go Obama! good.gif haha, just reading your signature.. but I am getting nervous, even though I am mad.. but even like my dad say : What's the worst that can happen? You move back to China and be with her.. They can't do anything else, because they don't have authority in China.. haha..

haha, Thanks SusieK!! good.gif I hope you get your approval soon too and not have to go through what I am going through.. but like I said, that day (February 21) is an all-or-nothing day... I have seen the decision made right after the interview.. sad.gif I am really worried about what they are going to ask and hope for a quick interview.. I really hope it is nothing like the "stokes" interview..

if I DIDN'T do what I did, then I would still be sitting here twiddling my thumbs instead of getting an interview with them.. They brought the battle, and I'll bring the ammunition!!

Firstenburg, forget about this so-called Becky person.. just call again after a few days.. MsZ says we all should wait our "slice" of the USCIS time.. well, sometimes this "slice" is much bigger (like in my case).. 311 days just to get ###### approved... I don't think so.. that is almost DOUBLE of what other people are waiting at.. so I had to do something in my position.. by faxing letters, calling them and getting a STRAIGHT answer... and that is how I got my LOCAL OFFICE INTERVIEW set up.. I have seen people waiting from 2006 and not doing anything.. This isn't some item you buy at the store and if they run out of stock , you just sit there waiting.. This is a life between you and your spouse!! I AM NOT GOING TO LOSE TO THEM... They know I have been calling too (my most was about 2 weeks ago.. got fed up and called 4 times).. they even knew it and didn't get mad.. because I was going to get mad first if I heard another stupid reply like this : "There are many factors that may affect your case...".. My reply : "WHAT THE #### ARE YOU TALKING ABOUT!!" Then that CSC person got mad too.. but I said "what the hell are you getting mad at me for? You can't even do your job right!" ... Then I got my local office interview.. well, after a few days getting mad at them.. (since it was already under security checks, I knew about the local office interview already)..

Nita.. you only submitted the letter twice so far? You can do better than that.. I was expecting you to submit twice in ONE DAY.. laughing.gif

Anyhow, some people (like me) TAKE ACTION because it has taken so long to do something already.. I have faxed HUNDREDS of faxes already (I have about 100 fax numbers, and did about 20-30 every time I faxed).. I don't bother faxing the USCIS because it will get nothing done.. get the other people to FORCE them to do things.. I had seen people who are still patiently waiting for something to get done.. that is NOT the way to approach this.. don't be afraid of the USCIS... mad.gif mad.gif don't let them control your lives and your every move..

and that's why you should start complaining, haha... like what I did.. I seen people who got transferred to local office way before me (in 2006) and still waiting there for USCIS to do something.. but YOU should do something and make more people aware of your case.. I have provided lots of numbers / contact info for you.. it's all up to you.. I can get you more (but I think it is different because you live in different place to contact your senators, congresmen, and others)..

basically, just be prepared for the "worst-case" scenario as well as the "best case" (approval).. I have talked with my parents and wife and WILL MOVE back to China to be with her if we fail.. I really don't want it that way, but ANYWHERE is good if I am with her... it really doesn't matter.. we can have a happy family in America, China, Iceland, Africa, Antarctica even... we are on this Earth for no more than 100 years (avg).. so enjoy the time with that special someone..
MY RULE : DON'T LET USCIS CONTROL YOUR LIVES AND WHO YOU WANT TO BE WITH... Their system is stupid and inefficient (the right hand doesn't know if the left hand slapped it or not)..

well, you can just write to your senators, congressmen, white house (vice president, president), ombudsman, district attorneys, governor, whoever.. that's what I did.. and fax often to bug the hell out of them.. One of the people called from the senators office and left a message : We received your request and appreciate it if you didn't send more. We recently received 9 faxes just last week regarding your situation. Your original one was sent in November." Write to anything that has a .gov extension =) Make the whole country know about the issue that you are having....

just called the RFE line and the very rude lady there told me I call too much and I can only call every 30 days. She said that she would not check my account for me and even if she did there won't be any work done on it because after it is assigned to an officer that it will still take 30 days to hear anything !!!!!

Does anyone in USCIS know what they are doing ????????

keep pushing, that's all I say... just take a look at me.. finally got something done with them.. good.gif people say don't mess with the government and seem scared of them.. well, I DON'T.. I want my wife to be here, so we can have a good family together.. DON'T GIVE UP.. never let the USCIS control you.. if I were you, I would send letters to my senators, congressmen, white house (vice president, president), whoever.. I have sent so many faxes recently that the senators office told me "we appreciate if you would stop sending, we recently received 9 of your faxes just in the last week"... that's because I faxed not just to them, but to others (so it fowarded to them, hehe)..

nooooooooo..... local interviews are BAD STUFF... they are suspicious of your case.. even this officer told me upfront about that.. he said it was because lots of cases have been fraud cases (also , especially among the young people).. get approved the normal way.. but if you do end up like me, you can bring your other family members to help (preferably your parents, since they have known you the longest).. or whoever has known you the longest.. good.gif Basically, It was THEIR IDEA to have the local interview, since they didn't trust me... The local office has the power because they are SUPPOSED to do only I-485 (Naturalization) green card interviews... I would assume they are more powerful than the USCIS Service centers.. well, once we get past the I-130/I-129F stage.. I think the local office does the adjustment stuff as well as the Naturalization stuff...

yes, faith11, this was a long fight.. "all or nothing" like I had put it.. but I got the "all" on my side...

just like my signature says... we are finally going to be together wub.gif

I made a promise (either way on what happens) we won't be apart for Christmas again... I haven't visited her on any of the major holidays, so we haven't been together... whistling.gif well, at least it is a start, so that's good.. they will be sending the application to the consulate within 1-2 weeks (as to what I saw from others who had a local interview)... wow, I still can't believe it.. some of you it seem also have a recent approval... Congrats QaSiM--aIsHa!!! Yay, now you are on your way out too... I hope that you get to be with your spouse soon... good luck!!

