I-130 Applied April 2007
I-129F Applied June 2007

November 2007 Status (USCIS Online) - both transferred to local office, LOS ANGELES
so I called saying "what's up??".. they said I was under security checks..

December 2007 - so I started making infopass on December 26 and they said my case wasn't at LA, and that it was at NBC (National Benefits Center).. they will transfer back.. they sent me a letter to show up for the local office interview February 2008 (after many calls and letters to senators, congressmen, and others - like I said above)..

February 2008 - went to local office interview (brought my parents - the examiner said that since I brought my parents, everything was ok - they wanted to verify and that they said a lot of fake marriages from China).. he said I can get approved and that please about 2 weeks to receive the approval notice..

June 2008 - nothing yet.. hired a lawyer in May 2008 to do a "writ of mandamus" (lawsuit) against USCIS..

see, there are people that waited longer..

well, I am going to call them everyday now and bother the hell out of them.. I also initiated the "writ of mandamus" and that is in progress.. the demand letter ( 30 days has passed already) was not responded to (even the lawyer said so), and they will file the complaint now and they will have 60 days to approve the case.. with a 30-day extension.. for those who haven't followed my story, I also wrote letters to congressmen, vice president, president (white house) and other people (about 100+).. and also received a local office interview and "passed" it (also brought my parents - February 2008).. they said everything looks ok and said that I would get approved, but I never received the NOA2.. they keep delaying, so I decided to hire a lawyer and do a lawsuit.. I wrote a letter to President Bush and he (or his office) forwarded to Dept of Justice (with a letter sent) and also forwarded to FBI (where the Records Name Division wrote back a letter stating there were no security checks on my case)... haha, I have been through a lot and still fighting.. now I am not even nice to them on the phone anymore..

seems there are a lot of people that are under security checks =( I just called them today, and they still don't know what is going on with my case.. I hope that I can get approved soon.. I don't know why they are doing it based on processing times.. maybe they are, they just looked at everything ONCE and that's it..

I wrote to all the candidates already =) only McCain seem to help out (he actually contacted CSC for me), Obama was 2nd and said he will forward the letter to my senator, while didn't receive a reply from Hillary.. the other ones from the start didn't reply either.. these were all done about 200-250 days from my filing date..

haha, a lot of things have happened to me.. they transferred my apps to the local office last November (2007).. and then I had a local office interview too.. brought my parents and everything (lucky I did) and the examiner said that everything looks fine because you brought your parents - they wanted to make sure it was a valid marriage... ####, like they don't have other things to do instead of wasting time and analyzing people.. Also, I have a government job and am a US Citizen.. so go figure.. what other ####### do i need to verify myself?.. For the I-130, I sent in as evidence my wedding invitation, 20+ pictures of both sets of parents, and sisters,uncles,aunts on her side.. and 3 affadivits of people who know both of us with their contact information (address and telephone and other stuff).. well, anyway, I was like "what the hell is going on??" , so I called them and ask where my case was.. they said they will transfer back to the local office again... I went there to ask in December 2007, so I got frustrated..

I have been sending letters to various people (congressmen, senators, governors, attorney generals, vice president, president, presidential hopefuls too).. anyone working the government.. well, I received a letter from President Bush stating they forwarded my letter (5+ pages with story from beginning and what's been happening to my case and current case status online saying it's way past time) to the FBI.. I received a letter from the FBI (Records management Division Chief) saying I had no security checks on my case (letter somewhere in january 2008).. USCIS had originally told me that I had security checks back in November.. so I went to the local office interview they set up for me in February 2008.. and the guy said i was to receive the approval notice within 2-3 weeks.. and nothing yet.. now it is like this:

so May 2008 , I hired a lawyer and going through the lawsuit now (writ of mandamus).. the lawyers have to send a "demand letter" and wait 30 days for a response.. the time just ended beginning of this week and they said they weren't expecting a response from USCIS anyway.. so now the 60-90 days wait will begin for the official complaint (taking it to court before a judge)..

haha, thanks Cassie.. I know I'm not the longest here.. but I try to put my experiences up to allow others to see what to do (in my case).. Also, with the letters, write one to the white house (just fax them plenty).. they will forward the letter to the Dept of Justice and FBI .. I got a letter back from FBI stating there were no security checks on my case.. that is good proof for the lawsuit and for the court.. good.gif

yay, I have a reason to be pissed off, right? good.gif still didn't help me when I went to the local office.. all that did was bring a security guard over in my face wanting to kick me out.. mad.gif mad.gif actually since the OP is still pretty early, you can try a few things below.. Platypius, you weren't really nice to me back then when I was waiting.. =( I'm just so confused as to all their excuses now.. don't attack me anymore.. I already miss my wife a lot and still haven't heard a decision.. so I'm really going to #### them up next time I call in..

