K-3 Spouse Visa Process & ProceduresPLEASE POST YOU NAME HERE IF YOU WANT TO DO SOMTHING ABOUT THE SITUATION?
Hi Kezzie,

I know, but this wait is frustrating for all of us..it's just the separation from our loved ones that hurt the most.. I would be lucky if I got to do AOS like you.. I would wait 20 years for AOS to get done (doesn't matter) because at least we are together (well, your son may not be with you guys, but at least you two are together for the current time being).. good.gif It's just not being able to touch and hold that is the worst feeling... even worse than these USCIS problems..

Hi Kezzie.. you didn't understand my post... since you did AOS, it is the "Beneficiary" moving to "Petitioners" country... I'm talking about the other way around... "Petitioner" moving to "Beneficiary" country... in other words, for your husband to move to Scotland =) good.gif will he be willing to do that for you?

Hi Kezzie.. I know about that result =( but that is the worst-case scenario.. I even told my wife that I would quit my government job to be with her.. We may not have as a good life in China as we do here.. but that is ok.. at least we can start out family... would you have done this too? I see you have a son too, so were both of you two willing to move to your spouse's country as well?? I saw some people get divorce on Visajourney because they couldn't handle it.. I would rather move to her country and not let USCIS control who we love, who we live with, and who we have a family with... She was very touched at what I said to her.. This visa journey has really broken both our spirits.. and probably it will not end soon too.. I guess we don't have the luck as other people.. wacko.gif

I agree that we should make a big fuss about this.. but I am afraid that we may need to sacrifice ourselves in the process, and that may not be good.. Kezzie, do you have any ideas what we can do in this situation? As you can see, I have been waiting since April.. =( Something has got to be done about this immigration system.. I guess that's how America started out in the first place (Americans didn't like the British controlling them)..

Let me see some good ideas (I already used the few ideas I have so far -- emailing various people in the government)..

that would be cool, SusieK... go Susie, go Susie, go Susie... yay... did you get your NOA1 for the I-129F yet?? Supposedly you should get that much faster than your I-130 NOA1... you can try asking for a REPLACEMENT NOTICE (took less than a week for me, but I really didn't call for that reason.. they assumed I lost my NOA1... sheesh)... wacko.gif wacko.gif I am just sad now.. don't know what is happening.. saw a CNN video this morning

http://www.cnn.com/v...ddy.in.box.wbko

and I just started to cry.. I want to be able to do that for her too... surprise her when she gets approved.. =) I have made my first INFOPASS appointment on December 26.. hopefully the people there will be much better after Christmas.. I'll even bring my parents to PROVE our VISA APPLICATION IS FOR REAL... if nothing happens at that appointment, then I'm going to take them to court on 1/1/2008..

The illegal immigrations ALSO get to be with your family too.. that is the most important thing.. I WILL WAIT for my spouse's status of adjustment papers to get approved for 20 years.. as long as we can see each other everyday and be able to hold each other... I'll even give them half my salary until then too.. it is the being apart that is the most difficult for us that are still waiting..

if you look under the I-129F.. there are many "categories" that people can come here.. one is the L - Intracompany Transfers... so if I have a company here and there (in China), then she would ALSO be able to transfer here as soon as 30 days?? The highest of these "categories" have a max of 2 months processing time..

I am still wondering what being a US Citizen is good for.. how it has helped us through this immigration process.. even with 1)H1B (temporary workers), they can come in less than 1 month.. so really we shouldn't have married at all.. we should have applied for H1B visa for her to come, and then NOT have the intention of immigrating here... then get married and do adjustment of status.. so basically "single" temporary workers have the best chance of coming to the US... blink.gif all the "adjustment of status" people have no right to complain here.. you are at least living with your loved ones and can see them or be with them more often than us.. but I'm not trying to attack you.. I'm attacking the immigration system and their priorities..

