I know.. it's pretty rare to see any petition over that long (we had a few longer on here too, and one person , the_dip_sticks, just got approved while waiting over 2 years)... I don't understand why they are lying and giving excuses everyday.. I even tried to get the FBI letter (which helped the lawsuit) stating I had no security checks.. no record of the two petitions (I-129F/I-130) I sent had gone through the FBI.. that was from the "Records Management Division Chief" too.. wacko.gif

Finally, the lawyer managed to finish the lawsuit and send it in.. official date is 7/29/2008.. so hopefully 60 days from now I will have an answer.. whistling.gif more retarded answers from the 1-800 call center.. now they said my case is still at the LOS ANGELES office, and still doing the so-called "background/security checks"..

yet I received a service request email from them on 7/9/2008 stating:

"The status of this service request is:
This case is in process and was sent to the USCIS local office in Los Angeles in November, 2007 for field review and investigation. The case file is currently in transit to this location, California Service Center. You will be notified by mail when a decision has been made or if additional evidence would be needed."

hey Jen.. how are you doing? I see you are almost all done with your journey now.. good.gif congrats on not giving up.. yeah, we are a bit over 500 days now.. and the lawsuit's time is almost up (in my signature) and at about 14 days left (out of 60). they have 60 days to respond back (with another 30 days extension), but over 95% (I checked too, made an account with PACERS - the whole court system.. they have all the cases from everyone who filed) succeed and end in "voluntary dismissal" by the plantiff (mainly because USCIS doesn't want to admit they were wrong in the 1st place).. Also, they use an excuse like : "We already finished your case and you have no reason to continue, so the lawsuit is moot".. something to that effect.. so they make up plenty of excuses not to look bad..

bad news.. I made an INFOPASS appointment and went to the local office.. Originally, my local office interview was held on the 8th floor (and the INFOPASS appointments on the 1st floor).. so I went to the 8th floor and asked for the person who interviewed me, but the security guard said I couldn't go in without an appointment (and I can't make these appointments, because it was at their request.. stupid reason #1).. so I went to the 1st floor and waited about two hours before I went to talk to someone at the booths (many booths , and they call your number).. she checked her computer and said there was nothing about an approval.. (I had a local office interview on 2/21).. she said that they transferred my case (I-129F, K3) to the CSC on 2/22... that was the latest status so far.. she told me to call CSC and request an "officer" (not the first person that picks up.. she even said they don't know anything more than you).. she said my case wasn't there anymore so she couldn't help me..

Then I went back to work and called them on the phone.. requesting for an officer and got one.. she told me that the I-130 had no movement since about three months ago, but the I-129F has been forwarded to CSC and that the CSC office has sent a transfer notice on 2/27.. never received it as of 3/7.. so you can tell how slow they are.. mad.gif mad.gif still haven't received it as of 3/10.. I told her all about my local office interview, and said I didn't trust them until they send out a letter in the mail stating I got an approval.. I knew something was up, and that's why I didn't celebrate yet..

so basically I haven't gotten an approval yet.. crying.gif crying.gif I just thought I did..

some info about it.. I also paid a team of lawyers to handle it.. hopefully it will come through and I get approved soon.. and for those who haven't followed, I did all the things you can do 1) faxing them everyday multiple times and to multiple people (have about 50+ on my list, senators, congressmen, presidential candidates (all 3 of them), US attorneys, governor, whoever), 2) service requests - they are stupid - did 3 of them on I-129F already and 2 of them on I-130.. 3) expedite requests , but the director didn't approve it, even called his office - I can give you the direct number, lol ... and wrote to ombudsman too.. basically the lawyers will push for the I-130 (since the I-129F was suppose to be faster, but isn't, and they said it isn't worth it now - I would still need to adjust later)..

same here, pushbrk.. all they told me was under "additional processing" and I was under Name check.. so I took the liberty of faxing the president and vice president and others (you guys know me, lol).. and they fowarded the letter to the Dept of Justice who then fowarded to FBI.. so I got a letter in the mail directly from the "Names Records Division" Chief , Michael Cannon.. something like that.. and saying there were no security checks on both of my cases and to "recheck with the local office".. they are just making excuses, jonbless mad.gif mad.gif that's why I'm doing what I'm doing now.. the "Writ of Mandamus" lawsuit for them to hurry it up.. a bit expensive, but it's worth it..

hmmm.. that's ok if they did.. at least they should ask for it again.. that may be a good excuse they can use.. well, I have made copies of my I-130 / I-129F.. I have 3 backpacks full of stuff to show them if they want to go to court.. I have kept Western Union receipts, hotel receipts, wedding rings, Skype info (about 15-20 months worth) , home phone records (with her home phone number circled in red), and other stuff).. also, created several folders of copies of I-130, I-129F, and supporting documents...

