K-1 Fiance(e) Visa Process & ProceduresAttorney Representation - What Good Is Having One?

i will... thank you my friend :)

K-1 Fiance(e) Visa Process & ProceduresAttorney Representation - What Good Is Having One?

However, the OP is dealing with Lagos, and says that the attorney made sure that "phone records, etc." were included (these are not normally part of an I-129F petition), so it could also be -- pending confirmation from the OP -- that the attorney is familiar with the unique dealings necessary for visa approval in Lagos.

now that is a good point and i certainly hope that is the case... it would be good to see that there are some decent attorneys out there that know how to deal with the more difficult consulates around the world

K-1 Fiance(e) Visa Process & ProceduresAttorney Representation - What Good Is Having One?

If a case has red flags, a GOOD family-based-immigration attorney can be very well worth the investment. To flatly say "You do not need an attorney" is something that NOBODY here can state with any assurance, without knowing every intricacy of another couple's situation.

  i totally agree with you on this but the fact that the OP is basically asking "what next" tells me that even if an attorney is needed in this case then this probably isnt the best attorney to have

K-1 Fiance(e) Visa Process & ProceduresMaking sure petition isn't lost

Well that's sobering. So what happens six months after the NOA1, I call, and it is lost? Do I have to re-file and wait another 5 months? Or maybe they can expedite in that case?

why are you so worried that it might be lost?? that was something that never once crossed my mind because i can honestly say that i havent ever seen a case of it happening on VJ.

just as night follows day... NOA2 will follow NOA1. it might not happen quite so quickly as that but it will happen because your case is exactly where it should be... sat in a box at USCIS along with every one elses that filed when you did :)

The infopass will not help you, as you will get always the same answer you are within the processing time.

  they wont even look to see if your case is lost or not until it is outside whatever the current processing time is

K-1 Fiance(e) Visa Process & ProceduresIts true that......

Even if they are told that an email account exists, under what legal authority would they have the right to hack into that account and read the contents? After all, they don't have the password to such accounts.

As for social media like Facebook, yes that's pretty much public to anyone so there's no legal limitation.

But hacking into email accounts? I seriously doubt that.

i would say it was highly unlikely but i wouldnt say with 100% certainty that it doesnt happen
Dan & JenniMaleEngland2012-03-22 19:38:00
K-1 Fiance(e) Visa Process & ProceduresIts true that......

Wait a minute... are you saying that the United States government will hack into an email account and read emails there if the account is mentioned? I find that difficult to believe. Especially since we give our email accounts to the USCIS for notification purposes.

im not saying they do... im saying that they can only do so if you tell them you have an email account. it wouldnt surprise me though if in certain cases they checked email and social networking accounts

The investigate information about you that even you don't know about.

i would definitely agree with that

K-1 Fiance(e) Visa Process & ProceduresIts true that......

Depends on your country
Depends on your past
Depends on if you were talking to your fiance at the same time as another or other women.
Depends on alot

Yes, I know a couple people who had their cheating past brought up at the interview
One overcame it cause the fiance had confessed to her everything so when the CO ask her about it and she said yes I know her and her name and I know what he was doing.

So if you were talking to another at the same time you said I love you to your fiance you should tell her everything so she will not have any surprises at your interview

good luck

USCIS can only check an email account if you tell them it exists.
USCIS dont know how many people of the opposite sex you are talking to unless you tell them or the email account you tell them about contains incriminating emails.
anyone who tells any government department (especially immigration) about an existing email account that contains incriminating emails is just dumb and deserves everything they get.

the embassy doesnt care about whether the intending immigrant is working or not and quite a few people from vVWP countries do what you hope to do. just make sure your fiancee shows strong ties to the UK when she travels to the US

so long as you read everything thoroughly, take your time, and follow the instructions then i think paying money for help is just a waste of money. im just starting out on the K-1 right now and to be honest with you... the help and advice ive received from the wonderful people on this site has made the whole thing a lot easier. read the guides, look trough the forums, and ask all the questions (no matter how dumb they might seem) that you want.

good luck

K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support (I-134)

After reading a little more, I am starting to be under the impression that the petitioner/fiance does not necessarily need to be the sponsor? In other words, instead of trying to have my father as a "joint" sponsor, I could actually just have him be the ACTUAL sponsor? Is this correct?

the petitioner will always be the primary sponsor with a K-1 visa

K-1 Fiance(e) Visa Process & ProceduresDS-156 problem

Hi everyone!

I see I'm not the only one who's had this problem. I tried finding a cure for the problem on forums, I tried doing it different times during the day and on different days of the week without any change.

What DID work however was to download the Safari web-browser and do it there instead of with Chrome, Firefox or Explorer.
Just wanted to share this in hope that it will help some of you!

You can download Safari here: http://www.apple.com/safari/

Hope it helps!

thanks for that... it does seem like different browsers work for different people though :)

K-1 Fiance(e) Visa Process & ProceduresOverstaying a tourist visa

You have to wait until the finding of inadmissibility is made. Since the OP knows that he has an overstay with an associated 10-year ban, he can come prepared to the interview with the waiver paperwork.

thanks :)
Dan & JenniMaleEngland2012-02-20 13:55:00
K-1 Fiance(e) Visa Process & ProceduresOverstaying a tourist visa

Not necessarily. The USCIS process primarily determines eligibility for the benefit. In the case of family-based immigration petitions, that means verifying the relationship. DOS determines the eligibility for the visa, which takes into account any grounds of inadmissibility on the part of the beneficiary.

so when should a waiver be submitted... right from the start or do you wait until you are asked to submit one??

edit: ok so i think Vanessa&Tony just answered my question :)

From the age of 18, you are considered as adult and your overstay will be calculated from this point. From 18 to 22, thats mean, 4 yrs overstay when you were adult. You have 10 yrs ban. You can apply for waiver.

while im not disagreeing about this... should this not of been spotted at USCIS level as the OP already has NOA2??

my future father in-law is more than happy to co-sponsor the I-134 and the I-1864 because he knows that if it doesnt work out between jenni and i then i will be on the first flight back to england.

tell your father that like jim says there are no obligations whatsoever in signing the I-134... and by the time it comes to signing the I-1864 which is legally binding you and your fiance will of had time to show him that your fiance wont likely ever apply for benefits because he will be wanting to work.

K-1 Fiance(e) Visa Process & Proceduresam lost. pls help
Indian Police Clearance Certificates should be obtained as follows:

  • All Indian IV applicants aged 16 and above, residing in India, should obtain police certificates from the local Passport Office.
  • Indian passport holders applying for visas outside India should obtain a statement from their local embassy or consulate confirming they have no criminal record.
  • Non-Indian IV applicants residing in India should obtain police certificates from the District Police Station serving their area of residence.
  • Indian police certificates are not available for foreign (non-Indian) applicants applying outside India.
my interpretation of that is that unless you have an indian passport then a police certificate isnt available to you... but i would check with the indian embassy in london seen as you used to be/still are?? an indian citizen. sorry dont know if you gave up indian citizenship when you became a UK citizen

K-1 Fiance(e) Visa Process & ProceduresGoing Insane

No need for me to call the misinformation line. You do not have to send in a front and back copy of your social security card to be approved for the K-1 petition. Showing my SS card was not needed at any point through filing the K-1 petition, my husband's K-1 visa interview, or when filing AOS and the AOS interview for my husband to get his green card. I was pointing out that I have never seen it asked for and it is not required, since you were essentially telling the OP he needed to send that in with his I-129F and he does not.

Copy of your SS card is not needed or required.

 i have never seen anyone that has sent in or even recommended sending in a copy of the SS card