2) after that, it is someone who can sneak over the fence (illegal).. I don't understand why the "illegals" are complaining.. they got to stay in this country... they are complaining on what????... at least you are in the country and possibly can get a job too... so US Citizens are lower priority than both these groups...

so if I had her apply her for temporary worker visa or have her sneak over it will be much faster... that's just great... sad.gif

they are too scared to post them now? I thought we would be having a monthly update of their processing times... mad.gif mad.gif I have been checking everyday since the 14th and nothing... probably did nothing the whole month.. devil.gif (and you wonder why you only get paid $11/hr).. like I posted in another topic.. you need to work hard to get good rewards.. it's good they are doing the "bonus" thing now and weeding out all the lazy people (since you probably can't fire them after the probation period without a very good reason)..

haha, and this is from a government employee too.. I admit, sometimes we do get the time to relax some, but most of the time we work hard (even work hard in getting the job - interview).. so we are rewarded with a good paying job..

thanks Marlita =) good.gif I hope you get to hear something real soon too.. did you get your I-130 NOA1 yet?? I see that some people are getting their NOA1 3 months from when they apply.. (apply September, received in December)..they say they are using Sept (the example) as the priority date.. but if you think about it, they are too busy just entering the stuff into the computer.. let alone getting the time to process our applications.. a couple of years ago, it might have taken at most a week.. (when I applied it was 1 1/2 months).. so there seems to be a bigger delay now =(

seems like they are just using this new "app" rule against me and saying I applied twice.. so there must be some confusion on their part.. I thought I had followed the filing instructions correctly (but yes, like you said, you might not need the NOA1 from the I-130).. probably a copy of the check would have been sufficient.. since they have JUST RECEIVED my app to process, seems that way.. what do you guys think? whistling.gif I wonder if this new rule applies to others before June 21 (the article's date) that haven't been approved yet.. maybe that's why we are having so many problems..

they didn't mention anything about security checks.. guess they didn't know about it.. I bet they were looking at the wrong application in their computer.. they asked me how I determined the difference of I-129 and I-129F.. I explained and they laughed and said I was teaching them.. they think they are the experts in immigration.. I admit, I may not be too, because of all their new rules (like the filing at the same time mentioned above).. the supervisor just said that my case was at the NBC and that approval will come soon.. it is already assigned to a officer to look at.. that is way different than what I got on the phone calling CSC (all those phone calls) ... they said my application is not in LOS ANGELES (repeated it many times).. then I showed them the latest case update online, and they said that was wrong.. they also said those people you call at CSC don't have the latest update too (all they do is look at the website, like us... the two people here said they don't know anything else, like what the automated system says.. so now I'm doing some research on this NBC (Benefits Center) place.. to see if they actually still do the I-129F.. I had thought they transfer all the I-129Fs to either VSC or CSC (to do that balancing work thing)..

I have a question on your cases... the I-129F starts with "MSC" while the I-130 starts with "VSC" or "CSC"?? does the I-129F ever change?.. MSC is the Missouri Service Center (previous name).. does the I-129F get transferred to VSC or CSC??

seems like the official date of change was 6/21/2007 (after both of my FILINGS).. yet they use this new "rule" against me now..

at the end, they just told me to wait.. they said probably April-May 2008 approval.. crying.gif crying.gif but they said my latest case update was wrong (on USCIS website), and that both of my apps are at NBC... so I'm doing some research on whether this is good for me or not..

they are basing the "new rules" on old applications.. crying.gif crying.gif where you can file together now, but can't do that before.. do you have an article about that you can find for me? there was also a supervisor talking to me... he said that now you are supposed to send in BOTH at the same time.. so just because they took long on my application.. now they are basing the new rules on me...

so now it seems like I have applied for two different applications (I-130 and I-129F).. since they didn't approve mine in time (to hold back either the I-129F or I-130), it seems I am in trouble.. they just told me to wait and that both my applications are at NBC.. hmmm.. what do you guys think? bad news.. =( they told me that I was supposed to apply the I-129F and I-130 at the SAME TIME.. not the I-129F after the I-130... is that true?? I thought I was supposed to get the I-130 NOA1 and attach it to the I-129F form?? crying.gif crying.gif that is why my applications are on hold.. they said my applications are at the NBC Center.. (not NVC).. they said I should hear something very soon.. I'm not sure of that.. they also said the USCIS website doesn't get updated, so go to your local office to make sure of the latest updates.. they even said the people who answer the phones don't know of your latest updates.. so in fact, my case is NOT TRANSFERRED to local office, but to the NBC..

can anyone help me on this? My I-129F got transferred it seems to NBC.. is that almost good to go (approved)??

sorry, a little off topic SusieK... but, take a look at this one mad.gif mad.gif I know it's a bit old, but take a look at the language..

http://www.uscis.gov...pdate113007.pdf

"U.S. Citizenship and Immigration Services (USCIS) is revising the filing instructions for the Petition for Alien Relative (Form I-130). Effective Dec. 3, 2007, all applicants filing stand-alone Form I-130s are encouraged to file their petitions with the Chicago Lockbox instead of a USCIS Service Center."