Also, if they wanted more info, they should send a RFE.. and they didn't =( so they are just making some excuse just to hold it.. but now that I have a lawyer and doing a lawsuit it should be different.. yes, CandleForLove has a lot of chinese getting approved.. but maybe something was wrong with my case?? I'm not sure.. I sent evidence along with my I-130.. pictures of both parents with us, and her family too at our wedding ceremony...

maybe because she is from China whistling.gif guess America is still biased towards some countries... where there seems to be a lot of fake marriages.. so they just hold it.. crying.gif crying.gif but maybe China had a bad impression so America is being hard on them.. but the thing I dont' understand is that they said my case is still under "additional processing security checks".. and I had sent a letter to the president (Mr. Bush) and he forwarded to the Dept of Justice, who forwarded to the FBI.. they sent a letter to my house stating I had no security checks on both of my cases (from their Records Management Division).. so someone is lying.. and the FBI isn't one to lie about things.. so that leaves only one..

We can share our advice and experiences so others can learn from them.. but I see that people are getting approved in less than 60 days now.. crying.gif I wish that USCIS would do the applications in order and not skip the "hard" ones like mine.. yes, most of the time I just have presents shipped over there (like See's Candies, Victoria's Secret -- haha, that's our little secret there, and Amazon.com DVDs).. I bought her lots of DVDs (30+ cartoons and things like "Chronicles of Narnia") - she understands about 70%-80% of it just by listening.. so it's not that bad.. to help her learn english.. and I prepared a schedule for her to learn english (she has homework everyday and I use online material too).. speaking, writing, vocabulary, listening.. all that stuff..

www.esl-lab.com (that's one that I use) - she has gone through all this already.. and is learning about grammar now.. she will be studying TOEFL very soon and her score is about 500-550 there.. so it's not that bad.. but of course there is room for improvement.. =)

Yes, I did have a good time.. 2 1/2 weeks of just us being together.. that is the best birthday gift for me =) We had a cake and bought balloons (about 30 of them) and just had fun with her mom and little sisters.. it was simple but it means a lot =).. This time I finally got to celebrate something with her for over 3 years time.. =) heart.gif We never got to celebrate anything, only over the webcam.. Like for Christmas, we both bought the christmas red hats and just put them on and celebrated over the webcam (like many of you).. I always had to go back once every 6 months, but not during any holiday time.. this next time would probably be Thanksgiving or Christmas.. so we can celebrate again for the holidays =)

for ninjarocket (OP), that reason of moving back is no good.. I tried it for my expedite reason and it didn't go through..

pretty much if nothing happens after 6 months, complain and call them everyday.. bother the hell out of them.. call them more than their mom will.. I even call more than once a day now because I know each person will give a different answer... mad.gif so this lawsuit will take about 3-4 months if anyone wants to pursue it.. hopefully something will come through for me.. about the expedite request, you can try for it, but don't keep your hopes up.. I had several service requests and an expedite try for each, but still failed.. =( even with valid reasons of "financial loss" and "USCIS error" (haha, maybe I shouldn't use this one).. but it is their error for taking so long..

even my lawyer said they won't pursue the I-129F anymore..

"The I-129F was supposed to be faster than the I-130, but in your situation it is obsolete since it has taken just as long as the I-130. Besides, once the I-130 is approved, CIS will deny the I-129F since it is moot. The goal is not for your wife to enter as a K3 but to enter as an immigrant (green card). So, our lawsuit will ask CIS to adjudicate the I-130. Once it is approved, then you may move on to the next step."

They are a good team of lawyers =) They just can't do anything yet because the demand letter needs 30 days to take effect..

