I filed the i29f fiance visa and sent it in on october 7 and recieved a letter and an email back that it was recieved and it is in initial review. It is now january 10 a little more than 3 months since then and I havent recieved anything else and It is still at initial rievew on the uscis website. Im starting to get a little worried. Is there something I should have done that I havent or was there something I was suppose to recieve in this period of time. I really dont want to mess this up my fiance is really all I have in this world and we truely need eachother and need to be with eachother. I need a little help or guidence. What should I do. Should I call them? If so which office would I call or service center. Im completely lost here. Please help me. Thank you for your time.

all embassies do it a different way but as far as i know all you can do with London is wait for them to send you the appointment letter

I emailed my Fiancee the instructions. I now need to print and proofread her G-325a and Statement of Intent to Marry looking for errors. Then I will email her those forms for her signature.

My Initial filing is getting close! I should have everything ready to go once I receive her snail mail.

Hello everyone, I have recently submitted an application package for a K-1 Visa. After I get the Visa, I was wondering if I could be married in my home country soon before I enter on the USA, due to the fact that the ceremony will be held in my home country. The records will be kept here in Belize. no you cant. you cant enter on a fiance visa if you are already married.

Also, once I travel on the K-1 and after we get married and submit the Adjustment of Status, why do I have to submit a I-864 Affidavit of support with this package, if I already submitted a I-134 Affidavit of support with the Visa application? the I-864 is legally enforceable whereas the I-134 isnt.

I have a UK passport and travel on a Visa Waiver. Can I use this to visit my home country after I submit the Adjustment of Status? Or when I re-enter will it void the I-145 application? Wont I be out of status if I stay in the USA 90 days after I enter on the K-1? unless you have AP or your greencard you will not be allowed to re-enter the US

I had a F-1 and after I graduated from University, I applied for Optional Practical Training and received a EAD valid for one year. I found a job and my company sponsored my H1-B (during this time I met my fiance). When applying for the I-165 Application for Employment authorization, do I renew the old EAD from my F-1? Or submit a new application? (I lost my old expired EAD) submit new

Hi there,

We're in the midst of getting our I-129F package ready for mailing next week, but there's one uncertainty:

The G-325A form asks for "Applicant's last address outside the United States of more than 1 year.". Do I, as the beneficiary have to fill that part out?

Also, does this mean the last place I lived in for over a year? For example I've been where I currently live for six months this month. I was at the last place for three years. Do I put the last place, or the current place despite having been there for six months?

Any help/tips would be appreciated!

1. Yes totally possible. Just contact USCIS, let them know you're cancelling the I-129F to move to the UK with your fiance instead. It's best to include this explanation if you ever try the US side again because it looks good that you cancelled it for a different route, not because you didn't care about him anymore

2. He just needs to do the VWP... unless for some reason he's ineligible. He needs to show ties to his home country like he would for any other visit. While he shouldn't lie to CBP if he said he was there to get married it doesn't look good so don't volunteer info unless they ask. When asked "business or pleasure" I said pleasure and then asked when my return flight was. Nothing harder than that.

3. I'm sure many people have. It's not messy. Obviously you would be starting from the start in terms of wait time but a girl I know did the UK one and it took around 3 months (MUCH shorter than for US visas). I recall one couple married and filed both the UK spousal visa AND US CR-1 at the same time. They were going to do whichever one was approved first. Didn't cause any issues that I'm aware of.

I have never heard of anyone using that letter. Perhaps it is some outdated part of the process? After your petition is approved, it is automatically sent to NVC, who then sends it onto the consulate you will be having your interview at. The consulate will then send the information needed to the beneficiary, or in the case of some consulates, the info is already available online for you to begin filling out the forms you will need and gathering documents together. It usually does not take long after your petition is approved for it to reach the consulate, so I would not think this letter is necessary at all.

Hi everyone and thanks so much for taking the time to read and reply to my question.

My fiance and I are just starting our VJ and I am getting ready to send him everything he needs to post (from me) with the I-129F.

