that's why I put a far estimate on my "Journey Together"... my expectations is for April 2008... anything earlier is considered a bonus.. =) don't put your expectations too high for USCIS.. if you expect it, and it doesn't come.. then you will get disappointed.. have a farther expectation (like me), and anything that is earlier is counted as a bonus.. :thumbs: it's not like I won't call them (using RFE trick) before April 2008... just my expectation for them is that far.. even though I have my "estimates" in my signature (8/27/2007 for I-130, and 9/26/07 for I-129F), I still won't think of them as accurate..

I don't, lol.. I base it on other timelines (about a year for about 80% of cases).. I know there are still some that are never approved or have problems.. but at most , it will come around April 2008 for me.. otherwise, I have put my estimates for my applications in my signature :thumbs:

I'm not going after the small fry this time.. the lawsuit last time (and this time) was/is going against the USCIS director as well as his staff.. I forgot, the lawsuit named a bunch of people (including the district attorney that represents them).. I have to look it up again in my email.. and well, this will be the first time you see someone fight against a consulate.. I need to find the consulate leader's name too so I can name them in the lawsuit..

not really.. a writ of mandamus lawsuit forces them to give an answer within 60 days if it is way past time.. let's just say we brought 3 suitcases full of stuff... haha, and still produced no result.. emails (I had about 250 printed out, plus hers), Skype chats, MSN chats, MSN webcam photos, I even took a photo in front of the post office (I heard rumors about that, but they didn't ask for it)..we also brought 10 photo albums (1,000+ pictures) showing everything (wedding, when I visit her family, in pajamas/sleepwear so they can tell I am close with her family)..

we got a blue slip =( crying.gif crying.gif she went to the interview, and they said "everything was ok", and the guy was about to issue the visa, but then he started talking with the "black widow" VO.. haha, you probably know who I am talking about.. they talked for a minute, and they put a "hold" on our case due to "name checks".. I went back the next two Mondays (American Citizen Hour) to ask why and if they were suspicious of our case, and they said everything was good, they just needed to do more processing on our case.. wacko.gif I talked with my lawyer to see what we can do, and I think we can do the lawsuit again (lawyer said they will send an inquiry in and told us to wait at least 90 days for us to do the lawsuit again).. that is our only way now.. I also called DOS, but all they see is "additional processing" on our case.. We also sent in a lot of emails to the Consulate, but the email replies say the same thing..

you should just use the "secret" list of contacts I have if you are having problems.. lots of people can direct you to them.. whistling.gif otherwise, doing research is MUCH better than getting a lawyer, and also all the websites (001, candleforlove, and visajourney as well) have people giving false/accurate information.. you just need to do your own research, and then you can tell what is true and misleading.. Example for me was I expected the case to go to China from NVC in about 3 months and it did.. I was able to track my case at China DHL too.. just do some research on each part of the visa and how long it will take and what it involves.. both of you should do research and not just one.. I find many spouses don't help their beneficiary spouse out on their visa case, and they just keep waiting.. this is just very sad.. how far are you (and him/her) willing to go to be together?.. I know that each case is different from mine.. it is how much effort you are willing to put down.. see how long our visa journey took and the difficulties we have been having..

Thanks guys for the info! Yeah, I found out USCIS only does the immigrant visas, while the Dept. of State does the ones for the non-immigrant ones. I knew this time I wasn't fully prepared.. I had told her parents also to bring house deeds and bank statements too. We provided 2011 tax return (we filed in February), pay stubs (about 5 each), I-134 (Affidavit of Support), and some other things too.. I have been doing some research and seeing what others did here in Visajourney.. My wife said that her friend from Shanghai is a lot richer than us and her parents were denied three times for a tourist visa.

Actually, she would be able to get her citizenship soon (she came in August 2009), so we can send in the Citizenship application in May.. from what I heard, you can start applying at 2 years and 9 months.. so we will go that route instead for now.. hopefully she can get her citizenship in 6 months (yeah, right) and apply for her parents (another 6 months).. so personally I'm looking at another 2 to 3 years before they come.. Reason we can't go back now is because she's pregnant and about to deliver =) At least something good came out of this.. :thumbs:

I'm applying for her parents for TOURIST visa now.. I know the difference between tourist (non-immigrant) and immigrant visa.. I'm saying it's all about the money to USCIS.. I have seen many people on here that were denied one time, two times, or even three times.. and then were approved using the same information provided.. From my history with them regarding my wife, I am no friend of theirs, and especially what happened this time.. I am going to fight this one too.. The cases should go through at least two or three people before being decided, and not just based off of one person's opinions..

Look at what I went through (as many from China) just to get my wife here.. 6 months processing time?? yeah, right.. and that's when I started calling and questioning them too.. so I gave them enough time.. For her parents, they didn't even look at her other stuff.. just looked through her application and denied them.. I would like to know the denial reason so I can fight that..

Yes, why don't they just charge $1,000 per person (tourist visa)... I'm willing to pay that.. it's a win-win for everyone.. they need to do less work (less denials, hopefully) and they make more money.. I know everyone may not have that kind of money.. I am not happy at all.. :(

We applied for a tourist visa for her parents (from China) and were denied yesterday. Her parents told her that it was denied based off of the DS-160. All they did was just take a look at that (even though we had I-134, invite letter, bank/house deed statements, tax return for 2011 from us, pay stubs, and other things) and nothing else. They said I filled out "retired" for both people and should put "unemployed" (because they come from village and should be considered "farm workers"). Also, they said my wife has only been here one year and doesn't make enough. I put my name on the I-134, and let's say I earn enough for her when she applied three years ago. My wife is saying don't fight this because she can apply for citizenship very soon, and hopefully they can come here next year on an immigrant visa.

Who said I ever backed down? :devil: I think it's the other way around.. I showed them who is the boss.. they may make the decision and have the higher authority in doing things, but I'll make sure their bosses (up to the President) knows about it..

My wife is currently in process for Citizenship now.. applied July, and biometrics just last week.. so at least this one is going smoothly.. they better not find anything wrong, otherwise I'm on the attack again.. and recently we got a baby boy too =) he's 3 months old.. guess gogo has a successor if anything goes wrong..

they didnt like it at all... i think they should have tried to further sue em... with them backing down just asserts their power. trust me on this one. most american bureaucrats would back down if the lawsuit evolves further. initial lawsuit is okay for them. they end up panicking when it stacks up for them. more suit stack up = money diverted from their original budget for legal = embarrasses them further more. every agency has a small budget/resource reserved for litigation. if the media shines on that, which i doubt, they would further give attention.

i am just giving you insight because i know couple of people within government that had been testifying as defendant. some where successful and some wasn't. there are a lot of subjective factors in court too. also witnesses from government are loaded with "things to say" and "things not to say".
