the next time they updatet the site all of the sudden they were at the end of August. So,... maybe... this will happen to us now, too? I am sure they will be moving soon. Yes, it's frustrating but there is nothing we can do about it. So, we will just have to wait it out.

I know that they have up to 90 days to send a NOA1 BUT that does not mean in my opinion that they have the right to do so just because they seem not to be able to catch up with their work load. I agree with skp on this: it's nice that they help out the other centers but they have a job to do within their own region, too. The whole screw-up with the employment-based petitions and the raise of the fees collided with USCIS inability to plan ahead and foresee that an increase in fees will lead to more petitions therefore they would need more employees to deal with data management.

90 days all nice and well but all the people who filed at the beginning of August get nearer to that mark and if USCIS VSC doesn't catch up they will be hearing from a lot of representatives and senators because I don't think that the way they're handling it is right.

Germanchick2502, have you heard anything from Vermont, NOA1 for your I-130 or check cashed? I sent mine to Vermont one month after yours and still nothing. I guess, I might just as well forget aBout getting NOA1 from them any time soon. Today is Updating Receipt date, I Bet, Vermont Service Center will stay the same for processing NOA1 for I-130. Nope nothing whatsoever!!!! I hate VSC!!! I can't believe that nothing has happened again. Another week and no news. blink.gif I am just as frustrated as the others who were forced to send their petition to Vermont. I have no idea what they're doing up there and what they're working on but on the update last week it said it could take up to 15 (!!!!!!!!!!!!!!!) weeks now to receive a NOA1 for I-130. It seems as if spouses are no longer important and they're dealing with everyone else before they start working on the I-130s again.

EDIT: I just checked the receipt and update USCIS page: and as of 10/19/07 VSC is working on 07/29 (something new for a change) and also nothing new on the California front. They're working on 08/30 just as the last weeks. So, here we go again. Another week of waiting to see if something happens!

We filed August 3rd. Our receipt notice was issued 12/26 and they say that they received our petition August 22. All the cases seem to be not online yet though. We tried to register our case online yesterday and it wouldn't accept the receipt number. Guess we'll have to wait a few more days until they update their own system.

He will meet the poverty line requirements even with the estimate although his income will be lower than last year. Does this matter? And does it matter that my husband earned just below the 125% poverty line in 2005? Its only like $800.00? Will they asked for a joint sponsor because of that? Can we try filing the I-864 without a joint sponsor or will we have to look for a joint sponsor now? Hey guys,
I have a question. On the I-864 question 23 asked for the current annual income. What do they mean? Does this ask for the annual income my husband had in 2007 (which is way above the 125% poverty line)? Or does it ask for what my husband has earned so far in 2008 (thats below the 125% line)? I am at a loss here. Please help! Thanks so much!!!

The baby is automatically an American citizen. All you need to do is find out about dual citizenship in Japan. For example: In Germany a baby born by a German citizen married to an American citizen automatically is both American and German citizen. All the mother has to do is report the birth to the American consulate and apply for an American passport. The baby is already registered in Germany at that point and therefore has both citizenships and can keep them all his or her life.
Of course, if the baby is born in the U.S. then it also is automatically an American citizen. So, all you have to do is google or search for information on dual citizenship Japan-U.S.A.

The second seems less detailed in information. I would call city council close to you and ask about the situation.

Nobody will be able to tell you this as every case is unique. Next thing you will get is the DS-230 (see the guides for more information) and they will review your I-864 and decide if the financial funds provided by the sponsor(s) are sufficient. Once the intending immigrant has all the documents for the DS-230 and the form is filled out you have to send that in and then NVC will check the documents and information provided. It all depends on what they decide upon once they receive the information and documentation required. My guess is it could be anywhere between a few weeks and a couple months. But thats just my guess and it could be a lot quicker.