"Once we received the above, we will issue the demand letter. The demand letter will instruct CIS to adjudicate your application within 30 days. If no response is received within 30 days, we will prepare to file the mandamus. The government has 60 days from the receiving the lawsuit to file their response. My official date starts May 12.. so pretty much until next week I can't do anything.. I have been calling them everyday too (well, not when I was in China).. but called yesterday when I got back and the person from the 1-800 place said all they were is a "call center" and can't do anything.. she wanted to transfer me to "level 2" officer, but I said forget it.. I have talked with them before and they are no help too.. they just said my case is still under "security checks" and that they can't do anything.. I had to argue and yell with them just to defend for myself.. so I have been through almost everything I can do now - sending letters to president, vice president, senators, congressmen, FBI and others.. haha, don't think I didn't try... =) (in lieu of a lawsuit).. that's what will be next

I would try an expedite request if I were you (OP) though.. keep trying all kinds of things like me.. finally I had to choose a lawyer and go for the writ of mandamus (lawsuit) against them.. it will play out in 3-4 months from now..

expedite requests don't work.. well, not for me.. I already asked for my I-129F / I-130.. stating it was "USCIS Error" and "Financial Loss to Individual".. My reason was that if this thing doesn't go thorough, then I would have to move back to China.. and wouldn't that count as a "financial loss" to our family?? My job is with the government now, and that still doesn't help..

haha, I have been under security checks since November 2007 (7 months from filing in April 2007).. they said I was under security check, so I wrote a letter to the White House (forwarded to FBI - you probably read it already what happened).. they sent a letter to my house stating no security checks.. also had a "local office interview" too in February 2008.. the guy said everything looks good and you will get approved, but nothing happened (even brought my parents to the interview stating it was for real).. then after that they said I was under "additional processing".. which pretty much means the same thing.. mad.gif mad.gif

still nothing yet.. came back from my trip to China for 2 1/2 weeks =) yay.. the Demand letter was sent May 12.. so the USCIS has 30 days to respond..

hi the_dip_sticks, yes, I found them close by (near Pasadena in Los Angeles) about 30 minutes where I live.. they seem to have a good track record and help solve difficult cases.. they are a team of 17.. I went with them due to the fact that an individual can trick you, but a whole team would have a harder time (hopefully) to trick you.. and they have postings as to their successes in the courts/lawsuits too.. give me a few months before saying I recommend them or not, haha.. but it is better to get a team of lawyers near where you live.. that way it is easier to send them stuff.. I went to their office already once to drop off some stuff needed (copy of I-130 and supporting documents).. they are preparing the "demand letter" now and I have to sign something.. so I'm going back Friday.. so it is better to find someone close by you..

basically a threatening letter for lawsuit (give them 30 days), then to the lawsuit (decision within 60 days, with a 30 day extension).. so a total of 120 days from the time I give them all the stuff.. that's not bad.. I can wait that long (considering I already waited all this time)..

just have some more patience .. good.gif you are almost done.. don't give up... don't let USCIS control your lives.. that's what I keep telling others and my wife.. that's why I'm not afraid in doing what I'm doing (sending and calling every week).. please, they say to call "once per month".. well, I wouldn't be calling in the first place if they did their job correctly... mad.gif mad.gif so if they get angry over the phone at me, then I'll do the same.. I have given them enough time already.. In 12 months, I haven't got past the 1st step (approval notice).. let alone the NVC and Embassy/Consulate problems.. so hopefully if the lawyer team does well in getting me the approvals, then I'll retain them (more money of course) to take me through the NVC and Consulate, so there would be no more problems hopefully..

gemilina, I thought you said everything was ok.. the Consulate/Embassy was happy with the new custody papers =) How long have they given you before they process it? I see most APs (from here) going for 2-3 months at least.. but you already got approved for your case interview already?

wow, 4 years just to get the interview.. =( did you inquire about it right after you got approved? That 970 days to 999 days is stupid.. Where did you case get stuck at? You said you filed in fall 2004, got approved December 13, 2004, got interview in February 2008, and sent back medical in this month.. so it looks like you are almost done =) I think that the approval expires in 2 years? (not sure on that, but it does expire, you can do some research on that).. keep pressing them and forcing them to approve.. probably wait another month or two and everything should be OK (make sure and ask them you aren't under "Administrative Processing".. if so, then you would probably have to wait a few more months).. unsure.gif