I went with my parents to the local office and sat there for 2 hours in the waiting room.. then they called my name and an asian person called us in.. before we had even sat down, he asked "who are these people with you?".. my dad said "dad and mom"... then he said "in that case, you will be approved".. then he just asked my parents a couple of questions (where are you guys from, how long lived in US, have you met her and her parents).. then he looked at some pictures from the backpack I brought.. (maybe 6-10).. I didn't even have to show my DVD or my copies of my forms.. then he said: "We are doing this because there are many fraud apps with young people".. "if the parents are there, it would be much better... automatic wild (trump) card"... we didn't even have time to react.. everything was over in less than 2 minutes.. we didn't have time to get comfortable (not that I wanted to) in the chairs yet... so if you want to get approved.. GET YOUR PARENTS TO COME AND SUPPORT YOU (or other CLOSE family members -- brothers and sisters)...

Thanks Nita&Assaad!! No need to apologize... happy.gif I am still worried about if it is real or not.. they aren't the most "trusted" people when they say things... I'll celebrate more when I get the NOA2 paper in the mail... does anyone know how long a local office interview approval will take to get the NOA2 in the mail? I'm guessing about 1-2 weeks.. my main question was the guy said that they will "forward the application (don't know which one, forgot to ask.. most likely the I-130 now because that was what the interview was for on the paper) to the Guangzhou Consulate".. does that mean they will skip over the NVC? does this happen often to the I-129F/I-130 applications.. I have seen lots of stuff on the web as to the I-130/I-485.. Thanks everyone again!! sorry to make this an everyday thing.. haha.. but the time has come for my battle.. even if I lose the battle, the war is not over.. K-3 Spouse Visa Process & ProceduresK-3 affidavit of support
I don't think you do a I-864 for K3..

"You also need to begin preparing an I-134 Affidavit of Support. The I-134 Affidavit of Support will be filled out by the US Citizen and sent to the spouse for the K3 interview. It is not required to be sent to the Service Center with the I-129F. Some Consulates require extra information to be included with the Affidavit, some may not even require the Affidavit itself, but still require the supporting documentation, so you need to hang onto it until you have learned whether or not there are additional requirements. These will be listed on the OF-167 "financial support" document the spouse receives from the Consulate. "

take a look at this page good.gif

http://www.uscis.gov...00045f3d6a1RCRD

I know it is for last year.. but the numbers are similar to there...

2007 POVERTY GUIDELINES*
Minimum Income Requirement for Use in Completing Form I-864

For the 48 Contiguous States, the District of Columbia, Puerto Rico, the U.S. Virgin Islands, and Guam:
Sponsor's Household Size 100% Poverty Line 125% Poverty Line
2 13,690 17,112
3 17,170 21,462
4 20,650 25,812
5 24,130 30,162
6 27,610 34,512
7 31,090 38,862
8 34,570 43,212
Add $3,480 for each additional person Add $4,350 for each additional person

that chart is crooked... basically for "you and your spouse" (2 people) you would need $17,112 (125% Poverty Level)...

K-3 Spouse Visa Process & Proceduresinteresting tidbit of news...
that's something we have to do for China.. they are real picky.. it basically 1-2 pages of how you two met , and give a timeframe of everything after that.. paragraph form (like a story, not just a timeline).. I wrote one in English already, and she wrote one in Chinese / English.. the interviewers may not be Chinese after all.. I just found the stuff on Candleforlove (mainly for China Guangzhou consulate).. also something about a picture of you in front of a post office holding a local newspaper.. where the date of newspaper and post office address are visible.. now this rule is stupid, haha.. but I still want to do it.. I see a lot of people getting blue slips (pass/fail - pink is pass, blue is need more evidence, white is fail).. normally they will give out blue slips before they give out a nasty white... you get about 2 or 3 chances, so that's good.. but I hear you have to repay the consulate fee, which is not good =(

well, anyway, take a look at some interviews that happened in your consulate.. and just try to do everything.. just like my local office interview.. I had prepared for everything, but it was a quick 2 minute interview (mainly because my parents were there too, everyone dressed up).. it's better to be more than prepared than not..

haha, I'm still confused.. if that is the case, then why are we waiting at the NVC in the first place? Can't they just "forward" our I-129F (since they are linked anyway now) to our consulates?.. or maybe this 4 months for Guangzhou Consulate is the "forwarding and receiving" part?...something is wrong in this situation.. well, the whole thing is wrong, but I'm at this certain part now.. laughing.gif

still not sure yet, when the NOA2 notice arrives in the mail.. that's when I will know.. I made a local office appointment on March 7 (infopass), just in case... but hopefully it will be here before then.. to tell you the truth, I don't know even if I am approved or not.. I'm not celebrating round 1 victory until I get that paper in hand.. then the round 2 battle will be the consulate battle.. I have seen some things I need to prepare (not just packet 3 or packet 4).. a "letter of evolution relationship" and also "all tickets / trips I made to China".. but that is just for people who are in China =)