Petitions filed with the Chicago Lockbox will be routed to, and adjudicated at, the appropriate USCIS Service Center. This routing will be based on the petitioner's place of residence in the United States.

"While the changes are effective December 3, any Form I-130 filed with the Service Center will not be rejected; it will be forwarded to the designated Chicago Lockbox."

Also, do you know of their "December" processing times? I haven't seen any updates this month.. Marlita.. just to be honest.. waiting from October is not much of a wait.. just take a look at me crying.gif crying.gif try doing 8+ months without anything and also being under security checks already (not the same thing as AP -- administrative checks).. yes, rebecca is doing AOS.. that's because she got lucky enough to do AOS.. some of us are just unlucky or have a spouse from a "unlucky" country (China isn't one of the more popular countries when it comes to immigration).. I don't know much about Jamaica though.. but I just want to say good luck to you too.. hope your approval will come soon enough.. just remember though, there are always people that are worse off than you.. and just to get you up-to-date.. I have been sending lots of letters to people all over (just ask around on VJ on my situation).. you probably will hear something around 6 months (typical time).. hopefully faster...

I will be going on my first journey to the LOCAL OFFICE to see what's up with my app.. My father is also coming and I'm bringing lots of evidence (Emails -- 150+, Pictures -- 200+, pay stubs (20+), telephone records (20+ months), copy of I-129F/I-130, G-325A, Copy of Passport, and other things).. I'm going to give them lots and lots of evidence this time.. If they want, I'll print out all 2000+ emails..

I'll have to join in the defense for Rebecca.. this really has NOTHING to do with her journey... and take a look at your journey , David.. you GOT APPROVED ALREADY... so please quit complaining... you want to see a long journey, take a look at mine.. 245+ days without ANYTHING.. so really, you don't know much about waiting yourself.. mad.gif you got approved within the 6 month timeframe.. some people have a shorter timeframe than you.. while others have longer... we are all in this journey together trying to bring our loved ones here.. some are just more lucky than others , as you can see.. the topic of this thread is to find someway to change that, and not try to attack others just because they are faster than you.. Yes, I even had a fight with rebecca too (but we put that behind us).. I cannot blame her for a slow USCIS system.. so you shouldn't either.. yes.. How are you holding up?? I think nerdette beats me out as the longest , hehe... I think there are many reasons from what they tell me.. 1) big delay due to increased apps (everyone knows this), 2) new rule on June 21 stating you can file BOTH AT THE SAME TIME.. even they tell me a reason might be because they thought I had submitted twice.. I showed the local office people the way I submitted (submit I-130, wait for I-130 NOA1, submit I-129F).. they say they never heard of filing separately.. they also laughed at me for saying I was trying to teach them (said they already had training for this) mad.gif mad.gif they are no experts.. anyone can ATTEND a training, but to UNDERSTAND it is different.. they think they are hot-shots, then why are they only getting paid $11 / hr?? hmmm... devil.gif well, anyways.. that is another reason... because they JUST RECEIVED our cases now for processing, so they use the new rules against us..

Hi nerdette, sorry to hear about your problems.. crying.gif crying.gif even now, I'm worse off than you...

I just called them, and now they are so rude.. I asked them I got a local transfer and the notice said I had to wait another 180 days from that LOCAL TRANSFER date.. and she said , "yes you do".. I said "How come?".. she said "That's the way it is.. it is from the local transfer date".. I said "but I already waited 180 days already, and my original application was sent in April".. she said " I know"... she was thinking "so what?"... that's what happens with the recent pay cut they got.. mad.gif mad.gif.. she was like it was my fault in calling her to inquire about my case.. then she had the attitude to ask me "don't be afraid to call USCIS with any more questions"...
