Well, if I wait a couple of months at NVC (wouldn't it equal to my wait for now??)... meaning I was expecting her to come April 2008 anyway, so it would just be the same? She was saying the I-130 is better due to lower fees and same time now as K3... They said they will send into NVC immediately once I write a letter to them explaining the delayed situation... I got someone's PASS (fax) number... once I fax my letter in, they will pursue whatever I tell them to send in... Please advise. K-3 Spouse Visa Process & Procedures	Nothing as of yet =(	Hi Everyone, I faxed in my letter yesterday regarding the over 180 days limit.. The USCIS person (female) said she will take a look at my app (I opted to go for the I-130) and if nothing is wrong, will approve and forward to NVC... nothing has happened since yesterday after I faxed it in... I called this morning just to confirm receipt of that fax.. the person didn't know but verified the fax number... hopefully I will hear something today... K-3 Spouse Visa Process & Procedures	Try to have a good weekend	I just did a quick estimate for approval time in my forum signature... at this rate, I'm looking at 400 days to reach the consulate for interview.. Estimate for I-130 to get approved I-130 200 days (until Approval) + 5-6 weeks *35-42 days* (NVC trip) + 3-4 months *90-120 days* (Consulate Trip) + 1 month *30 days* (Consulate) ==> 400 Days (5/20/2008) Nice birthday present for me next year (5/21), but I really wanted a nice Christmas present this year... =( Edited by gogo, 02 November 2007 - 04:46 PM.	gogo	Male	China	2007-11-02 16:42:00

I'm just frustrated that this WASN'T even our fault... their systems go down, and we have to wait a couple of months for their stupidity in NOT HAVING A BACKUP SYSTEM??... even with a daily backup, you will only lose 1 day's data and just re-enter that day again... but delaying for 2-3 months is being NOT RESPONSIBLE... does this count as an USCIS ERROR?? It seems they don't really care if I work for the government or not.. actually, they had to do a background check on me when I was hired in.. and I also faxed in the letter with a cover letter too.. stating the dept's name (Fire Dept) and other information... even my wife was a little concerned (I pasted some information for her about the security checks).. it is mainly done on the "petitioner"... I hear about the "administrative checks" done on people after approval and after the NVC... so that "check" must be done on the "fiancee/spouse" side.. seems that will also take 6 months - 1 year.. hopefully we won't get "checked" that time.. and the visa people at Guangzhou will see we got "checked" already and everything is good to go..	gogo	Male	China	2007-11-07 10:07:00

I already told her and we are both very sad at this.. they say to expect at least 6 months time... 204 days + 6 months... man... that's too long... ==> 400 days just to get approved... that's messed up... I looked it up, and it is background check based on the petitioner.. that is totally wrong.. are these "security checks" spot checks on people? Some people get it , some people don't?? Even people who applied after me got approved already (even from the same country -- China --)... "iray" congrats on your approval.. he applied after me though and didn't get any security checks.. I WORK FOR THE #%w)%#%)( GOVERNMENT ALREADY!!! What kind of security checks do you need, you FREAKING people?? I already had background checks done when I got the job.. also background (financial) checks when I apply for credit cards... I don't have a criminal background (but I will, if you guys don't hurry it up).. who cares if I get deported?? I just called now, and it was actually a nice lady (who didn't get mad).. she said they are doing "additional security checks" on my application.. what is involved in this?? I asked her how long it will be, and she said she didn't know.. Why are they doing security checks on me?? I work for the damn ### government already.. Has anyone else gone through this?? Why are we being flagged?? That is just wrong.. she couldn't even provide an estimate timeframe as to when it will be finished.. 1 year?? 2 years??? K-3 Spouse Visa Process & Procedures	another day goes by.... not been touched	same here ... no touches... maybe we are all under "security checks"... I faxed over to 7 of my state's congressmen/women and also one of California's senators... hopefully I will hear something in a month or two regarding this situation.. I signed their "privacy" form and faxed my letter to them also... well, at least try to have a nice holiday (Monday is a holiday for us).. innocent.gif maybe that's why the USCIS people aren't working... just be strong and stay positive.. I read a topic on visajourney where the two people divorced and went their separate ways because the visa journey took too long (over 2 years already)... you can't let USCIS decide who you are and want to be with.. Love will conquer everything... your love for each other will make this journey better, and when you are finally together, it will make your relationship and family stronger.. For me, I just received a letter stating they will forward my letter to my congressman (haha, I tried 7 different ones from California).. Congressman David Dreier was kind enough to help me forward to the congressman that serves my district =) Hopefully I will hear something next week.. My Honey, who told you that you are still under 6 months time?? Maybe it was still before 6 months when the Senate congressman helped you checked it? I am going to send a weekly fax to the congressmen of California (different ones, I don't care).. and also to both Senators, and the Governor... I will keep pushing them to help me approve my case... I am giving USCIS a deadline of 1/1/2008 (already told my wife) before I am going to sue them.. with that date, it will be over the 6 months timeframe (for sure) and way past the recommended approval time for me.. I just faxed in my letter to 7 of our congressmen in California (just looked up 7, including my district) and also my senator too (Dianne Feinstein)... I'll send more next week to other congressmen and the other senator (Barbara Boxer).. I just had to fill out the privacy casework form.. and just wrote a letter stating all my information (and also complaining because I work for the government already, what is with the background checks... but in a nicer language).. Hopefully I will hear something soon... but they say it won't work.. lawyers, senators, congressmen are useless if it goes to security checks (FBI name check)... that's because they probably think it is stupid too.. why do some people get it , while others don't? The US Attorney often contacts the USCIS office and pressures them to act." so I also faxed to the US Attorneys in California (3 of them) asking for their help.. also updating my letter stating that "further action will be taken (writ of Mandamus) if this is not resolved soon. (I will be giving them a deadline of 1/1/2008 -- 260 days).. I even wrote all that... 260 days... that is 8+ months just to get approved... plenty of time for them to act on... if I do get denied, I will see them in court (so it doesn't really matter)... best for them to approve me (just like so many Visajourney people on here)... I found some numbers from inside USCIS that some people might not know.. does anyone know the Director's fax number? I have been on Google, and nothing yet.. Last time the USCIS person gave me a fax number, but it might just be for their department (and not the Director's personal fax number).. I have sent a whole package to each congressman/senator/governor and also to their various offices (11 people, but over 25 fax numbers).. (3 pages, 1st page -- Authorization Form, 2nd page -- whole page stating my situation with priority dates, working for the government, other people processing / approved before us, and March people can come in October while we are forced to wait, and 7 months without touches, and also these ##%*%# security checks)... hopefully they will respond to my request soon (just like you)...