1) send letters to congressmen, senators, attorney generals, vice president, president.. hmmm.. where did I see that before? I've been telling about that ever since I started sending letters..

2) call your senators and congressman/woman and keep bugging them..
3) call USCIS everyday too, bug the hell out of them..

4) for over a year's wait, you can do what I do.. a "writ of mandamus" lawsuit against them..

It annoyed me back then when people complained about the "injustice of it all", and it annoys me now. In the US this process takes a long time. It always has, it always will. Pitching a b!tch about it will accomplish nothing, except maybe slow the whole process down while the onslaught of emails, Congressman inquiries, etc are dealt with. If you've been waiting over a year, then yeah....you have a reason to be pissed off. Otherwise, it's just a bunch of whining.

actually, best to do it over a year of filing.. =) the NOA1 date is stupid.. I filed my petition April 13, 2007, and received the NOA1 on May 29, 2007 (so I filed the I-129F on June 4, received date of June 11).. that's why they said I filed two different applications.. I followed the correct filing instructions (like everyone else here), but the local office people laughed at me while I explained how I filed.. mad.gif mad.gif

hi , I may be of help.. actually I filed my I-130 in April 2007, and they transferred my case in November 2007...

To answer your question, I received a "summons" to show up at the local office on February 21, 2008 around January 2008. I also brought my parents too (everyone was dressed up in suit and tie) to attend the interview. I brought my 3 backpacks full of information (copies of I-129F, I-130, and other evidence) Even my mom and dad said I had prepared a lot because I always keep up-to-date on many of the immigration forums online. I also submitted the pictures to him of the time we spent together (with both parents and family at the wedding party too). (a couple of albums full). The official didn't ask for any additional evidence when he spoke to us. At first, he was really mean because he thought I had brought lawyers with me. The whole interview didn't last more than a few minutes. When I sat down, he asked "who are those two people with you?". After he knew it was my parents, he started asking them questions ("Have you seen her before?, "Have you seen her family?", "Did you attend the wedding ceremony?" (I produced the pictures, but he just glanced at them). He then said that he just wanted to verify because there has been lots of fake marriages from China and that just because my parents were here, that was a big bonus and that we will get the approval notice within 2-3 weeks after that. He said that everything looks good and we just shook hands and left. Now I learned a lesson from that interview to always get something in writing but I was nervous because normally people don't get transferred to the local office. He had a big folder in front of him with (I'm assuming) the letters I had sent to various senators and congressmen (it was a big folder). His name was "John Tu" from the 8th floor. After a few weeks, I made another infopass and also walked up to the "fraud" office, but the guard wouldn't let me in because he said that I was supposed to make an appointment. The infopass appointment that I made was on the 1st floor, so he wouldn't let me talk to John Tu about the situation. The guard mentioned that it wasn't really that fast, and should take about 2 months to receive your notice.

To answer your question simply, yes, they asked questions concerning the validity of our marriage.

You can probably do a lawsuit if you waited over a year... otherwise keep sending out letters (more than to your congressman).. I sent letters to senators, attorney generals, white house (president, vice president, first lady, chief secretary) and ombudsman too..

First off, writing to the president, white house, FBI, Dept of Justice, congressmen, senators is not useless.. I did it, and it helped me get approval (also because I did a writ of mandamus - lawsuit).. Second, I believe the timeframe should be between 6-8 months for approval, if nothing happens, give them another 30 days and then start writing everybody.. there is plenty of stuff to do to get your approval.. it is just how far you are willing to push for that.. how important is your wife/husband to you? I'm willing to go all the way... devil.gif my advice is to get ask other depts of the government if you are under any security checks.. even like the FBI says, they finish most of theirs in 72 hours (so at most 1 week).. if anything more than that, the office is just holding your petition..

did you get any lawyer to help you before? Did you also do a lawsuit too (just like me?).. that usually scares them, but it's good to have a lawyer as backup.. what does the denial say on the letter? do some research on appeals (and you probably could file an appeal lawsuit too, not sure of that).. We didn't wait as long as you (but considering I am US Citizen already, it is long enough), but we may be going down the same path..

oh, sorry.. just had lunch.. you give them your info on BOTH PEOPLE :
1) FIRST NAME + LAST NAME
2) A # if you have both, but probably just the US Citizen
3) Case Number
4) Email addresses (both)..

I put both for everything.. anything else that can help.. in China, she has a China Passport ID number.. I also put down my home phone and cell phone.. maybe it's too much, but I just want to get her here.. besides, the FBI probably has all that info already.. good.gif

I just sent it this morning, so probably not expecting anything for at least a month or two..