I have 2 questions:
1) I am sending my fiance: form: 325A, Statement of intent to marry and a passport photo. Is there anything else I need to send him for the initial I-129F form?
2) When sending the "Statement of intent to marry" where do I attention it to? In the example in the guide it says to put the "(USCIS service center address)", how do I know which which service centre to address the letter? (if it has any bearing on where to address this letter, we will be residing in Minnesota)

If you have any tips or advice, I would love to hear it, I did not know what to expect before visiting VJ and now looking at everything we need I am a little overwhelmed.


1. unless you have any evidence of having met in person like your passport stamp or boarding passes, or you have been married previously then that is all you need to send.

2. putting an address makes it look more professional but i really dont think that they care to be honest. if you want to put an address then put the same address as where you mail it to.

read and re-read the guides on here, ask as many questions as you want, check and double check everything, and you will soon realise it really isnt that hard.

the Philippines doesnt seem to care much for co-sponsors but being a student could work in your favour. i think you would need more than 20k in savings to use that for the affidavit of support but together with any assets like your house it might be possible... maybe.

Good Afternoon :)

My fiance filed our I-129f just yesterday so we are at the very early stages of applying for a K-1 visa. I'd just like to touch base with some people in a similar situation or those that may be able to answer my questions!

My fiance and I are hoping to get married in the US within 3 months of the K-1 visa being issued but, because we do not know how long this process will take, have decided to plan for a courthouse marriage and then have a 'proper' wedding later. Logistically this works better for us as he is hoping to return to school in August and won't finish until May/June of 2013, so our theoretically timeframe looks like a marriage in September/October 2012 (assuming the K-1 has successfully been issued by then) and then to have our wedding in June/July 2013 time. Has anyone done a similar thing?

Also, assuming our marriage to be in September/October and us staying on top of all the paperwork, when will it be likely that I can start applying for work in the US? What is your experience with getting AOS and your greencard for work?

this is what most K-1ers do from what i have seen but so long as you marry within 90 days of entering the US then do what works best for you.

the sooner you marry the sooner you can apply for AOS. EAD (employment authorisation), and AP (advanced parole for travel outside of US). EAD and AP take about 3 month and AOS about 6-12 month right now.... so you are looking at 3 month after applying before you can work.

you can call them all you want but i think you will end up even more frustrated after the phone call than you are now. yes there are people who filed after you that have already been approved... but there are also people who filed before you that are still waiting.

after reading through a lot of posts since i joined VJ i have come to one conclusion... every phone call you make and every answer you dont get leads to more and more frustration and anger.

sorry i got back to you guys kinda late but gooood news shes approved...the reason why she got called back a couple of reasons??? she didnt sign her intent letter..and they didnt collect her ds-156...i was totllay surprised when they called me i swear i just got off the phone with her..when i called and told her she had to go back...she thought i was kidding..today was an emontional roller coaster but then again this whole process has its ups and downs but today really was the cherry on the cake..thank you guys for ur input ur answers and ur time..she will be home soon..now to get prepared for part 2...but first a honey moon break :P :lol: :no:

for London you are looking at about 2 - 3 month from NOA2 to interview. a july wedding is possible and while making plans is ok... setting dates is never a good idea

I have a friend in the process of getting his wife to U.S. on a K1. Interview in 3 weeks.

How difficult is the interview? His wife doesn't have a clue of what is going on. She didn't even know her husband filed K1 for her until last week.
I'm thinking not much questions since they are only engaged.


My wife just went through interview for CR-1 and it was difficult. 30 minutes of questions!

you sent your I-129F pretty much the same time as us :)

yes it is an additional fee. once the embassy give you your interview date you call a phone number in the US and pay the visa fee that way... that is why it is in dollars. the medical fee is paid on the day of your medical in London and that is why it is in pounds.

Congrats.

In short, your petition will be sent to NVC ( national visa center), then a case number will be assigned to your visa application and your application will be sent to the US Embassy in the UK.
You will receive the so-called packet 3 which tells you what documents you need to gather. You also have to go to medical exam. When you have gathered all the required documents, you call the US embassy and schedule an appointment for interview.

Right now it's a good time to start gathering documents, affidavit of support and financial documents etc
Someone has posted a very good guide for UK somewhere, I can't find it but maybe some other people from UK will help you with that.

not for London its not. completing the medical before the embassy have logged you in to the system and sent out packet 3 means there is a chance that your medical results will get mislaid at the embassy. all embassies have a certain way that they like things done and trying to beat the system can lead to problems in my opinion... plus a medical can be scheduled within a matter of days in London anyway so it wouldnt really save any time.

USCIS will send your approved petition to the NVC who will log it in to the system and then forward it to the US embassy in London (expect this to take a good few week right now). once London receives your case they will log it in to their system and mail you packet 3 which will refer you to this website... http://london.usembassy.gov/iv_15.html you then need to follow the instructions given... mainly: fill in and return the forms except DS-2001, book and take your medical... http://www.visamedicals.info/us.asp then once you have done that and gathered all the documents you need like police certificate and afidavit of support, send DS2001 to the embassy. they will then send you an interview appointment.

no point in calling the embassy at all... you do it the way they say.
$350 for the interview.
£210 for the medical. you may also need immunizations if you havent already had them at your GP

Retirement Income above supportive levels is Important. Additional Income even though the employer refuses to write a statement or letter is easily bypassed by check stubs/bank account records.
Sounds like your father-in-law just needs to spend a day getting paperwork together and provide you what you need to sponsor.
Your pretty smart, you know what other forms are needed.

For this purpose, only a copy of the data page of the US passport is needed, not every page. Color is best. Perhaps he can scan and email that to you, so you can print it and include it with his original signed I-134 and supporting documents.

I know nothing about military, but find out numbers for the pension department and get a statement of pension details. Mom could even have something in his paperwork from when he left the military. Doesn't have to be recent if it states a dollar amount and it continues for life. Surely the embassy will know that much anyway....that it's payment forever.

But if his most recent tax return shows over the limit, then that's likely enough. I had a folder full of financial stuff and they weren't interested in anything but the first thing that showed enough and handed the rest back.

They might even approve Jenni on an I-134 in London if she's that close. Do you have any money in the bank to show that can contribute to your keep?? I know you want to cover the bases with the FIL and you'll need him for AOS because it's stricter, so might as well get his stuff now.

i think all this waiting around is making me think too much because i was sure i knew the answers to everything i needed only a week ago lol

Jenni's income is about $1000 below the stated poverty level so to be on the safe side her dad will act as co-sponsor. he is a retired colonel from the air force so has a good pension which more than meets the required amount to co-sponsor and he is currently in Afghanistan working for a private contractor after receiving an offer too good to refuse. his employment income also meets the required amount.

1) i know we need proof of him being a USC but we are not sure what to use as he obviously has his passport with him somewhere in Afghanistan. he was born on a US military base in the UK (both parents USC's) and according to his wife it appears that he has a US issued birth certificate that says he was born in the UK... is a copy of that ok to use?? if not then what else can we use?? how about an out of date passport??

2) what would be best to show proof of his income... either his pension or employment as his employer wont write a letter but will provide a phone number to call and his employment income doesnt show on his last tax return as he wasnt working when it was filed. is it ok to use the tax return as proof of his pension or will the embassy call the number provided by his employer?? is there something else that can be used??

Adam just received a letter from the embassy with a form to be filled outand sent back. It apparently was a release so they could obtain a police certificate direct from New Zealand. Has anyone else encountered this? We have no worries about the certificate (he worked for the police in NZ and has a clear certificate) our only concern is if this will hold up/ slow down progress. We are waiting on an interview date and I wonder, will set the interview before receiving the certificate?


they wont give you an interview date until the certificate comes back but i cant imagine it will take that long to get anyway

the main thing is that you got your NOA1.... that proves that your case is with them and will be worked on when they eventually get round to it. it has only been a few days though so it might show up soon :)
